Previous issue date: 2014-08-21 / The present study aims focuse on the Brazilian procedural law, specifically the institute of the provisional execution in court rulings, authorized by the Code of Civil Procedure in the cases of appeals that are received only in their non-staying effect, with a procedure regulated by the article 475-O of the Code of Civil Procedure. As such, it encompasses the provisional execution with exact amount against a solvent debtor in the Code of Civil Procedure. The present study is justified by the need to carry out court rulings, mainly the ones provided by first instance judges, in order to avoid that the plaintiff, prevailing party of the demand, wait for the trial of the appeal put in motion by the opposing party, to only then perform the execution. The technique of researching indirect documentation was used, and the approach method is the logical deductive. The research approached the following items: the effectiveness of the court rulings, mainly within the ambit of execution, as well as its sentences, its respective chapters and efficacy; the moment of the efficacy of the decisions, approaching the provisional execution title, the provisional execution and the advanced judicial protection, and the execution of the astreintes ; the concept of the provisional execution, the situations that lead to it, and its distinctive criteria in relation to the definitive execution, specifically the bond and the responsibility of the execution creditor; the procedure of the provisional execution; and other questions considered relevant, even if they don t compose the focus of the study, such as the provisional execution against the Public Treasury, the provisional execution of the fees and the procedural costs, and the specific provisional execution. The investigation shows the necessity and the urgency to carry out the court rulings, and the theme should be continuously studied / O presente estudo objetiva focar o direito processual civil brasileiro, especificamente o instituto da execução provisória das decisões judiciais, autorizada pelo Código de Processo Civil, nos casos dos recursos que são recebidos apenas em seu efeito devolutivo, com procedimento regulado pelo artigo 475-O, do Código de Processo Civil. Abrange, assim, a execução provisória por quantia certa contra devedor solvente no Código de Processo Civil Brasileiro. Justifica-se esta pesquisa pela necessidade de se efetivar as decisões judiciais, mormente as proferidas pelos juízes de primeira instância, de modo a evitar que o autor e vencedor da demanda aguarde o julgamento do recurso interposto pela parte contrária para só então realizar a execução. Utilizou-se a técnica de pesquisa da documentação indireta e o método de abordagem é o lógico-dedutivo. A pesquisa abordou os seguintes itens: a efetividade das decisões judiciais, em especial no âmbito da execução, assim como as sentenças, seus respectivos capítulos e eficácia; o momento da eficácia das decisões, abordando o título executivo provisório, a execução provisória e a antecipação de tutela, e a execução das astreintes ; o conceito da execução provisória, as situações que a ensejam e os seus critérios distintivos em relação à execução definitiva, especificamente a caução e a responsabilidade do exequente; o procedimento da execução provisória; e outras questões consideradas relevantes, ainda que não componham o foco do trabalho, como a execução provisória contra a Fazenda Pública, a execução provisória dos honorários e das custas processuais e a execução específica provisória. A investigação mostra a necessidade e a urgência de se efetivar as decisões judiciais, devendo o tema ser continuadamente estudado

自由的行政裁量與受限的法拘束力—大法官會議解釋的個案分析 / The Impossibility of Legal Constrain on Bureaucratic Discretion: A Case Study of Supreme Court Rulings林俞君, Lin, Yu-Chun Unknown Date (has links)
本研究透過公共選擇途徑,檢視行政機關面對主管之行政命令遭大法官會議宣告違憲後的裁量行為,藉此瞭解行政機關面對司法審查的制衡監督,將表現出哪些樣態的裁量模式;並藉由公共選擇途徑關於理性自利人的假設,以「交易」的概念連結行政與法律,以補充兩者過去缺乏交集、各說各話的現象。
本研究追蹤至民國97年底為止判決行政命令違憲的解釋,共66筆。依大法官解釋是否賦予行政機關修改命令的裁量,以及命令是否修改,將66筆解釋分成四大類,並統計修改所費的時間。透過統計分析以及深度訪談,本研究發現:大法官未賦予行政機關修改裁量,雖然確能提高命令修改的比例,但是對於控制行政機關在一定的年限內完成修改卻未有顯著的結果。行政機關雖然原則上會停用違憲法規,但卻不一定願意將新的作法明文化,其間的理由包括節省修正命令的成本,或是爭取更多決策商議的機會等。縱使最後依然完成修正,「依法行政」卻不是其真正的動機;減少組織成本或政策執行成本、增加組織的正當性等才是行政機關決定修改、不修改命令,或是否在期限內完成修訂的真正理由。而大法官解釋對行政機關的制衡力量,也因為大法官作成解釋之後再無有效的監督機制而打了折扣。同時,司法審查與行政之間的制衡關係必須放在整個民主授權結構中進行理解;正因兩者關係並非處於真空環境,授權結構的資訊不對稱、多重委託與多重代理的問題,同樣會發生在司法對行政的監督關係中,因此大法官在結構上就無法完整地扮演制衡、監督行政機關的角色。
基於以上發現,本研究認為司法對行政的制衡,除了司法審查制度本身以外,應當依照行政機關的偏好模式設計監督機制。包括將違憲的命令交由行政院研考會統一管考、監察院可針對行政機關延遲修正命令的行為進行糾正,並要求遭判違憲的行政命令之修正、失效與廢止皆須對外公告,避免行政機關以節省成本為由,讓法規失去扮演政府與人民之間的契約的功能。 / This research intends to answer the question of “how Supreme Court Rulings have impacts on bureaucratic discretion?” As the superior judicial review authority, Supreme Court Rulings are usually thought as an authority which bureaucrats must obey. Is it really the case? In this research, both bureaucrats and Supreme Court are seen as rational actors who have preferences over different outcomes, as the Public Choice theorists usually depict. Author utilizes public choice theory to bridge the gap between the fields of public administration and public law on the issue..
Empirically, this study collects the administrative decrees which were announced unconstitutional by Supreme Court before the end of 2008 in Taiwan. Sixty-six Supreme Court Rulings are found and categorized into four groups by two dimensions: (1) whether the grand judges give the bureaucrats discretion and (2) whether the bureaucrats follow the grand judges’ will to reform the decrees. Both secondary data analysis and in-depth interviews are used in this research to figure out bureaucrats’ preference and the way they respond to the grand judges’ decisions. The statistical result shows that after been announced unconstitutional by the Supreme Court, about 15% of the administrative decrees stay the same. The reasons for this “unresponsiveness” to the Supreme Court Rulings are varied case by case. Basically speaking, bureaucrats take laws as means to fulfill their tasks. They are not motivated to follow the rule of law if there is a requirement to pay an excessive costs to achieve the policy goals. It is interesting to know that judicial review is high on its moral ground but sometimes it is a mechanism without an administrative devises to enforce their rulings. Also, the problems of information asymmetry, multi-principle and multi-agent will also be found in the relationship between Supreme Court and bureaucrats.
To sum up, on the one hand, this research has shown that to follow the rule of law is not bureaucrats’ priority. As a result, an administrative mechanism is needed to enforce the Supreme Court Rulings. For example, the Research, Development and Evaluation Commission (RDEC) of Executive Yuan or the Control Yuan can be assigned to do the job. However, on the other hand, the Supreme Court always stands on the side of protecting human rights against government activities, sometimes the rulings might lead to government activities unworkable as we can see from the cases of the Rulings 400 and 440. How to balance the issue of protecting citizen’s rights and governability of the administrative agencies is one of the key problems needed to be solved in order to realize democratic governance in the future.

required for its elaboration, as well as, the legal aspects and possibilities of its content,
emphasizing the prevention against litigation that the institute can offer, which is currently
not much explored in the national scenery. This work studies the legal business elaborated
by the spouses before they get married institutes rules, mainly on the future family s
patrimony. It regards and presents the legal nature of the pre nuptial agreement, and
focuses the importance of such agreement as a tool to prevent disputes in the ambit of
family law, presenting its legal and social usefulness. This study also debates forms for the
optimization of the use of this tool. This study details the formal elements indispensable to
any pre nuptial agreement, as well as the doctrinaire and jurisprudential views on the
agreement content. This work also demonstrates a brief background of family and marriage
in order to make the understanding of its main subject easier. It presents a number of types
of property rulings, how they are dealt with in the Brazilian legal system and their
correlation with the pre nuptial agreement. The study also explores examples of provisions
that may be set forth in clauses of pre nuptial agreements, both in the patrimonial and
extra-patrimonial ambits. It points out polemic matters related to the pre nuptial
agreements, debating hypothesis of solution for each of them. Furthermore, it presents the
effect of the pre nuptial agreement in private international law and the hypothesis of
invalidity of pre nuptial conventions / O presente trabalho aborda o Pacto Antenupcial, analisando as formalidades

A presente dissertação dedica-se ao estudo da relação entre a teoria e a prática do Supremo Tribunal Federal no que diz respeito aos limites da interpretação conforme a Constituição. A partir do confronto entre as principais lições doutrinárias sobre o tema e os acórdãos proferidos pela Corte nos processos do controle abstrato de constitucionalidade, verifica-se que os limites reconhecidos pela doutrina e pelo Tribunal não são obedecidos em muitos dos precedentes, casos nos quais tem-se a utilização da interpretação conforme como mecanismo de correção e integração judicial do direito. Nesse cenário, busca-se averiguar a legitimidade de tal conduta pelo aplicador do direito. Chega-se, assim, a conclusão de que, nos casos em que o Supremo Tribunal Federal se vê diante de hipóteses em que há lacuna ou antinomia que não podem ser resolvidas pela interpretação conforme em sua função de decisão, o princípio da inafastabilidade da jurisdição impõe a aplicação da integração conforme a Constituição, desde que ela não esteja vedada tácita ou expressamente pelo ordenamento e que a decisão que a determine esteja fundamentada. / This study tries to understand the relationship between theory and practice regarding the limits of the interpretation according to the Constitution. Confronting the most common jurisprudence that relates to the topic and the decisions that the Supreme Court emitted in the cases of abstract judicial review, it becomes clear that the before mentioned limits of the interpretation according to the Constitution aren\'t respected by the decisions of the Court and that the technique is used as a mechanism of correction and integrity of the law. In this scenario, this study tries to reveal the legitimacy of the decisions the Supreme Court took on this basis. The conclusion one has arrived at states that in the cases in which the Supreme Court confronts itself with antinomy or law blanks that can\'t be resolved by regular interpretation, the non liquet principle forces the Court to correct or to integrate the law, as long as: 1) it isn\'t expressly or implicitly forbidden by the constitutional text; and 2) the decision is thoroughly motivated.

Recent attacks on media freedom in South Africa, that includes the ruling ANC party’s proposal for statutory regulation of the press, have seen press self-regulation fiercely contested and the ombudsman of the Press Council of South Africa (PCSA) defending the press’ constitutional right to freedom of expression.
Extensive arguments have been made by government, the public and the press for other forms of press regulation, such as statutory and independent co-regulation. In addition no accurate, detailed trends arising from complaints the ombudsman has dealt with in recent years, have been freely available on which arguments in such a debate could be based.
This research analyses the complaints dealt with by the press ombudsman in recent years in order to evaluate the present self-regulatory system, which is based primarily on the theories of freedom of expression and social responsibility of the press.
The analyses involves determining what trends exist in complaints cases that the ombudsman, Joe Thloloe, has dealt with since he took office in August 2007, until August 2011 when a Review of his office was published by the PCSA.
The study takes a qualitative approach, with some degree of quantification, and utilises document analysis and qualitative content analysis as data collection methods to analyse 593 cases, with specific focus on government complaints which form 15% of all cases analysed.
The findings reflect that the ombudsman’s approach in dealing with complaints was fair, that he displayed intolerance for transgressions and that his rulings were free of any obvious bias. This is evident in, amongst other findings, the very few appeals lodged against his rulings and even less successful appeals. In addition the press often voluntarily corrected their mistakes before prompted by the ombudsman. The findings also dispel some of the ANC’s criticisms that have led to its calls for statutory press regulation, such as the public and government’s acceptance of the self-regulation system, complaints from government largely having involved accuracy and not privacy as the ANC claimed, and that government’s failure to sign the legal waiver often resulted in cases being dismissed.
The findings also point to a significant increase in complaints, specifically from government, in the year 2010, which is the year in which the ANC renewed its calls for statutory regulation. This does not necessarily reflect a sudden decline in the quality of journalism but rather indicates that the ruling party differed fundamentally in its philosophical thinking regarding the press, which was perhaps informed by a developmental model of the press rather than the social responsibility model on which the present system is based. In this sense the government sees it fit to interfere or censor the press if it feels the system is not performing.
The findings show the ombudsman’s office lacked proper record-keeping from which accurate statistics could be derived, leaving a gap for criticism against the ombudsman. In addition, most often complaints against newspapers involved accuracy and fairness (such as not asking for comment). As is evident in several complaints falling outside the ombudsman’s mandate and the high number of dismissed cases, the findings also point to a lack of awareness or information of the system and of the ombudsman’s roles.
In light of the theoretical frameworks that set out how the self-regulation system, which is entrenched in the notion of press freedom, can enhance the cause of press freedom by its ombudsman enforcing a socially responsible Press Code, the findings ultimately lead to the conclusion that the ombudsman’s work has advanced the cause of press freedom in South Africa during the research period. / Thesis (MA (Communication Studies))--North-West University, Potchefstroom Campus, 2013

D’autant plus qu’en France, la motivation des décisions judiciaires et en particulier, des arrêts de la Cour de cassation est une obligation essentielle et le contrôle de la motivation, une mission première pour garantir le droit à un procès équitable. Actuellement la motivation des arrêts de la Cour de cassation est l’objet d’un projet de réforme dans le cadre plus général de celui de la Cour de cassation. Ce projet est suivi avec intérêt au Koweït, pays très influencé par la procédure civile française sous le contrôle d’une juridiction supranationale. Il n’y a de douter que le Koweït inclura dans sa trajectoire juridictionnelle tout progrès issu de la réforme en cours. / This study that compares the French legal system and the Kuwaiti legal system is a valuable study with multiple aspects to its legal research and professional applications. For France, the rulings of its "Court" and overseers is necessary for a just trial. Now, they both are a study subject for a project to alter the role of the “Court” in a general way. This project is of utmost importance to the Kuwaiti judicial system as it affected by its history with the French civil law. In addition, it is important as well for the respected and known place as the highest court in the judicial system. (Compared with the European court for human rights). It is without a doubt that Kuwait will take it into consideration these positive changes for the role of the "Court".
