An injured party in criminal proceedings and his/her protection The diploma thesis deals with the position of the injured party and his protection during the entire criminal proceedings and a description of the rights at his disposal in its individual phases. It draws information from legislation, literature, case law and electronic resources. The diploma thesis is divided into five chapters. The first includes the definition of the term injured party, both its positive and negative definitions. It also describes the differences between the terms 'injured party' and 'victim of a crime'. The second chapter focuses on the description of the rights that belong to all injured, as well as those that belong only to the injured, who have the status of a subject in adhesion proceedings under § 43, paragraph 3 of the Criminal Procedure Code. The most important of these rights are characterized in more detail. It is also describing the possibility of injured party to waiver his procedural rights and analyzing the problem of partial waiver. The last part of the chapter is devoted to minors as the injured parties and their special position in criminal proceedings. The issue of victims of sexual offences and their protection through criminal law Abstract The theme of this diploma thesis refers to the issue of victims of sexual offences and their protection through criminal law. This thesis aims to theoretically analyse this issue, describe the specifics of the victimisation process, and focus on protecting victims of sexual offences through criminal law. The author also asks in the introduction why these victims are victimised by so many. It also evaluates the legislation in selected areas and suggests possible changes in the legislation. The thesis itself is divided into six chapters, each of which deals with different aspects of this theme. The first chapter deals with the current legislation on selected crimes of rape, sexual abuse and sexual coercion. The author also discusses the degree of their latency, which is relatively high in crimes against human dignity in the sexual field. The second chapter defines the various concepts related to the issue of victims of sexual offences. These are terms such as victim, particularly vulnerable victim or false victim. How a TikTok video by Finnish police is representing the victim : A Multimodal critical discourse analysis on victim blaming in Tiktok video

The Finnish police have power and influence as they are gate keepers of the criminal justice system. Governmental crime reduction policies rely on the actions of the police and in 2020 the Finnish police made a TikTok video to warn adolescences about dangers of sexting. My thesis uses Lerner’s Just world hypothesis and Bacchi’s What’s the problem represented to be as a theoretical framework, and multimodal critical discourse analysis (MCDA) to identify how the victim is represented in the TikTok video. The analysis on the content of the TikTok video is representing the victim as culpable for the crime against him/her. When the analysis is applied to the theoretical framework, it can be argued that the instructive TikTok video bears pressing social and institutional problems and extends people’s responsibility for avoiding crime and therefore fails achieving a balanced policy between crime prevention and criminal justice response.

Testifying in court as a victim of crime : vocabulary required by illiterate individuals with little or no functional speech

People with disabilities are at high risk of becoming victims of crimes. Those individuals with little or no functional speech (LNFS) are even more at risk of being victims of crime. One way of reducing the risk of being a victim of crime is facing the alleged perpetrator in court as a witness; therefore it is important for people with LNFS who have been victims of crimes to have the relevant vocabulary needed to testify in court. The aim of this study was to identify and describe the legal core vocabulary required by illiterate victims of crime, who have little or no functional speech, to testify in court as witness/witnesses. A mixed method, exploratory sequential design consisting of two different phases was used to address the aim of the research. The first phase was qualitative and included two different data sources, namely in-depth semi-structured interviews (n=3) and focus groups (n=22). The overall aim of this phase was to develop a measurement instrument. Results from Phase 1 were used in Phase 2, the quantitative phase, in which the measurement instrument (a custom designed questionnaire) was socially validated by 31 participants. The results produced six distinct categories which represented the core legal vocabulary and 99 words that represented the fringe legal vocabulary. The findings suggested that each communication board should be individualized to the individual and the specific crime. La place de la victime dans le procès pénal, étude de droit comparé : droit burkinabé sous l'éclairage du droit international / The role of the victim in the criminal trial, a study of comparative law : Burkina Faso law seen in the light of international law

Le droit international reconnaît deux droits fondamentaux aux victimes : le recours devant un tribunal et la réparation de leurs préjudices. Le recours devant un tribunal se décline en plusieurs droits : le droit d’accéder à un tribunal, le droit à l’information, le droit à l’avocat, le droit à être entendu dans la procédure. Le droit international recommande en outre, aux États de prendre des mesures pour assurer la protection des victimes et leur prise en charge. Au plan international, la création de la Cour pénale internationale et des juridictions communautaires participent,considérablement à la mise en oeuvre des droits reconnus aux victimes. Au niveau national, il existe une divergence de point de vue des législations des États, concernant le statut de la victime dans le procès pénal. Les pays de la Common Law reconnaissent généralement la victime comme témoin au procès pénal. Tandis que les pays de droit continental lui reconnaissent la qualité de partie civile. Cependant, la mise en oeuvre des droits des victimes reste une préoccupation importante dans tous les cas. Cette étude comparative laisse apparaître clairement que la place de la victime en droit burkinabé ne correspond pas à la dynamique de l’évolution entamée au plan international sur ce sujet. En effet, le Burkina Faso s’est doté, au lendemain de son indépendance, d’un Code de procédure pénale largement inspiré du droit français. Cependant, l’absence d’une véritable politique pénale prenant en compte les intérêts des victimes d’infraction limite la participation de ces dernières au procès pénal. La réparation des préjudices subis par les victimes n’est pas effective car l’auteur n’a pas souvent les moyens de payer et il n’existe pas de système d’indemnisation publique.L’absence d’alternatives au procès pénal classique est un autre point de faiblesse de la justice burkinabé. On retient également, une insuffisance des mesures visant à protéger les victimes. Quant à l’aide aux victimes, elle n’est pas assurée du fait de l’absence d’un programme étatique visant la prise en charge de leurs besoins. Du côté du milieu associatif, des initiatives existent, mais n’atteignent pas vraiment la grande majorité des victimes. Face à cette situation,nous avons jugé essentiel de proposer diverses pistes de solutions, parmi lesquelles les suivantes : le renforcement des droits des victimes dans les procédures classiques, l’amélioration du droit à la réparation des victimes, le recours à des programmes de justice restauratrice et la mise en place de mesures d’aide aux victimes. / International law recognizes two fundamental rights for victims: the right to a court and the right to compensation of any loss. The right to a court includes the right of access to a court, the right toinformation, the right to legal representation and the right to a hearing. International law also recommends that States take measures to ensure the protection and support of victims. At the international level, the establishment of the International Criminal Court and other international bodies made a considerable contribution to the implementation of victims’ rights. At the nationallevel, there is a divergence of views between the laws of the States concerning the status of the victim in the criminal trial. Common-law countries generally recognize the victim as a witness at the criminal trial, whereas continental law countries accord the victim civil-party status. However,implementation of the rights of victims remains a major concern in all cases. This comparative study clearly shows that the role of the victim in Burkina Faso law does not correspond to the dynamics of the evolution begun at the international level on this subject. Although, following independence, Burkina Faso adopted a code of criminal procedure largely inspired by French law,the lack of any real criminal policy taking into account the interests of victims of offences means they have only limited rights of participation at the criminal trial. Reparation of damage suffered by victims is not effective because offenders often do not have the means to pay and there is no system of public compensation. The absence of alternatives to the classical criminal trial is another weakness of the criminal-justice system in Burkina Faso, as is the lack of measures to protectvictims. Likewise, assistance for victims is not assured because of the absence of a State program to support their needs. While initiatives are taken by community organizations, they do not really reach the vast majority of the victims. In this situation, we have found it essential to propose various possible solutions, including: strengthening the rights of victims in the standard procedures, improving the right to reparation for victims, using restorative justice programs an dimplementing measures of assistance for victims.

Die Komplexität des Sicherheitsempfindens bringt es mit sich, dass nicht wenige Theorien vorhanden sind, mit denen versucht wird, das Zustandekommen von Kriminalitätsfurcht bzw. Sicherheitsempfinden zu erklären. Die Theorie der generellen Ängste, der sozialen Desorganisation, der sozialen Problemperspektive bezeichnen einige Pfade dieser Entwicklung. Die erste und scheinbar selbstevidente Theorie war jene der Viktimisierung. Es schien auf der Hand zu liegen, dass Viktimsierungserfahrungen die Kriminalitätsfurcht steigern.

This thesis deals with cultural image of Jan Palach. It focuses especially on symbols and myths contributing to construction of this image. The main emphasis is given on the concept of sacrifice - the study analyzes comparisons of Jan Palach to archetypes of Jesus Christ and young martyrs. In the second part author analyzes national dimension of Palach's cultural image. She deals with comparison of Palach to Jan Hus and analyzes Palach's funeral as a part of tradition of Czech public funerals - quiet national demonstrations. The methodology of the study is discourse analysis, which is applied not only on texts (fiction and nonfiction), but also on photographic and film footage.

“Allt våld mot kvinnor måste upphöra” : Våld i nära relationer, Genus och Det ideala offret i kommunala handlingsplaner -en kvalitativ innehållsanalys

Syftet med studie var att analysera, beskriva och jämföra fyra kommuners handlingsplaner mot våld i nära relationer med hjälp av kvalitativ innehållsanalys. Utifrån genus och teorin om det ideala offret. Analysen av handlingsplanerna visade att våld i nära relationer beskrevs som ett komplext våld som inte går att hitta en ensam orsak till utan att det handlar om flera olika orsaker. I handlingsplanerna beskrivs vidare våld i nära relationer som ett våld som mestadels kvinnor utsätts för, detframkommer även att våldet sker i alla typer av relationer och samhällsklasser. Kvinnan beskrivs i handlingsplanerna som det svagare könet vilket stämmer in på vår genusteori av Harding och den symboliska processen. Det finns också en konstruktion av kvinnan som det ideala offret och en reproducering av normer och attityder som ger en stereotypisk föreställning om våld i nära relationer, i de kommunala handlingsplaner vi analyserade. / The purpose of the study was to analyse, describe and compare fourmunicipal action plans against intimate partner violence with the help of qualitative content analysis. Based on gender and the theory of the ideal victim. The analysis of the action plans showed that intimate partner violence was described as a complex act of violence and there is not only one ulterior cause, it is about several ulterior causes. In the action plans is the intimate partner violence described as a repeated act of violence to which most women are exposed to, but they also state that the violence occurs in all types of relationships and in all classes of society. The woman is described in the municipal action plans as the weaker sex, which is in line with our gender theory by Harding whit the symbolic process. There is a one-sided constructionof the woman as the ideal victim and a reproduction of norms and attitudes as a stereotypical conception of intimate partner violence, in themunicipal action plans we analysed.
