The objective of this study is to conduct a critical evaluation of the Namibian
law and policy framework that currently regulates small-scale mining in
Namibia. The discussion begins with an introduction to small-scale mining in
Namibia which deals with the practice of small-scale mining, inter alia, as far as
it is defined and the possible affects thereof. Small-scale mining affects various
second generation rights of persons directly involved therein as well as the
community as a whole. These rights include child labour; unemployment;
gender issues; public health care; occupational health and safety; access to
finance; poverty alleviation; and access to mining tools, machinery, markets
and buyers.
The law and policy framework applicable to small-scale mining in Namibia is
accordingly critically discussed in terms of the strengths and weaknesses of the
current framework. It is found that small-scale mining is quite well regulated in
Namibia, but the current law and policy framework is not without its problems.
Some of the main weaknesses identified are the centralised nature of the
application for and pegging of claims, the lack of formal provision and
regulation of the off-set markets, and the lack of access to finance for smallscale
miners.
Recommendations are made, such as that regulatory measures should be put
in place to make provision for and to regulate the off-set markets for the
minerals being mined by the artisanal miners. At the end of the study further
research topics which relate directly to the regulation of small-scale mining in

Conflict and injustice are endemic to the imperfectness of human existence, and the Church of
Christ is not immune to them. Various means can be adopted to solve conflict in the church.
This study is concerned with legal restitution through calling at a major assembly, as provided
in Article 31 Church Order.
Statement of the problem
Biblical grounds for the right of appeal are largely lacking in the Reformed church polity. In
addition, there is no clear definition of the concept 'injustice' in Article 31 Church Order. In the
case of appeals brought to a synod of the RCSA, the verdict usually contains no guidelines on
how the matter should be dealt with in practice in order to effect reconciliation. Consequently,
the outcome of an appeal does not necessarily contribute to the solution and restoration of
broken relationships.
Aim and method of work
This study endeavours to
determine the biblical grounds of appeal and legal restitution in Reformed church polity
through scriptural study;
establish the essence and content of appeal in Reformed church polity; and
examine the functioning, treatment and application of appeal with a view to legal restitution
in the RCSA, and address shortcomings in this respect.
Findings
Legal restitution occurs when
an appeal is judged according to clearly defined norms;
the verdict rests on the same norms; and
the necessary steps had been taken to reconcile the parties involved in the appeal
Organisation
The study is divided into four main sections:
biblical foundation of appeal with a view to legal restitution;
historical development of appeal with a view to legal restitution;
fundamental definition of appeal with a view to legal restitution; and practical treatment of appeal with a view to legal restitution. hierdie studie fokus op die sekuriteit en veiligheid van nopvoeder, veral tydens
die afrigting van sport. In die studie is daar na opvoeders verwys in hulle rolle as
sportafrigters, wedstrydbeamptes en administrateurs by skole.
Hierdie navorsing val binne die vakgebied Onderwysreg en die opvoeders se
sekuriteit en veiligheid word onder andere vanuit n gemeenregtelike perspektief
bespreek. Om die studie geldig te maak, is al die rolspelers wat by sportafrigting
by die skole betrokke is, by die studie ingesluit.
Die Grondwet, onderwyswetgewing, beroepsveiligheid en –gesondheidswetgewing,
tersaaklike regspraak en die gemene reg is as regsdeterminante
ontleed. Daar is veral in die bespreking van die gemene reg gefokus op
deliktuele aanspreeklikheid as regsdeterminant.
In die studie is n kwalitatiewe ondersoek na opvoeders se persepsies gedoen.
Daar is gefokus op deelnemers in die onderwys in n spesifieke geografiese area
is, en die hele spektrum van rolspelers is betrek. Een prominente bevinding van
die studie is dat opvoeders gretig is om meer inligting oor die regsaspekte
rakende sportafrigting te bekom. Dit is vir die meeste deelnemers n onbekende
veld en hulle is van mening dat indien hulle meer ingelig is, dit n groot bydrae sal
lewer tot hulle eie veiligheid en sekuriteit, sowel as dié van leerders.

Towards a legal history of white women in the Transvaal, 1877-1899Grobler, Marelize 05 August 2010 (has links)
This dissertation creates a background for studying white women in the Transvaal between 1877 and 1899. Legal documents are used as primary sources, as they are invaluable for researching women’s history, in that they provide a new perspective. When writing women’s history, it must be grounded in theory, as, especially when it comes to history in court cases, concepts like ‘history as performance’ and ‘occasionalism’ are significant. Of course, an eye must also firmly be held on concepts such as ‘gender’ and ‘deconstruction’, since it dictates how one should approach one’s sources. A history of the Transvaal is necessary, for when studying the court cases one must be able to position the women within a framework of their lives, and what type of living they made. Therefore, part of the dissertation is a political, but also social and economic, history of the Transvaal, written with specifically white women in mind. Sources for the socio-economic historical framework include literary accounts and secondary works on the period. The framework for the court cases further includes creating a legal stage on which to position women, which is accomplished by using legal sources like law reports, but also laws and resolutions. It is only once a detailed framework has been created that one can scrutinise court cases for issues surrounding white Transvaal women’s legal position, and agency. AFRIKAANS : Hierdie verhandeling skep die agtergrond vir ‘n studie van wit vroue in Transvaal tussen 1877 en 1899. Regsdokumente word as primêre bronne gebruik, aangesien dit van onskatbare waarde is in die ondersoek van vrouegeskiedenis, deurdat dit ‘n nuwe perspektief bied. To accomplish this, the secured property will be sold at an execution sale, after the correct procedure has been followed. Over the past decade, foreclosure proceedings have undergone significant changes, largely owing to section 26 of the Constitution, 1996, and sections 129 and 130 of the National Credit Act 34 of 2005. The following stages in the foreclosure process are identified: pre-trial debt enforcement procedure; determination of jurisdiction; court procedure; attachment and execution sale. Both the pre-trial debt enforcement procedure and the court procedure have recently been substantially amended by legislation and case law. Although legislation and case law currently regulate the foreclosure process satisfactorily, some disturbing aspects of execution sales remain and these deserve the legislator’s attention. / Private Law / LL.M.

An increase in international trade has resulted in an increase in the carriage of goods by sea, which has also promoted the business of marine insurance on a very huge scale. Marine insurance contracts fall within both the admiralty jurisdiction where admiralty laws apply and special contract law where the rules and principles of contract law apply. In certain circumstance this has left the courts with a dilemma in deciding in particular cases which law should apply; whether maritime law, contract law or marine insurance law.
There are certain principles under the law of contract that are said to be profound and cannot be ousted easily by substantive law. The principle of party autonomy is one of these principles and it has gained international recognition through a number of cases. However, to date, courts are faced with difficulties in deciding whether to uphold the choice of law on jurisdiction and governing law exercised by parties or resort to substantive law, either by virtue of admiralty law or any other statutes in a country, which provisions may be contrary to the clause on choice of law under the contract. In South Africa practice has shown that courts are always reluctant to apply the clause on choice of law if they believe such application is against the public policy and interest in South Africa. This begs the question as to the precise meaning and effect of “public policy and interest” and how this principle influences the long-standing and well-established principle of party autonomy in admiralty jurisdiction.
This dissertation is aimed at providing a legal response to this problem by analysing case law and the different viewpoints of various writers.
