Para tanto, faz-se, inicialmente, uma contextualiza??o do tema, apontando-se para os principais marcos normativos, internos e externos, do que se convencionou chamar de proibicionismo em mat?ria de drogas, bem como para as diferentes esp?cies de iniciativas liberalizantes hoje em trajet?ria ascendente no cen?rio internacional. Em seguida, analisa-se a interven??o estatal em apre?o ? luz dos referenciais da dignidade da pessoa humana, da liberdade e da vida privada, pondo-se em relevo, no ponto, entre outros aportes, os diversos precedentes da jurisdi??o constitucional estrangeira sobre o tema. Ato cont?nuo, confronta-se a pol?tica em tela com aquele que talvez seja, nos dias de hoje, o principal mecanismo de controle das medidas restritivas de direitos fundamentais, qual seja, o crit?rio da proporcionalidade, aqui representado pelos consect?rios cl?ssicos da adequa??o, da necessidade e da proporcionalidade em sentido estrito. Depois disso, examina-se a tipifica??o penal em pauta ante o par?metro da igualdade e os interesses gerais da sa?de e da seguran?a p?blica. Com base nos elementos te?ricos e emp?ricos arrolados no desenvolvimento, concluise, enfim, pela inconstitucionalidade da op??o do legislador ordin?rio de impor san??es de natureza criminal aos usu?rios ? problem?ticos ou n?o ? de subst?ncias ou produtos capazes de causar depend?ncia f?sica ou ps?quica. / This dissertation has the main objective to assess the legal and constitutional legitimacy of the legislative state act that criminalizes the conduct of carrying drugs for own consumption - in the case of Brazil, art. 28 of the Federal Law n.? 11.343 of August 23rd, 2006. Therefore, it is done, initially, a contextualization, pointing the main regulatory frameworks, internal and external, of what is conventionally called prohibition in the matter of drugs, as well as the different species of liberalizing initiatives today on an upward trend in the international scenario. Then analyzes the state intervention in question in the light of references of human dignity, freedom and privacy, emphasizing, in the point, among other contributions, the various precedents of foreign constitutional jurisdiction over the theme. Immediately thereafter, confronts the policy in screen with what is perhaps, these days, the main control mechanism of the restrictive measures of fundamental rights, namely the proportionality test, here represented by classical elements of appropriateness, necessity and proportionality in the strict sense. After that, it examines the criminalization on the agenda before the parameter of equality and the general interests of health and public safety. Based on theory and empirical enrolled in the development, it is concluded, finally, the unconstitutionality of the option of the ordinary legislature to impose criminal penalties on users - problematic or not - of substances or products capable of causing physical or psychological dependence.

?Porque o funk est? preso na gaiola? (?): A criminaliza??o do funk carioca nas p?ginas do Jornal do Brasil (1990-1999)

In terms of sources, songs released throughout this decade were used, also laws and draft laws that were specifically aimed at funk music and especially the contents presented in ?Jornal do Brasil? during this same period, which had as main theme the carioca funk. The analysis of the selected sources allowed to conclude that the persecution carried out by the public power against the manifestations of the carioca funk (mainly the funk dances) were the result of the persecution against the adherents of the movement, that is, against the funk dancers (funkeiros); mostly black, young, poor and favela dwellers. In this sense, the occurrence of organized gang-sackings in October of 1992 marks the history of the funk movement, once the suburban funkeiros were pointed out as the main culprits of the pillages occurred in the beaches of the South Zone. From this blame, a stigmatized image had been built upon the funkeiros by the mainstream media that reduced them to potential violent, dangerous, and criminal subjects. This was evidenced in the fact that the absolute majority of the events about carioca funk music in ?Jornal do Brasil? have presented the funk music and the funkeiros in a negative way.We therefore perceive that the criminalization of funk music in the 1990s was largely based on racism and social prejudices against black, poor, favela dwellers, which represented funk?s greatest producing and consuming mass. / Tendo em vista a persegui??o contra o funk carioca, desenvolvida ao longo da d?cada de 1990 (e intensificada nos anos 2000), esta disserta??o teve como objetivo principal encontrar explica??es para a criminaliza??o do movimento funk carioca. Nesse sentido, foram utilizados, em termos de fontes, can??es lan?adas ao longo desta d?cada, leis e projetos de leis que se destinavam especificamente ao funk e, principalmente, os conte?dos presentes no Jornal do Brasil, neste mesmo per?odo, que tinham como tema principal o funk carioca. A an?lise das fontes selecionadas permitiu concluir que a persegui??o levada a cabo pelo poder p?blico contra as manifesta??es do funk carioca (sobretudo os bailes funk) eram fruto da persegui??o contra os adeptos do movimento, ou seja, contra os funkeiros, em sua maioria jovens negros, pobres e favelados. Nesse sentido, a ocorr?ncia dos arrast?es em outubro de 1992 marcam a hist?ria do movimento funk, uma vez que os funkeiros suburbanos foram apontados como os principais culpados pelos arrast?es que ocorreram nas praias da Zona Sul. A partir desta culpabiliza??o, fora constru?da sobre os funkeiros pela grande m?dia uma imagem estigmatizada que os reduziu a sujeitos violentos, perigosos e criminosos em potencial. Isto ficou comprovado no fato de a maioria absoluta das ocorr?ncias sobre o funk carioca no Jornal do Brasil ter apresentado o funk e os funkeiros de forma negativa. Percebemos, portanto, que a criminaliza??o do funk na d?cada de 1990 esteve calcada, em grande medida, no racismo e nos preconceitos de origem social contra os jovens negros, pobres e favelados, que representavam a grande massa produtora e consumidora do funk.

Por fim, s?o problematizados os desdobramentos e as perman?ncias das ra?zes hist?ricas da pol?tica criminal, relacionando-as com as dificuldades atualmente encontradas na consolida??o do paradigma garantista proposto pelo Estatuto da Crian?a e do Adolescente. / This thesis investigates the historical influence of the criminal policy in the context that shapes the first specific law for children and adolescents in Brazil, the 1927 Children's Code, a standard that inaugurates the conceptual scission between children and "minor" and their different treatment by the State. The study addresses the demand for order in the context of changes in the working world in the transition from the slave system to the capitalist mode of production, and the corresponding disciplinary and punitive control mechanisms directed to the segment of childhood and adolescence. The theoretical route proposes a questioning of the political construction of law and justice, as well as the conformation of the punitive techniques, and the construction of the stereotype of the "delinquent", prime target of the criminal policy, focusing on the process of criminalization of the segment in question through the confrontation of the Critical perspective with the approaches of Classical and Positive schools. This research shows the imposition of a bourgeois morality that obscures the social conflict attributing it to people isolated by the criminalization of their conduct; and points out that the historical forms of selective social control were greatly influenced by psychiatry and psychology, either by the elaboration of the image of the "delinquent" or by the expected performance of custodial institutions. Finally, the developments and the permanence of the historical roots of the criminal policy are problematized, relating them to the difficulties currently encountered in the consolidation of the legal garantism paradigm proposed by the Children and Adolescent Statute.

Neste campo de tens?es s?o flagrantes os processos de criminaliza??o da pobreza, seletividade penal e encarceramento em massa como dispositivos de classifica??o, conten??o e exterm?nio dos que s?o considerados excedentes ao capitalismo. Em meio a este cen?rio, interessou saber qual lugar tem sido destinado e ocupado pela Psicologia junto ? Justi?a Penal. O objetivo geral desta tese ?, portanto, analisar as rela??es existentes entre a Pol?tica Criminal e os discursos/pr?ticas psicol?gicos ligados ? Justi?a Penal no Brasil. O percurso metodol?gico trilhado iniciou-se com a revis?o da literatura nacional e internacional relacionada ? pol?tica criminal, saberes criminol?gicos tradicionais, criminologia cr?tica e psicologia jur?dica (principalmente ligada ? esfera penal). Como etapa complementar, foram acessados 84 pareceres psicol?gicos presentes em processos criminais de uma Vara de Execu??es Penais sediada em uma capital brasileira. No decorrer do debate te?rico travado ao longo do estudo, fragmentos dos documentos investigados foram confrontados com os postulados da criminologia cr?tica, referencial te?rico central da tese, com vistas a exemplificar argumentos e colaborar com o melhor entendimento da discuss?o apresentada. O trabalho aponta que as pr?ticas psicol?gicas ligadas ao campo penal s?o fortemente influenciadas por pressupostos das Criminologias Liberal e Positivista; que o trabalho do psic?logo majoritariamente corrobora a pol?tica criminal vigente; e que os fazeres psicol?gicos comprometidos com a defesa e promo??o dos direitos humanos ocupam posi??o contra-hegem?nica no ?mbito penal. Conclui-se afirmando as necessidades de participa??o ativa da Psicologia na constru??o de um novo projeto ?tico-pol?tico de sociedade; atua??o profissional como resist?ncia ?s pr?ticas de ortopedia social e; reinven??o das pr?ticas psicol?gicas neste campo de modo a superar as ilus?es burguesas de ressocializa??o, readapta??o e reeduca??o dos autores de crimes. / The criminal justice system has historically represented a fertile field for the interaction between Psychology and Law. In this field, one can observe a series of mechanisms of social control and criminal management of misery which are put into operation daily as a strategy for maintaining the capitalist mode of production and its principles. Different criminological discourses as well as the support of other fields connected to Law, such as Psychology, contribute to imposing criminal practices. Processes of criminalization of poverty, criminal selectivity and mass imprisonment as devices for the classification, confinement and extermination of those considered surplus to capitalism are flagrant. In this scenario, we aimed at investigating the role that Psychology has been assigned and played within Criminal Justice. Therefore, the general objective of this thesis is to analyze the relationship between Criminal Politics and the psychological discourses / practices related to Criminal Justice in Brazil. The methodology involved a review of the national and international literature related to criminal politics, traditional criminological knowledge, critical criminology and legal psychology (mainly linked to the criminal sphere). As a complementary step, we accessed 84 psychological reports included in criminal proceedings of a Court of Criminal Appeals based in a Brazilian capital city. For the theoretical debate proposed in this study, excerpts from the analyzed documents were confronted with the postulates of critical criminology ? central theoretical framework for the thesis ? with a view to exemplifying arguments and collaborating with a better understanding of the discussion. The work points out that the psychological practices related to the criminal field are strongly influenced by the assumptions of Liberal and Positivist Criminologies; that the work of psychologists mostly corroborates current criminal politics; and that the psychological actions taken towards the defense and promotion of human rights occupy a counter-hegemonic position in the criminal sphere. The conclusions emphasize the need for the active participation of Psychology in the construction of a new ethical and political project of society; professional action as a resistance to social orthopedic practices and the reinvention of psychological practices in this field in order to overcome the bourgeois illusions of re-socialization, rehabilitation and re-education of perpetrators.

O adolescente em conflito com a lei e a escola: criminaliza??o e inclus?o perversa

The research was developed in the Community-based Assisted Freedom Program of Pastoral do Menor , in Fortaleza (capital city of Cear? State, Brazil). The study has engaged 21 adolescents, eight program professionals, three members of the Center for Defense of Child Rights in Cear?, five teachers and eight school principals and education managers from the schools attended by the adolescents in the neighborhoods of Pirambu, Tancredo Neves, Jardim Iracema e Bom Jardim. It intends, based on dialectical and historical method, to define the investigated adolescents as persons with a very singular insertion into the social structures of neoliberal capitalism. Their adolescence is subject to consumerism appeals, to the limits imposed by these appeals and to perverse ways of insertion in the system, such as criminalization, segregation and marginalization. It reveals that the school attended by the adolescents reproduces such conditions of insertion. At the same time, these conditions are elements of identity, by which the adolescents are characterized. / O presente estudo trata de uma investiga??o que visa identificar a rela??o entre adolescentes em conflito com a lei, cumprindo medida socioeducativa de liberdade assistida, e a escola. Foi desenvolvido no Programa de Liberdade Assistida Comunit?ria da Pastoral do Menor de Fortaleza CE -, e dele participaram 21 adolescentes, sete familiares, oito t?cnicos do Programa, tr?s membros do Centro de Defesa da Crian?a e do Adolescente do Cear?, cinco professores e oito diretores e coordenadores das escolas freq?entadas pelos adolescentes, nos bairros Pirambu, Tancredo Neves, Jardim Iracema e Bom Jardim. Busca-se, fundamentados no m?todo hist?rico e dial?tico, caracterizar os adolescentes estudados enquanto pessoas que t?m uma inser??o particular na estrutura social do capitalismo neoliberal, em que sua adolesc?ncia se encontra sujeita aos apelos de consumo, aos limites em face deles, e ?s formas perversas de inser??o no sistema, como a criminaliza??o, a segrega??o e a marginaliza??o. Por muitos anos, o racismo no Brasil permaneceu como pr?tica disseminada, por?m silenciosa, gra?as ? sedimenta??o do dogma da democracia racial, tendo em vista a miscigena??o observada na forma??o do povo brasileiro (mistura do ?ndio nativo, do europeu portugu?s e do escravo africano). Com efeito, as pol?ticas antidiscriminat?rias acabaram sendo alijadas da agenda governamental. Nada obstante, estudos sociol?gicos demonstraram, de forma inexor?vel, o contr?rio. A discrimina??o por conota??o de ?ra?a?/cor ? uma met?stase que se alastrou no seio da sociedade brasileira. A popula??o negra acabou subordinada e ? margem da integralidade das conquistas sociais dos novos tempos. Diante de tal panorama, a Constitui??o Federal de 1988, buscando tutelar eficazmente o direito ? igualdade, sob a perspectiva da proibi??o de discrimina??o racial negativa, inovou ao prever um mandado expresso de criminaliza??o do racismo, esp?cie de dever fundamental dirigido ao pr?prio Estado, notadamente ao legislador infraconstitucional. Vieram, ent?o, as respectivas leis penais, criminalizando as condutas discriminat?rias. Todavia, apesar da ineg?vel import?ncia de tais mecanismos, verificou-se que o direito penal, por si s?, n?o foi capaz de refluir esse multifacetado e complexo fen?meno social (racismo), motivo pelo qual tem-se por objetivo primordial analisar o desenvolvimento no processo dogm?tico de concretiza??o constitucional do direito ? igualdade, na perspectiva da antidiscrimina??o racial, para, logo ap?s, apontar caminhos te?ricos aptos a propiciar avan?os em tal tem?tica. Sendo constatado, no curso da presente pesquisa, a imprescindibilidade na evolu??o de pol?ticas p?blicas que proporcionem tanto a redistribui??o econ?mica, quanto o necess?rio reconhecimento ao status, valores e ? cultura das pessoas negras, a fim de que possam promover a almejada emancipa??o de tal parcela da popula??o brasileira (hoje j? majorit?ria), de modo a deixar para tr?s, de uma vez por todas, a sombra da escravid?o. / Despite the scientific denial of human classification into biological races, racial discrimination is perceived as a social issue. Thanks to the belief of a racial democracy, racism was, for many years in Brazil, a widespread practice that resulted from the multicultural background of the Brazilian people (which is a mixture of native indians, the Portuguese European and African slaves). As a result, anti-discriminatory policies ended up being pushed out of the government?s agenda. Nonetheless, sociological studies have shown, inexorably the opposite; discrimination by ?race?/skin color is a social virus that widely spread through Brazilian society and as such, the black population became subordinate and alienated from social achievements. For this reason, seeking to effectively safeguard the right to equality through banning racial discrimination, the 1988 Brazilian Federal Constitution broke new grounds, criminalizing racial discrimination, as an ultimate State responsibility enforced by the legislator. Criminal laws then emerged, proscribing discriminatory behavior. Nevertheless, despite the undeniable relevance of such legal mechanisms, criminal laws were not sufficient to prevent this multifaceted and complex social phenomenon (racism) and for this reason, the main goal became to analyze the evolution of the dogmatic process of constitutional realization of the right to equality, in the context of racial non-discrimination, to find theoretical paths able to provide improvement on this matter. It has been noted, through this research, the need for improvement of public policies that provide both economic redistribution of wealth, as well as the recognition to the status, values and culture of black people, to allow and promote the emancipation of this part of the population (now already majority) and to leave behind once and for all, the shadow of slavery.
