Love Promoting Justice: An Augustinian Approach to Transitional Justice from the Context of GuatemalaSnyder, Joshua Randolph January 2015 (has links)
Thesis advisor: Stephen J. Pope / Transitional justice responds to injustices and violations of human rights following a period of repressive rule or civil war. This dissertation argues that the needs of post-conflict societies are best served by local, participatory approaches to transitional justice. In the case of Guatemala, it was essential for the nation to embrace its common religious narrative as a resource for rebuilding the republic. The Guatemalan Catholic Church worked to build peace out of the ashes of state sponsored terror. It demonstrated the prophetic role of the Church by offering a collective voice condemning those in positions of authority for their neglect of the basic human rights of the majority of Guatemalans. The CEG also highlighted the reconciliatory function of the Church by promoting forgiveness and reconciliation within the public square. This experience calls for theological ethical reflection on how the Catholic Church could best serve the needs of civil society in the wake of nearly forty years of political violence. Responding to the need for critical theological reflection, this dissertation proposes a transformationalist understanding of the relation of love to justice for transitional justice. It draws its inspiration from a selective reading of Augustine and Augustinian scholarship. An Augustinian approach to transitional justice brings together the high moral ideas of love, justice, forgiveness, and peace while at the same time acknowledging the ever-present reality of sin and human weakness. It attempts to transform a post-conflict society into a moral community whose citizens are on a journey toward the destination of temporal peace. It realizes that we may never reach our destination of temporal peace, but we can glimpse it from afar. This dissertation offers the following ten Augustinian insights as a framework for a theological approach to transitional justice. 1) Charity is the motivating force for transitional justice and the pursuit of socio-political reconciliation; 2) Charity transforms our understanding of justice from noninterference and retribution to rehabilitating and reconciling; 3) Transitional justice ought to be contextual, paying attention to the unique concerns of a given post-conflict society; 4) Distinguishing, without bifurcating, the ends of the temporal and celestial commonwealths offers a positive, but not naïve, evaluation of the Church’s potential to be an instrument of social transformation; 5) Post-conflict societies need to foster conditions that allow for pluralism and social cohesion through civic friendship; 6) Post-conflict societies must develop social practices to train citizens in the civic virtues of love, justice, and friendship; 7) Transitional justice requires an ethical retrieval of the truth through the healing of memory; 8) Transitional justice upholds the moral obligation to admonish and correct sinful social behavior; 9) Transitional justice ought to foster the just and prudential protection of society through the use of coercive force on behalf of society’s most vulnerable citizens; and 10) Post-conflict societies need to cultivate and sustain an ethos of active hope that, far from inducing political passivity, promotes civic engagement. / Thesis (PhD) — Boston College, 2015. / Submitted to: Boston College. Guider / As the Archdiocese of Boston continues to heal from the clergy sexual abuse crisis, it is engaged in a pastoral planning process designed to prepare parishes for the task of evangelization. According to the 2012 Synod of Bishops on the New Evangelization, the goal of evangelization is to “create the possibility” for an encounter and relationship with Jesus. To create the possibility for people to encounter Jesus Christ in faith, the implementation of the New Evangelization in the Archdiocese of Boston at this point in its history must focus on two aspects: healing the inner life of the Church, its communio, through a process of conversion and reconciliation and engaging the Church in the missio given it by Jesus by becoming a church of the poor. This paper begins with a presentation of the New Evangelization as described in papal and other ecclesial documents highlighting several principal themes: the context and content of the New Evangelization, the Church and the poor, Christian witness, conversion, reconciliation, Christian hope, and apologetics. Following a brief overview of the North American context in which evangelization must take place, the third chapter focuses on conversion as a response in love to God’s invitation to live in the love of the triune God and on reconciliation as the healing of relationships through celebrations of reconciliation and through the work of the church community. The fourth chapter presents the challenge of becoming a Church of the poor by which the Church comes into closer relationship with Jesus who is present in the suffering poor. Finally, the hope to which God calls us is eternal life in the loving communion of the Father, Son, and Spirit in the Kingdom of God. The Role of Jus Post Bellum in the 21st Century: Human Security and Political ReconciliationKwon, David January 2018 (has links)
Thesis advisor: Kenneth Himes / The category of jus post bellum (jpb, postwar justice and peace) is a welcome addition to discussions of the justice of war. The goal of this dissertation is to review the significance of this recent development within the just war tradition. This project is based on a proposition that just war should aim at just peace; peace does not mean the absence of armed conflict, but it requires the establishment of justice. There is no true peace if it exists for the strong but not for the weak, for the victor but not for the vanquished. At the heart of jpb is the establishment of a just peace. With this preliminary proposition in mind, this dissertation endeavors to challenge the view of those who argue that reconciliation, mainly political reconciliation, is the first and foremost ambition of jpb. Instead, it attempts to justify the proposition that achieving just policing, just punishment, and just political participation are key to building a just peace, of which the fundamental characteristic must be human security. In the immediate aftermath of war there is little or no policing, punishment, or avenues for political participation to protect the civilians of defeated states, especially the most vulnerable ones. Therefore, this project argues (i) that human security is a neglected theme in the discourse of moral and theological intellectual traditions; and (ii) that a more balanced understanding of jpb must pay direct attention to the elements comprising human security in a postwar context as well as the quest for reconciliation. In particular, holding a realistic view that war is inherently destructive of people, institutions, and infrastructure, this project focuses on justice in reconstruction—reconstruction of just policing, just punishment, and just political participation. This destruction raises questions about the fulfillment of justice in the damaged postwar society. Considering these issues through the lens of human security and political reconciliation theories, I propose my “maxim(um) of ethical minimalism” for jpb—the principle of achieving to the highest extent possible human security, which is the necessary and essential outcome for jpb. It is the norm for jpb of achieving the common good to the highest extent possible, with priority on human security, using nonviolent means insofar as possible and violent means when necessary. This proposal contends that determination of the content of the responsibilities for just war reconstruction should be specified on the basis of the damage to relationships that need to be not merely restored, but also fundamentally transformed in the postwar society that prevents future threats. This thesis pays particular attention to civil society peacebuilding, which needs to be considered only to the extent that it is an objective of the postwar discussion and to the extent it is affected by jpb decisions. Yet, my primary thesis is that this transformative vision of jpb should be distinguished from an extensive buildup of a civil society scheme, which requires a wider and longer range of peacebuilding efforts. Instead, it must be tempered by realism in a careful and concrete manner, since the priority should be given to human security in the immediate aftermath of war. This study is an exercise in applied political ethics that employs various disciplines—security studies, international law, and peacebuilding work—to address the topic of jpb as a means of illuminating the theological discourse. Plainly, I employ this literature to explore how contemporary scholars view the idea of jpb and how this relatively new development fits within the Christian tradition of just war, a moral tradition that is historically interdisciplinary. Further, this attempt is a valuable contribution to the just war tradition by identifying what I view as three key themes of jpb, namely, three practices that are essential to implementing jpb immediately after a war: just policing, just punishment, and just political participation. No Brasil, o câncer atualmente é a segunda causa de morte e algumas das explicações devem-se ao fato do melhor controle das doenças infectocontagiosas e ao envelhecimento populacional global, uma vez que o câncer é considerado uma doença cuja idade média está acima de 60 anos. As comorbidades as quais estão diretamente associadas ao envelhecimento e o uso de diversos medicamentos são necessários para o controle adequado das outras patologias, por outro lado, representa um importante fator de risco para resultados negativos de saúde. A conciliação de medicamentos visa a redução de medicamentos desnecessários, com uma avaliação criteriosa do farmacêutico, que pode ajudar a otimizar a terapia medicamentosa, reduzir custos, aumentar a conformidade e reduzir a toxicidade e eventos adversos relacionados aos medicamentos. OBJETIVO: Avaliar a prevalência da polifarmácia, automedicação, a adesão e conhecimento da farmacoterapia domiciliar; as principais dúvidas e as necessidades de orientação em relação à farmacoterapia em geral; harmonização farmacoterapêutica, discrepâncias, interações medicamentosas, medicamentos inapropriados para idosos e duplicidade terapêutica. CASUÍSTICA E MÉTODOS: Pacientes admitidos dos pelo Serviço de Oncologia Clínica e Ginecologia do HCFMRPUSP com idade igual ou superior a 60 anos e diagnóstico confirmado de neoplasia maligna. Foram aplicados os testes de adesão e conhecimento da farmacoterapia domiciliar e após a saída hospitalar do paciente realizada a revisão das farmacoterapias (domiciliar e hospitalar) e a conciliação de medicamentos. RESULTADOS: Foram incluídos 157 pacientes, idade média 68,4 anos, maioria do gênero feminino (60,5%), raça branca (84,1%), ensino básico (40,1%), neoplasia maligna em mama feminina (26,1%), em uso de polifarmácia (70,7%) e adepto de automedicação (50,3%), em que o uso de medicamentos (p= 0,01) e a automedicação (p= <0,01) foram significativamente correlacionados com o gênero feminino. Na farmacoterapia domiciliar, a média de conhecimento total foi de 62,9% e maioria caracterizada como não aderente (73,4%), o armazenamento dos medicamentos foi prevalente na cozinha (51%) e as principais dúvidas relacionam-se à caligrafia (79%). A harmonização farmacoterapêutica foi observada em 82,3% dos pacientes. A discrepância foi observada em 90,5% dos pacientes, prevalecendo a omissão (304). Foi significativamente diferente a interação medicamentosa quando comparada as farmacoterapias, domiciliar e hospitalar (p <0,01). Em ambas farmacoterapias, a maioria dos pacientes fez uso de medicamentos inapropriados para idosos, 84,1% (132 pacientes) e 85,3% (134 pacientes), respectivamente. A duplicidade terapêutica observada foi mínima, 18 pacientes (11,7%) na farmacoterapia domiciliar e 29 pacientes (18,8%) na hospitalar. CONCLUSÃO: a inserção do cuidado farmacêutico pode contribuir na educação do paciente em relação aos riscos da automedicação, melhoria no conhecimento, adesão e armazenamento dos medicamentos; e o processo de conciliação de medicamentos pode auxiliar a prática clínica na harmonização farmacoterapêutica e reduzir as discrepâncias, principalmente em relação à omissão. A inclusão de sistemas de alertas na prescrição médica pode reduzir os riscos de interações medicamentosas e uso de medicamentos inapropriados para idosos. / In Brazil, cancer is currently the second cause of death and some of the explanation is due to better control of infectious diseases and global aging, since cancer is considered a disease whose average age is over 60 years. Comorbidities that are directly associated with aging and the use of several medications are necessary for the adequate control of other pathologies, on the other hand, it represents an important risk factor for negative health outcomes. Medication reconciliation is aimed at reducing unnecessary medications, with careful evaluation by the pharmacist, which can help optimize drug therapy, reduce costs, increase compliance, and reduce toxicity and drug-related adverse events. OBJECTIVE: To evaluate the prevalence of polypharmacy, self-medication, adherence and knowledge of home pharmacotherapy; the main doubts and orientation needs regarding pharmacotherapy in general; pharmacotherapeutic harmonization, discrepancies, drug interactions, inappropriate medications for the elderly and therapeutic duplicity. MATERIALS AND METHODS: Patients admitted to the HCFMRP-USP Clinical Oncology and Gynecology Service aged 60 years or older and confirmed diagnosis of malignant neoplasia. The adherence tests and knowledge of home pharmacotherapy were applied and after the patient\'s hospital discharge, the pharmacotherapies (home and hospital) and medication reconciliation were reviewed. RESULTS: A total of 157 patients, mean age 68.4 years old, female (60.5%), Caucasian (84.1%), primary education (40.1%) and malignant neoplasia (P = 0.01) and self-medication (p = <0.01), using polypharmacy (70.7%) and adept of self-medication (50.3%), Were significantly correlated with the female gender. In home pharmacotherapy, the mean total knowledge was 62.9% and most characterized as non-adherent (73.4%), drug storage was prevalent in the kitchen (51%) and the main doubts related to calligraphy (79%). Pharmacotherapeutic harmonization was observed in 82.3% of the patients. The discrepancy was observed in 90.5% of the patients, with omission prevailing (304). Drug interaction was significantly different when compared to pharmacotherapies, home and hospital (p <0.01). In both pharmacotherapies, the majority of patients used drugs inappropriate for the elderly, 84.1% (132 patients) and 85.3% (134 patients), respectively. The therapeutic duplicity observed was minimal, 18 patients (11.7%) in the home pharmacotherapy and 29 patients (18.8%) in the hospital. CONCLUSION: the insertion of pharmaceutical care can contribute to the education of the patient in relation to the risks of self-medication, improved knowledge, adherence and storage of medications; and the medication reconciliation process can help clinical practice in pharmacotherapeutic harmonization and reduce discrepancies, especially in relation to omission. The inclusion of alert systems in the medical prescription can reduce the risks of drug interactions and the use of drugs inappropriate for the elderly.

Ce travail, qui est donc une écriture de l’histoire du passé violent et de ses voies d’extrication en Mauritanie, a supposé de notre part de répondre à deux impératifs : premièrement, comprendre le sens des événements, le comment et le pourquoi. Cette nouvelle conception de réaction prompte contre les difficultés des entreprises a trouvé un véritable engouement auprès du législateur marocain. / The precautionary and amicable treatment of difficulties of firms is suitable resolution to preserve viable firms, audit debit and safeguard jobs. The French legislator, across the installation of a juridical armory which favours the precocious treatment of difficulties of firms, could make a huge step towards clearing up and eclipse of repressive and criminal mind to the advantage of the measurements of prevention and repairing of successive damage in said difficulties. This new comprehension of prompt reaction against difficulties of firms found a true infatuation to the Moroccan legislator.

Magister Artium - MA (History) / Nokuthula Simelane, born near Bethal in Mpumalanga, joined the ANC's armed-wing
uMKhonto we Sizwe (MK) as a courier while studying at the University of Swaziland in the
early 1980s. In 1983 she set out on a mission to South Africa on the pretext of purchasing
clothing for her up-coming graduation. Simelane was however abducted, and has since not
been heard from nor has her body been found. Her disappearance was one of those
examined by the Truth and Reconciliation Commission (TRC) of South Africa.
These are some facts about Simelane. This thesis seeks to explore how Simelane's
biographies manifest themselves across multiple genres and in so doing determine their
similarities and differences, with a view to understanding the difficulties of producing the
biography of a missing person. The genres of biography I examine relation to Simelane are:
the TRC's Amnesty Committee (AC) hearings, the Human Rights Violations Committee
(HRVC) hearing, their transcripts and the TRC reports; a documentary film called Betrayal
directed by Mark Kaplan; and a statue of Simelane located in Bethal sculpted by Ruhan
Janse van Vuuren.

La gestion des ressources humaines est une tâche importante pour toutes les organisations. Avec le nombre de candidatures en augmentation grâce à plusieurs plateformes en ligne, il est souhaitable de faire correspondre automatiquement les candidats avec des offres d’emploi. Les approches existantes utilisent les CVs sans compléter les informations par des recherches sur le Web, notamment le Web social. L’objectif de cette thèse est de surmonter cette limitation et proposer des méthodes pour découvrir des ressources en ligne pertinentes pour un demandeur d’emploi. À cet égard, une nouvelle méthode pour l’extraction d’informations clés à partir des CVs est proposée. Il s’agit d’un problème difficile puisque les CVs peuvent être multilingues et avoir des structures assez variées. En plus, les entités présentes sont suivant ambiguës. L’identification et la réconciliation des ressources en ligne en utilisant les informations clés sont un autre défi. Nous proposons un algorithme pour générer des requêtes et classer les résultats pour obtenir les ressources en ligne les plus pertinentes pour un demandeur d’emploi.. En outre, nous abordons spécifiquement la réconciliation de profils dans les réseaux sociaux grâce à une méthode qui est capable d’identifier les profils de individus à travers différents réseaux. Cette méthode utilise notamment les informations relatives à la localisation géographique des profils. A cet égard, nous proposons un algorithme permettant de désambiguïser les toponymes utilisés dans les profils pour indiquer une localité géographique ; cet algorithme peut être également utilisé pour inférer la localité d’un individu lorsqu’il ne l’a pas renseignée. Des expériences sur des ensembles de données réelles sont menées pour tous les différents algorithmes proposés dans cette thèse qui montrent de bons résultats. / Finding the appropriate individual to hire is a crucial part of any organization. With the number of applications increasing due to the introduction of online job portals, it is desired to automatically match applicants with job offers. Existing approaches that match applicants with job offers take resumes as they are and do not attempt to complete the information on a resume by looking for more information on the Internet. The objective of this thesis is to fill this gap by discovering online resources pertinent to an applicant. To this end, a novel method for extraction of key information from resumes is proposed. This is a challenging task since resumes can have diverse structures and formats, and the entities present within are ambiguous. Identification of Web results using the key information and their reconciliation is another challenge. We propose an algorithm to generate queries, and rank the results to obtain the most pertinent online resources. In addition, we specifically tackle reconciliation of social network profiles through a method that is able to identify profiles of individuals across different networks. Moreover, a method to resolve ambiguity in locations, or predict it when absent, is also presented. Experiments on real data sets are conducted for all the different algorithms proposed in this thesis and they show good results.

Teaching national values in an era of reconciliation: a critical examination of B.C.'s draft high school Social Studies curriculum, 2015-2018Dubensky, Kate 23 April 2019 (has links)
Canadian public life is currently informed by what can be broadly considered an era of reconciliation. While definitions abound, the aim of reconciliation is just relations between Canada and Indigenous nations. Efforts on the parts of federal and provincial governments to apologize and atone for the discriminatory treatment of racialized immigrant groups has also been characterized under the broad banner of reconciliatory politics. While official positions indicate that there is to be a role for schooling in reconciliation efforts, what this means – both in terms of remedies and the nature of the problem they aim to address – remains unclear. At the same time, a new curriculum in British Columbia has been said to contribute toward reconciliation. This dissertation engages contemporary discussion about reconciliation in Canada through a critical examination of the most recent B.C. curriculum, 2015-2018, and asks how dominant national values are making space, or not, for robust and meaningful inclusions of previously marginalized and excluded histories and perspectives. Specifically, in this dissertation I am interested in how the production of national values and priorities in curricula are accommodating of the goals of reconciliation, and revealing of its limits. To do this I compare the national values present in this most recent curriculum to those reported to be present during the late 18th and early 19th centuries in secondary historical literature. Employing a settler colonial theoretical perspective, I assess the ways in which the values produced in the new curriculum continue to center the nation-state and dominant culture values. While nation states like Canada tout progressive mechanisms, such as multicultural policies and multicultural education, to reconcile challenges to state authority, such mechanisms employ and enforce cultural terms that are compatible with Canadian multiculturalism, without attending to less congruent aspects of Indigenous-Canadian relations, like those of land and resources. My findings indicate that while progressive curricular inclusions contribute to increased plurality in educational spaces, there are limits to their efficacy. This is the case primarily because these inclusions are produced through and operate within liberal frameworks that re-center the Canadian nation state. This dissertation contributes to literature that examines the condition of settler colonialism in educational settings in countries like Canada. My conclusions suggest that the efficacy of curricular inclusions that pursue reconciliation will be limited unless teacher education – both pre- and in-service – includes a critical self-analysis of settler colonial privilege and conditionality, and the nation state. / Graduate

Diferentemente de formações dessa natureza e finalidade, a formação das Escolas de Perdão e Reconciliação convidam o educando a cumprir um deslocamento subjetivo por meio da prática do perdão, apoiando-o através de um espaço grupal acolhedor, catártico, linguageiro e reflexivo. Compreendendo o humano em suas quatro dimensões (comportamental, emocional, cognitiva e espiritual), as ESPERE provocam um espaço de tensão política ao aproximar a teoria e a prática do perdão à experiência de justiça. Com base na Educação Popular, a pedagogia do curso investe esforços no autocontrole e no apoio das relações humanas através de atividades plásticas, jogos e dinâmicas de grupo, fazendo com que as pessoas tenham, ao final, podido restaurar-se de um episódio violento de seu passado, experimentar essa nova relação com ele e querer multiplicála em sua prática como facilitador. Com a ajuda do outro, o participante do curso ainda promove a desconstrução de antigas verdades, reflete sobre as relações de poder dos conflitos, questiona-se quanto ao papel da vingança e da punição na sociedade e alfabetiza-se emocionalmente para se comunicar de modo assertivo. Isto cumpre consolidar práticas restaurativas informais para que possam seguir em direção à formalidade. Os capítulos do trabalho foram divididos da seguinte maneira: (1º) é feita uma explanação sobre as práticas restaurativas, seus valores e princípios, para levarmos em conta a hipótese destas estarem vinculadas a dois polos fundamentais que se apoiam: a exigência de uma repactuação social conseguida na radicalização do protagonismo dos envolvidos; (2º) fazemos um levantamento histórico-institucional do Centro de Direitos Humanos e Educação Popular de Campo Limpo (CDHEP) para que possamos situar as ESPERE dentro de um projeto de sociedade que a ONG empreende até os dias de hoje; (3º) abordamos a chegada das ESPERE no CDHEP como ponte fundamental para possibilitar a construção de uma Justiça Restaurativa independente e popular; (4º) reservado à descrição da formação das ESPERE e apontamentos para reflexão; (5º) são colocadas algumas contribuições e reflexões que articulam nossas experiências como educadores, retomando a hipótese e os apontamentos a fim de caracterizarmos as mudanças fundamentais da Justiça Restaurativa no que tange seus resultados, pressupostos, entendimentos e ética / This research is based on the outlook of a psychologist in a training program for facilitators in restorative practices. As opposed to other programs of this nature, the training programs of the Schools of Forgiveness and Reconciliation invite the students to create a subjective dislocation through the practice of forgiveness, supporting them in a welcoming, cathartic and reflexive group context. Understanding the human being in its fours dimensions (behavioral, emotional, cognitive and spiritual), the ESPERE schools create a context of political tension by uniting the theory and practice of forgiveness to the experience of justice. With its basis in Popular Education, the trainings theory is based in self-control and the support in human relations through artistic activities, games and group dynamics, in such a way that permits the participants to, in the end, restore themselves regarding a violent episode from their past, experience a new relationship with it, and pass this on as a facilitator. With the help of others, the participants achieve deconstruction of old truths, reflect about the power relations in conflicts, question themselves about the role of revenge and punition in society and build an emotional basis to communicate assertively. This consolidates informal restorative practices, in order to later move on to a formal approach. The chapters of this dissertation were divided as follows: (1st) an explanation about restorative practices, their values and principles, considering that these practices are linked to two main ideas, which support one another: a demand for social repactuation achieved by the radicalization of the empowerment of those involved. (2nd) The second chapter is a historical account of the institution Center for Human Rights and Popular Education of Campo Limpo (CDHEP), placing the ESPERE in the context of a project of society that the NGO continues to carry out to this day; (3rd) The third chapter addresses the arrival of the ESPERE at CDHEP as a fundamental bridge for the construction of an independent and popular Restorative Justice; (4th) The forth chapter is reserved for the description of the ESPERE training program and notes for reflection; (5th) In the fifth chapter contributions and reflections are put forth, which articulate our experiences as educators, and resume our hypothesis characterizing the main changes in Restorative Justice regarding results, assumptions, understandings and ethics
