Ce travail de thèse traite du problème de surveillance en ligne de défaillances électriques dans les entrainements électriques à base de machines synchrones à aimants permanents (MSAP) par une méthode de suivi paramétrique. Les défauts de court-circuit entre spires au stator sont souvent critiques et doivent être détectés au plus tôt avec un bon taux de confiance afin d’informer un système superviseur de la présence d’une défaillance pour limiter les risques encourues par l’environnement matériel et humain situé autour de la machine en défaut. La méthode que nous proposons de mettre en œuvre pour la détection des courts-circuits statoriques est basée des techniques d’identifications récursives. Nous proposons d’identifier en ligne les paramètres d’un modèle diphasé électrique de l’actionneur synchrone et d’analyser les variations des paramètres identifiées lors de l’apparition d’un défaut. Pour assurer les performances des méthodes d’identification, il est souvent nécessaire de disposer d’un signal d’excitation additionnel pour assurer les bonnes performances des algorithmes. Ces signaux peuvent cependant perturber le fonctionnement normal de la machine et entrainer des pertes additionnelles. Dans ce contexte, nous proposons une approche par identification faisant appel à un modèle diphasé spécifique appelé « le repère de Park à courants orientés ». Ce repère permet, tout en réduisant la complexité du problème d’identification, d’obtenir des propriétés d’auto-excitation intéressantes et donc d’éviter l’utilisation d’une excitation additionnelle. Des simulations sont menées à l’aide d’un modèle fin de la machine permettant de reproduire des situations de défaillances de manière virtuelle et d’éprouver l’efficacité des algorithmes dans ces situations dégradées. Cette machine, pouvant fonctionner en générateur ou en moteur, est intégrée dans un environnement complet, incluant le cas échéant une alimentation, une charge mécanique et éventuellement une commande, ce qui permet également de tester les algorithmes pour des fonctionnements en boucle ouverte et en boucle fermée. Les résultats présentés permettent de valider les techniques proposées et montrent qu’elles permettent d’extraire automatiquement, à partir des variations des paramètres identifiés, un indicateur de défaut. Des résultats expérimentaux sont également présentés en fonctionnement générateur sur une machine spécialement re-bobinée pour permettre la réalisation de défaut statoriques. Les algorithmes sont implantés sur une cible de calcul numérique afin de démontrer la faisabilité temps réelle de la détection / This work deals with the on-line monitoring of electrical faults in permanent magnet synchronous machine (PMSM) by parameter monitoring method. The inter-turns short-circuits faults in stator are often critical and have to be detected as early as possible with a high confidence rate to inform the supervisor system of the fault presence in order to limit the risk for the material and human environment. The proposed method is focus on the detection of short-circuits in stator and based on recursive identification technique. The on-line parameter identification uses an electrical diphase model of the PMSM and the analysis of the estimated parameter variations is performed to detect the presence of stator faults. In a general way, to ensure the performance of identification algorithms, it is necessary to have additional excitation signals. Consequently, those signals could disturb the normal operation of the drive. To overcome this problem, a specific diphase model in currents oriented Park reference frame is introduced for identification process. By reducing the complexity of identification problem, this reference frame provides an interesting auto-excitation property that leads to avoid the utilisation of additional excitation signals. The simulations are performed using an accurate model of PMSM that allows reproducing the failure situation and prove the efficiency of algorithms in degraded situations. This machine, operating as generator or motor, is integrated in a complete environment, included a power supply, mechanical load and control process. The detection scheme is then tested in open and closed loop operation. The results obtained from the simulation process underline the ability of the proposed technique to detect a stator fault occurrence and show that a fault indicator can be extracted automatically from the variation of estimated parameters. Experimental results are also achieved. A PMSM, with a specific winding including additional connexion points for stator short-circuit realisation is used. The algorithms are implemented in a numerical calculator in order to demonstrate the feasibility of the real-time faults detection for a generator operation mode

The Natal Afrikaner and The Anglo-Boer WarWassermann, Johannes Michiel 07 March 2006 (has links)
The invasion by the Boers of Natal set a process in motion that changed the lives of Natal Afrikaners forever. As a group which shared family, cultural, and other ties with the invaders, but were British subjects by citizenship, they had to make a difficult decision: join the Republican forces or remain loyal to the crown. Factors which influenced this decision, amongst others, were the pre-war suspicion of all Natal Afrikaners by the Natal authorities and the prevalence of a general anti-Republican sentiment. Despite the above-mentioned, and the sympathy which existed for the plight of the Republics, very few Natal Afrikaners joined the commandos. Doing that would have meant economic annihilation. This the Natal Afrikaners understood and the majority remained neutral. Matters were complicated when the British Army and the colonial authorities withdrew south, leaving especially the Afrikaners of the Klip River county unprotected. When occupation did not convince the Afrikaners of the area to join, a well-thought out strategy based upon fear and misinformation, brought most into the fray. Duty on these commandoes was generally slack, subversive in nature, and as much as one can expect from people forced into military combat. A small group, however, managed, despite the pressures placed upon them, to remain loyal to Britain. For these loyalists the greatest rewards were in terms of economics and power. In stark contrasts were the economic experiences of the Natal Afrikaners who were somehow, either directly or indirectly, guilty of high treason. All their possessions were systematically looted or destroyed, leaving most of them in an impoverished state. Secondly, through a range of court cases 409 Natal Afrikaners or associated people were convicted of treason, mostly by the purposefully introduced Special Court and special magistrate. The outlined experiences coincided with victimization on socio-political and cultural levels under Martial Law. Afrikaners resident in the southern part of Natal, and especially in Umvoti county, did not suffer directly because of the war but experienced a different kind of war namely a pseudo war in which they were spied upon, viewed with suspicion and under Martial Law harassed. However, these Afrikaners managed to maintain some political power while economically they carried on as before the war. They attempted to use these assets to assist the Afrikaners who had to endure desertion by their own government and Boer occupation. Natal Afrikaners also experienced other aspects of the war normally associated with the Republics. Some were arrested as POWs, while others were deported to concentration camps within the Colony. Furthermore, as a result of the war, relations between Natal Afrikaners and English colonists and Africans suffered. La thèse examine les influences horizontales entre les juges constitutionnels des États membres de l’Union européenne dans l’interprétation de la constitution. Si ces influences s’inscrivent parfois dans la ligne de la mise en œuvre des obligations supranationales communes, elles interprètent surtout l’existence de valeurs partagées entre les États que les juges constitutionnels sont appelés à protéger, voire l’existence d’une identité commune, d’un idéal de justice constitutionnelle qui s’articule autour de la protection de l’État de droit, et en particulier des droits fondamentaux. Ce sont en effet les principes attachés au constitutionnalisme moderne qui animent le plus les échanges entre les juges constitutionnels nationaux. Ce phénomène d’inspiration réciproque est intéressant car il demeure spontané, et souligne la volonté du juge de rejoindre un standard commun qui se consolide progressivement par des interprétations diverses, et traduit la reconnaissance d’une équivalence systémique dans la protection de l’État de droit. L’ordre juridique étranger inspire ainsi le juge national puisqu’il s’aligne au standard national du constitutionnalisme. / Once attached exclusively to their national constitution, nowadays constitutional judges of the member states of the European Union in particular apply norms from different legal systems,. Their openness to foreign law, whether voluntary or not, creates a network of constitutional principles that are common to all national systems and eventually harmonise their interpretation. The European constitutional standards represent the mutual acceptance between two legal orders of their capacity to adequately respect the fundamental values of the constitution, especially fundamental rights, and the convergence of their implementation.

La question prioritaire de constitutionnalité constitue une véritable « révolution » en droit interne, tant au regard des institutions de l’ordre juridique français qu’au niveau de la protection constitutionnelle des droits fondamentaux des citoyens. Ce mécanisme novateur, permettant désormais au Conseil constitutionnel d’opérer un contrôle de constitutionnalité des lois a posteriori, ne peut toutefois fonctionner sans le concours des juridictions ordinaires qui s’érigent désormais en juges du filtre de la constitutionnalité. Or, en prenant le parti d’organiser une telle procédure, le constituant et le législateur organique ont invité officiellement le juge administratif à participer au contrôle de la constitutionnalité des lois. Au-delà de ce premier constat, que la thèse s’attache à étayer in concreto, l’entrée en vigueur de cette nouvelle voie de droit a entrainé une modernisation du droit tant au niveau juridictionnel qu’institutionnel. Celle-ci s’analyse comme la conséquence immédiate du processus de constitutionnalisation des diverses branches du droit qu’accroit de manière exponentielle l’utilisation quotidienne de la question prioritaire de constitutionnalité. Le droit du contentieux administratif, qui voit certaines de ses règles renouvelées sous l’effet de la nouvelle jurisprudence constitutionnelle affectant concomitamment l’office du juge administratif et plus globalement l’exercice de la justice administrative, montre que le juge administratif n’est pas seulement acteur de ce mécanisme mais aussi son sujet / The priority preliminary ruling on the issue of constitutionality is a real "revolution" in domestic law, both in terms of the institutions of the French legal system and at the level of constitutional protection of fundamental rights of citizens. This innovative mechanism, now allowing the Constitutional Council to reviewa posteriori the constitutionality of laws, however, can not function without the help of the ordinary courtswhich are now elevated as judges of the constitutional filter. Taking the party to organize such a procedure, the constituents and the legislator officially invited the administrative courts to participate in the review of the constitutionality of laws. Beyond this observation, which the thesis illustrates concretely, the entry in force of this new remedy has led to a modernization of the law both at the institutional and the jurisdictional levels.This is the immediate consequence of the process of constitutionalisation of the various branches of the law which the daily use of the priority question of constitutionality exponentially increases. The contentious rules before administrative courts, which are renewed under the influence of the new constitutional case law affecting simultaneously the powers of the administrative courts and more generally the exercise of administrative justice, shows the administrative courts are not only the participants of the process but also its subject matter

It especially does not allow us torationally understand all the situations in which we can see its concrete and technical application.Among the different guarantees, defense rights seem to present themselves as a distinct, separate concept. Theyare in themselves a true standard introduced into the substasntive law in the form of a fundamental principlewhere the different guarantees ensure its effectiveness. Contextualizing the Law: Sentencing Decisions of Sexual Assault Cases of Dallas County, 1999-2005Greening, Megan 12 1900 (has links)
The incidence of sexual assault inundates the courts with many cases each year. Given the unique nature of the crime, judges and juries are faced with an array of different scenarios to which they are required to make fair, justifiable and consistent decisions. I examine child sexual assault cases of Dallas County 1999-2005, I look at both legal and extralegal factors including case characteristics, institutional characteristics and characteristics of the defendants and the victims. First, I examine the impact of the independent variables on sentence length using regression analysis to determine influences on sentencing for judges and juries. Second, I examine the same factors using Probit analysis to determine which characteristics make a life sentence more probable for those decision-makers.

An assessment of the constitution of the Evangelical Lutheran Church in southern Africa within the Bill of Rights as enshrined in the South African Constitution Act 108/1996Mashiane, Mafabo Andries Bernard 28 July 2008 (has links)
The constitution of ELCSA was adopted in the constitutional assembly held on 15 to 19 December 1975 at Rustenburg, Tlhabane. The constitution of South Africa was adopted on 08 May 1996 and amended on 11 October 1996 by the constitutional assembly. It is obvious from this situation that the ELCSA constitution was put together and adopted during the rule of the National Party in consideration of the constitution of South Africa at the time. This suggests that the bill of rights was not taken into account when the constitution of ELCSA was written. The church‘s top down management system of administration is questionable. The harmony of rights and the ELCSA constitution was tested. The labour relations requirements are not taken into consideration by the ELCSA constitution given the procedures followed to add in addressing employee disputes. The ELCSA constitution was critically evaluated for compliance. The areas of the South African Constitution that were not considered at the initial stage of the church constitution were identified during the study. It is imperative though that the Church should not find her self-making concessions on issues that are contrary to Christian beliefs and norms that form the basis of the faith. Dr Martin Luther’s two kingdoms provided some guidance when the church was under pressure regarding certain issues that are required by the law of the country. Particularly the church does not condone abortion. In this study it was established that some areas require the church to mobilise and challenge the state. The study is concluded by a discussion of areas that present conflict between the church and legal requirements, areas that the church is omitting to do and areas that the church has to take a stand on. Previous issue date: 2013-09-25 / The present work has the objective of demonstrating the admissibility of the institution of the technical witness, widely used by North American law, in the specialized procedure inscribed by Law 9.009, of 1995, as an immediate way of
accomplishing the fundamental right of access to justice, and, in a mediate way, as the materialization of the principle of human dignity protection. The Federal Constitution, of 1988, imposes the necessary observance of the fundamental
principle in comment, imposing a roll of fundamental rights which, in their essence, aim to assure the enforcement of that commandment. Among the fundamental rights we mentioned, some of them apply in a direct way to processual relations. In this sense, the fundamental right of access to justice emerges with the scope of providing the necessary resources to the attainment of an adequate jurisdictional guardianship,
useful and just, by means of a process which, from its instrumental nature, promotes the accomplishment of that purpose. The creation of specialized procedures turns out
as the manifestation of the mentioned fundamental right, and, thus, the law of special courts strengthens that commandment. However, in virtue of the orality principle, the
evidential production in this procedure suffers certain restrictions, which make it impossible the accomplishment of proof that compromisse the reasonable duration of the procedure, established within the framework of the maxim of orality. Therefore, this work has as object the demonstration of the admissibility of the institution of the technical witness in the specialized procedure of Law 9.009, of 1995, in view of the need of accomplishing the fundamental right of access to justice. For the making of this dissertation we used bibliographical research, including national and foreign
doctrines, as well as national jurisprudence. / O presente trabalho tem como objetivo demonstrar a admissibilidade do instituto da testemunha técnica, comumente utilizado no direito norte-americano, no
procedimento especializado insculpido pela Lei 9.099, de 1995, como forma imediata de efetivação do direito fundamental do acesso à justiça, e, de maneira mediata, como concretização do princípio da proteção à dignidade humana. A Constituição
Federal, de 1998, impõe a necessária observância ao princípio fundamental em comento, impondo um rol de direitos fundamentais que, em sua essência, visam assegurar a efetivação daquele mandamento. Dentre os mencionados direitos fundamentais, alguns se aplicam de forma direta às relações processuais. Surge, nesse sentido, o direito fundamental do acesso à justiça com o escopo de prover
subsídios necessários à consecução de uma tutela jurisdicional adequada, útil e justa, por meio de um processo que, a partir de sua natureza instrumental, promova a realização de tal finalidade. A criação de procedimentos especializados verifica-se como manifestação do direito fundamental mencionado, e, sendo assim, a lei dos juizados especiais vem fortalecer o referido mandamento. Entretanto, em virtude do princípio da oralidade, a produção probatória nesse procedimento sofre

Em um primeiro momento, examina-se a previsão normativa desse preceito. Em seguida, realiza-se uma pesquisa de jurisprudência para verificar se o posicionamento dos tribunais superiores e estaduais se encontra em consonância com a previsão do principio no piano normativo e teórico Optou-se por abordar este tema em virtude da escassez de trabalhos no pais que tratam do assunto, cujo estudo é de fundamental importância para o desenvolvimento da arbitragem. A regra da competência-competência confere eficácia e celeridade ao instituto, porquanto afasta a interposição de medidas antiarbitragem e de medidas procrastinatórias pela parte que não tem interesse na instauração do procedimento arbitrai. 0 principio da competência-competência, previsto 8°, paragrafo único, da Lei n° 9.307/96, confere aos árbitros a prerrogativa de apreciar, em primeiro lugar, eventuais questionamentos acerca da validade, existência e eficácia da convenção arbitrai, postergando o controle estatal ate o término da arbitragem. Este estudo, portanto, além de analisar o modelo de regulação desse principio no Brasil, busca examinar se o Judiciário tern interpretado este preceito, se de fato respeitam a prerrogativa do tribunal arbitral de analisar regularidade de seus poderes de forma antecedente, em relação ao Judiciário. L'évolution des rapports entre le juge et l'arbitre au regard des récentes réformes en droit de l'arbitrage québécois : les compétences exclusives et non exclusives du juge étatiqueKoffi, Ange Marina N'gbo 04 1900 (has links)
L'arbitre représente le juge dans la procédure d’arbitrage: il tranche, juge et détient la balance de la justice dans cette procédure. Bien que ses décisions soient des sentences arbitrales, elles n’ont pas la force exécutoire d’un jugement judiciaire qui impliquerait une sanction en cas de non-exécution de celle-ci par la partie contre laquelle elle a été rendue. Ainsi, les thèses selon lesquelles les rapports du juge et de l’arbitre sont conflictuels, selon lesquelles les pouvoirs attribués à l’arbitre pour mener sa mission à terme et le principe d’incompétence du juge étatique dans le déroulement d’un arbitrage interne ou international, deviennent réfutables. Soumises pour contrôle et à l’appui du juge étatique, l’instance arbitrale et la sentence arbitrale s'intègrent dans l'ordre juridictionnel. Elles doivent cohabiter ensemble dans une même atmosphère juridique. Le juge dans cette optique a l’obligation de protéger et de respecter la volonté des parties, tout en veillant au bon déroulement de la procédure arbitrale. Ainsi, au regard, des nouvelles réformes en arbitrage en vigueur au Québec, en France et dans plusieurs autres États, les rapports entre les tribunaux judiciaires et l’arbitrage ont évolué vers l’entente, la collaboration et la complémentarité.
De plus, les textes légaux et les règles qui gouvernent la procédure arbitrale sont d’une grande importance dans notre exposé, car elles contribuent à la démonstration de ces nouveaux rapports. Ce sont, en effet le respect des règles et la possibilité pour les parties de les manipuler qui rendent l’arbitrage attrayant.
Le présent mémoire vise à démontrer l’évolution des rapports entre le juge et l’arbitre au regard de récentes réformes dans le droit de l’arbitrage québécois parallèlement au droit de l’arbitrage français. Notre stratégie consistera à identifier les pouvoirs attribués au juge étatique et à analyser la place de choix réservée au juge étatique dans cette procédure. Puisqu’il s’avère être un appui précieux à l'arbitrage, il conviendrait de redéfinir sa place dans cette procédure, afin de dissiper toutes les incompréhensions qui ont pu exister. / The arbitrator represents the judge in the arbitration proceedings: he decides, judges and holds the balance of justice in the arbitration proceedings. Although its decisions are arbitral awards, they do not have the enforceable force of a judicial judgment that would involve a penalty in the event of non-performance by the party against whom it was issued. Thus, the arguments according to which the reports of the judge and the arbitrator are conflicting, according to which the powers assigned to the arbitrator to complete his mission and the principle of incompetence of the state judge in the conduct of an internal or international arbitration, become refutable. Submitted for review and in support of the State judge, the arbitral body and the arbitral award shall be incorporated into the judicial order. They must live together in the same legal atmosphere. The judge in this regard has the obligation to protect and respect the will of the parties, while ensuring the smooth conduct of the arbitral proceedings. In light of the new arbitration reforms in force in Quebec, France and several other states, the relationship between the courts and arbitration has evolved towards understanding, collaboration and complementarity.
In addition, the legal texts and rules governing arbitral proceedings are of great importance in our presentation, as they contribute to the demonstration of these new reports. It is, in fact, the respect of the rules and the possibility for the parties to manipulate them that make the arbitration attractive.
The purpose of this brief is to demonstrate the evolution of the relationship between the judge and the arbitrator in light of recent reforms in the law of Quebec arbitration in parallel with the law of French arbitration. Our strategy will be to identify the powers assigned to the state judge and to analyse the place reserved for the state judge in this procedure. Since it proves to be a valuable support for arbitration, it would be appropriate to redefine its place in this procedure, in order to dispel any misunderstandings that may have existed.
