Theory of Law understood as Prudential Theory of Law / Teoría del Derecho entendida como Teoría Prudencial del Derecho

During centuries, law has been studied and understood under a human view. This way of understanding law used the argumentation, the topic, the rhetoric and the dialectics as working methods. The result was a plural and continuously in movement humanistic law. The situation changes in 19 century with the beginning of the iuspositivism movements with a focus in the study of law as legal frame. The result is a rigid, non-flexible and poorly adapted to judicial experience law. We understand that this situation must change and is urgent to combine science and prudence in order to be able to provide a Theory of law, that can be understood as a Prudential Theory of Law. This according to our understanding will enable the recuperation of a more flexible, plural and humanistic and above anything a fairer judicial experience. / Durante siglos se ha estudiado y entendido el Derecho en clave humana. Esa forma de entenderlo usaba de la argumentación, de la tópica, de la retórica, y de la dialéctica como métodos de trabajo. El resultado era un Derecho humanista, plural y en permanente movimiento. Esta situación cambió en el siglo XIX con el inicio de las corrientes iuspositivistas, que enfocan el estudio del Derecho como ordenamiento jurídico. El resultado es un Derecho rígido, poco flexible, y poco adaptado a la experiencia jurídica. Entendemos que esta situación debe variar, y que urge combinar ciencia y prudencia para ofrecer una Teoría del Derecho que pueda ser entendida como Teoría Prudencial del Derecho. Creemos que de ese modo se retomará una visión de la experiencia jurídica más flexible, más plural, más práctica, más humanista y sobre todo más justa.

Die doel van die navorsing was om riglyne daar te stel vir die hantering en ondersteuning van hierdie mense. Vanuit 'n in-diepte literatuurstudie, het dit geblyk dat die grootste probleme waarmee agterblywendes gekonfronteer word, wentel random problematiese emosies, veroordeling deur omstanders en belewings van persoonlike onvermoe om te midde van intense rousmart selfaktualisering optimaal te volvoer. 'n Vraelys wat aspekte (socs dit uit die literatuurstudie geblyk het) inkorporeer, is opgestel en aan agterblywendes gegee om te beantwoord. Die studie bevestig dat die agterblywendes as die werklike slagoffers na 'n selfmoord agtergelaat word, maar dat sinvolle intervensie hierdie persone in staat kan stel om ten spyte van die gebeure weer optimaal te selfaktualiseer. / Suicide is a controversial topic. It causes both bystanders and survivors to feel insecure. An important reason for this is that it is an unnatural death which directly opposes the norms and values of the majority of people. ldiografic research has been undertaken to closely examine the experiences of suicide survivors as they are the real victims who are left to cope with a complex reality after a suicide. The objective of this study was to provide guidelines to effectively manage and render assistance to survivors. From an in depth review of available literature it appeared that troubled emotions, being denounced by bystanders and the inability to proceed with continued qualitative self-actualization are some of the most important problems survivors have to cope with. A questionnaire, incorporating significant aspects reported in literature, was compiled and given to survivors to complete. From their responses certain facets seemed to be problematic. Among the more problematic aspects were complicated interpersonal relations, the basic need to grieve at their own pace, the preference that bystanders avoid analysing the suicide and possible contributing factors (especially in the presence of survivors) and the recognition that each survivor's grief is personal and unique. A chapter has been devoted to a wide range of therapeutic techniques that can be implemented to facilitate the support given to survivors. The study also describes a case study as well as the progression of sixteen individual therapy sessions. Therapeutic intervention was mainly based on hypnotherapy as a form of relaxation therapy during which the focus is placed on problematic emotions and perceptions which prevent continued qualitative self-actualization. Educational Psychological guidelines along which assistance can be rendered by psychologists, teachers as well as other support services are given. This study not only confirms that the survivors are the actual victims of a suicide, but also that it is possible to assist these people to achieve optimal self-actualization through meaningful intervention. / Psychology of Education / D. Controle social institucionalizado é a participação de representantes de segmentos da sociedade civil organizada, em Conselhos populares, no controle social dos serviços e das políticas públicas. Esse estudo buscou investigar o desafio do exercício da participação popular no âmbito do controle social autônomo, na perspectiva da cidadania ativa associada à emancipação. Adotando uma abordagem quali-quanti foram selecionados para investigação em caráter exploratório, Conselhos que atuam no controle da política de alimentação escolar em modelos de gestão centralizada, descentralizada e semicentralizada. Os procedimentos metodológicos se desdobraram em dois eixos - o primeiro tratou do controle social no plano legal, utilizando-se da análise de artigos de leis e normas reguladoras do modelo: Constituição Federal (1988), Plano Diretor de Reforma do Aparelho de Estado (1995), Lei de Diretrizes e Bases da Educação Nacional (1996), Plano Nacional de Educação (2001), Normas regulamentadoras específicas do Programa Nacional de Alimentação Escolar: Lei 11.947 (2009) e Resolução nº 038 (2009). O segundo eixo buscou investigar o controle social no plano institucional, combinando análise documental com investigação dos conselhos na prática do controle social. Para tal, foram aplicados questionários junto aos conselheiros e realizadas entrevista com os Gestores. Os dados foram registrados em quadros e planilhas do sistema EXCCEL, utilizando-se para tratamento dos dados qualitativos o recurso da análise de conteúdo. Os resultados revelam que, no plano formal, o modelo atende aos princípios da cidadania ativa, mas apresenta inconsistência na sua estruturação, delineando atribuições de controle social focadas na função fiscal. Revela ainda, que o modelo estabelece uma relação de dependência, conselheiro-gestor, que favorece o atrelamento dos Conselhos ao Poder local, delimitando o espectro de autonomia dos conselheiros. Os resultados sugerem alteração na estruturação do modelo e elaboração de um Programa de orientação envolvendo a educação permanente para Conselheiros. / This study aims to characterize the social control in the National Program of School Feeding - NPSF, exercised by the Board of School Food - BSF, in a perspective of active citizenship. Institutionalized Social Control is the participation of representatives from segments of the organized civil society, in the popular councils, in the social control of services and public policies. The study tried to investigate the challenge of the exercise of popular participation into the autonomous social control, from the perspective of active citizenship related to the emancipation. Adopting a quali-quanti approach, Councils were selected to investigation in an explanatory character, that operate in the control of the policy of school feeding in centralized, decentralized and semi-centralized management models. Methodological procedures were deployed on two axes - the first one approaches the social control in the legal area, using articles of laws and regulatory norms of the model: Federal Constitution, 1988, Law of Directives and Bases of Education, 1996, Master Plan for Reforming the State Apparatus, 1995, National Education Plan, 2001, Specific Regulatory Standards of the National School Feeding Program: Law No. 11947, 2009 and Resolution No. 038, 2009; the second axe tried to investigate social control in the institutional area, combining documental analysis with the investigation of councils in the practice of social control. Therefore, questionnaires were applied to counselors and interviews were realized with the managers. The data were recorded in tables and spreadsheets EXCEL system, using the resources of content analysis for the analysis of qualitative data. The results suggest that, in the formal area, the model meets the active citizenship principles, but the results also show inconsistency in the structure, outlining attributions of social control focused on fiscal function. The model establishes a relationship of dependency counselorsmanagers, which promotes the bundling of Councils to the Local Authority, delimiting the spectrum of the autonomy of the counselors. Método: A pesquisa incluiu as seguintes bases eletrônicas de dados: PUBMED, EMBASE, LILACS e “The Cochrane Collaboration Controlled Trials Register”. Todos os estudos publicados que envolveram os efeitos antitumorais (mecanismos celulares e moleculares) dos canabinóides foram considerados para esta revisão. Desta forma, foram levados em conta não somente ensaios clínicos (randomizados ou não) como também estudos experimentais in vivo e in vitro. A estratégia de busca bibliográfica compreendeu todas as publicações de cada base de dados até 31 de dezembro de 2009. O exame minucioso de todas as referências bibliográficas dos artigos importantes para esta revisão (incluindo artigos de revisão) foi igualmente realizado com o objetivo de selecionar artigos que não tivessem sido capturados pela estratégia de busca eletrônica. Resultados: De 3.920 artigos inicialmente identificados, 117 preencheram os critérios de inclusão para esta revisão. Todos os estudos incluídos nesta revisão sistemática foram experimentais (in vivo e/ou in vitro), excetuando-se um estudo clinico piloto fase I/II em humanos. Em todos os estudos experimentais incluídos, os canabinóides exerceram atividade antitumoral in vitro e/ou evidência antitumoral in vivo em vários modelos de células tumorais e tumores, respectivamente. As atividades antitumorais incluíram: efeitos antiproliferativos (sequestro do ciclo celular), diminuição da viabilidade e morte celular por toxicidade, apoptose, necrose, autofagia, efeitos antiangiogênicos e antimigratórios. As evidências antitumorais incluíram: diminuição do tamanho tumoral, efeitos antiangiogênicos e antimetastáticos. Adicionalmente, a maioria dos estudos descreveu que os canabinóides apresentaram seletividade na ação antitumoral em vários modelos tumorais. Desta forma, as células normais usadas como controle não foram atingidas. O fator segurança na administração dos canabinóides também foi demonstrado in vivo, em ratos com tumores marcados com células tumorais. O único estudo realizado em humanos, por sua vez, demonstrou segurança na administração intratumoral do delta-9-THC em pacientes com glioblastoma multiforme recorrente. Conclusões: Os vários canabinóides testados em múltiplos modelos de tumores apresentaram efeitos antitumorais in vitro e in vivo. Estes achados indicam que os canabinóides são compostos promissores para o tratamento das neoplasias. No entanto, pesquisas em seres humanos através de ensaios clínicos randomizados, metodologicamente bem conduzidos, devem ser realizadas para a avaliação de eficácia dos mesmos antes que eles possam ser indicados para esta finalidade. Este é o caso do delta- 9-THC e do canabidiol, que já foram testados e aprovados para uso em humanos em outras condições clínicas. Outros canabinóides, no entanto, necessitam ainda de pesquisas farmacocinéticas, farmacodinâmicas e toxicológicas antes de poderem ser testados em seres humanos. / Objective: To evaluate, through a systematic review of the literature, the antitumoral effects of cannabinoids on any type of cancer, involving both human beings and animal samples, as well as cultured tumor cells. Method: Research included the following electronic databases: PUBMED, EMBASE, LILACS and "The Cochrane Collaboration Controlled Trials Register. All published studies involving the antitumoral effects (cellular and molecular mechanisms) of cannabinoids were considered for this review. Thus, not only clinical trials (randomized or not) but experimental studies (both in vivo and in vitro) were taken into account. The bibliography search strategy included all publications of each of these databases until December 31, 2009. The scrutiny of all the references from the relevant articles for this review (which included review articles) was also performed, in order to select items that could not have been captured by the chosen electronic search strategy. Results: From 3,920 initially identified articles, 117 fulfilled the inclusion criteria for this review. All the studies included in this systematic review were experimental (in vivo and/or in vitro), except for a pilot clinical trial phase I/II involving humans. In all experimental studies included, cannabinoids exerted antitumoral activity in vitro and/or antitumoral evidence in vivo in several models of tumor cells and tumors, respectively. The antitumor activity included: antiproliferative effects (cell cycle arrest), decreased viability and cell death by toxicity, apoptosis, necrosis, autophagy, as well as antiangiogenic and antimigratory effects. Antitumoral evidence included: reduction in tumor size, antiangiogenic, and antimetastatic effects. Additionally, most of the studies described that the canabinnoids exercised selective antitumoral action in several distinct tumor models. Furthermore, normal cells used as controls were not affected. The safety factor in the cannabinoids’ administration has also been demonstrated in vivo in rats with tumors which were marked with tumor cells. The sole study in humans demonstrated safety in intratumoral administration of delta-9- THC in patients with recurrent glioblastoma multiforme. Conclusions: The various cannabinoids tested in multiple tumor models showed antitumoral effects both in vitro and in vivo. These findings indicate that cannabinoids are promising compounds for the treatment of cancer. However, methodologically well conducted research on humans through clinical trials has yet to be performed in order to evaluate their effectiveness. This is the case of delta-9-THC and cannabidiol, which have been tested and approved for use in humans in other clinical conditions. In the case of other cannabinoids, however, further pharmacokinetic as well as pharmacodynamic and toxicological studies are required before their being tested in humans. / TEDE / BV UNIFESP: Teses e dissertações

Mediální výchova ve výuce českého jazyka na středních školách / Media educaton in Czech lessons on high schools

The aim of this diploma thesis, which is entitled "Media education in Czech lessons in secondary schools", is to map out the current state of integration of a cross-sectional theme named Media Education into the Czech lessons of all kinds of high schools in the Czech Republic. The educational process is seen from the perspectives of all its participants. The thesis should bring the list of excerpted scientific texts and research dealing with the object of our interest. And it also aims to describe the interfaces of both educational subjects which emerge from the requirements for the students. The research part is aimed at providing the informations about the particular signs of media education in the obligatory school subject of Czech lessons as well as the success of this effort to increase media literacy by the high school students. This information should be collected by a content analyses of school curricular documents, interviews and questionnaires of both sides of the educational process.The work also brings an analyses of teaching materials represented by Czech lesson textbooks, which are evaluated according to the integration of our cross-sectional theme and its possibilities. The output of this thesis is the suggestion of our own didactic instrument, the didactic test.

Besides the convenience of oral use, other benefits were achieved with the new drug, with faster therapeutic responses and increased survival, giving the CML similar characteristics as chronic diseases. In this scenario, there was another challenge, drug compliance, since a significant proportion of patients fail to ingest all the prescribed doses of imatinib. The concern was to optimize the adherence of CML patients, the hematology ambulatory at the Clinical Hospital of the Federal University of Goias (HC-UFG), led the authoress to create a film cartoon, as a pro-adhesion educational intervention model. To investigate the effectiveness of this new educational material, we used in 65 patients three adherence measures, two indirect (Morisky Test and Molecular Response [MR]) and direct (plasma dosage of IM), before and after the screening of film. In univariate analysis, from the Morisky Test, the film was striking, with increased adherent patients, which increased from 15 (23.1%) to 43 (66.1%). The results of MR showed an improvement trend after the movie, because the positive molecular response (major MR or complete MR) increased from 81.5% to 86.1%. Regarding the serum levels of IM, with daily doses of 400-800 mg IM, the premovie samples showed higher average than the post-movie (2473.16 ± 1049.55 ng/ml versus 1414.72 ± 715 73 ng/ml), with a variation coefficients interpatients of 43.4% and 50.6%, respectively. This high dispersion index found has been reported by other authors. By multivariate analysis, patients were divided into three groups. The first brought together compliant patients before and after the film with a good therapeutic response (major MR) after the intervention. It was: patients over 53 years old, females, with associated diseases before and after the treatment of CML that use more than two drugs in addition to imatinib. The second group was marked by the change of not adherence pre to adherence post-film. Its features were younger than or equal to 53, the absence of other disease before the CML, the use of less than two drugs and complete molecular response after the film. In the third group, we observed patients without molecular response before and after the educational intervention and no medication adherence after the film. They had in common their age (less than or equal to 53 years), and drug discontinuation due to adverse reactions. The last represents the set of patients resistant to the educational film, drawing attention to the fact that only one pro-adhesion method may be insufficient for all individuals. It is concluded that medication adherence was higher among patients older than 53 years, the educational film is an effective proadhesion assistance and continuing education, if combined with another method, it could help maintain or enhance the benefits achieved in this work. / O tratamento da leucemia mielóide crônica (LMC) mudou radicalmente com o advento do mesilato de imatinibe (MI). Além da comodidade do uso oral, outros benefícios foram alcançados com o novo fármaco, como respostas terapêuticas mais rápidas e aumento da sobrevida, dando `a LMC características semelhantes `as de doenças crônicas. Neste cenário, surgiu outro desafio, a adesão medicamentosa, pois uma proporção significativa de pacientes deixa de ingerir a dose prescrita de imatinibe. A preocupação em otimizar a adesão dos pacientes com LMC, do Ambulatório de Hematologia do Hospital das Clínicas da Universidade Federal de Goiás (HC-UFG), motivou a autora a criar um filme em desenho animado, como modelo de intervenção educativa pró-adesão. Para investigar a eficácia deste novo material educativo, empregou-se, em 65 pacientes, três medidas de adesão, duas indiretas (Teste de Morisky e Resposta Molecular [RM]) e uma direta (dosagem plasmática do MI), antes e depois da exibição do filme. Em análise univariada, pelo teste de Morisky, o filme foi impactante, com aumento dos pacientes aderentes, que passaram de 15 (23,1%) para 43 (66,1%). Os resultados da RM indicaram uma tendência de melhora após o filme, pois a resposta molecular positiva (RM maior ou RM completa) passou de 81,5% para 86,1%. Em relação `a dosagem sérica do MI, com doses diárias entre 400-800 mg de MI, as amostras pré-filme apresentaram média superior `as do pósfilme (2.473,16 ± 1.049,55 ng/ml versus 1.414,72 ± 715,73 ng/ml), com coeficientes de variação interpaciente de 43,4% e 50,6%, respectivamente. Este elevado índice de dispersão encontrado tem sido relatado por outros autores. Pela análise multivariada, os pacientes foram separados em três grupos. O primeiro, reuniu os pacientes aderentes antes e após o filme e com boa resposta terapêutica (RM maior) após a intervenção. Foram eles: os doentes com mais de 53 anos, do gênero feminino, com doenças associadas antes e após o tratamento da LMC e que usam mais de dois medicamentos além do imatinibe. O segundo grupo foi marcado pela mudança de não adesão pré para adesão pós-filme. Suas características foram idade menor ou igual a 53, ausência de outra doença antes da LMC, uso de menos de dois medicamentos e resposta molecular completa pós-filme. No terceiro grupo, observou-se pacientes sem resposta molecular antes e depois da intervenção educativa, bem como não adesão medicamentosa após o filme. Eles tinham em comum a idade, menor ou igual a 53 anos, e suspensão do medicamento por reação adversa. Estes últimos representam o conjunto de pacientes resistentes ao filme educacional, chamando atenção para o fato de que somente um método pró-adesão pode ser insuficiente para todos os indivíduos. Conclui-se que a adesão medicamentosa foi maior entre os pacientes maiores de 53 anos, que o filme educativo é uma intervenção pró-adesão eficaz e que a educação continuada, aliada a outro método, poderia ajudar a manter ou ampliar os benefícios conquistados neste trabalho.

O presente trabalho visa desenvolver métodos analíticos que permitam determinar as concentrações de oxitetraciclina por Cromatografia Líquida de Alta Eficiência, no leite, plasma e líquido sinovial, além de analisar as concentrações correspondentes em gado leiteiro em lactação portadoras de doença do casco submetidos aos tratamentos intramuscular e tópico. Adicionalmente, são tecidos comentários sobre a eficácia clínica destes tratamentos. Desta forma, objetivando determinar a depuração de oxitetraciclina no organismo dos animais tratados, a concentração no sítio de ação e a quantidade residual em leite, as amostras biológicas foram colhidas e quantificadas em diferentes tempos pré e pós-administração do fármaco. Os métodos analíticos validados apresentaram linearidade, limite de detecção, quantificação, exatidão, precisão e recuperação adequadas à quantificação do antibiótico nas matrizes estudadas. Através da administração do medicamento por via intramuscular, observou-se resíduos acima dos limites máximos (100ppb) estabelecidos pela legislação brasileira para oxitetraciclina no leite até 120 horas após a última administração do medicamento pelo esquema seriado de doses. Já pela via tópica, não foram observados valores residuais na matriz biológica. Do ponto de vista clínico, o tratamento tópico foi eficiente nos animais tratados, levando a cura das lesões. Com relação ao tratamento intramuscular, não foram observados resultados satisfatórios, pois a maioria das lesões não regrediu após as administrações. / The purpose of the present work is to develop methods which allow the determination of oxytetracycline by High Pressure Liquid Chromatography in milk, serum and synovial fluid, as well as analyze the corresponding concentration in milk cattle with foot lameness subjected to intramuscular and topical administration of the antibiotic. It is also commented the clinical efficacy of these two treatments. Thus, to determine the clearance of oxytetracycline in the body of the treated animals, the concentration on the site of action, and the antibiotic residue in milk, biological samples have been collected and analyzed for the oxytetracycline content at different times before and after the drug administrations. The validated analytical methods showed suitable linearity, detection and quantification limits, accuracy, precision and recovery, allowing proper quantification of the antibiotic in the studied biological matrices. When administered intramuscular1y, oxytetracycline residues were observed in milk above the maximum limits (100ppb) established by the brazilian legislation up to 120 hour after the last administration of the medicine using multiple doses treatment, whereas on topical use, residues were not observed in this matrix. When analyzing the clinical aspects, topical treatment was very efficient, leading to the healing of the treated animals. In relation to intramuscular treatment, non satisfactory results were observed, as most of lesion did not disappear after the antibiotic administration.

Introdução: A asma e a DPOC são doenças crônicas inflamatórias que afetam a qualidade de vida dos pacientes. O tratamento medicamentoso é feito, em sua maioria, por via inalatória utilizando para isso os dispositivos inalatórios. O uso incorreto dos dispositivos inalatórios diminui a eficácia dos medicamentos, o que pode ocasionar a não aderência dos pacientes ao tratamento. Vários tipos de programas educativos para asma e DPOC têm sido desenvolvidos, diferenciando-se quanto à forma de abordagem, à situação em que a doença é atendida e aos desfechos considerados. O farmacêutico por meio de um programa educacional pode orientar os pacientes sobre a técnica correta dos dispositivos inalatórios e auxiliar este paciente na adesão ao tratamento. Objetivos: Realizar a compilação e sistematização dos resultados dos trabalhos apresentados pelo programa de atenção farmacêutica aos pacientes asmáticos e portadores de DPOC do ICHC FMUSP e do programa de pós-graduação de Fisiopatologia Experimental. Método: estudo retrospectivo e descritivo dos trabalhos de conclusão dos alunos do Curso de Aprimoramento Profissional em Farmácia Hospitalar e Introdução a Farmácia Clínica da Divisão de Farmácia do ICHC FMUSP e do programa de pós-graduação de Fisiopatologia Experimental da Faculdade de Medicina da USP. Estes estudos desenvolveram a temática da atenção farmacêutica e educação em asma e em DPOC, apresentados entre os anos de 2004 a 2012 que não tiveram artigos ou capítulos de livros publicados. Resultados: Foram enviados três capítulos para publicação no livro Atenção Farmacêutica - Gestão e Prática do HCFMUSP e um artigo será publicado no Jornal Brasileiro de Pneumologia. Conclusão: Publicações acadêmicas com o tema atenção farmacêutica ao paciente portador de doenças respiratórias crônicas demonstram a importânica da orientação/ educação desses pacientes quanto ao tratamento de suas doenças respiratórias / Introduction: Asthma and COPD are chronic inflammatory diseases that affect the quality of life of patients. Drug treatment is done mostly by inhalation, using for it inhalation devices. Incorrect use of inhalers decreases the effectiveness of medications which can cause non-adherence of patients to treatment. Various types of educational programs for asthma and COPD have been developed, differing on the mode the approach, the situation in which the disease is answered and the outcomes considered. The pharmacist through an educational program can educate patients about the proper technique of inhalation devices and assisting the patient to adhere to treatment. Objectives: Perform the compilation and systematization from studies data submitted by the pharmaceutical care program for patients with asthma and COPD developed by pharmacists from course of improvement of the Division of Pharmacy ICHC USP and also by the program of graduate Experimental Pathophysiology, Faculty of Medicine, USP. Method: A retrospective, descriptive study with the outcomes of studies of the students that completed the course in Professional Development Course in Hospital Pharmacy and Introduction to Clinical Pharmacy, of Division of Pharmacy of ICHC USP and the program graduate in Experimental Pathophysiology, Faculty of Medicine of USP. The studies show the theme of pharmaceutical care and asthma education and COPD, submitted between the years 2004 to 2012 and who had no articles or book chapters related books published. Results: three book chapters were sent for publication in the book Pharmaceutical Care - Management and Practice HC FMUSP and one article will be published in the Brazilian Journal of Pulmonology. Conclusion: academic publications on the theme pharmaceutical care to patients with chronic respiratory diseases shows the importance orientation/education of patients regarding the treatment of their respiratory diseases
