Towards a conceptual decision support systems framework aimed at narrowing the tax gap in South Africa : a narrative case study

Revenue collection agencies across the world aim to maximise revenue collection by minimising tax noncompliance. The different types of tax noncompliance are collectively referred to as the tax gap phenomenon, which revenue collection agencies address by means of various enforcement approaches and capabilities. Much like any organisation, the resources required to execute these capabilities are finite and require accurate organisational decision-making in order to make optimal use thereof. Information technology, and specifically decision support systems (DSS), is critical in enabling this decision-making process. Using the Structuration Model of Technology, the information needs, demand and offerings of revenue collection agencies are explored given their objective of narrowing the tax gap phenomenon using DSS. Emphasis is placed on the manner in which IT is used to address taxpayer noncompliance, the way in which IT supports knowledge creation and subsequently also facilitate the decision-making process of tax practitioners, and also the different types of IT offerings made available to decision-makers in the form of DSS. In doing so, this research presents the results of a case study on the South African Revenue Service in which a conceptual decision support system framework is developed aimed at minimising the tax gap phenomenon. The research is conducted as a qualitative single case study and presented through a narrative analysis. The framework is systematically constructed as the research findings emerge and concluded by means of a framework validation and transfer ability test. The research result is a conceptual DSS framework acting as a reference point to other revenue collection agencies with the objective of addressing taxpayer noncompliance through DSS. / Jurisprudence / D. Essays on governance, public finance, and economic development

This thesis is composed of three distinct but related essays. The first essay studies the role of the size of the economy in mitigating the impact of public sector corruption on economic development. The analysis is based on a dynamic general equilibrium model in which growth occurs endogenously through the invention and manufacture of new intermediate goods that are used in the production of output. Potential innovators decide to enter the market considering the fraction of future profits that may be lost to corruption. We find that depending on the number of times bribes are demanded, the size of the economy may be an important factor in determining the effects of corruption on innovation and economic growth. The second essay presents an occupational choice model in which a household can choose either formal or informal entrepreneurship or at the subsistence livelihood. Credit market constraints and initial wealth conditions (bequest) determine an agent's occupational choice. Corruption arises when bureaucrats exchange investment permits for bribes. Corruption worsens credit market constraints. Equilibrium with corruption is characterised by an increase (decrease) in informal (formal) entrepreneurship and a decrease in formal entrepreneurship wealth. Since corruption-induced credit constrained households choose informal entrepreneurship as opposed to subsistence livelihood income in the formal sector, the informal economy is shown to mitigate the extent of income inequality. The third essay explains the role of bureaucratic corruption in undermining public service delivery, public finance, and economic development through incentivising tax evasion. The analysis is based on a dynamic general equilibrium model in which a taxable household observes the quality of public services and decides whether or not to fulfil his tax obligation. Bureaucratic corruption compromises the quality of public services such that a taxable household develops incentives to evade tax payment. We show that corruption-induced tax evasion increases the likelihood of a budget deficit, renders tax payable increase counter-productive, and aggravates the negative effect of bureaucratic corruption on economic development.

Le rôle des États-Unis dans le maintien des pratiques d’opacité financière

Notre recherche vise à vérifier s'il existe un lien entre l'intérêt des Américains pour les investissements étrangers et le maintien des structures opaques de la finance internationale. Les pratiques d'opacité financière (utilisation abusive du secret bancaire, faibles mesures d'identification du client, faible règlementation bancaire, absence d’échange d’information fiscale, absence d’obligations d’enregistrements de compagnies et de fiducies, possibilité d’établir la propriété d’une société avec des prête-noms, utilisation de bons au porteur, manque d’encadrement des fiducies, etc.) semblent accommoder les États qui les dénoncent. Utilisant les théories des jeux à deux niveaux de Putnam, de la règlementation et de l’équilibre de Nash, nous faisons le lien entre le niveau national et international. Notre recherche consiste en deux études de cas. La première traite d’un projet de règlement de l’Internal Revenue Service visant à assurer la déclaration de revenus d’intérêt sur les dépôts bancaires des non-résidents. La seconde traite d’une série de projets de loi déposés au Sénat et à la Chambre des représentants des États-Unis. Ils cherchent à assurer la transparence du processus d’enregistrement de compagnies de manière à faciliter l’accès des agences d’application de la loi à l’information sur les bénéficiaires effectifs des compagnies formées en sol américain. Notre recherche ne permet pas de confirmer notre hypothèse avec certitude. Cependant, nos données tendent à indiquer que les groupes d’intellectuels et les groupes de pression financiers incitent le gouvernement des États-Unis à freiner la mise en application de certaines mesures prévues par le régime antiblanchiment (particulièrement l’identification du client et le partage d’information avec des pays tiers) pour attirer l’investissement étranger. / Our Study aims to verify whether the United States’ interest in attracting foreign investment is linked to international financial opacity. Financial opacity practices (abusive use of bank secrecy, weak “Know Your Client” procedures, unregulated banking sector, no tax information exchange, absence of corporate and fiduciary registration obligations, possibility to set up corporations with nominee, possibility to issue bearer shares, lack of regulations for trusts, etc.) appear to accommodate even the states openly opposed to them. Using Putnam’s theory of two level games, regulation theory and Nash’s theory of equilibrium, we establish a link between the national and international levels. Our analysis includes two case studies. The first one deals with a project regulation from the Internal Revenue Service intended to ensure reporting of deposit interest paid to non-resident aliens. The second is a study of a series of project law presented to the United States Senate and House of Representatives. Those bills would allow for incorporation transparency to assist law enforcement in their efforts to identify beneficial owners of companies formed in the United States. Our hypothesis is not fully confirmed. However, our data tends to indicate that think tank and financial lobby groups influence the United States into stalling enactment of some anti-money laundering measures (particularly client identification and information sharing with tiers countries) in order to attract foreign investment.

L’effet des lois sur l’évasion fiscale : une synthèse systématique des recherches évaluatives

Contexte et objectif. L’évasion fiscale a généré des pertes annuelles variant entre 2 et 44 milliards au Canada entre 1976 et 1995. Avec la croissance de l’évasion fiscale dans les années 1980 et 1990 plusieurs législations se sont attaquées à ce phénomène en mettant en place des mesures telles que les amnisties, les réformes fiscales et les nouvelles lois. Ces dernières reposent non seulement sur des principes théoriques distincts, mais leur efficacité même est remise en question. Bien que plusieurs auteurs affirment que les criminels en col blanc sont réceptifs aux sanctions pénales, une telle affirmation repose sur peu de preuves empiriques. L’objectif de ce mémoire est donc de réaliser une synthèse systématique des études évaluatives afin de faire un bilan des lois fiscales et d’évaluer leurs effets sur la fraude fiscale. Méthodologie. La synthèse systématique est la méthodologie considérée comme la plus rigoureuse pour se prononcer sur l’effet produit par une population relativement homogène d’études. Ainsi, 18 bases de données ont été consultées et huit études ont été retenues sur les 23 723 références. Ces huit études contiennent neuf évaluations qui ont estimé les retombés des lois sur 17 indicateurs de fraude fiscale. L’ensemble des études ont été codifiées en fonction du type de loi et leur rigueur méthodologique. La méthode du vote-count fut employée pour se prononcer sur l’efficacité des lois. Résultats. Sur les 17 indicateurs, sept indiquent que les lois n’ont eu aucun effet sur l’évasion fiscale tandis que six témoignent d’effets pervers. Seulement quatre résultats sont favorables aux lois, ce qui laisse présager que ces dernières sont peu efficaces. Toutefois, en scindant les résultats en fonction du type de loi, les réformes fiscales apparaissent comme une mesure efficace contrairement aux lois et amnisties. Conclusion. Les résultats démontrent que les mesures basées sur le modèle économique de Becker et qui rendent le système plus équitable sont prometteuses. Les amnisties qui visent à aller chercher des fraudeurs en leur offrant des avantages économiques et en suspendant les peines sont non seulement inefficaces, mais menaceraient le principe d’autocotisation basé sur l’équité. / Introduction and objectives. Between 1976 and 1995, tax evasion has generated losses varying between 2 to 44 billions in Canada. In order to stop the upward trend observed in tax evasion in the 1980s and 1990s, several jurisdictions introduced legal measures such as amnesties, tax reforms and new legislations. Not only these measures rest on different paradigms but their effectiveness has yet to be proven. While it is generally argued that threats of legal sanctions are effective to deal with offenders involved in economic crimes, such a claim rests on weak empirical evidence. By conducting a systematic review, the objective of this thesis is to further our understanding about the effect of tax laws on tax evasion. Method. Systematic review is referred to as the most suitable method to review a body of literature on a given subject and to determine its effect on a particular outcome. We searched 18 databases that led to the identification of 23,723 references. Overall, 8 studies containing 9 evaluations met inclusion criteria and were kept for the review. These studies assess the effect of tax laws on a total of 17 variables. All studies were assessed based on the type of law and their methodological robustness. The vote-count method was then used to identify effective measures. Results. Out of the 17 outcomes, 7 indicate that laws have no effect on tax evasion while 6 show increases in tax evasion indicators. Only 4 outcomes were in the expected direction. On the other hand, by grouping results according to the type of measures, tax reform appears as the only effective intervention. Conclusion. Our results suggest that programs based on Becker’s economic model and that promote equity are promising. Amnesties seeking to identify tax evaders by offering economic advantages and sanction immunity are not only ineffective but could compromise a system based on self-assessment, which rest on the principle of perceived equity.

Legal aspects of the fight against tax evasion The aim of this thesis is an analysis of selected institutes fighting against tax evasion. Furthermore, an analysis of reasons for their implementation, their purpose and the problems associated with them. Also the current impact of tools that have been part of Czech law for long is reviewed. The thesis is divided into 8 chapters. The first chapter deals with basic concepts, such as a tax, its functions and principles. The second chapter discusses what is tax evasion, the issue of defying what is still considered a tax evasion and what not, and also highlights the socio- economic origin of tax evasion. Furthermore, the chapter summarizes effective and necessary tools in fight against tax evasion in the European Union, which provides the legal framework in tax laws for the Czech Republic. Finally, this chapter is an overview of the effects of cooperation and active battle against tax evasion within the European Union. In following chapters, various mechanisms are analysed. This dissertation broadly focuses on the problematics of the tax evasion in the field of the value-added tax from the perspective of the European Union law wherefore it does not contain parts devoted just to the national instruments combating tax evasion. The aim of the dissertation is the analysis of the terms which could be met due to the inconsistent terminology concerning tax evasion, then the aim is to provide classification of the tax evasion and to analyse individual measures combating tax evasion recognised by the European Union law. Therefore, the case law and opinion of the professional community are examined by the descriptive, analytical and comparative scientific method and later, founded conclusion are generalized by the synthetic method pointing out the pitfalls of their application in the Czech legal environment. The result of this dissertation shall be the coherent insight to the terminology connected with the tax evasion in the field of the value-added tax and the analysis of legal instruments combating tax evasion established by European Union law containing the evaluation of individual aspects of this issue. In the first part, constitutional institutes concerning to the matter were carefully explored, with a special highlight for the lawfulness, tipicity and fiscal capacity principles. In addition, it was also subject to our review the defects of the legal transactions, since the majority of CARF decisions relies on them to disregard the acts conducted by taxpayers. From the empirical research, it was noted certain common qualities related to the sample of decisions under analysis, which revealed that transactions that imply on tax saving, structured through indirect legal acts, and performed within a short period of time and between related parties are likely significant characteristics at CARF s trials. Besides that, it called our attention the magnitude of influence that the so called business purpose has on the judgment process by CARF´s judges. The results suggest that, despite the discrepancy regarding the qualification of the illicit act (sham, fraud, abuse of rights, etc...), transactions with similar characteristics tend to have the same outcome when it comes to decision reasoning. In fact, the study supports that there is hegemony of use of the sham institute to base the disregard of acts, mostly on the grounds of lack of business purpose to justify the practice by taxpayers. At last, we critically analyzed the reasoning of such decisions based on pre-juridical criteria. We stressed our opinion that the assessment of the tax law should not depend on external factors, such as the time taken between the transactions, their parties or even the existence of such a subjective concept as business purpose, in breach of lawfulness and tipicity principles / Neste trabalho, apresentamos as conclusões da pesquisa jurisprudencial realizada junto ao Conselho Administrativo de Recursos Fiscais CARF, em casos envolvendo planejamento tributário, com o enfoque de identificar a fundamentação dessas decisões. Como ponto de partida, analisamos cuidadosamente os institutos constitucionais afetos à matéria, sendo especialmente destacados os princípios da legalidade, tipicidade e capacidade contributiva. Neste contexto, também foi objeto de estudo os vícios dos negócios jurídicos e institutos correlatos, já que a maioria das decisões do CARF os utiliza como fundamento para possibilitar a desconsideração de atos praticados pelos contribuintes. Neste contexto, da pesquisa empírica, pudemos notar a existência de certas características presentes nas decisões dos casos selecionados, que nos fizeram concluir que operações que impliquem economia de tributos, alcançadas por meio de negócios jurídicos indiretos, compostas por atos encadeados em curto espaço de tempo e realizados entre partes relacionadas são algumas das propriedades relevantes nos julgamentos da matéria pelo CARF. Além disso, nos chamou a atenção a magnitude de influência que o chamado propósito negocial tem sobre a tomada de decisão pelos julgadores do CARF. Foi possível notarmos que, a despeito de eventual discrepância com relação à tipificação do ilícito (simulação, fraude, abuso de direito e etc...), operações com características semelhantes tendem a ter suas decisões fundamentadas da mesma forma. Em realidade, o que pudemos concluir foi a hegemonia da utilização do instituto da simulação para embasar a desconsideração dos atos praticados, na maioria dos casos, sob o argumento de não haver propósito negocial apto a justificar a conduta realizada pelos contribuintes. Por fim, analisamos criticamente a fundamentação dessas decisões em critérios préjurídicos. Enfatizamos nossa opinião de que a incidência da norma jurídica tributária não deve depender de fatores externos ao Direito, tais como o tempo decorrido entre as operações, as partes que a realizaram ou até mesmo a existência ou não de conceito tão subjetivo como é o propósito negocial, sob pena de macularmos o princípio da legalidade e da tipicidade

The first one analyses the juridical treatment against the Tax Order according to the Brazilian legislation , mainly the Law number 8.137/1990, in which the corpus of analyses , of the types of tributary crime it is , specifically tax evasion written on the 1º and 2º of the Law number 8.137/1990 , studying the beginning and the development of the tax offence and its ontological aspects , due to penal punishment , the significance principle act and its extinctive cause of punishment , focusing on the penalty under legal prevision of the article 34 of the Law 9.249/1995 , that revaluated referred form , before repealed from the texts of the Law which issued the matter. The second goal aims to study the divergence on the moment the payment should be done under doctrinaire view, Judicature and the position of the Federal Supreme Court, the Justice and their divergent points. To make this research, an evaluation of the efficacy of the Civil Law was made, its influence to work on the tributary obligation public safe reimbursement and taxpayer owed after dilation. As a result, it was considered the existence of a weak punitive system in relation to the crimes mentioned , thus it goes against the constitutional scope; the reform requirement that allows real implementation of the Democratic Law State and thus prevent tax evasion growth in the country / O presente estudo tem dois objetivos, tendo como primeiro objetivo uma análise ao tratamento jurídico dado aos Crimes Contra a Ordem Tributária segundo a legislação brasileira, em especial a Lei nº. 8.137/1990, em que o corpus de análise, dos tipos de Crimes Tributários, é, especificamente, os Crimes de Sonegação Fiscal previstos nos artigos 1º e 2º da Lei nº. 8.137/1990, estudando o nascimento e a evolução desta espécie de delito tributário e os seus aspectos ontológicos, especialmente ligados à punibilidade penal, o emprego do Princípio da insignificância e as causas de extinção da punibilidade dos mesmos, destacando o pagamento sob a previsão legal do artigo 34 da Lei nº. 9.249/1995 que revalidou referida forma anteriormente revogada dos textos de lei que tratavam da matéria. Já o segundo objetivo, visa analisar a divergência quanto ao momento em que o pagamento deverá ocorrer sob a ótica doutrinária, jurisprudencial e o posicionamento do Supremo Tribunal Federal e do Superior Tribunal de Justiça em seus pontos divergentes.
