The thesis analyzes selected issues in the U.S. criminal justice system, and the solutions proposed by American libertarians. First, it introduces libertarianism as a whole, based on both contemporary and historical sources. The thesis then examines the real influence of libertarians on U.S. politics, and the possibility that libertarian proposals might be adopted. It analyzes the successes of the U.S. Libertarian Party and introduces movement and factions in the two major parties, Republican and Democratic, and today's influential politicians who at least partially promote libertarian proposals. In the final, pivotal chapter, the thesis uses the theoretical base provided in the first chapter to analyze the shortcomings of the U.S. criminal justice system, and the solutions and changes that libertarians propose. The structure of this analysis follows the generally accepted structure of the system itself, dealing with criminal law and its enforcement through policing, courts and corrections. On each of these levels, the thesis introduces both the libertarian critique of today's system and examples of specific issues and proposed solutions. La recherche démontre que les personnes en situation d’itinérance (PSI) sont contrôlées, exclues, (sur)judiciarisées et qu’elles sont confrontées à de nombreux obstacles lorsqu’elles se retrouvent devant les tribunaux (accès à un avocat, capacité à négocier, sentences mésadaptées, etc.). Toutefois, malgré leur influence sur les procédures judiciaires et l’accès à la justice, nous en savons peu sur le travail des avocats de la défense qui représentent les PSI. Comment identifient-ils une situation d’itinérance (visible ou cachée) et de quelle manière adaptent-ils leur pratique lorsqu’ils travaillent avec cette clientèle ? Quelles stratégies utilisent-ils pour négocier avec les autres acteurs impliqués (procureurs, juges, intervenants socio-judiciaires, etc.) aux différentes étapes du processus judiciaire, notamment le cautionnement et la détermination de la peine ? Enfin, dans quels contextes collaborent-ils avec les programmes de justice thérapeutique et quels sont les impacts de leurs interactions avec les parties prenantes non juridiques, comme les travailleurs sociaux ou les intervenants communautaires ? Pour répondre à ces questions, je me base sur les données provenant d’entretiens semi-dirigés réalisés auprès d’avocats de la défense criminelle et pénale (N=41) œuvrant dans la région du Grand Montréal (Montréal, Laval, Longueuil) entre juillet et décembre 2021. Suivant une analyse de type « codebook » fondée sur les entretiens et la littérature socio-légale, je soutiens que les avocats qui représentent des PSI sont limités dans leur capacité de négociation, principalement en raison du manque de ressources (sous-financement de l’aide juridique, manque de logements abordables, de services en santé mentale et de thérapies, etc.) ainsi que du fonctionnement même du système judiciaire (rythme expéditif, emphase mise sur la responsabilité individuelle, etc.). Afin de pallier les obstacles, ils sont appelés à remplir diverses tâches extrajudiciaires (accompagnement pour la demande d’aide juridique, référencement vers ressources psychosociales, collaboration avec intervenants, etc.), allant parfois jusqu’à adopter un rôle s’apparentant à celui d’un travailleur social. Ces constats soulignent l’importance de modifier les lois qui ciblent disproportionnellement les PSI, d’investir dans le soutien communautaire et d’offrir les outils nécessaires aux professionnels du droit afin qu’ils puissent dégager des alternatives à la judiciarisation non seulement des PSI, mais aussi de plusieurs accusés socio-économiquement défavorisés et/ou marginalisés. / Research shows people experiencing homelessness (PEH) are controlled, excluded, (over)criminalized and that they face many obstacles when they find themselves in court (access to a lawyer, ability to negotiate, inappropriate sentences, etc.). Despite the influence they have on legal proceedings and access to justice, we know little about the work of defense lawyers representing PEH. How do they identify who is experiencing homelessness (visible or hidden) and how do they adapt their practice when working with this clientele? What strategies do they use to negotiate with other actors involved (crown attorney, judges, socio-judicial stakeholders, etc.) at different stages of the judicial process, in particular bail and sentencing? Finally, in what contexts do they collaborate with therapeutic justice programs and what are the impacts of their interactions with non-legal actors, like social workers or community stakeholders? To answer these questions, I rely on data from semi-structured interviews conducted with criminal defense lawyers (N=41) working in the Greater Montreal area (Montreal, Laval, Longueuil) between July and December 2021. Following a “codebook” type analysis based on interviews and socio-legal literature, I argue that lawyers who represent PEH are limited in their ability to negotiate, mainly due to lack of resources (underfunding of legal aid, lack of affordable housing, mental health services and therapies, etc.) as well as the very functioning of the judicial system (fast pace, emphasis on individual responsibility, etc.). To overcome these obstacles, criminal defense lawyers are called upon to perform various extrajudicial tasks (accompaniment for the application for legal aid, referral to psychosocial resources, collaboration with community organizations, etc.), sometimes going as far as adopting a role similar to the one of a social worker. My findings underscore the importance of modifying laws that disproportionately target PEH, investing in community support and providing the necessary tools to legal professionals so that they can find alternatives to the criminalization not only of PEH, but also of several socio-economically disadvantaged and/or marginalized defendants.

government courts. It argues that since the Constitution of the Republic of South Africa
Act no 108 of 1996 has given everyone the right to use the language of his or her
choice, all official languages must be used equitably in conflict resolutions in divorce
discourse in both traditional and government courts. Most of the Vhavenḓa, especially
the elderly, cannot speak more than one official language and this is relevant in conflict
resolution. This thesis contends that conflict resolution in divorce discourse is mainly
dominated by English and Afrikaans while Tshivenḓa as well as sign language is not
used. Instead of enjoying the freedom of utilizing Tshivenḓa as a spoken official
language as used by the court interpreter. Therefore, this thesis argues that time has
come that government courts accord equal status to all official languages and that
Tshivenḓa language should be utilized as English and Afrikaans in conflict resolution in

La perspective européenne a renouvelé l’intérêt de la question du maintien ou de la suppression du dualisme juridictionnel en France à travers deux approches : la résistance aux modèles concurrents d’organisation juridictionnelle d’une part, le crible des standards européens d’autre part. Considéré comme un modèle d’organisation juridictionnelle, le système français a inspiré la majorité des Etats européens. Le phénomène a néanmoins été temporaire. Désormais, la plupart des Etats européens ont un système d’organisation juridictionnelle qui se rattache à un autre modèle. Engager le système français dans une telle voie est juridiquement faisable mais peu opportun en pratique. Le système français en tant que modèle – quoique minoritaire – d’organisation juridictionnelle a donc vocation à perdurer. Sur un autre front, l’alignement du système français sur les standards européens a également fait émerger l’hypothèse de sa suppression. Les condamnations, réelles ou potentielles, de la juridiction administrative et du procès mené devant elle, ainsi que du Tribunal des conflits et de la procédure suivie devant lui, ont montré que les réformes étaient inévitables et imposé de revenir sur des pratiques séculaires bien établies. Elles ont également contribué à rapprocher la juridiction administrative de la juridiction judiciaire et le procès administratif du procès civil. « Sauvé » au prix de nombreuses transformations, le système n’en est pas moins parvenu à préserver ses caractéristiques essentielles, prouvant sa capacité d’adaptation. Un temps affaibli, le dualisme juridictionnel n’a, en définitive, pas été altéré. Mieux, son fondement technique, justification contemporaine du dualisme juridictionnel, en est sorti renforcé. / The European perspective has shed new light on the question of whether maintaining or ruling out jurisdictional dualism in France through two main approaches: on the one hand, the resilience of substitutable models and, on the other hand, the scrutiny of European standards. Considered as a model, the French system has inspired the majority of states in Europe. This wave of inspiration has nevertheless been short-lived. Indeed, most states in Europe have established a judicial system, which is different from the French model. Bringing the French system towards the one adopted by most states in Europe is juridically feasible but raises several issues in practice. As a result, the French system, albeit minor amongst the European states, is probably prone to live on. Furthermore, bringing the French system towards European standards raised the question of a likely end of it. In fact, the French system came under critics, whether effective or potential, of its administrative courts and legal proceedings, together with critics concerning its so-called “Tribunal des conflits” and the legal proceedings. These critics point to the fact that reforming the French system was inevitable. Such reforms led the French system back on some of its secular anchored practices. Eventually, reforms also contributed to bring closer both the administrative court and the administrative legal proceedings to both civil court and civil legal proceedings. Saved at the cost of numerous reforms, the French system nevertheless managed to preserve its basic structures. This in turn provides evidence that the French system is able to adapt itself to an evolving European environment. Finally, the technical founding principles of jurisdictional dualism have been reinforced.

The cultural revitalisation or adjustment model of Anthony Wallace provides a basis for
interpreting religious, political and other revitalisation movements. This study focuses on
political revitalisation movements. Participation in the activities of revitalisation movements does
not always occur voluntarily. Leaders of such movements apply techniques and methods of
intimidation enforcing change and participation. In South Africa, political revitalisation was
inter alia brought about by the ANC as political liberation movement who used methods of
violent and non-violent intimidation to force people, regardless of their ethnic affiliation, to
support the movement and enforce political change. The ANC inter alia used charactersitic
cultural phenomena and components of Bantu-speakers as resources for intimidation to ensure
unanimity, participation and ultimately to achieve political liberation. Cultural components that
were exploited included communality, group solidarity, administration of justice, songs and

Text in Afrikaans / This study is about the provision of a prototype court preparation programme for the primary school child that had been sexually assaulted. The programme is developed from a Gestalt approach.
Literature regarding several existing court preparation programmes was studied and compared in order to identify certain themes for the child's preparation. Knowledge regarding the court, procedures and the functions of the various role players was conveyed to the child with emphasis on the child's role as witness. The research strategy utilised in the study was that of the intervention research and specifically the D&D-model that comprises six phases. The study incorporates the first three phases plus the first step of the fourth phase. Semi-structured interviews and focus groups were utilised to establish which themes could be addressed to support the child towards being a credible witness. In this project the various International Instruments, namely the United Nations Convention of the Rights of the Child; 1989, the Beijing Rules and the African Charter, relating to the guidelines of the establishment of a minimum age for criminal capacity are furnished. The developments regarding the issue of criminal capacity since 1998 in Australia, the United Kingdom and Hong Kong are highlighted. The historical position and the current position in South African law with regard to the issue of criminal capacity are discussed as well as the implementation
thereof by our courts. The statistics on children under 14 years in prison over the past five years are furnished. The introduction of the Child Justice Bill, 2002 by Parliament and the deliberations following the introduction, focusing on the issue of criminal capacity is highlighted. The proposed provisions of the Child Justice Bill, 49 of 2002 codifying the present common law presumptions and the raising of the minimum age for criminal capacity are furnished. The evaluation of criminal capacity and the important factors to be assessed are discussed as provided for in the Child Justice Bill, 49 of 2002. A practical illustration of a case where the criminal capacity
of a child offender was considered by the court is, discussed and other important developmental factors that should also be taken into consideration by the court are
identified and discussed. Important issues relating to criminal capacity, namely, time
and number of assessments, testimonial competency of the child offender, evolving
capacities and age determination are discussed and possible problems identified and some solutions offered. The International Criminal Tribunal for Rwanda's approach to serious violations of humanitarian lawMutabazi, Etienne 11 1900 (has links)
On October 1, 1990 the Rwandan Patriotic Front launched a war from and with the support of the Republic of Uganda against Rwanda. This war was accompanied by unspeakable violations of International Humanitarian Law. Both conflicting parties violated the basic rules protecting the civilian population in situations of armed conflicts. The United Nations Security Council, acting under Chapter VII of its Charter, passed resolution 955 of November 8, 1994 establishing the International Criminal Tribunal for Rwanda to prosecute alleged responsible of such violations.
This study investigates the background of the ICTR and questions the nature of the conflict that prompted the Security Council to establish another ad hoc international criminal tribunal after the one established for the former Yugoslavia. It further inquires into its jurisprudence and reflects critically on the ICTR's approach to serious violations of IHL under Article 3 Common to the Geneva Conventions and Additional Protocol II. / Jurisprudence / LL. Text in Afrikaans with summaries in Afrikaans and English / For many years divorce has been viewed exclusively as a legal problem that had to be addressed by the courts in our adversarial system of litigation. Divorce, however, also entails social problems which are not addressed in our legal system. It appears further that our adversarial legal system tends to heighten the conflicting interests of individual family members at divorce and to encourage animosity and irreconcilability.
In an attempt to ameliorate the harsh consequences of the adversarial legal system at divorce, two no-fault grounds for divorce were introduced to enable divorcing spouses to make the decision about the termination of their marriage themselves. This greater freedom that no-fault divorce afforded parties quickly led to a demand for a new system of dispute resolution at divorce. The Hoexter Commission consequently, recommended the establishment of a family court with a social component where mediation services are offered. In both Australia and New Zealand the introduction of no-fault divorce was attended by the establishment of family courts where mediation services are offered. In mediation the parties involved, with the assistance of an impartial third, may sort out and find solutions to all their divorce-related problems. It also appears that mediation has always played a prominent role in the resolution of family disputes in the indigenous communities of South Africa.
Owing to financial restrictions, South Africa is still without a family court. So far, only the Mediation in Certain Divorce Matters Act 24 of 1987 has emanated from the recommendations of the Hoexter Commission. This Act, which provides for the institution of enquiries by the office of the family advocate to determine the best interests of children at divorce, professes in its title to have introduced mediation as an alternative system of dispute resolution at divorce. From the contents of the Act it is apparent, however, that it provides for mediation only in a very limited sense. Consequently, it is necessary to amend this Act to make provision for real, comprehensive and accessible mediation services for the public in all family law disputes. This amendment could best be achieved by regulating existing private and community mediation services and integrating them into the formal legal process. / Egskeiding is baie jare lank as 'n regsprobleem beskou wat in ons adversatiewe stelsel van

dispuutbeslegting by egskeiding geskep. Die Hoexterkommissie het gevolglik aanbeveel
dat 'n gesinshof met 'n maatskaplike komponent ingestel word waarby onder andere
bemiddelingsdienste beskikbaar meet wees. In sowel Australie as Nieu-Seeland het die
invoering van skuldlose egskeiding inderdaad gepaardgegaan met die instelling van
gesinshowe waar bemiddelingsdienste beskikbaar is. In die bemiddelingsproses kan
mense self, maar met die bystand van 'n onpartydige derde, al hulle probleme by
egskeiding uitsorteer en oplos. Dit blyk verder dat bemiddeling nog altyd 'n prominente rol
by die beslegting van gesinsgeskille in inheemsregtelike gemeenskappe in Suid-Afrika
gespeel het.
Weens finansiele beperkings is Suid-Afrika nog steeds sonder 'n gesinshof. Al wat tot
dusver uit die Hoexterkommissie se aanbevelings voortgevloei het, is die Wet op
Bemiddeling in Sekere Egskeidingsaangeleenthede 24 van 1987 wat daarvoor voorsiening

belange van kinders kan instel. Alhoewel die titel van die Wet voorgee om vir bemiddeling
as 'n alternatiewe stelsel van dispuutbeslegting by egskeidng voorsiening te maak, blyk dit
uit die inhoud van die Wet dat dit bloot vir 'n baie beperkte vorm van bemiddeling voorsiening maak. Dit is gevolglik nodig dat hierdie Wet gewysig word om by alle
familieregtelike kwessies vir ware, omvattende en toeganklike bemiddelingsdienste aan die
publiek voorsiening te maak. Die geskikste wyse waarop dit bewerkstellig kan word, is om
bestaande private en gemeenskapsbemiddelingsdienste te reguleer en in die formele
