"La investigación del patrimonio del ejecutado" analiza los arts. 589, 590 y 591 de la Ley española 1/2000, de Enjuiciamiento Civil.El estudio abarca el conjunto de mecanismos legales previstos para determinar el objeto del embargo, a saber, la manifestación de bienes del ejecutado, la investigación judicial, la colaboración de terceros y la investigación del ejecutante. La tesis analiza en profundidad el régimen jurídico de dichos medios de investigación y sus límites (en particular, los derechos fundamentales del ejecutado), proponiendo formas de rellenar las lagunas legales y de mejorar la coordinación entre los distintos medios de investigación.La tesis examina asimismo el Derecho comparado, buscando en él soluciones practicables para el Derecho español. / The thesis analyzes Articles 589, 590 and 591 of the Spanish Code of Civil Procedure (Ley 1/2000, de Enjuiciamiento Civil).The study focuses on the instruments for the disclosure of assets in order to enforce judicial decisions. These instruments are the debtor's declaration of assets, the tracing of assets by the Court, the collaboration of third parties and the tracing of assets by the creditor.The thesis makes an in-depth analysis under Spanish law of these mechanisms and its limits (in particular, the fundamental rights of the debtor). It also proposes ways to fill the gaps of the Spanish legislation and to improve the coordination between each of the instruments to trace and disclose the debtor's assets for enforcement purposes.The study also analyses Comparative Law, in the search of other practical solutions for Spanish Law.

Dans le cadre du développement international du mouvement du libre accès aux publications scientifiques, cette thèse analyse plus précisément la situation française dans le contexte européen. Cette analyse a été menée à travers une démarche de recherche-action, au sein d’un groupe d’acteurs du Groupement français des industries de l’information (GFII) concernés par le libre accès.Nous cherchons tout d’abord à mettre en évidence les forces motrices du développement du libre accès en nous appuyant sur une méthodologie prospective développée au LIPSOR/CNAM.Les résultats nous ont conduit à contribuer à la conception d'un site d’information dont la finalité est l'affichage des politiques des éditeurs nationaux en matière d'auto-archivage afin d'accompagner les pratiques de dépôts au niveau national. L’analyse prospective a en effet révélé l’importance des embargos pour les équilibres financiers des éditeurs.De façon plus distanciée, nous amorçons également une réflexion sur l’impact réel du libre accès sur deux moteurs semblant jouer un rôle croissant dans l'économie de la connaissance, à savoir la créativité et l’interdisciplinarité. / Within the framework of the international development of open access to scientific publications, this thesis analyses more precisely the French situation in the European context. This analysis was carried out through a process of action research within a group of actors of the French Professional Group for B to B Information and Knowledge (GFII) who are concerned by open access.At first, we seek to highlight the driving forces behind the development of open access by relying on a method of prospective developed by LIPSOR/ CNAM.The results led us to contribute to the design of an information website whose purpose is to display the national publisher policies on self-archiving practices in order to support the development of new deposit practices at the national level. The prospective analysis has indeed revealed the importance of embargo periods for the financial balances of the publishers.By adopting a more distanced point of view, we initiate a new reflection about the real impact of open access on two important driving forces which seem to play an increasing role in the knowledge economy, namely creativity and interdisciplinarity.

British personnel in the Dutch navy, 1642-1697Little, Andrew Ross January 2008 (has links)
An international maritime labour market study, the thesis focuses on the Dutch naval labour market, analysing wartime Zeeland admiralty crews. The research is based primarily on unique naval pay sources. Analysis of crew compositions has not been made on this scale in the period before. The 1667 Dutch Medway Raid is the starting point, where a few British played a leading role – amongst many others reported on the Dutch side. Pepys and Marvell primarily blamed their joining the enemy on the lure of superior Dutch payment. The thesis asks how many British there were really, how they came to be in Dutch service, and whether this involvement occurred, as indicated, at other times too. Part One is thematic and explores the background mechanisms of the maritime environment in detail, determining causation. First, the two naval recruitment systems are compared and completely reassessed in the light of state intervention in the trade sphere. Two new sets of ‘control’ data – naval wages and foreign shipping – are amongst the incentives and routes determined. British expatriate communities are examined as conduits for the supply of naval labour and civilian support. British personnel are compared and contrasted with other foreigners, against the background of Anglo-Dutch interlinkage and political transition from neutrality through conflict to alliance. Part Two is chronological, covering four major wars in three chapters. Micro-case studies assembled from the scattered record streams enable analysis of the crews of particular officers and ships. Seamen were an occupation that made them a very little known group: the thesis examines the different career types of British personnel of many different ranks, shedding light on their everyday lives. The thesis shows that British personnel were an integral part of Dutch crews throughout the period, even when the two nations were fighting each other. The basic need of subsistence labour for employment took precedence over allegiance to nation/ideology, demonstrating limitations in state power and the continual interdependence forced on the maritime powers through the realities of the labour market.

This thesis examines the development of decision making taken by two countries, the United Kingdom and the United States, in response to Croatia’s declaration of independence from Yugoslavia. The focus is on the recognition process and the reasoning and rationale used by the government officials and diplomats of the United Kingdom and United States to arrive at their policy decisions and opinions. The concentration is mainly on events from the early 1990s until mid 1992. Topics explored include matters such the politics behind non-recognition, democratic social norms, respect for human rights and Western national interests.
The thesis first hypothesizes, then analyses, which International Relations theory, that is, realism or constructivism, possesses the best capacity explain why these nations initially withheld their recognition of Croatia’s independence before moving to accept the Republic of Croatia as an independent state. The role of the International Relations theories is to offer an interpretation and understanding of these events and decisions. Subsequently, they are judged on their ability to do so. The thesis finds that via the insight of scholars, analysts and theoretical perspectives that both the John Major government of the UK and the George H.W. PhD (African Studies) / Department of African Studies / In the 1980s South Africa was subjected to cultural embargo. However, at the height of the embargo, Paul Simon went against the political climate of the day and mounted a cross-cultural, multinational music project called Graceland. Although South African popular music can facilitate the prosperity of musicians, only few musicians have succeeded in fostering this aspect. Using popular music and pop culture Afrocentrism as frameworks, this study analyses the Graceland project in the context of the South African popular music of the 1980s. The empirical research approach leaning towards the qualitative method was used. Interviews and literature review were the main modes of data gathering. Owing to the sensitivity of the subject, ethical considerations were adhered to. The cultural embargo, as well as other political interventions aiming at pressurising the South African government to abandon its apartheid policies, were well-meaning, but at the same time, the cultural embargo had a negative impact in that the popular culture of the country went unrecognised by global players. It was envisaged that this study would help in understanding the motivations and intentions of the planners of the Graceland project, and how these were to benefit the South African music sector. / NRF

This thesis entitled "Transformation through Trade. The pioneers of the New Eastern Policy in the 50s and 60s." examines the efforts of the German entrerpreneurs during the Cold War to revive trade relations with the Sowjetunion and to the states within its sphere of power. Because Europe was divided politically into two antagonistic systems, and due to the embargo imposed on West Germany by the Allied Powers, the entrepreneurs encountered extreme difficulties in their attemps to renew trade. The determined efforts of the economic diplomats, which were fundamental in creating conditions for the new eastern policy, reached their peak in 1970 when the Gas Pipeline Deal was concluded.
