Neste momento de reorganização dos espaços profissionais, definir e valorizar o trabalho interdisciplinar, especialmente na relação entre a Psicologia e o Direito, possivelmente provocará, no meio jurídico, transformações nas ações e nas representações relacionadas à proteção da criança. O lugar do psicólogo passou a ser discutido nessa perspectiva, pois as propostas de depoimento especial para a escuta da criança em situação judicial o coloca na função de facilitador do diálogo entre o juiz e a vítima, em um método de inquirição. Com isso, o aprendizado da interdisciplinaridade é prejudicado, porque o psicólogo tem seu conhecimento científico desvalorizado, assim como as técnicas que orientam seu trabalho são submetidas aos procedimentos e finalidades do Direito. Diante de tal impasse, a presente pesquisa tem por objetivo analisar e discutir as representações dos juízes e dos desembargadores quanto ao papel do psicólogo na produção de subsídios para as decisões judiciais, nos casos de violência sexual na infância. O referencial teórico que embasa as reflexões e análises é a Teoria das Representações Sociais, com enfoque na relação entre a Psicologia e o Direito, exposta no texto dos acórdãos judiciais. Today, there is a continued debate about its role in cases of child sexual abuse. At this time of reorganization of the professional field, to define and enhance interdisciplinary work, especially in the relationship between psychology and the law, will possibly provoke, amid the juridical environment, transformations in the actions and representations related to child protection.The role of the psychologist enters the debate in regards to the special testimony for listening to a child's legal situation. This puts him in the role of facilitator of dialogue between the judge and the victim in a method of inquiry. Thus, the interdisciplinary learning is impaired because the psychologist has their scientific knowledge devalued. Also, the techniques that guide their work are subject to the procedures and purposes of the law. Faced with this impasse, this research aims to analyze and discuss the representation of the judges and judges of the high court as to the role of psychologists in the final judgment in cases of childhood sexual violence. The theoretical referential that underlies the reflections and analysis is the Social Representations Theory, focusing on the relationship between psychology and the law, exposed in the text of judicial decisions. Konstruktioner av en sexköpare : en diskursteoretisk analys av offentliga dokument / Constructions of a Sex Buyer : a Discourse Theoretical Analysis of Public Documents

The purpose of this study is to present dominant discourses of sex buyers in public documents published before and after the implementation of the Swedish sex buyer law; making the purchase but not the sale of sexual services illegal. The purpose is further to examine what consequences these discourses might have on social work with sex buyers. We also aim to illustrate how language, gender, sexuality and power can be understood in the reading of the empirical material stretching from 1981 to 2016. With a discourse theoretical approach drawn from Laclau and Mouffe (2008 [1985]), five prominent discourses are identified; the average man, the homosexual man, the woman as a sex buyer, the man with the problematic sexuality and the sex buyer in need of help. The main findings are that processes of conflict among the discourses outlines a social problem where discourses that don’t include the heterosexual man as a sex buyer are subdued. Gender and sexuality in general and male heterosexual sexuality in particular is performed. As demands on a stricter legislation is propositioned we identified a linguistic offset; from descriptive graphic characteristics of the sex buyer to a depersonalization focusing on the action rather than the actor.

The purpose of this study is to examine social workers’ discourses about the Swedish sex purchase law and how they perceive that the sex purchase law and the social workers’ professional ethical principles affect the social workers’ ability to support people who are selling sex. This study is a discourse analytical interview study based on a social constructionist perspective. The study focuses on analyzing the interviews based upon an inductive method. The interviews are qualitative and semi-structured. The interviews were conducted by interviews with three social workers with experiences of working with people who sell sex. The central focus of the study is to analyze the social workers’ statements that are regarded as their perceptions. The statements serve as arguments that answers the purpose questions. The results show that the interviewed social workers perceive that the sex purchase laws do affect the social workers’ ability to support people who sell sex. On the other hand, they show disagreement on whether the social workers’ professional ethical principles affected the social workers’ ability to support people who sell sex.

Indecent assault consists in an unlawful and intentional indecent assault which is and is intended to be indecent. There is some controversy in the case law whether the indecency is committed only by acts which are, objectively speaking indecent, against the view that even though the act is not indecent itself, may nevertheless found a conviction of indecent assault if it was the intention of the accused to act indecent and such intention was conveyed to the victim. It is submitted that the last mentioned approach is to be preferred but that the following test should be used: 1. If the act, is objectively speaking indecent and there is no doubt about the unlawfulness as well as the indecent intention of the accused, the crime of indecent assault was committed. 2. If the act is objectively speaking indecent but the indecent intention of the accused can not be proven, there is a rebuttable presumption that the accused acted with an indecent intention. Such as presumption must be rebutted b the accused himself. 3. Thesis (LLM)--Stellenbosch University, 2005. / ENGLISH ABSTRACT: In 2002 the South African Law Commission published a report in which amendments to the existing rules of criminal procedure and evidence were proposed. A number of these recommendations have since been included in a Bill that was tabled before Parliament in 2003. The proposed amendments largely reflect values which underlie the "Victims' Rights" movement. The aim of this thesis is to consider the possible influence of these amendments on the constitutionally guaranteed fair trial rights of the accused. The study focuses on those amendments that play a role in the prosecution of alleged sexual offences against children, and shows that although the recognition of victims' rights is important, it should not be done at the expense of a fair trial. Dangers inherent to the proposed amendments are therefore highlighted. The rights of the accused are used to test the desirability or not of the proposed amendments. Foreign authority is used to support the argument made in the thesis. / AFRIKAANSE OPSOMMING: In 2002 het die Suid-Afrikaanse Regskommissie 'n verslag gepubliseer waann veranderings aan die huidige strafprosesreg- en bewysregreëls voorgestel word. 'n Aantal van hierdie voorgestelde wysigings is intussen opgeneem in 'n Wetsontwerp wat in Augustus 2003 voor die Parlement gedien het. Die voorgestelde wysigings reflekteer tot 'n groot mate waardes wat die "Victims' rights" beweging onderlê. Die doel van hierdie tesis is om die moontlike invloed van hierdie wysigings op die grondwetlik verskanste billike verhoor regte van die beskuldigde te ondersoek. The Effect of Social Media on Public Awareness and Extra-Judicial Effects: The Gay Marriage Cases and Litigating for New Rights

When the Supreme Court grants new rights, public awareness is a crucial part of enforcement. Gerald N. Rosenberg and Michael J. Klarman famously criticized minority rights organizations for attempting to gain new rights through the judiciary. The crux of their argument relied heavily on the American media's scanty coverage of Court issues and subsequent low public awareness of Court cases. Using the 2013 United States v. Windsor and Hollingsworth v. Perry rulings as a case study, I suggest that the media environment has changed so much since Rosenberg and Klarman were writing that their theories warrant reconsideration. Minority rights groups now have access to social media, a potentially powerful tool with which to educate the public about the Supreme Court and new rights granted by the Court.

A comparative legal analysis of the effects of divorce on marital property

The movement of people from county to country brought about an increase in international marriages. However, South African private international law rules with regard to the proprietary consequences of marriage are not on par with their foreign counterparts. The prejudicial rule which governs proprietary consequences of marriage has raised difficulties for our courts in past and recent cases. The advent of a new constitutional dispensation in South Africa forbids discrimination based on sex, gender and marital status. Furthermore, the question is asked whether parties to a marriage with a foreign matrimonial domicile may rely on section 7(3) of the Divorce Act 70 of 1979. The classification of redistribution orders in private international law matters has given rise to uncertainty. The objectives of the study are to suggest workable alternatives to the current connecting factor for proprietary consequences of marriage in South African private international law and to investigate the availability of redistribution orders to spouses applying for divorce in South Africa. / Private Law / LL. Hierdie onderskeid op grond van seksuele georiënteerdheid mag moontlik ongrondwetlik wees. Voorts is daar 'n menigte regte en verpligtinge wat outomaties uit huweliksluiting spruit, maar nie outomaties op lewensverhoudings van toepassing is nie. Hierdie onderskeid op grond van huwelikstaat mag eweneens moontlik teen die bepalings van die Grondwet van die Republiek van Suid-Afrika, 1996 indruis. Hierdie studie is gevolglik daarop toegespits om ondersoek in te stel na die grondwetlikheid van hierdie twee onderskeide. Die ondersoek word geloods met verwysing na relevante wetgewing en regspraak. 'n Bondige oorsig van fundamentele regte word as agtergrond verskaf. SUMMARY The definition of marriage differentiates between heterosexual and homosexual life partners with regard to the capacity to marry. This differentiation on account of sexual orientation may possibly be unconstitutional. Furthermore there are a multitude of rights and obligations that automatically flow from marriage, which are not automatically applicable to life partnerships. This differentiation on account of marital status may also violate the provisions of the Constitution of the Republic of South Africa, 1996. Accordingly this study is aimed at investigating the constitutionality of these two differentiations. The investigation is conducted with reference to relevant legislation and case law. A concise overview of fundamental rights is provided as background.
