Principes de conception et d’utilisation des e-portfolios de présentation en milieu universitaire

Cette recherche se propose d’étudier, d’un point de vue de la problématique et de la méthodologie relative à l’ergonomie humain-machine, la manière dont les e-portfolios de présentation peuvent s’insérer dans le milieu universitaire. Un e-portfolio est généralement défini comme étant une collection d’informations qui illustre la scolarité, l’apprentissage ou la vie professionnelle d’une personne à travers une sélection de résultats marquants au cours de formations ou d’études, mais aussi qui regroupe les réflexions personnelles de l’apprenant sur son apprentissage, son parcours, la planification d’une carrière ou la construction d’un CV. Tout au long de cette étude nous avons chercher à comprendre à travers une analyse ciblée des besoins comment l’apprenant peut mettre en avant une démarche réflexive tout au long de son parcours. Il s’agit aussi de comprendre comment les e-portfolios de présentation pourraient se démarquer et offrir un véritable outil de placement aux étudiants comme aux recruteurs. Pour tenter de répondre à ces questions, nous avons procédé à des entretiens avec les recruteurs et les étudiants en vue de comprendre leurs attentes. L’ensemble des informations recueillies on permis de créer une maquette fonctionnelle sur laquelle ils ont pu interagir. Les éléments d’analyse issus de ces rencontres et des tests d’utilisabilité de l’outil nous ont permis de mettre sur pied une maquette finale. / Based on the human-machine ergonomics methodology, this study deals with how e-portfolios of presentation could be implemented in the University. An e-portfolio can be defined as a structured amount of information displaying the education, learning and working experience of a person in relation to a selection of outstanding results. It also includes personal reflections on the learner on those accomplishments, on his career plan, on his working experience or simply on his resume. With a focused needs’ analysis, we try to understand how learners could put forward a reflexive thinking throughout their career. Also, we try to figure out how e-portfolios could become an effective investment tool for students as well as for employers. To answer these questions, we have made many interviews with employers and students in order to assess and understand their expectations. The sum of collected information has helped us to design a primary model on which they will be able to interact each other. After that phase, and according to all the usability tests conducted on that model, we developed the final model for an e-portfolio.

Le document technologique original dans le droit de la preuve au Québec

L’adoption de la Loi concernant le cadre juridique des technologies de l’information en 2001 a permis de mettre en place un cadre juridique favorisant l’intégration des technologies de l’information dans le droit. Plus particulièrement en droit de la preuve, cela a conféré au document technologique la qualité d’élément de preuve. Dans ce contexte il a été nécessaire d’adapter certains articles du Code civil du Québec et du même fait certaines règles dont la règle de la meilleure preuve, telle que prévue à l’article 2860 C.c.Q.. Cette règle s’appuyait jusqu’à présent sur la notion d’original, notion propre au support papier dont il a fallu trouver un équivalent pour le document technologique. C’est ce qu’a fait la Loi en prévoyant à son article 12 les caractéristiques de l’original technologique. Nous nous penchons sur cette notion en regardant quelles sont ses origines et ses justifications, puis nous avons analysé l’article 12 de la Loi qui traite de l’original sous forme technologique. Enfin nous nous sommes interrogé sur la place des reproductions dans le contexte technologique et nous avons vu que celles-ci ont pris de plus en plus d’importance à côté du document original, au fur et à mesure du perfectionnement des moyens de reproduction. / The adoption, in 2001, of the Act to Establish a Legal Framework for Information Technology (the Act) allowed the establishment of a legal framework facilitating the integration of Information Technology in law. More specifically in law of evidence, this allowed for the recognition of the technology-based document as evidence. In this context, it was necessary to adapt certain sections of the Civil Code of Québec and, thus, certain rules, among which the best evidence rule, set forth in Section 2860 C.C.Q. Until the Act, this rule relied on the original, a concept specific to the paper medium; consequently, it became necessary to find an equivalent for the technology-based document. This was done by Section 12 of the Act, which sets out the technology-based original’s characteristics. We will look into this concept’s origins and rationale, before analysing Section 12 of the Act, which addresses the original in a technological form. We will then examine the reproductions’ place in the technological context, and ascertain their growing importance beside that of the original document’s, as the means of reproduction continuoulsy improved.

Contribution à l'analyse critique de la certification équitable depuis une perspective juridique : l'exemple du secteur viticole / Contribution to the critical analysis of Fairtrade certification from a legal perspective : the wine sector example.

La thèse s’attache à définir la certification équitable depuis une perspective juridique. Tant l’analyse de sa dimension formelle que matérielle permettent de conclure qu’elle est caractérisée par un dualisme face au droit étatique. Elle entretient à la fois une relation d’autonomie et d’hétéronomie à l’égard des ordres juridiques étatiques. Sur le plan formel, le caractère autonome du régime équitable est révélé par l’existence d’un ordre juridique distinct des ordres étatiques. En effet, les institutions du régime équitable jouent le rôle de tiers impartial et désintéressé à l’égard des producteurs du Sud et des acheteurs du Nord. Le rapport d’hétéronomie se manifeste par l’intervention d’éléments provenant d’ordres juridiques étatiques au sein du régime. Celle-ci contribue à sécuriser et à bonifier le régime équitable. Sur le plan matériel, l’autonomie du régime se traduit par des dispositions inédites. Bien qu’originales par rapport aux normes d’origine étatique, l’analyse de ces normes montre qu’elles ne se placent cependant pas en situation de concurrence face à celles-ci. Elles interviennent plutôt comme complément. Les standards de la certification équitable ne comportent cependant pas que des normes inédites. Plusieurs reprennent textuellement des dispositions d’instruments juridiques internationaux et nationaux d’origine étatique, alors que d’autres les traduisent dans un langage plus accessible et adapté au contexte de leurs destinataires. Dans ces deux cas, il s’agit de réitérer le droit en vigueur plutôt que de s’y opposer en ne se limitant pas à le répéter mais plutôt en facilitant sa connaissance et sa mise en œuvre par des mesures concrètes. / The thesis aims to define fairtrade certification from a legal perspective. Both its formal and its material dimensions allow concluding that it is characterized by a dualism towards state law. It is both autonomous and heteronomous in relation to state legal orders. On the formal dimension, the fairtrade regime autonomy is revealed by the existence of a legal order distinct from state orders. Indeed, fairtrade regime institutions act as the impartial and disinterested third party towards the producers of the South and the buyers of the North. The heteronomy is shown by interventions, in the fairtrade regime, of elements originated in state legal orders. These interventions contribute to secure and improve the fairtrade regime. On the material dimension, the regime’s original provisions reveal its autonomy. The analysis concludes that these provisions although novel if compared to state norms are not competing with the latters. To the contrary, they intervene as a complement to state legal orders. Fairtrade standards do not only contain unprecedented norms. Several simply reproduce the exact wording of state legal instruments, while other translate them into a more accessible and context adapted language. In both cases, they reiterate the law instead of contradicting it. The regime’s main appeal is that it does not repeat the law but contributes to facilitate its understanding and implementation by concrete measures.

Analyse économique du développement des nouveaux marchés biologiques : le cas des marchés biologiques domestiques au Kenya

L’agriculture biologique sort aujourd’hui des frontières des pays du Nord en se développant dans de nombreux pays dits du Sud. Cette dynamique a tout d’abord été celle d’un positionnement sur des filières d’export de produits à haute valeur ajoutée. Parallèlement à l’export, émergent dans un nombre croissant de pays en développement, et notamment au Kenya, des marchés domestiques. La thèse pose la question des dynamiques permettant l’émergence et le développement de ces nouveaux marchés. La recherche est structurée autour de quatre questions. La première porte sur les formes d’organisation des échanges de produits biologiques à Nairobi. À partir du cadre de l’économie néo-institutionnelle, nous expliquons comment, en l’absence de systèmes de certification crédibles, ces produits parviennent à être vendus avec premiums. La seconde question porte sur les conditions d’accès des producteurs à ces marchés. Il est fréquent de mettre en avant leur caractère plus rémunérateur. Or, une partie des producteurs qui pourraient effectivement vendre sur ces marchés privilégient les marchés conventionnels. À partir du concept de coûts de transaction, nous montrons le rôle de coûts de négociation et de suivi. Dans notre troisième chapitre, nous posons la question des effets de l’accès à ces marchés sur la diversification des cultures des producteurs, et par là sur la durabilité économique et environnementale de leurs exploitations. À partir des apports de la micro-économie, nos résultats confirment l’effet positif de l’accès aux marchés biologiques.Enfin, notre quatrième et dernier chapitre consiste en une analyse de l’efficacité de ces marchés et des conditions de leur pérennité. Nous proposons une grille d’analyse associant économie de l’information et analyse de la construction de la qualité. Elle nous permet de comparer les différents dispositifs de certification existant au Kenya. L’analyse montre que le dispositif le moins efficace est celui qui est amené à se développer, posant ainsi la question de la pérennité des marchés biologiques domestiques kenyans. / Over the past two decades the organic agro-food system has been transformed, extending beyond Northern countries and expanding in many so-called developing countries.This dynamic was first a positioning on high added value products’ export markets. Since several years, domestic markets have emerged in a growing number of developing countries, including Kenya. This thesis attempts to shed light on the dynamics explaining these new markets’ emergence and development. The research is based on four questions. The first one concerns the way organic transactions have been organized in Nairobi. Based on neo institutional economics, we explain how, in the absence of credible certification systems, these products are able to be sold with premium. The second question deals with the conditions of producers’ access to these markets. It is common to highlight that organic domestic Kenyan markets are more profitable than conventional ones. However, some producers, who could actually sell in these markets, prefer conventionalones. Thanks to the concept of transaction costs, we show the role of negotiation and monitoring transaction costs. Chapter 3 analyses the effects of selling on organic market on crops’ diversification, as a proxy of economic and environmental sustainability .Based on microeconomics’ contributions our results confirm the positive effect of organic markets. Finally, our fourth and final chapter provides an analysis of the conditions of these markets sustainability. We propose an analysis grid combining economy of information and quality construction approach, based on Hirschman (1970) works.This grid helps us comparing different certification and verification schemes existing in Kenya. Analysis shows that the least effective scheme is the one that is bound to grow,raising the question of the sustainability of Kenyan domestic organic markets.

Energy Performance Certification and Green Building : A comparison between the environmental effect and the discharge of carbon dioxide

<p>The major climatic problem has been worsening extremely rapidly over the last decades and if no measures are taken soon, we will experience severe consequences over the years to come. It is therefore imperative to take instant actions to slow down the climatic changes that are also causing crucial health problems in different parts of the planet. The basis of this thesis is that both Energy Performance Certification (EPC), and Green Building (GB) aim to reduce carbon dioxide emission within the building sector which accounts for more than 40% of the total energy use both locally and globally. This thesis discusses and compares the environmental impacts made by Green Building and Energy Performance Certification in order to evaluate how different or similar they are in terms of energy performance efficiency of buildings.</p><p> </p><p>In order to accumulate as much facts and resources possible, research was done to find reliable internet sources and relevant books which took approximately two weeks. The rest of the ten weeks that were assigned for this project were spent writing this thesis while taking practical part in an Energy Performance Certification process and evaluation. There are three questions that this thesis is aimed to answer, which are:</p><p>-               How is Energy Performance Certification beneficial for our community welfare?</p><p>-               Why should owners/occupiers choose to transform their houses/buildings to Green Building certified constructions?</p><p>-               Is there a way of combining Energy Performance Certification with Green Building?</p><p> </p><p>There are many benefits that our Swedish and European Community can gain from applying Energy Performance Certification of building according to the Directive, including reducing carbon dioxide emission and introducing alternative and renewable sources of energy. As to whether GB is better than EPC or vice versa, there is ultimately a very fine line that divides the two. When comparing new constructions of EPC with new constructions of GB the only benefits that can be gained from GB are firstly that the buildings are guaranteed to be completely environmental friendly, and secondly that the owner/occupier may choose between four different levels of certifications. Other than that, they both have many similar beneficial factors which make it difficult to a state if one of them is better than the other.</p><p> </p><p>Lastly, it is very possible to combine the two into one complete standard, but only for new constructions. The energy performance of old existing buildings is much more difficult to improve due to e.g. the high costs involved or the cultural value of the constructions. Nevertheless, this may very well change in the further future when the rapidly improving technology within the building sector will hopefully contribute to finding cost- and energy-efficient solutions for existing buildings that will consequently contribute to GB and EPC being able to combine their regulations and make one single standard that can be applied in all the Member States, or if possible in the entire European Union Community.</p> / <p>De allvarliga klimatproblemen har förvärrats i oerhört snabb takt under de senaste decennierna och om inget görs snart, kommer vi att få uppleva allvariga konsekvenser under de kommande åren. Exploring professional development experiences of the professionally unqualified practicing teachers in rural secondary schools.

Attempts to address global pressure to achieve Education For All (EFA) have been hampered by two fundamental challenges in developing countries, namely an acute shortage of teachers and the large rural populations in these countries. In addition there is a trend for qualified competent teachers to shun working in rural settings. While recruitment of professionally unqualified graduate teachers into the teaching profession has become internationally accepted, to address particularly rural school postings and EFA commitments, there remain outstanding questions regarding how such teachers grow and develop in those rural contexts. An understanding of how these teachers develop professionally is crucial. The study explored professional development experiences of professionally unqualified practicing teachers in rural secondary schools. Through a double site study involving two international sites, Zimbabwe and KwaZulu–Natal, South Africa, an interpretive/qualitative design was adopted. Three-interview series supported by document reviews and photo elicitations were employed to explore these teachers’ experiences. Data was transcribed and manually analysed inductively utilizing open coding. The findings suggest that professional development for these teachers occurs in a number of sites, namely: through the Post Graduate Certificate in Education (PGCE) / Post Graduate Diploma in Education (PGDE) programme; in the school through practice and school meetings; in the wider professional sites; and in informal communities. Drawing on Cultural Historical Activity Theory to describe, analyse and understand data, I argue that the professionally unqualified practicing teachers experience professional development through interaction in multiple domains of formality and experience: formal, non formal, informal and experiential. Professional development occurs across these domains however, findings show that these teachers feel incapacitated by lack of support. This implies a need for more supervisory and resource support. The teachers conceive their professional development experiences in rural secondary school contexts as underpinned by having to ‘make-do’, relational dimensions, interdependence and agency as well as resourcefulness, creativity and improvisation to address gross resource limitations. The thesis suggests a need for further research into enhancing professional development practices of the professionally unqualified practicing teachers in rural school settings. Professional development can be supported. Given that teachers are teaching in under resourced and geographically rural contexts where they have ‘to make-do’, this has a bearing on the achievement of EFA goals within the wider context. In relation to the Cultural Historical Activity Theory, my argument is that the framework provides a useful generic, analytical tool for thinking through how professional development occurs in multi-domains. However, on its own it does not provide a complete lens to make sense of the variations in professional development within the domains and levels of formality and experience. The thesis therefore argues for an additive model to CHAT, which includes domain based distinctions of formality and experience that may expand the framework and deepen its applicability specifically, in trying to understand professional development issues. Un e-portfolio est généralement défini comme étant une collection d’informations qui illustre la scolarité, l’apprentissage ou la vie professionnelle d’une personne à travers une sélection de résultats marquants au cours de formations ou d’études, mais aussi qui regroupe les réflexions personnelles de l’apprenant sur son apprentissage, son parcours, la planification d’une carrière ou la construction d’un CV. Tout au long de cette étude nous avons chercher à comprendre à travers une analyse ciblée des besoins comment l’apprenant peut mettre en avant une démarche réflexive tout au long de son parcours. Il s’agit aussi de comprendre comment les e-portfolios de présentation pourraient se démarquer et offrir un véritable outil de placement aux étudiants comme aux recruteurs. Pour tenter de répondre à ces questions, nous avons procédé à des entretiens avec les recruteurs et les étudiants en vue de comprendre leurs attentes. L’ensemble des informations recueillies on permis de créer une maquette fonctionnelle sur laquelle ils ont pu interagir. Les éléments d’analyse issus de ces rencontres et des tests d’utilisabilité de l’outil nous ont permis de mettre sur pied une maquette finale. / Based on the human-machine ergonomics methodology, this study deals with how e-portfolios of presentation could be implemented in the University. An e-portfolio can be defined as a structured amount of information displaying the education, learning and working experience of a person in relation to a selection of outstanding results. It also includes personal reflections on the learner on those accomplishments, on his career plan, on his working experience or simply on his resume. With a focused needs’ analysis, we try to understand how learners could put forward a reflexive thinking throughout their career. Also, we try to figure out how e-portfolios could become an effective investment tool for students as well as for employers. To answer these questions, we have made many interviews with employers and students in order to assess and understand their expectations. The sum of collected information has helped us to design a primary model on which they will be able to interact each other. After that phase, and according to all the usability tests conducted on that model, we developed the final model for an e-portfolio.

Le document technologique original dans le droit de la preuve au Québec

L’adoption de la Loi concernant le cadre juridique des technologies de l’information en 2001 a permis de mettre en place un cadre juridique favorisant l’intégration des technologies de l’information dans le droit. Plus particulièrement en droit de la preuve, cela a conféré au document technologique la qualité d’élément de preuve. Dans ce contexte il a été nécessaire d’adapter certains articles du Code civil du Québec et du même fait certaines règles dont la règle de la meilleure preuve, telle que prévue à l’article 2860 C.c.Q.. Cette règle s’appuyait jusqu’à présent sur la notion d’original, notion propre au support papier dont il a fallu trouver un équivalent pour le document technologique. C’est ce qu’a fait la Loi en prévoyant à son article 12 les caractéristiques de l’original technologique. Nous nous penchons sur cette notion en regardant quelles sont ses origines et ses justifications, puis nous avons analysé l’article 12 de la Loi qui traite de l’original sous forme technologique. Enfin nous nous sommes interrogé sur la place des reproductions dans le contexte technologique et nous avons vu que celles-ci ont pris de plus en plus d’importance à côté du document original, au fur et à mesure du perfectionnement des moyens de reproduction. / The adoption, in 2001, of the Act to Establish a Legal Framework for Information Technology (the Act) allowed the establishment of a legal framework facilitating the integration of Information Technology in law. More specifically in law of evidence, this allowed for the recognition of the technology-based document as evidence. In this context, it was necessary to adapt certain sections of the Civil Code of Québec and, thus, certain rules, among which the best evidence rule, set forth in Section 2860 C.C.Q. Until the Act, this rule relied on the original, a concept specific to the paper medium; consequently, it became necessary to find an equivalent for the technology-based document. This was done by Section 12 of the Act, which sets out the technology-based original’s characteristics. We will look into this concept’s origins and rationale, before analysing Section 12 of the Act, which addresses the original in a technological form. We will then examine the reproductions’ place in the technological context, and ascertain their growing importance beside that of the original document’s, as the means of reproduction continuoulsy improved.
