L'intégration politique des mormons aux États-Unis : de Reed Smoot à Mitt Romney / The Political Integration of the Mormons in the United States : from Reed Smoot to Mitt Romney

L’Église de Jésus-Christ des Saints des Derniers Jours, ou « Église mormone », émargea au cours de la première moitié du XIXe siècle dans une Amérique en proie à des mutations sociales et religieuses. Joseph Smith, son prophète-fondateur, l’inscrivit dès le départ dans une radicalité doctrinale en « protestant » les fondamentaux du christianisme tels qu’ils avaient été définis et acceptés auparavant. Il s’attira de ce fait le courroux des « Églises établies », en particulier de celles du protestantisme évangélique. Malgré une américanité foncière, sa religion fut affublée de l’étiquette « un-american » et ses disciples furent persécutés, poussés à édifier leur « Sion » sur la « Frontière », puis dans l’Ouest, à la périphérie de la société américaine. Contrairement à bien d’autres groupes religieux ou de mouvements utopiques, les « mormons » réussirent à transformer leur marginalisation en force, développant par la même occasion des particularismes qui firent d’eux un « peuple à part ». Or, ils s’éveillèrent aussi à l’évidence que pour échapper aux persécutions, ils devaient se positionner au cœur de l’action politique du pays. L’investiture de Mitt Romney par le Parti républicain pour l’élection présidentielle de 2012 témoigne de leur réussite. Mais comment cela fut-il possible ? Romney fut aussi l’objet d’une formidable opposition religieuse au cours de la phase des primaires du Parti qui n’est pas sans rappeler celles fomentées par les protestants contre les catholiques Al Smith (1928) et John F. Kennedy (1960). Comment expliquer ce refus de voir un mormon à la Maison blanche ? Nous répondons dans cette thèse à ces questions, et à bien d’autres, notamment en illustrant le fait que Romney, J. F. Kennedy et Al Smith eurent un prédécesseur en Reed Smoot, apôtre mormon dont l’élection en 1902 au Sénat fédéral fut à l’origine du plus grand procès politico-religieux d’Amérique. / The Church of Jesus Christ of Latter-day Saints, or “Mormon Church,” emerged during the first half of the 19th century while America was undergoing social and religious changes. Right from the outset, Joseph Smith, the prophet-founder, set the Church in a radical opposition, “protesting” the dogma of traditional Christianity as they had been defined and accepted for centuries. He attracted the ire of the “established Churches” of Evangelical Protestantism. In spite of the profound Americanness of his religion, it was labeled un-american and his followers were persecuted, driven out, and forced to build their “Zion” on the Frontier, and then in the West, on the margins of American society. Unlike several other religious groups and utopian movements, the “Mormons” managed to turn their marginalization into strength, developing thereby traits that made them “a peculiar people.” Yet, they also realized that to escape persecutions, they had to be at the center of the nation’s politics. The nomination of Mitt Romney by the Republican Party for the 2012 presidential election testifies to their success. How did that come about? Romney was also the object of a sturdy religious opposition during the Party’s primaries that reminded the ones set up by the Protestants in the cases of Al Smith (1928) and of John F. Kennedy (1960). How does one account for this refusal to see a Mormon in the White House? In this dissertation, we answer these questions, and to many more, particularly as we illustrate the fact that Romney, J. F. Kennedy and Al Smith had a predecessor in Reed Smoot, a Mormon apostle whose election in 1902 to the U.S. Senate set the tone for the greatest religiously and politically-motivated trial ever in American history.

Seditious theology : imaginative re-identification, punk and the ministry of Jesus

The following thesis investigates the British punk movement of the mid-late seventies and suggests that, by performing acts of imaginative re-identification, we may gain greater insights into both the phenomenon of punk and aspects of Jesus’ life, ministry, and teaching despite their axiomatic and sometimes problematic differences. To do this we explore the power of the sartorial creations that the movement adopted and the way in which they conveyed an oppositional protest message and stance. We explore punk graphics and the way in which they could offer a targeted critique of the nation. We look at punk performances and how they confrontationally engaged with their audiences and what they wanted to elicit in return. We reflect on women in punk, punk in Northern Ireland and the relationship between punk and the black community and the degree to which punk exhibited a counter-cultural attitude to relationships. Concluding our look at punk we investigate how society, the authorities and commerce reacted to the movement, before investigating punk as a trans-historical essence. Having explored punk and established imaginative connections we then revisit aspects of Jesus’ life and consider him as a subversive who negated some of the national symbols of Israel, collided with Jewish national authority and reversed many of the nation’s perspectives. We look at the more confrontational nature of Jesus, his use of symbolic physical statements and his interaction with women, teaching on enemies and the way he related to the outcast. We then conclude by showing the degree to which the present-day church has been absorbed into the surrounding culture and explore two instances in post-war theology where there has been a recovery of the more seditious pattern within Jesus’ life before seeing whether there is anything that the church may learn from imaginatively identifying with punk.

É um documento rico de possibilidades interpretativas, favorecendo a leitura de valores que podem nos dar a ler os valores que contribuíram para a construção da identidade protestante kalleyana naquele período. Importantes conceitos foram trazidos para este diálogo como o de leitura, apropriação e representação a partir de teóricos da historia cultural. Buscou-se problematizar as identidades representadas. Dirigiu-se o olhar para as contribuições culturais e educacionais que Kalley trouxe para o Brasil, especialmente através da Escola Bíblica, uma estratégia de mostrar a literatura da salvação mediante o saber bíblico escolar. / The work problematize the emergence of Protestant identity built by Kalley from 1855. We develop conceptual and analytical objectives constructing a bibliographic and documentary analysis of the life and work of Robert Kalley and Kalleyanismo in General, treading a path that seeks to capture this methodological identity through the analysis of tactics, gimmicks that have characterised the Protestantism in Brazil, particularly in the city of Rio de Janeiro, between the years 1855 and 1876 by problematizing for these processes in terms of identity, and about consumer practices in Protestant áreas, responsible for the preparation of new religious identities. A document that emerged in the 19th century had great importance as a trail of identity in the making of this dissertation was "Brief exposure of the fundamental doctrines of Christianity". It is a rich document of interpretative possibilities of writings that can give us the read values that have contributed to the building of Protestant identity Kalleyana in that period. Important concepts were brought to this dialog as the reading, ownership and representation submitted by theorists of cultural history. Sought problematizing the impersonated identities. Drove my look at educational and cultural contributions that brought to the Brazil Kalley, especially through the Bible School, a strategy to show the literature of salvation through Biblical knowledge.

The replacement of the doctrine of pith and marrow by the catnic test in English Patent Law : a historical evaluation

This dissertation is a historical evaluation of the movement of the English courts from the doctrine of pith and marrow to the Catnic test in the determination of non-textual infringement of patents. It considers how and why the doctrine was replaced with the Catnic test. It concludes that this movement occurred as a result of the adoption by a group of judges of literalism in the construction of patents while another group dissented and maintained the correct application of the doctrine. Although the Court of Appeal and the House of Lords initially approved the literalist approach, they, after realising its untennability, adopted the dissenters’ approach, but, ultimately, adopted the Catnic test in which features of the dissenters’ approach were included. The dissertation concludes that the doctrine of pith and marrow, correctly applied, should have been retained as the Catnic test creates uncertainty and confusion. / Mercantile Law / LL.M.

A presente tese carrega o ônus de afirmar a relevância dos textos de Henry David Thoreau para a filosofia moral. Duas estratégias paralelas foram utilizadas para cumprir a tarefa. A primeira consiste na discussão pormenorizada de um conjunto de autores que apresentaram para Thoreau diferentes visões sobre a moralidade e o papel da filosofia na tecitura de uma vida digna de ser vivida: o Unitarismo de William Ellery Channing, as doutrinas do Scottish Common Sense de Dugald Stewart e Thomas Reid, o utilitarismo teológico de William Paley, o intuicionismo racional dos Platonistas de Cambridge (representados aqui por Ralph Cudworth), Orestes Brownson e Ralph Waldo Emerson – dois dos principais nomes do Transcendentalismo da Nova Inglaterra e Samuel Taylor Coleridge, Victor Cousin e Thomas Carlyle – primeiros intérpretes do Idealismo Alemão para o mundo de língua inglesa. A segunda estratégia articula a reação de Thoreau a essas diferentes posições sobre a moralidade, mostrando como, a partir dessa reação, ele foi capaz de formular um exercício de pensamento moral, cristalizado, emblematicamente, na escritura de Walden. Two parallel strategies have been used to complete the task. The first is a thorough discussion of a group of authors who presented to Thoreau different views on morality and the role of philosophy in the weaving of a life worthy of being lived: William Ellery Channing´s Unitarianism, the doctrines of the Scottish Common Sense - Dugald Stewart and Thomas Reid, William Paley´s theological utilitarianism, rational intuitionism of Cambridge Platonists (represented here by Ralph Cudworth), Orestes Brownson and Ralph Waldo Emerson - two of the leading names of New England Transcendentalism and Samuel Taylor Coleridge, Victor Cousin and Thomas Carlyle - first interpreters of German Idealism to the English-speaking world. The second strategy articulates Thoreau´s reaction to these different positions on morality, showing how, from this reaction, he was able to formulate an exercise in moral thinking, crystallized, emblematically, in the writing of Walden. The concept of "fictional identity" was designed to capture different techniques used in this exercise.
