Selling transit: perception, participation, and the politics of transit in Kansas City, Missouri

Master of Regional and Community Planning / Department of Landscape Architecture/Regional and Community Planning / Huston John Gibson / Informed and robust stakeholder participation in the transit-planning process gives residents and communities a remarkable opportunity to take ownership of the shaping of their city’s future form and function, and allows planners to design transit networks that serve the full range of citizen needs. Therefore, the degree to which citizens are permitted to participate in the formation of a city’s transit plan has a significant influence on both its final design and its subsequent adoption by civic and political leaders. Concurrent with the influence of citizen input is the role of political strategy, since many urban transit plans must meet voter approval and a poorly-run political campaign can sink even the most substantial of transit plans. In seeking to analyze both the role of public participation and the role of campaign strategy, this study employs descriptive historical research and stakeholder surveys to assess the impact and perceived importance of inclusive design practices, as well as the political impact of a transit campaign’s general strategy, on the voter approval of transit-related ballot initiatives in Kansas City, Missouri. There are two central implications of this project. One is that the failure of transportation planners and civic activists in Kansas City to accommodate the wishes and input of diverse groups of residents and community leaders in the planning process has led to repeated defeats whenever said plans are presented to Kansas City voters for approval. The other is that urban politics and campaign strategies play a larger role in selling transit proposals than many leading figures in Kansas City have realized, and that the city’s unique political and geographic structure requires a more nuanced and technologically-diverse approach to voter persuasion than has been applied thus far. It can be theorized that reversing both of these trends will increase the likelihood of future voter approval of transportation initiatives. In addition to a political and historical analysis of transit in Kansas City, this study seeks to examine whether deliberate public participation in the transportation planning process has a direct impact on citizen support for transportation-related ballot initiatives in Kansas City.

Procedimentalização nos Conselhos de Políticas Públicas: o caso do Conselho Municipal de Habitação de São Paulo / Proceduralization in the Public Policy Councils: case study of Conselho Municipal de Habitação de São Paulo.

A presente pesquisa tem como objetivo geral analisar a procedimentalização nos Conselhos Municipais de Políticas Públicas, isto é, analisar o regime jurídico dos procedimentos administrativos aplicáveis aos Conselhos, bem como o modo de participação dos Conselhos no processo orçamentário municipal de São Paulo. Embora existam há mais de duas décadas, a revisão da literatura indica que os Conselhos em geral têm se destacado mais como instâncias de fiscalização do que de planejamento de políticas públicas. Como objetivos específicos, a pesquisa pretendeu averiguar a adequação dos procedimentos administrativos que regem o Conselho Municipal de Habitação de São Paulo (CMH) e analisar sua participação no processo orçamentário municipal com base na Análise de Conteúdo das Atas de Reunião de 2003 a 2015. Como resultado, a pesquisa identificou que o CMH não elaborou nem aprovou, desde o início, nenhuma das propostas orçamentárias (PPA, LDO e LOA) do Fundo Municipal de Habitação (FMH), nas quais se formalizam as diretrizes, metas, programas habitacionais e planos de aplicação de recursos do Fundo, ao contrário do que dispõe a Lei Municipal 13.425/02. Na fase de execução orçamentária, foi possível perceber que o Conselho tem atuado, quase exclusivamente, como agente gestor do Fundo, apreciando e aprovando previamente as propostas de operações (projetos e atividades) a implementar. Além disso, a pesquisa evidenciou que o processo decisório do CMH tem se desenvolvido sem o necessário esclarecimento e sem a adequada instrução processual, principalmente, no que diz respeito ao direito à ampla defesa e à produção de provas pelos conselheiros. A pesquisa concluiu que o CMH deveria agir, com maior ênfase, no planejamento e elaboração das propostas orçamentárias na fase de elaboração da política pública; e como órgão de fiscalização, monitoramento e avaliação na fase de implementação da política pública, estas, afinal, sua vocação institucional; ao invés de atuar como agente operador do Fundo, que pressupõe competências legais e administrativas estranhas ao Conselho. / This research has the general objective of analyzing the proceduralization in the Municipal Public Policy Councils, it means, analyze the legal regime of administrative procedures of Councils as well as the mode of participation of the Councils in the São Paulos municipal budget process. Although there are more than two decades, the literature review indicates that the Councils in general have stood out more as supervisory bodies than in the public policy planning. As specific objectives, the research intended to verify the adequacy of the administrative procedures governing the Conselho Municipal de Habitação de São Paulo (CMH ) and analyze their participation in municipal budgeting process based on the Content Analysis of the Minutes of Meetings of 2003-2015. As result, the survey also found that the CMH, since the beginning, did not made or approved none of the budget proposals (PPA, LDO and LOA) of Fundo Municipal de Habitação (FMH), in which the guidelines, goals, housing programs and plans application of Fund are formalized, against the Municipal Law 13,425/02. In the budget execution phase, was possible to realize that the CMH has worked almost exclusively as Fund manager agent, appreciating and previously approving the concrete operations (projects and activities) to implement. In addition, the research showed that the CMH\'s decision-making process has not been observing the proper right of notice and comment, especially about the right to comment and offer evidences by the counselors. The research concluded that the CMH should act with greater emphasis in the planning and preparation of the budget proposals at the stage of elaboration of public policies; and as a supervisory body, monitoring and evaluation at the implementation phase of public policy, these, after all, your institutional vocation; instead of acting as manager agent of the Fund, which presupposes legal and administrative expertise out of the Council.

A participação pública na gestão de área contaminada: uma análise de caso baseada na Convenção de Aarhus / Public Participation in management of contaminated site: a case study under the Aarhus Convention principles

Esta dissertação de mestrado tem como objetivo principal avaliar a participação pública em um caso de gestão de área contaminada no Estado de São Paulo. Para a busca do foco no desenvolvimento desta pesquisa, foram consideradas as três bases de sustentação da Convenção de Aarhus: o acesso à informação, a participação no processo decisório e o acesso à justiça. Esta Convenção foi escolhida por constituir um conjunto consistente de conceitos e recomendações sobre a participação pública em questões socioambientais. É conceituada a Convenção de Aarhus e são discutidos os preceitos das documentações desse acordo internacional, fazendo comparações com alguns autores. Para atender aos objetivos dessa dissertação, é aplicada uma metodologia de estudo de caso, avaliando e verificando se esta participação atende aos preceitos da Convenção, por meio de análise qualitativa. A pesquisa foi realizada por meio de entrevistas individuais com atores envolvidos no caso da Shell Vila Carioca: população do entorno da empresa, técnicos do sistema ambiental e da saúde, representantes do sistema jurídico, médico, jornalista, vereador, representante do terceiro setor e representante da empresa Shell. Foi realizado um paralelo do caso estudado no Brasil com Woburn, o caso de áreas contaminadas nos Estados Unidos que também teve grande repercussão na mídia. Os resultados mostraram as diferentes visões e expectativas de cada ator para o caso. Entre outros aspectos, conclui-se que a população não foi informada adequadamente pelos órgãos públicos, que a participação da população neste caso ainda está se iniciando e que existem mecanismos judiciais para o acesso à justiça, embora a maioria da população não os conheça. Como sugestão, a autora propõe a inserção da participação pública nas etapas do Projeto de Lei de Proteção da Qualidade do Solo e Gerenciamento de Áreas Contaminadas / The objective of this work is to evaluate the participation of the public at a contaminated site case in the State of São Paulo. The basis for the analysis was the three pillars established by the Aarhus Convention (right to access information, right of the public participation and right to access the justice). This tree pillar scheme is a consistent array of concepts regarding the public participation process in environmental matters. The concepts of the Convention were discussed under the view of several authors. To evaluate in the real world the use of the concepts of the CONVENTION a case study were performed: Vila Carioca Contaminated Site in the City of São Paulo. The methodology used were interviews with all main actors involved as local population, environmental state officials, journalist, public attorneys, NGO people, city council members and ,industry representative. The interviews were conducted in person. The results showed the different views and expectations about the problem for each actor, which was very interesting to understand how the conflicts can start. In order to compare the public participation in other country a The Woburn Case in USA was reviewed. The main findings were: that the public participation is far from the proposed by the Convention, mainly regarding access to information and public participation. Regarding the access to justice, even though the Brazilian Justice be slow and costly, the points required by the Convention do exist. As a result of the findings the author proposed a suggestion of items introducing participation of the public to be inserted in a Law Project regarding Management of Contaminated Sites, in discussion nowadays at the São Paulo State Congress

Solução consensual de conflitos sanitários na esfera administrativa / Consensual resolution of conflicts heath in the administrative process.

Este trabalho tem por objeto examinar a atuação administrativa consensual, com enfoque na solução de conflitos sobre prestações materiais de saúde na esfera administrativa. A Constituição Federal de 1988 reconhece expressamente a saúde como direito fundamental de todos e determina ser dever do Estado garanti-lo, mediante políticas sociais e econômicas que visem à promoção, proteção e recuperação da saúde. Para alcançar os fins estatuídos pelo constituinte, diversas políticas públicas têm sido elaboradas e executadas. Porém, tendo em vista que grande parte da população não tem acesso às ações e serviços de saúde, o trabalho se propõe a indicar possíveis alternativas para enfrentar esta problemática brasileira. Para construir uma concepção dogmática adequada à compreensão do direito à saúde e de suas repercussões jurídicas, a dissertação analisa a teoria dos direitos fundamentais, explicitando as variadas funções que o direito à saúde pode exercer conforme o caso concreto. A função positiva do direito à saúde é destacada neste estudo, sobretudo, sua importância no Estado Social na promoção da igualdade material. Na sequência, o trabalho se dedica ao estudo do Sistema Único de Saúde (SUS), com base na estrutura delineada pela Constituição para conduzir a elaboração e a execução de políticas sanitárias. Em seguida, o tema da participação popular na Administração Pública é examinado como vetor do caráter Democrático do Estado, analisando seus pressupostos, instrumentos e, ainda, suas formas de expressão no âmbito do Sistema Único de Saúde (SUS). Por fim, o texto explora o modelo de Administração consensual no Brasil, especialmente no tocante à atividade de dirimir controvérsias na via administrativa, buscando identificar se, e em quais casos, esta atuação configura um autêntico módulo convencional. Feito o recorte temático proposto como linha de pesquisa, o trabalho examina instrumentos pró-consensuais institucionalizados para a solução de conflitos em matéria de saúde na via administrativa, apontando caminhos voltados à realização do direito fundamental à saúde e aos objetivos do Estado previstos na Constituição Federal. / This essay intends to examine the consensual administrative action, approaching to the conflict resolution regarding to medical supplies as well as healthcare services in the administrative process. The Federal Constitution of 1988 expressly recognizes health as a fundamental right and States guarantee duty, through social and economic policies, which has the propose of health promotion, protection and recovery. In order to realize the constitutional aims, a lot of public policies have been developed and implemented. However, considering that great amount of the population does not have access to healthcare actions and services, the study has the purpose of identifying possible alternatives to deal with this Brazilian issue. In order to develop an appropriate dogmatic understanding related to right to health and its legal repercussions, this essay analyzes the fundamental rights theory, explaining the various right to health functions that could be used according to the case. The right to healths positive function is highlighted in this essay, mainly, its importance to the Social State regarding to substantive equality promotion. Afterwards, this essay studies the Brazilian healthcare system (so-called Sistema Único de Saúde, or simply SUS), based on the structure outlined by the Constitution related to development and performance of public health policies. Then, the public participation theme in Public Administration is analyzed as a Democratic State conductor, going through its assumptions, instruments, and also its way of expression in the Brazilian healthcare system (SUS). Finally, the study explores the Brazilian consensual administrative model, especially in relation to conflict resolution activity in the administrative process, with the view to identify if, and in which cases, this action consist on a genuine conventional mechanism. In the conclusion, the analyze focuses on institutional mechanisms in favor of conflicts resolution by consensus regarding to heath in the administrative process, pointing out possible ways which conduces to right of heath effectiveness and achievements related to the objectives stated in the Federal Constitution.

The debate around what is participation is not new, but with the advent and the propagation of the communication technologies, especially Internet, new democratic possibilities have been created, since the mechanisms are able to change the way by which the public opinion consulting, and consequent1y listening to these consultations, can be treated. My inquiries come from the need of verifying how the public participation in information society occurs, considering at first the question: how and in what extent is democratic participation influenced by the use of new information and communication technologies? To c1arifysome historical processes which led to globalization phenomenon, I used, as reference, authors as Manuel Castells, Antonio Negri and Michael Hardt, Gilles Deleuze, Félix Guattari and Pierre Lévy, among others; professionals who work in mediation of the social constructionism, and algo a recent literature on the theory of formation of intelligent collectives of the communication networks, approached according to aspects of the social concepts of Mark Granovetter and Barry Wellman and algo under swann intelligence (Kerckhove). Working in the field of Digital Inc1usion in the last five years, it is from my professional experience, especially through Program Acessa SP, of São Paulo State Government, that I decided to carry this study through. In the processes of elaboration and implantation of the Program Acessa SP, varied experiences had been adding, amongst them Fala SP, a consulting project to the public which lasted three years, subject chosen for the study of case of this dissertation / o termo participação pública é utilizado em programas, projetos e iniciativas de governos de Estado democráticos. o debate em tomo do que seja a participação não é novo, mas com o advento e a propagação das tecnologias de comunicação, sobretudo a Internet, novas possibilidades democráticas foram criadas, já que os mecanismos inaugurados têm a capacidade de mudar a maneira pela qual as consultas à opinião pública, e conseqüentemente a escuta a essas consultas, podem ser tratadas. Minhas investigações partem da necessidade de se verificar como ocorre a participação pública na sociedade da informação, considerando-se em princípio a questão: como e em que extensão as práticas democráticas são influenciadas pelo uso das novas tecnologias de informação e comunicação? Assessing communities of unreceptive receptors : an investigation into environmental impact assessment's formation of environmental subjects

EIA's contribution to increased environmental awareness is a posited means by which EIA's contribution to a substantive level of environmental protection can be measured. However, little research has been done to evaluate and properly contextualise this increased environmental awareness in members of the public who participate in EIA and its associated processes of public participation. Utilising a Foucauldian understanding of power and governmentality, this research has shown how this process of becoming environmentally aware takes place within a broader application of governmental power and it is within this context which the success (or otherwise) of steering towards a greater environmental awareness must be evaluated. The biopolitical intentions EIA has for managing environmental life in general draws strict boundaries of expertise and authority in governing the environment, and as products of this formation of governmental power the public become subjects of expert direction. In opposition to this, the public produced a rural environment and local community as defined and governed by forms of experiential knowledge, which although pertaining to a truth-oriented mentality of rule, exerted a similar biopolitical control over the environment and immutable form of authority and expertise within it. It is contended that for EIA to penetrate bounded environments and disrupt their totalising environmentalities, the tool must extend the meaning of uncertainty to explicitly recognise the conflict that exists between actors and their respective environments. In this way, EIA can contribute to a form of self-reflexive and -critical environmental citizenship deemed necessary for a thorough investigation into the political dimensions of the environment and its associated substantive measures of enhancement and protection. Employing a realist governmentality approach to the case-study of the 2016 public inquiry in shale energy proposals in Lancashire, this research generated discourse analyses of key policy documents and public contributions to the inquiry in addition to a 'lived experience' of the inquiry as a participatory space through participant observation. The key findings were that at the policy level, the participating member of the public is produced as both a trustee and an expert, heightening the potential for conflict. Further to this, the experiences of the public inquiry added to this potential by seeking to impose on the participant an individualised, silent identity which was directly contradicted by the public during 'non-technical' sessions who sought to participate actively and collectively. Within their contributions the public produced further internal conflicts, with aspects of this discourse relying on existing institutionalised forms of knowledge and expertise to respond to environmental problems, while in others asserting that localised and personal experiences were necessary. EIA as a technique of government can have a leading role in defining the environment in both a physical, surrounding sense and as a mentality. To do so and challenge essentialised and concrete ideas regarding the environment avoiding the acts of exclusion that underpin them becoming normalised the thesis builds on the analysis to make a proposition for a more effective agonistic EIA process.

The main findings were: that the public participation is far from the proposed by the Convention, mainly regarding access to information and public participation. Regarding the access to justice, even though the Brazilian Justice be slow and costly, the points required by the Convention do exist. As a result of the findings the author proposed a suggestion of items introducing participation of the public to be inserted in a Law Project regarding Management of Contaminated Sites, in discussion nowadays at the São Paulo State Congress

Na cidade de São Paulo, as inundações, consideradas a consequência das chuvas intensas e da impermeabilização do solo urbano, têm causado impactos consideráveis. As contínuas e frequentes inundações e as intervenções para contê-las, de alto custo para o Poder Público, justificam a busca de uma abordagem complementar à puramente técnica-hidráulica, que dê atenção aos aspectos sociopolíticos inerentes à drenagem urbana e ao manejo de águas pluviais, o foco principal desta pesquisa. Seus objetivos são: uma análise crítica sobre a incorporação do sociopolítico na malha de disciplinas do curso de Engenharia Civil; uma análise crítica da visão dos profissionais envolvidos, direta ou indiretamente, com a gestão urbana sobre a incorporação de aspectos sociais no planejamento e na implantação de obras de drenagem urbana; e se estes aspectos são incorporados aos projetos de obras de drenagem e se atores sociais localizados na área de uma bacia hidrográfica valorizam esta incorporação. A pesquisa concluiu que, ainda que aspectos sociopolíticos estejam incorporados na malha de disciplinas dos cursos de Graduação em Engenharia Civil e ainda que os profissionais da gestão urbana valorizem os aspectos sociais tanto quanto os aspectos técnicos das obras de drenagem, o planejamento e a implantação de obras de drenagem em construção na área da bacia hidrográfica, foco geográfico desta pesquisa, não incorporam os aspectos relativos ao sociopolítico. A bibliografia consultada e os exemplos concretos apresentados mostram a importância da incorporação dos aspectos sociopolíticos nas intervenções. Os conceitos discutidos ajudaram a formular recomendações para a incorporação do sociopolítico na malha das disciplinas e nos projetos de obras hidráulicas. São recomendações que visam, além da preservação ambiental e do atendimento ao interesse público, maximizar os benefícios da solução técnica. / In the city of São Paulo, intensive rains and urban impervious cover are being held responsible for flooding events which have been causing increase in runoff volume and in peak discharge. The high costs of technical hydraulic interventions to contain the frequent flooding impacts justify the search for an alternative approach: the incorporation of the sociopolitical complexities of urban stormwater drainage, the main theme of this research. Its objectives are: understand if and how sociopolitical complexities are being incorporated to Civil Engineering education; how professionals directly or indirectly involved in urban stormwater management see the incorporation of sociopolitical complexities in planning and implementation of stormwater drainage construction works and, finally, if these complexities are integrated in the projects being planned and being implemented in an urban watershed area. The research concluded that Civil Engineering education incorporate courses which open space for the discussion of sociopolitical aspects; that professionals involved in urban management value the incorporation of sociopolitical aspects in planning and implementation of storm water construction projects, but that in the watershed area where projects are being implemented such aspects are not taken into account. The bibliography and the concrete examples examined show the importance of incorporating sociopolitical aspects in drainage construction projects. The concepts brought forward help identify recommendations for the incorporation of sociopolitical aspects in Civil Engineering education and in the planning and implementation of stormwater constructions projects. These are recommendations which aim at increasing environmental preservation, meeting the public interest and maximizing the benefits of the technical solution.

Analysis of national election manifestos of the African National Congress about service delivery between 1994 and 2014

Thesis (MPA.) -- University of Limpopo, 2018 / This study analyses the national election manifestos of the African National Congress on the subject of service delivery between 1994 and 2014. One of the arguments advanced in this thesis and corroborated in the theory of democratization by elections is that elections play an important role in the struggle for better governance and democracy. The election manifestos, in this regard, serve as instruments of ensuring accountability to the voters as well as gauging the performance of those in government. The party in government must implement its election manifestos; otherwise it must face electoral consequences through a democratic election process. However, there is a view aptly sustained in the study that elections are at times not a reliable or credible measure of a democratic outcome because many voters do not have the necessary knowledge to make rational choices in order to counteract the effects of poor or lack of implementation of election manifestos regarding service delivery. Therefore, as cautioned in the thesis, conscious public participation will remain an empty slogan if the majority of the electorate is left and forgotten languishing in poverty and arrogance. The sustainability of participation by citizens is hugely compromised in an environment infested with rampant corruption and runaway impunity. The study followed an interpretivist paradigm with a qualitative approach. ANC members in four villages –Duthuni, Tshisaulu, Ha-Mushavhanamadi and Ha-Ratshiedana (ward 35, Thulamela Municipality) were purposively targeted as the research population for the study. For practical reason, not all members of the ANC in the villages were reached to participate in the study. Ultimately, 42 members of the ANC in the villages formed the research sample. Data collection techniques used were face-to-face interviews, semi-structured questionnaire and document review (data triangulation). The rationale for using data triangulation in the study was to ensure that the weaknesses of a single data collection strategy were minimized and to ensure that the strategies complemented and verified one another. A total of 12 interviews were conducted, 30 questionnaires were administered and five ANC national election manifestos were perused. Three qualitative data analysis strategies were adopted, namely, conversation analysis, discourse analysis and content analysis. Analysis and interpretation of qualitative data consisted of words and observations and not numbers or statistics because the researcher did not want to quantify nor generate numerical data for purposes of statistical analysis.
