The efficacy of the Truth and Reconciliation Commission hearings in East London: perceptions of participantsPule, Quincy January 2012 (has links)
This study examines the degree to which the Truth and Reconciliation Commission hearings in East London have mitigated the impact of gross human rights violations on some of the Duncan Village victims. The research draws upon responses from a convenience sample of victims of apartheid atrocities guided by their own individual experiences, literature on conflict management, and TRC hearings that took place in other African states. The East London TRC hearings alert one to the brutality of the apartheid regime whose political intolerance unleashed violence against ordinary citizens of East London. Despite being seen as a witch hunt against the apartheid security establishment, most of the victims feel the TRC opened lines of communication between former enemies, although one cannot conclusively say that total reconciliation between victims and perpetrators has been achieved. Insofar as telling the truth is concerned, the concept defies unanimous acceptance as a contributor to peaceful co-existence. The mere fact that some perpetrators refused to appear before the TRC is an indication that the value attached to it differs from person to person, particularly in a situation where the political landscape is characterized by intimidation and fear. The treatise unveils the East London TRC as a platform for compromise as some of the victims felt anger and hatred for the perpetrators would amount to perpetual self-imposed ostracism. Noting that the TRC was never meant to hurt anyone, the treatise ushers one into a space where reconciliation takes precedence over vengeance.

Depuis plus d’une décennie, la République Centrafricaine (ci-après le Centrafrique ou la RCA) et la République de Côte d’Ivoire (ci-après la RCI ou la Côte d’Ivoire) traversent des conflits militaro-politiques graves qui se sont accentués pour le premier en 2012 et pour le second en 2011. Ces crises qui, dans la plupart des cas tirent leurs racines dans la mal gouvernance et une absence de volonté politique ont un dénominateur commun : des dégâts matériels importants et en perte de vies humaines. Des crimes graves dans la hiérarchie de l’horreur ont été commis (crimes de guerre, crimes contre l’humanité et crimes de génocide). Compte tenu de la gravité de ces crimes qui transcendent profondément la conscience humaine, les deux pays ont engagé des processus de justice transitionnelle, à travers des mesures judiciaires et non judiciaires en vue de faire face à leur passé douloureux et réconcilier les populations et communautés divisées. Comment intégrer la Justice dans une stratégie plus globale du processus transitionnel pour la réconciliation nationale favorable à un nouvel avenir démocratique ?Certes, la répression de ces crimes par les tribunaux centrafricains et ivoiriens, la Cour Pénale Internationale (CPI), la Cour Pénale Spéciale (CPS) en RCA ou au titre de la compétence universelle de juridiction est un objectif prioritaire poursuivi par les deux pays. Cependant, la justice classique s’est montrée incapable d’en juger tous les auteurs, tant leur nombre est important et tant les faits qui leurs sont reprochés sont graves. C’est pourquoi les autorités centrafricaines et ivoiriennes ont envisagé d’autres mécanismes complémentaires à la justice pénale destinés à rétablir un vivre ensemble entre les populations divisées, notamment la création des Commissions Vérité et Réconciliation. Elle est chargée d’établir une vérité historique sur les crimes du passé en vue de tourner définitivement la page. En dehors de cette institution classique de la réconciliation nationale, d’autres structures ont été créées, soit pour combler les lacunes des précédentes initiatives, soit pour connaître d’autres domaines nouveaux. La religion a aussi joué un rôle important; soit qu’elle promeut la tolérance religieuse, l’acceptation des différences ou la résolution pacifique des conflits, soit qu’elle apparaît comme cause de conflits, à travers la promotion ou la diffusion des messages de haine et de division.Mais dans la démarche de conciliation de ces deux objectifs, comment entreprendre le processus de réconciliation nationale sans pour autant avaliser les pratiques d’impunité ? C’est en ce sens que la répression des crimes graves apparaît comme un mécanisme nécessaire de la justice transitionnelle.Enfin, il est important de noter que les crises que connaissent les deux pays obéissent à des mobiles politiques, mais aussi institutionnels. C’est pourquoi des réformes institutionnelles ont été engagées dans plusieurs domaines, entre autres, la Réforme du Secteur de la Sécurité (RSS) avec le désarmement, la démobilisation et la réinsertion des tous les combattants. Des réformes ont aussi été entreprises dans le domaine de la bonne gouvernance et de la justice constitutionnelle pour que désormais, les actions des gouvernants soient soumises au droit. / For more than a decade, the Central African Republic (CAR) and the Republic of Côte d'Ivoire (RCI or the Ivory Coast) are going through serious military-political conflicts which have been accentuated for the Central African Republic in 2012 and for RCI in 2011. These crises, which in most cases are rooted in poor governance and lack of political will have a common denominator: significant material damage and loss of life. Serious crimes in the hierarchy of horror have been committed (war crimes, crimes against humanity and crimes of genocide). Given the seriousness of these crimes that profoundly transcend human consciousness, both countries have engaged in transitional justice processes, through judicial and non-judicial measures to deal with their painful past and reconcile divided populations and communities. How to integrate justice into a more global strategy of the transitional process for national reconciliation in favour of a new democratic future?It is true that the repression of these crimes by the Central African and Ivorian courts, the International Criminal Court (ICC), the Special Criminal Court (SPC) in CAR or under universal jurisdiction is a priority objective pursued by both countries. However, classical justice has proved incapable of judging all the authors, as their number is important and the facts they are accused of are serious. This is why the Central African and Ivorian authorities have considered complimentary mechanisms to criminal justice aimed at restoring living together among the divided populations, materialized by the creation of the Truth and Reconciliation Commission (CDVR). It is responsible for establishing a historical truth about the crimes committed in order to definitively turn the page. Apart from this classical institution of national reconciliation, other structures have been created, either to fill the gaps of previous initiatives or to find other new areas. Religion has also played an important role; either it promotes religious tolerance, acceptance of differences or peaceful resolution of conflicts, or it appears as a cause of conflict, through messages of hatred and division.But in this process of reconciling these two objectives, how can we begin the process of national reconciliation without endorsing practices of impunity? It is in this sense that the repression of serious crimes appears as a necessary mechanism of transitional justice.Finally, it is important to note that the crises in both countries are politically motivated, but also institutional. This is why institutional reforms have been initiated in several areas, including Security Sector Reform (SSR) with the disarmament, demobilization and reintegration of all combatants. Reforms have also been undertaken in the field of good governance and constitutional justice so that, henceforth, the actions of the rulers are subject to the law.

Conflict Resolution and Reconciliation in Sudan: Inter-Tribal Reconciliation Conferences in South Darfur State up to 2009.Bashar Gado, Zuhair M. January 2013 (has links)
This study explores and critically examines the role of indigenous mechanisms (the Inter-Tribal Reconciliation Conferences-ITRCs) in resolving tribal conflicts in South Darfur State of Western Sudan. The fundamental question raised by this study is: have these reconciliation conferences- 1989-2009- been able to address the root causes of the tribal conflicts and are they capable of serving the same role that they once did?
Tribal leadership structures, such as Native Administration (NA) and their mechanisms of conflict resolution/management in Darfur, have been subjected to highly significant changes over time. The question is to what extent these changes further fuelled tribal conflicts and/or have negatively affected the capability of the NA and the ITRCs to deal with these conflicts?
This thesis relies on archive records and reports of the ITRCs and data generated through interviews conducted with key informants. Through a detailed analysis the study: 1) presents a detailed account of the major conflicts and their causes in South Darfur; 2) identifies the changing identities of the protagonists and of the perceived causes; 3) assesses the effectiveness of the agreements reached by these conferences when considered alongside the causes identified.
Analysis of the ITRCs shows that tribal conflicts in Darfur (from1980s), and South Darfur in particular, were connected to the wider political conflict in the Sudan and the region respectively. The analysis suggests that the history of neglect/marginalisation of the region by successive governments, and the political manipulation of the NA and local government, have negatively affected the performance of these institutions. The experience of the ITRCs indicates that they were unable to address the underlying causes of the tribal conflicts, such as land disputes, the manipulation of the NA and local government, rape and mass killings.

Western archival institutions have both silenced and misrepresented Indigenous peoples in Canada for more than a century. These actions have in turn assisted in the colonization and subjectification of a myriad of Indigenous communities within the colonial construct of Canada. This institutional complicity in the colonization process has recently come under fire. Questions have arisen about how these institutions can be decolonized and how they can be used in partnership with Indigenous peoples to strengthen the Indigenous voices they once silenced. The institutional decolonization of archives becomes especially important when the archival institution in question has been given the responsibility to care for records that relate to gross human rights abuses perpetrated against Indigenous peoples. This is the case for the National Centre for Truth and Reconciliation (NCTR) at the University of Manitoba, which has a mandate to preserve and share the truths of Residential School Survivors. / May 2017

durable peace has eluded Israeli Palestine.
A theoretical background study was made on the articulation of identity within a
civilization. This established identity formation as a political process. To see how the
manipulation of the structure within which identity formation processes take place, six
critical indicators were identified. These are: Manufacturing conditions of
underdevelopment; Un-integrated social and political systems, and distributive injustice;
Fostering cleavages, stereotypical images and political symbolism; Placing issues under
the 'sign of security'; The production of insecurity through the manipulation of identity
formation processes; and Monopolising the conflict resolution process.
Political elite creation and perpetuation of structures for conflict shows an inherent
inability to bring about a lasting peace in a protracted social conflict for conflict has
become the source, rather than the outcome of policy formation. As a result this thesis
calls for a more inclusive approach to conflict resolution, one that goes beyond the
processes of arbitration, mediation, negotiation and facilitation, to include conciliation at
grass roots level between civilizations, sincerely exploring the underlying emotional
legacies of fear, hatred, sorrow and mistrust. / AFRIKAANSE OPSOMMING: Hierdie studie fokus op die rol gespeel deur politieke elites in die voortslepende
vraagstuk rondom vrede in Israel/Palestina.
'n Teoretiese agtergrondstudie is onderneem om die uitdrukking van 'n samelewing oftewel
volksidentiteit te ondersoek. Die studie het laat blyk dat identiteitsformulering 'n

The two most prominent cultures that continue to have a defining influence on the
socio-political developments in a multi-cutural South African society, are the Western
and African cultures. Because of the differences between these two cultures and the
respective roles members of each culture have played in the socio-political history of
South Africa (especially with regard to the rise and fall of apartheid), conflict and
alienation in most cases define the relationship between members of these cultures.
Not only does it negatively impact on the multi-cultural society of South Africa as
such, it also has far-reaching Implications for the continent as a whole, seeing that
South Africa Is regarded as the economical and political powerhouse of Africa upon
which are pinned the hopes of millions for a better life. As a result, the importance of
reconciliation and unity in the multi-cultural South African society cannot be overemphasized.
It is a Biblical imperative that all members of society should live together in peace
and harmony. To this end, the church is commanded to serve the reconciliation of
Christ to the world (2 Corinthians 5:11-21). One of the instruments to the dlsposal of
the reformed churches in South Africa for the completion of this mission, is the
liturgical song. The reformed liturgical song consists of poetry (text) and music
(melody) which are woven together in such a way that the text of the song is carried
directly into the heart of the singer or listener. The combined power of poetry and
music provides the church with a powerful therapeutic and communicative instrument
by which the truth of the gospel of Christ can effectively be proclaimed to the world.
A closer look at the current situation in the multi-cultural South African society reveals
that the reformed churches in South Africa (of both Western and African
backgrounds) haven't as yet properly played their part in the attaining of
reconciliation and unity in society. The central question for research in this study,
therefore, is the following:
In what way can the reformed liturgical song contribute to the attainment of
the ideal of reconciliation and unity in the multi-cultural South African society?
The research in this study is structured according to the model for Practical Theology
that was developed by Zerfass (1974:164-177). This model entails that specific base theoretical
principles are compared with meta-theoretical perspectives to eventually

Nyungar wiring boodja : Aboriginality in urban AustraliaHemmers, Carina January 2012 (has links)
The present thesis examines the themes of ‘shared history,' ‘place-making,' and ‘reconciliation' to assess how these come together in the establishment of an Aboriginal identity in Perth, Western Australia. Focusing on individuals who do not represent the common stereotypes associated with Aboriginal Australians, it will be demonstrated that these individuals are forced into an in-between place where they have to continually negotiate what Aboriginality means in the twenty-first century. Taking on this responsibility they become mediators, stressing a ‘shared history' in order to create a place for themselves in the non-Aboriginal landscape and to advance reconciliation between Aboriginal and non-Aboriginal Australia by fighting the dominant discourse from within. Beginning with the State and Government's Native Title appeal premiss that Nyungar never existed, this thesis will examine this claim by first presenting an account of the history of southwest Western Australia to establish the place Aboriginal people have been forced into by the colonists during early settlement, and the processes of which extend into the present day. From there on in the focus will be on individual Aboriginal people and their careers and businesses, examining how they attempt to redefine what is perceived and accepted as Aboriginality through different interaction and mediation ‘tactics' with non-Aboriginal Australians. Finally, this thesis will take a closer look at the reconciliation movement in Australia and the people involved in it. It will determine different approaches to reconciliation and assess their possibility and meaning for the construction of a twenty-first century Aboriginal identity. The thesis will conclude that although Nyungar are forced into the dominant discourse, their resistance from within credits a new kind of Aboriginality that is just as valid as the ‘traditional' and ‘authentic' Aboriginality imagined by non-Aboriginal Australia.
