poss?veis dificuldades encontradas e enfrentadas. Inicialmente, atrav?s de uma breve
apresenta??o da obra, s?o abordadas quest?es relacionadas ao texto escolhido, bem como a
sua estrutura e import?ncia no processo composicional. Mais ? frente, s?o analisadas,
identificadas e propostas resolu??es para as dificuldades existentes do ponto de vista das
execu??es, vocais e instrumentais, e do gestual aplicado ? reg?ncia, sendo abordado,
detalhadamente, cada movimento que comp?e a obra. O trabalho tamb?m apresenta um
memorial que descreve todo o processo pr?tico de prepara??o da Cantata: reedi??o da
partitura; sele??o e perfil dos cantores e instrumentistas; os ensaios; modifica??es e
adequa??es na partitura; e uma breve entrevista com quatro cantores e dois instrumentistas
que participaram do processo. A intera??o com a compositora, durante parte significativa do
trabalho, traz uma marcante amplia??o dos poss?veis esclarecimentos e desenvolvimento das
ideias, potencializando uma execu??o coerente da obra. / This study aims to document the preparation process for the implementation of "Cantata To
Praise and Glory"(Cantata Para Louvor e Gl?ria), composed in 1985 by composer Cleide
Dorta Benjamin (1936 - ), in order to anticipate and address the possible difficulties faced
by future conductors, singers and instrumentalists. Issues that relate to the chosen text as well
as its structure and importance in the compositional process, are initially addressed through a
brief presentation of the work. Consequently, by addressing every detail of the work,
solutions to vocal and instrumental execution difficulties, as well as with the conducting
gesture, are analyzed, identified and proposed. The work also presents a report that describes
all the practical processes of preparation of the Cantata: reissue of the score; selection and
profile of singers and instrumentalists; rehearsals; changes and adjustments to the score; and a
brief interview with four singers and two musicians who participated in the process. The
interaction with the composer throughout a significant part of the work, brings a notable
increase of possible clarifications and idea development, enabling a coherent performance of
the work.

Scalable Estimation and Testing for Complex, High-Dimensional DataLu, Ruijin 22 August 2019 (has links)
With modern high-throughput technologies, scientists can now collect high-dimensional data of various forms, including brain images, medical spectrum curves, engineering signals, etc. These data provide a rich source of information on disease development, cell evolvement, engineering systems, and many other scientific phenomena. To achieve a clearer understanding of the underlying mechanism, one needs a fast and reliable analytical approach to extract useful information from the wealth of data. The goal of this dissertation is to develop novel methods that enable scalable estimation, testing, and analysis of complex, high-dimensional data. It contains three parts: parameter estimation based on complex data, powerful testing of functional data, and the analysis of functional data supported on manifolds. The first part focuses on a family of parameter estimation problems in which the relationship between data and the underlying parameters cannot be explicitly specified using a likelihood function. We introduce a wavelet-based approximate Bayesian computation approach that is likelihood-free and computationally scalable. This approach will be applied to two applications: estimating mutation rates of a generalized birth-death process based on fluctuation experimental data and estimating the parameters of targets based on foliage echoes. The second part focuses on functional testing. We consider using multiple testing in basis-space via p-value guided compression. Our theoretical results demonstrate that, under regularity conditions, the Westfall-Young randomization test in basis space achieves strong control of family-wise error rate and asymptotic optimality. Furthermore, appropriate compression in basis space leads to improved power as compared to point-wise testing in data domain or basis-space testing without compression. The effectiveness of the proposed procedure is demonstrated through two applications: the detection of regions of spectral curves associated with pre-cancer using 1-dimensional fluorescence spectroscopy data and the detection of disease-related regions using 3-dimensional Alzheimer's Disease neuroimaging data. The third part focuses on analyzing data measured on the cortical surfaces of monkeys' brains during their early development, and subjects are measured on misaligned time markers. In this analysis, we examine the asymmetric patterns and increase/decrease trend in the monkeys' brains across time. / Doctor of Philosophy / With modern high-throughput technologies, scientists can now collect high-dimensional data of various forms, including brain images, medical spectrum curves, engineering signals, and biological measurements. We introduce a computation-based statistical approach that achieves efficient parameter estimation scalable to high-dimensional functional data. The second part focuses on developing a powerful testing method for functional data that can be used to detect important regions. We will show nice properties of our approach. The effectiveness of this testing approach will be demonstrated using two applications: the detection of regions of the spectrum that are related to pre-cancer using fluorescence spectroscopy data and the detection of disease-related regions using brain image data. The third part focuses on analyzing brain cortical thickness data, measured on the cortical surfaces of monkeys’ brains during early development. Subjects are measured on misaligned time-markers. By using functional data estimation and testing approach, we are able to: (1) identify asymmetric regions between their right and left brains across time, and (2) identify spatial regions on the cortical surface that reflect increase or decrease in cortical measurements over time.

or substituted when Western legal institutions are used.
Information has been collected by way of interviews with a panel of
knowledgeable men and women and controlled by reference to
available literature. An attempt was made not only to identify and
define legal principles, but also to take note of those cultural
institutions and social processes functioning outside the law.
Although it is possible to identify the general principles of delict as
well as several subjective rights that may be infringed, the peculiar
nature of delict must be borne in mind and set off against the unspecialised nature of indigenous law.
The indigenous law of delict shows clear signs of adaptation to new
circumstances, but there is evidence of the retention of proven legal

Section 29 of the Constitution of the Republic of South Africa, 1996 states that everyone has the right to basic education. This provision must be interpreted in order to determine whether it refers to a period of education, or a certain standard or quality of education that also includes infrastructure.
In this dissertation, the scope of the right to basic education and the state’s obligation with regard to infrastructure, are discussed. The dissertation will point out that the right to basic education should also consider the best interests of the child-standard as well as the right to equality. The Constitution provides that everyone has the right to basic education, which implies that there should be no discrimination against any child. In order to determine the scope of section 29 and the duty of the state accordingly, the provisions of international instruments must also be consider. The Convention on the Rights of the Child, the African Children Charter and specifically the International Covenant on Economic, Social and Cultural Rights refer to the obligations of the state in respect to the provision of basic education and infrastructure.
The Schools Act provides for the Minister of Basic Education to prescribe minimum norms and standards relating to school infrastructure. The importance of minimum norms and standards for quality education has been investigated with specific reference to libraries, learning material and water and sanitation facilities. The regulation of small-scale mining in Namibia :|ba legal perspective / Divan de JonghDe Jongh, Divan January 2013 (has links)
The objective of this study is to conduct a critical evaluation of the Namibian
law and policy framework that currently regulates small-scale mining in
Namibia. The discussion begins with an introduction to small-scale mining in
Namibia which deals with the practice of small-scale mining, inter alia, as far as
it is defined and the possible affects thereof. Small-scale mining affects various
second generation rights of persons directly involved therein as well as the
community as a whole. These rights include child labour; unemployment;
gender issues; public health care; occupational health and safety; access to
finance; poverty alleviation; and access to mining tools, machinery, markets
and buyers.
The law and policy framework applicable to small-scale mining in Namibia is
accordingly critically discussed in terms of the strengths and weaknesses of the
current framework. It is found that small-scale mining is quite well regulated in
Namibia, but the current law and policy framework is not without its problems.
Some of the main weaknesses identified are the centralised nature of the
application for and pegging of claims, the lack of formal provision and
regulation of the off-set markets, and the lack of access to finance for smallscale
miners.
Recommendations are made, such as that regulatory measures should be put
in place to make provision for and to regulate the off-set markets for the
minerals being mined by the artisanal miners. At the end of the study further
research topics which relate directly to the regulation of small-scale mining in

Conflict and injustice are endemic to the imperfectness of human existence, and the Church of
Christ is not immune to them. Various means can be adopted to solve conflict in the church.
This study is concerned with legal restitution through calling at a major assembly, as provided
in Article 31 Church Order.
Statement of the problem
Biblical grounds for the right of appeal are largely lacking in the Reformed church polity. In
addition, there is no clear definition of the concept 'injustice' in Article 31 Church Order. In the
case of appeals brought to a synod of the RCSA, the verdict usually contains no guidelines on
how the matter should be dealt with in practice in order to effect reconciliation. Consequently,
the outcome of an appeal does not necessarily contribute to the solution and restoration of
broken relationships.
Aim and method of work
This study endeavours to
determine the biblical grounds of appeal and legal restitution in Reformed church polity
through scriptural study;
establish the essence and content of appeal in Reformed church polity; and
examine the functioning, treatment and application of appeal with a view to legal restitution
in the RCSA, and address shortcomings in this respect.
Findings
Legal restitution occurs when
an appeal is judged according to clearly defined norms;
the verdict rests on the same norms; and
the necessary steps had been taken to reconcile the parties involved in the appeal
Organisation
The study is divided into four main sections:
biblical foundation of appeal with a view to legal restitution;
historical development of appeal with a view to legal restitution;
fundamental definition of appeal with a view to legal restitution; and practical treatment of appeal with a view to legal restitution.
