The immoral legality of targeting child soldiers : A humanitarian dilemmaAndersson, Ellen January 2023 (has links)
The thesis functions as an overview of the protection of children used in hostilities and their targetability under international law, primarly in international humanitarian law. The author questions the established presumption, that children directly participating in hostilities, shall be equally targetable as their adult colleges and counter parts. In times of conflicts, international humanitarian law offers children a special protection status. The prohibition against recruitment and use of children under the age of 15 illustrates two of the most relevant protective regimes. Despite these protective rules, children directly participating in hostilities remain lawful targets and their special protection status becomes severely less useful. For these reasons, the author argues, that the presumption of equal target ability hinders the Special protection of children to have the practical impact for children used on the battlefield it intened to.The tremendous amounts of child soldiers recruited by non-state armed groups shows that the prohibition against recruitment and use aren't respected. However, the author argues that the ICC juris prudence and national initiatives illustrate that the presumption of equal targetability can be challenged under international law. And, that the special protection for children in times of conflict, and international law as a whole does motivate differanting rules for targeting children versus adults participating in hostilities. For arguments presumably made on moral grounds, military personnel are willing to put themselves at greater risk to spare the life of a child soldiers forced to take part in a conflict, he or she definitely did not start. The Vancuver principles and the The Canadian Armed Forces Joint Doctrine Note shows that states are willing to follow in these footsteps by adding extra precautionary measures in the planning state of a military operation and to completely differentiate the rules for targeting children and adults. Lastly, the author argues that the rules for targeting cultural property ( set out in the 1954 Convention for the Protection of Cultural Property), could be an example on how to differentiate the rules for targeting children. In this regard the author argues that, like cultural property, children directly participating in hostilities should only be lawfully targeable, at last resort, when there is no other way to fulfill the military advantage.

Exploring the prospect that voluntary human shields can take a direct part in hostilitiesParis, Emma January 2024 (has links)
This doctrinal thesis centers around the topic of voluntary human shields as a complex phenomenon requiring further scholarly attention. Specifically, this paper acknowledges that the actions of certain voluntary shields renders their classification as civilians strenuous, in which it is explored if the notion of Direct Participation in Hostilities might apply. As such, the research question contemplates: To what extent, if at all, can voluntary human shields be considered as taking a direct part in hostilities when shielding lawful targets? The analyses have concentrated on both a theoretical examination of the ICRC’s Interpretive Guidance, and on an empirical investigation into two cases of voluntary human shields: the Serbian citizens in 1999 and the Palestinian women in 2006. Evidently, the findings indicate that voluntary human shields can to some extent take a direct part in hostilities, while the generalizability of our results are appreciated. Ultimately, this thesis provides additional insights into the topic, as increasingly relevant and required within the contradictory and existing research field, while also anticipating avenues for future research.

Med utgångspunkt i det moderna arbetslivet och de krav som detta medför på dagens medarbetare har den aktuella studien valt att inrikta sig på den psykosociala arbetsmiljön. Studien utgår ifrån Julian Rotters teori om locus of control. Syftet med studien är att undersöka hur inre och yttre kontrollfokus påverkar upplevelserna av möjligheten till återhämtning och delaktighet. Studien är kvantitativ, och har genomförts på uppdrag av en medelstor kommun i Västsverige. Webbaserad enkät har använts. Resultatet visar att inre kontrollfokus har en signifikant positiv påverkan på både den upplevda möjligheten till återhämtning och den upplevda delaktigheten. Inre kontrollfokus är dessutom av större betydelse för den upplevda möjligheten till återhämtning och den upplevda delaktigheten hos medarbetarna i kommunen, jämfört med de som är chefer med budget- och/eller personalansvar. Således anses inre kontrollfokus kunna påverka den psykosociala arbetsmiljön i positiv riktning.

[pt] O contexto desta pesquisa é a crise do modelo democrático exclusivamente representativo. Ele é ambiência para a perpetuação de uma relação entre Estado e povo que não é baseada na comunicação e inviabiliza trocas de razões, típicas de relações de poder. O modelo representativo e um contexto de desigualdade social facilitam a dominação entre classes, negam reconhecimento aos pobres, prejudicando seu autorreconhecimento político, e impedem a comunicação entre governo e cidadão. Os conceitos de agir comunicativo, dominação e justificação, em Habermas e Forst, são fundamentais para um parâmetro democrático baseado na intersubjetividade. Democracia é um conceito em disputa. Não se pretende apresentar um conceito melhor, entretanto, analisam-se as conjunturas sociais e políticas que contribuem para um descrédito do modelo democrático e fortalecem estruturas de dominação e de agir estratégico incompatíveis com a democracia. Representative democracies are environments for the perpetuation of relations that are not based on communication between State and people. They make the exchange of reasons typical from relations of power impossible. Contexts of representative democracies and social inequalities enable class domination, deny recognition to the poor and harm their political self-recognition, preventing communication between government and citizens. The concepts of communicative action, domination and justification in Habermas and Forst s works are essential to build a democratic paradigm based on intersubjective relations. It is not intended to present a rightful/truthful concept of democracy. The aim is to analyze social and political contexts that discredit the democratic system and strengthen domination structures and strategic action that are incompatible with democracy. Starting at the point where democracies must comply with justice and communication standards based on intersubjective ethics. It cannot favor strategic action and sustain non-recognition and domination structures. In this sense, the adoption of direct participation mechanisms are able to amplify democratic feature of the system, enabling the reduction of strategic action cleaning the path for a communicative action. As well of allowing the shift from relations of domination to relations of power, granting intersubjective recognition. In addition, they foment spaces of encounter and conflict as interaction between strangers. It is possible that it concurs to the amplification of the dialogue and the reduction of non-representative structures that are not responsives.

Atskyrimo principas ginkluotuose konfliktuose yra tarptautinės humanitarinės teisės
pagrindas, reikalaujantis, kad konflikto šalys visuomet skirtų civilius gyventojus ir kombatantus,
civilinius ir karinius objektus. Tačiau dėl visuotinės privatizacijos padidėjus civilių ir privačių
kompanijų, dalyvaujančių ginkluotuose konfliktuose, skaičiui bei nuolat tobulėjant karinėms
technologijoms, riba tarp civilių ir kombatantų ėmė nykti. Norėdami pritaikyti atskyrimo principą
šiuolaikiniams ginkluotiems konfliktams, šiame darbe, visų pirma, analizavome tiesioginio
dalyvavimo karo veiksmuose įtaką šio principo taikymui ir nustatėm, kad asmeniui, tiesiogiai
dalyvaujančiam karo veiksmuose, atskyrimo principas nebetaikomas, jis tampa teisėtu kariniu
taikiniu ir praranda apsaugą nuo karo veiksmų keliamų pavojų. Tiesioginiu dalyvavimu karo
veiksmuose siūlėme laikyti veiksmus, atitinkančius žalos masto, tiesioginio priežastinio ryšio tarp
atliekamo veiksmo ir kilusios ar kilsiančios žalos ir ryšio su ginkluotu konfliktu bei viena iš
konflikto šalių reikalavimus. Visų antra, nagrinėjome atskyrimo principo ginkluotuose konfliktuose
taikymą PKSK personalo atžvilgiu. Nustatėme, kad dalis PKSK darbuotojų galėtų būti laikomi

humanitarian law, requiring that the Parties to the conflict would at all times distinguish between the
civilian population and combatants and between civilian objects and military objectives. But
because of the increased number of civilians and private companies participating in armed conflicts
due to the global privatisation and permanent technological improvement of military equipment, the
line between civilians and combatants begin to blur. In order to apply the principle of distinction to
modern armed conflicts, firstly, we analysed an influence of direct participation in hostilities to the
application of the principle of distinction and determined that for person who directly participates in
armed conflicts the principle of distinction is no longer applicable and this person becomes a legal
military target with no general protection against dangers arising from military operations. An act
which is considered to be direct participation in hostilities should meet the requirements of threshold
of harm, direct causation and belligerent nexus. Secondly, we studied the application of the principle
of distinction to the personnel of private military and security companies in armed conflicts and
determined that part of this personnel might be considered combatants and because of that become

Student Attitudes towards Flipped Classroom : A Focus Group Study on Attitude Change in Swedish Upper Secondary School, within Mathematics towards Flipped ClassroomÖlmefors, Oscar January 2016 (has links)
In traditional schooling, one-way monologue from teacher to student is the established way of communication in the classroom. Modern pedagogues are presently breaking free of this status quo. This master thesis explores whether there is a change in the student’s attitudes towards their schooling and whether there is an academic benefit for the student when applying a flipped classroom model. This study was performed in Swedish upper secondary school during the students’ last course in mathematics. The study was carried out using focus group interviews and direct participating observation. During the six-week period of interviews and participating in the classroom written tasks were collected and analysed, and the classroom was filmed to help analysing behaviour of the students, both with flipped classroom and without. The outcome shows positive reactions from the students concerning this change in pedagogics, but also some inertia in some individuals. The result shows a positive attitude change concerning communication and collaboration in the classroom, although no difference in academic achievement were visible. More studies are needed, but a theoretical base needs to be built before future studies can be conducted. Today flipped classroom is undertheorized in ways of an academic model. Future research could be theorizing flipped classroom and exploring whether implementing this pedagogic model also brings forth a change in academic achievement apart from changing the attitudes of the students.

Cette ambiguïté a conduit à des interprétations divergentes du concept d’hostilités et des critères juridiques utilisés pour définir une participation directe par opposition à une participation indirecte (effort de guerre).D’ailleurs, les conflits contemporains posent de nouveaux défis quant à la définition et la mise en oeuvre de la notion de la participation directe aux hostilités. Les moyens de guerre de haute technicité (l’attaque de réseaux informatiques) et l’externalisation des forces armées (sociétés militaire privées), illustrent l’imbrication croissante des activités civiles et militaires et la difficulté à identifier précisément qui participe directement aux hostilités et quelles sont les mesures à prendre pour protéger ceux qui n’y participent pas directement. / The notion of direct participation in hostilities has never been precisely defined in international humanitarian law. This ambiguity has led to differing interpretations of the concept of hostilities and legal criteria imply a distinction from direct participation in hostilities as opposed indirect participation (war effort).Indeed, contemporary conflicts have given rise to further challenges in terms of defining and implementing the notion of direct participation in hostilities. The use of high-tech warfare (computer network attack), privatization of the armed forces (private military company), among others, illustrate the increased intermingling of civilian and military activities which make it difficult to determine who is taking a direct part in hostilities and what measures should be taken to protect those who are not directly participating.

The Killing of Osama bin Laden, Was it Lawful?Elfström, Amanda January 2012 (has links)
The main purpose of this work is to investigate if the US ́s killing of Osama bin Laden on 2 May 2011 in Abbottabad in Pakistan was lawful. The background to the killing is what happened on 11 September 2001 when four US airplanes were hijacked and crashed into World Trade Center and Pentagon. Al Qaeda, a terrorist organisation led by Osama bin Laden, was immediately suspected for the attacks, which led to the starting point of the US ́s ‘global war on terror’. This work tries to give a short brief on ‘global war on terror’ and answer if there is a global war on terror and/or if a new category of war is needed. In order to get an answer to the main question of this work I had to investigate if US is in an international armed conflict or in a non-international armed conflict with Al Qaida. Another important question to investigate is if an armed conflict in one State can spill over to another State and still be consider as an armed conflict. Other important questions to answer are, if Osama bin Laden was a legitimate target under international humanitarian law, if he was a civilian or if he had a continuous combat function and what level of participation in hostilities he had? Not less important is also to investigate if human rights law is applicable when Osama bin Laden was killed, especially the fundamental right to life. Lastly I end my investigation with a quick review of the laws of jus ad bellum in order to get an answer if US had a right to resort to force in Pakistan. My conclusion is that the US was not involved in an armed conflict with al Qaeda in Pakistan where the killing took place. The conflict between the US and al Qaeda in Afghanistan is to be categorised as a non-international conflict. This conflict cannot be described as a conflict that has spilled over to Abbottabad where Osama bin Laden was killed. All people, including Osama bin Laden, has a right to life. Because of lack of information on what happened in Abbottabad when Osama bin Laden was killed it is impossible to give a clear legal answer if the US had the right to kill him. It could be lawful, but it could also be considered as a crime against international human rights law.
