Structural behaviour and stability of steel beam-column elements in under-deck cable-stayed bridge / Plieninių paspyrinių tiltų gniuždomų lenkiamų elementų įtempių deformacijų būsena ir stabilumas

The dissertation investigates the issues addressed to Under-Deck Cable-Stayed (UDCS) bridge, analyses its in-plain structural behavior and stability verification with an approach of Advanced Analysis. The main objects of research include effective form-finding of steel UDCS bridge, structural behaviour and stability analysis by means of beam-column elements based on the Direct Analysis Method. The study approaches a few main tasks such as a new form of UDCS bridge by accounting for the economical and efficient structural design criteria; dealing with the generalized calculation models of the additionally restrained steel beam-column elements; the development of the computational method for the direct analysis of the steel structures and especially bridges using generalized calculation models and outlining practical guidelines for UDCS bridge design. The dissertation consists of five parts including Introduction, 4 chapters, Conclusions, References and 3 Annexes. The introduction reveals the investigated problem, importance of the thesis and the object of research and describes the purpose and tasks of the study, research methodology, scientific novelty, the practical significance of results examined in the thesis and defended statements. The introduction ends in presenting the author’s publications on the subject of the defended dissertation, offering the material of made presentations in conferences and defining the structure of the dissertation. A test of an etiological model: The development of disordered eating in Division-I university female gymnasts and swimmers/divers.

Certain sport environments may contribute to the development of disordered eating and those that heavily emphasize weight and/or body shape can be particularly damaging to an athlete's body image, self-concept, and eating behaviors. In particular, female athletes in collegiate sports are at a greater risk for engaging in unhealthy behaviors because they face both societal pressures from Western culture to be thin, in addition to sport pressures that focus on performance and appearance. According to the American Medical Association almost half of American women are trying to lose weight, illustrating that societal pressures alone to be thin and attractive can influence the development of disordered eating. Athletes are exposed to the same sociocultural pressures as their nonathlete counterparts, and would be expected to have similar feelings about their bodies as women in general. Add subsequent pressures like team "weigh-ins," coaches' body comp preferences, judges' critiques, revealing attire, and endurance/strength demands, and the stage is set for the development of disordered eating. In the current study, participants were 414 Division-I female gymnasts, swimmers/divers, and they completed self-report measures assessing sport pressures, body satisfaction and disordered eating behavior to test Petrie & Greenleaf's etiological model. Results indicate that sport pressures do lead directly to dietary restraint, a precursor to disordered eating, and are not always mediated through internalization and body dissatisfaction. These findings suggest that decreasing and intervening with perceived sport pressures may lessen the risk of female athletes developing an eating disorder.

The legitimacy of judicial law-making and the application of judicial discretion in South Africa : a legal comparative study

The concept of judicial law-making impacts on the extent, meaning and scope relationship between the legislature, the executive and the judiciary. It is an integral function of the courts while its shape, meaning and nature seem to lack sufficient formulation and articulation, which results in an inherent problem regarding its legitimacy. This study examines the legitimacy and the working of the South African constitutional judicial law-making concepts. Its effect on the constitutional relationships between all three branches of government is scrutinized. In order to fully probe this concept, its impact and application on the separation of powers, judicial review, constitutional deference and mandatory minimum sentences becomes inevitable. The introductory part of this study looks at origins and historical development of the separation of powers doctrine and its application under the 1996 South African Constitution. The latter part focuses on the nature and the scope of judicial review, judicial law-making, constitutional deference and mandatory minimum sentences with a view establishing the impact of these concepts in our judicial law-making. The development of these concepts by South African courts, and what seems to be the lack of formulation and articulation of South African constitutional judicial law-making which raises questions regarding its legitimacy is probed. This research recommends that it is of the utmost importance that South Africa develops its own unique and comprehensive doctrine of separation of powers. The Constitution further requires reforms in order to clarify the extent to which the courts can go when formulating laws and public policy in the interests of justice, and whether the interests-of-justice test is capable of delivering a well-informed outcome in developing this jurisdiction’s laws. South African jurisprudence also needs to be developed in empowering the legislature to make laws which are constitutionally compliant without making the courts the sole expositor of the Constitution. Lastly, the extent to which the legislature can enact certain laws must be redefined, which on face value might seems to be encroaching into the courts’ independence and authority. / Criminal and Procedural Law / LL. The conflict between the First Amendment and the Sixth Amendment is not new nor is it easily decipherable. Both amendments appear to have absolute priority, yet they appear to conflict (Erickson, 1977). The First Amendment declares unequivocally, "Congress shall make no law...abridging the freedom of speech, or of the press[,]" while the Sixth Amendment states with equal force, "In all criminal prosecutions, the accused shall enjoy the right to a speedy public trial, by an impartial jury of the state and district wherein the crime shall have been committed..." (U.S. Constitution, Amendment I, Amendment VI). Free speech and an unrestricted press can lead to a partial jury, but a jury unbiased by the media may mean restricted speech. In the judicial system the debate about how to balance these two competing constitutional rights has raged for decades, but one critical area—the nature and characteristics of requests for judicial "gag" orders—has been largely ignored. This thesis analyzed 103 cases from the Media Law Reporter volumes 19 through 33 (approximately 1991-2005) where gag orders were requested because of pretrial publicity. Those 103 cases were evaluated for the type of case, the reason for the case, when the gag order was requested, who requested the gag order, why they requested the gag order, who opposed the gag order, why they opposed the gag order, and why the gag order was granted or denied. It was found that although the issue of gag orders and their use in trials is not settled there is a general pattern to how they tend to be used. This study found that gag orders are most commonly used by judges in serious criminal trials, particularly at the federal level. Further, these cases usually involved juries, and the targets of the gag order were the parties involved in the trial, not the press.

「沒有標準化就沒有現代經濟。」在知識經濟時代,掌握制定規則權力者,就占有主宰市場的領導地位。由於絕大多數標準係由政府或私人組織所制定,因此,研究標準制定組織具有重要意義。此外,觀察當代立法趨勢,政府以採訂私人組織或非政府組織所擬定之產業標準的方式,擴增其管制功能,在此潮流下,採訂私人草撰標準成為法律規範一環,此舉一方面可能形成授權立法之漏洞,另一方面將迫使個人暴露於著作權侵權行為之刑事、民事以及行政制裁大帽。同時,政府將產品標準及認證之工作委由產業協會等私人組織承擔亦成主流,該項¬「公益性」作業即可能成為事實標準制定者用來限制競爭、不當逐利的手段。 本文便以上述爭議問題為出發點,討論標準制定組織所擬定之標準,特別是經過政府機關以法律規範形式採用後,是否仍該當著作權的保護客體?並將研究延伸到網路產業中標準著作權保護的適當性問題,以及針對標準這類事實編輯物的資料庫保護進行分析;其次,本文將針對一國之產業標準制定組織為研究重心,探討例如標準制定與認證中的限制競爭及獨占管制的法律問題,以及隱然成為事實標準的市場領導者涉及智慧財產權的拒絕交易紛爭等課題。然而,針對上述命題的前提要件是對標準的概念與應用有相當之瞭解,以導入標準制定組織之運作、不同層級標準制定過程之影響及其所涉及之智慧財產爭議問題研究。因此,本文將對國家標準以及行業標準制定及運用過程所涉及之著作權及競爭法問題作深入且廣泛之瞭解,以此為基礎,分析各層級標準制定體系的規範內涵,繼而詮釋一國保護行業標準之著作權與競爭法之法律規定;並提出建言作為我國標準化體系之發展、參與國際標準制定活動、標準著作權保護分析架構、事實編輯物(資料庫)保護模式、競爭法對標準與認證活動之適用以及切入拒絕交易案件等之參考。 / In a knowledge-based economy, whoever dominates rules-developing overpowers the market. Most of the standards are set by the government and private organizations; therefore, a study on standard-setting organizations is of essential value. The Government leverages its regulatory function by adopting law standards promulgated and copyrighted by non-governmental actors. Despite governmental ambitions, no one is responsible for evaluating the legitimacy of this approach ex ante and no framework exists to facilitate analysis. On the other hand, standard-developing and conformity assessment increasingly falls on the shoulders of industry associations and lead to impartiality concerns from the antitrust law perspective. Regarding standards that are generated and controlled by private actors exposing citizens to criminal, civil and administrative sanctions, this paper contributes an analytical framework and proposes institutional mechanisms to implement it in terms of copyright. This paper extends by questioning if copyright would be an appropriate form to protect standards in the Internet industry. Then, it explores ways to protect compilation of facts and databases once they are de facto standards. Following the antitrust concerns, this paper focuses on industry standard-setting organizations within a specific territory to explore the antitrust and unfair competition problems confronting the role of the de facto standard-setters or the certification performers and the refusal to deal involving intellectual property issues. As foundations, this paper initiates by a detailed study of concepts and applications surrounding standardization; then, it leads to how a standards is produced, how standard-developing organizations in various levels affect the market, and how the intellectual property problems involves in standardization. In conclusion, based upon in-depth coverage of copyright and antitrust predicaments facing applications of national standards and industry standards, this paper interprets how copyright and antitrust laws work to protect business standards. At the same time, it delivers suggestions for the development of our standardization system, involvement of international standard-setting activities, an analytical framework for standards in copyright, protection for compilation of facts and databases, and how antitrust laws works when it comes to non-governmental standard-setting actors.

The evolution of social behaviour : the effect of mating system and social structure in the European badger Meles meles

Studies of mating systems and social organisation have been central to understanding of the evolution of social behaviour. The European badger Meles meles is a good species in which to study these processes, as its complex social system provides an opportunity to investigate how both natural and kin selection shape the evolution of mating systems and social structure. In this thesis, I use behavioural and genetic data to describe the mating system and social organisation of a high-density badger population and examine the occurrence of cooperative breeding. I genotyped 915 (85%) badgers trapped in Wytham Woods (1987–2005), 630 of which were cubs, and assigned both parents to 331 cubs with 95% confidence. This revealed a polygynandrous mating system, with up to five mothers and five fathers per social group. Mounting behaviour was also polygynandrous and I show the strongest evidence to date for multiple-paternity litters. I demonstrate, for the first time, that groups consisted of close and distant kin: approximately one third of group members were first-order kin, and overall group members had slightly lower relatedness levels than half-siblings. Within groups, adult and yearling females had higher pairwise relatedness than males, and neighbouring groups contained relatives. These findings result from the high level (42%) of extra-group paternities, 86% of which were assigned to neighbouring males. For the first time I show that females avoided inbreeding by mating with extra-group males; however, incestuous matings did occur. Promiscuous and repeated mountings were observed, which may reduce male–male aggression and infanticide, but may also promote sperm competition, genetic diversity, and / or genetic compatibility. Just under a third of adult males and females were assigned parentage each year and I quantify, for the first time, reproductive skew within badger groups. Correlations between relatedness, group productivity, and reproductive skew were not consistent with the predictions of incomplete-control models; rather, resource availability may play a role. Older and younger badgers displayed reduced annual breeding success, with male success increasing initially with experience. The Restraint, Constraint, and Selection Hypotheses did not explain the age-related breeding pattern in females. Variance in lifetime breeding success (LBS) was greater for males. Males that only bred within or only outside of their groups had half the LBS of males that did both. Females that were assigned maternity probably bred cooperatively and allonursed non-offspring, which has not been demonstrated previously. No benefit was established, however, in terms of litter size, probability of offspring breeding, or offspring lifetime breeding success, with more mothers in a group. In conclusion, badger social groups are fostered through kinship ties. Polygynandry and repeated mounting may have evolved originally to reduce male–male aggression and infanticide by males, through paternity masking. Although plural breeding occurs, group living appears to be costly. Motivation to disperse may be reduced through high-levels of extra-group paternities, which may also reduce inbreeding. Cooperative breeding among mothers may represent a low-cost behaviour with indirect benefits due to high levels of relatedness between female group-members. Badger sociality therefore represents an early stage in the evolution of social behaviour.

Examining the maintaining factors of anorexia nervosa

This thesis is a qualitative investigation of the factors which maintain anorexia nervosa (AN) according to the transdiagnostic theory of eating disorders (Fairburn et al., 2003). AN is difficult to treat and continues to evade complete understanding. The present study aimed to promote further understanding of food restriction and physical activity in relation to the constructs of clinical perfectionism, core low self-esteem, mood intolerance, and interpersonal difficulties. Twenty females with self-reported AN were recruited from Guelph, Ontario and participated in semi-structured interviews. Thematic analysis revealed eight major themes for clinical perfectionism, five for core low self-esteem, five for mood intolerance, and six for interpersonal difficulties. The in-depth emotional accounts and details of food restriction and physical activity in relation to the four constructs examined in this study may contribute to further appreciation of AN, informing practitioners and family members, promoting empathy, and improving treatment options.

More specifically, this thesis deals with the study of the development of the building, the technological regulation for the flat roof, and the subsequent chapters - design and assessment of the lifting mechanism, optimal design of the building site, timetable, itemized budget, control and test plan, etc. An interesting point is the simulation of the construction, where a 3D model and a video are created. The thesis is based on a borrowed documentation of the project.
