Process and Meaning : A Coverian Analysis of Animal Defenders International v. UK and the Procedural Turn of the ECtHRSkagerlid, Arvid January 2021 (has links)
In this thesis, the legal theory of Robert Cover is employed to analyse the procedural turn of the ECtHR. The text studies how Animal Defenders International v. the United Kingdom (ADI) and subsequent case law relate to the margin of appreciation doctrine and how this can be understood from a Coverian point of view. The margin of appreciation is thus seen as a product of an interplay between paideic and imperial forces where the imperial, or world-maintaining, influences on the doctrine are the strongest. ADI and later cases are read as further accentuating the focus on the nomos of the state relative to competing nomoi already at work in the case law of the procedural turn. The thesis is closed with an amalgamation of Cover’s ideas with the democratic theory of Jacques Derrida which results in a discussion on what a Coverian re-evaluation of the approach outlined in ADI could look like.

The aim of this study is to explore heritage processes within contemporary urban planning in Sweden, which is done through a single-case study. The point of departure for the study is the management of Havrekvarnen, an early modernist industrial building within an urban development area of Nacka, Sweden. Through parallel decisions by the County Administrative Board and the local Municipality in 2016, the building was firstly, listed with the strongest legal, cultural, and historical protection available, and secondly, the municipal urban regulations were changed so that the landowner was given permission to pursuit a reconstruction of the building, replicating its original appearance. As such the case constitutes a hitherto unique example of a listed future reconstruction in Sweden. The study examines how the process took place, focusing on actors and critical junctures involved in the execution and how the description of the building's heritage-values changed. The study uses a composite theoretical framework of authorized heritage discourse and actor network theory. To this an explaining-outcome process tracing is applied as method. Through a sequential process of collecting empirical data, in the form of archival records and interviews, the process was mapped through the conceptualization of a causal mechanism. The method had not previously been used in the field of art history and was chosen as such with a tentative approach. The study gives an extensive presentation of the legal and practical framework surrounding heritage processes within urban planning in Sweden, as well as puts the study within a local historical context. The results of the study show that within the observed case, a trade-off situation between authenticity and aesthetic historical values arose, caused by the poor technical condition of the building: the aesthetic values were deemed to take precedence in the assessment. The study also shows how antiquarian consultants have had a decisive influence on the process of legislative enabling of the reconstruction of Havrekvarnen. The research design’s use of process tracing to map heritage processes is thus deemed useful for future enquiries within the field of art history and heritage studies.

This diploma thesis examines changes, which the Czech-German Future Fund went through during its almost 20 years of functioning. The first part the author dedicated to theoretical concepts, which shed light on study of the Czech-German Future Fund. These theoretical concepts are reconciliation and public diplomacy. Thereafter are in tis thesis described efforts to compensate victims of National Socialism in Czechoslovakia and in the Czech Republic. This part of thesis is followed by description of the Czech-German Future Fund and its history. Based on this German-Czech Declaration of Mutual Relations and their Future Development of 1997 was the fund's mission to compensate victims of National Socialism, who didn't receive a compensation until then. The fund fulfilled this mission after 10 years of its function and also went through by many changes during almost 10 years of its functioning. The author describes these changes on which is based description of the project policy development of Czech-German Future Fund. After that the diploma thesis concentrates on changes in individual fund project groups, which are supported by the fund. L'obiettivo del presente lavoro è quello di esaminare criticamente le prospettive teoriche più note sul problema delle relazioni tra sviluppo concettuale del bambino ed acquisizione della prima lingua. Per quanto il lavoro si concentri in particolare sullo sviluppo della componente lessicale, ovvero sul legame tra concetti e apprendimento delle parole con cui gli stessi vengono codificati, verranno necessariamente trattati anche alcuni aspetti relativi alla competenza morfologica e sintattica. Dopo aver presentato sinteticamente le principali teorie proposte nell'ambito della linguistica acquisizionale e della psicologia dello sviluppo, procederemo ad una problematizzazione e discussione dei punti critici delle stesse alla luce dei risultati ottenuti in sede sperimentale negli ultimi anni. Partendo dalla consapevolezza che nell'ambito della linguistica, forse ancor più che in altre discipline, il contrasto tra impostazioni teoriche diverse si traduce spesso in discrepanze significative nell'interpretazione degli stessi dati empirici, abbiamo cercato di dare lo stesso spazio ai vari orientamenti teorici. L'obiettivo di questa tesi, infatti, non è quello di dare giudizi di merito sulla validità di una teoria in quanto tale rispetto ad un'altra, quanto di discutere in modo trasversale i nodi più problematici delle varie teorie e le implicazioni delle stesse. Questo intento è particolarmente evidente nelle conclusioni della tesi, strutturate intorno ad una serie di domande di ricerca. / This work provides a critical overview of the major theoretical perspectives on the relationships between conceptual development and first language acquisition. While our focus is on lexical development (ie. on the relation between learning a word and acquiring the relevant concept), we will also touch on some aspects which pertains more specifically to morphological and syntactical development. After briefly introducing the major theories developed in the field of first language acquisition and developmental psychology, we will discuss them in the light of experimental data collected in recent years. As the same empirical findings tend to be interpreted in completely different ways, in our work we tried to give voice to authors supporting different views. Our goal is not to assess the merits of these theores as such, but to take this comparison as an opportunity to discuss the implications and issues thereof. This will be particularly clear in the Conclusions of our work, which are structured as a series of research questions.

Business men find this a very valuable means of doing business when time means money. The motion pictures bring us the story of the book we have not had time to read and the characters from its pages talk to us from the screen. In short, we must have quicker ways of doing things.
