<p>Sveriges 16 miljökvalitetsmål utgör ett politiskt handlingsprogram för att nå en ekologisk hållbar utveckling och Miljöbalken utgör de rättsliga verktygen för att nå dessa miljökvalitetsmål. Miljöbalkens tillämpning i praktiken övervakas av tillsynsmyndigheterna. Naturvårdsverkets projekt Tillsyn och Miljömål (TIM) skapade år 2003 en modell för tillsynsplanering som är styrd av miljökvalitetsmålen, dvs. miljömålstyrd tillsyn.</p><p>Syftet med denna uppsats är att studera hur miljömålstyrd tillsyn fungerar i praktiken på kommunal nivå. För att uppfylla syftet har ett antal frågeställningar formulerats kring implementeringen av miljömålen i tillsynsplaneringen, arbetssättet med målstyrd tillsyn, fördelar och nackdelar med TIM-modellen, dess utvecklingsbehov och framtida miljötillsyn samt det miljörättsliga perspektivet på miljömålstyrd tillsyn. Detta gjordes genom intervjuer med ett urval av inspektörer från kommuner som arbetar med målstyrd tillsyn. Resultatet av intervjuerna analyserades och diskuterades i jämförelse med tidigare studier inom området.</p><p>Slutsatserna visar att generellt sett verkar TIM-modellen fungera bra för kommunerna som målstyrningsverktyg för tillsynsplaneringen och många av målstyrningens fördelar syns i resultatet. Men det finns fortfarande en del områden som TIM-modellen behöver utveckla för att underlätta användningen och göra den mer användbar. Slutsatserna är redovisade som rekommendationer ur två perspektiv, den ena är riktad mot kommuner med råd och tips medan den andra är inriktad mot Naturvårdsverket och modellens utvecklingsmöjligheter.</p>

Magistro baigiamojo darbas, nagrinėjanti ekologinės teisės įgyvendinimo Lietuvoje socialinį veiksmingumą, yra aktuali, nes ekologinės teisės nuostatos, nors ir pakankamai išsamiai bei kryptingai reglamentuojančios aplinkos apsaugos teisę, dažnai esti mažai veiksmingos. Ekologinės teisės veiksmingumą analizuojant per Nord Stream dujotiekio projekto įgyvendinimo ekologinius aspektus, atskleidžiama daugiausia aplinkos apsaugos reglamentavimo krypčių ir principų. Taip pat pabrėžtina, kad Nord Stream dujotiekio tiesimo problema šiandien yra viena svarbiausių Baltijos jūros regiono valstybių ne tik ekologinių, bet ir politinių, socialinių, ekonominių problemų. Darbo objektas: išanalizuoti ir įvertinti ekologinės teisės normų socialinį veiksmingumą. Tyrimo tikslas: išanalizuoti ir įvertinti ekologinės teisės įgyvendinimo Lietuvoje, kaip tarptautinės ir Europos Sąjungos teisės subjekto, socialinį veiksmingumą. Siekiant išsikelto tikslo, pagrindiniai uždaviniai: įvertinti tarptautinės aplinkos apsaugos politikos veiksmingumą sprendžiant pasaulines aplinkosaugos problemas, išanalizuoti Europos Sąjungos ir Lietuvos aplinkos apsaugos teisės aktų kryptis ir veiksmingumą, įvertinti Nord Stream projekto suderinamumą su tarptautinėmis, Europos Sąjungos, taigi ir Lietuvos aplinkos apsaugos teisės normomis, išanalizuoti Lietuvos veiksmus Nord Stream dujotiekio projekto planavimo procese bei užtikrinant aplinkos apsaugos nuostatų įgyvendinimą. [toliau žr. visą tekstą] / Master Work, analysing social efficiency of implementing environmental law in Lithuania, is relevant in understanding why environmental laws, though comprehensive and strict, often seem to fail proving their social efficiency. Analysing Nord stream pipeline project, one can reveal any amount of basic environmental principles and guidelines. Also to be emphasized, that Nord Stream project nowadays is one of the most controversial environmental, as well as political, social, economical issue in the Baltic Sea region. The object of the research is to analyse and assess the efficiency of environmental laws. The aim of the research is to analyse and assess the social efficiency of implementing ecological law in Lithuania, as subject of international and EU law. Main tasks in achieving the mentioned aim: to assess the efficiency of international environmental policy solving environmental problems worldwide; to analyse main streams and efficiency of EU and Lithuanian environmental laws; to assess the project of Nord Stream in the context of international and EU, including Lithuanian laws; also to analyse the actions of Lithuania in the process of Nord Stream project planning and ensuring the embodyment of environmental laws. O trabalho abordará as conseqüências dos atos terroristas no meio ambiente. A aplicação da disciplina da responsabilidade civil é o mecanismo jurídico adequado para o enfrentamento da questão referente à responsabilidade pelos danos causados ao meio ambiente pela atividade terrorista. Os atos terroristas, que atualmente assombram a comunidade mundial, além de acarretarem inúmeras e terríveis mortes humanas, acarretam também danos ambientais, que podem prejudicar, em muitos casos, grande parte da população mundial, colocando o futuro da humanidade em grave perigo. O meio ambiente é essencial para a sadia qualidade de vida e está interligado ao direito à saúde e à vida, sendo caracterizado como um direito da pessoa humana de terceira geração. Assim, abordaremos o direito a um meio ambiente equilibrado e sadio como um direito fundamental do homem. O meio ambiente reflete valores comuns e superiores e constitui interesse comum de toda a sociedade. Dessa forma, estabelecer o responsável pelos danos ambientais ocorridos e que sejam decorrentes dos atos terroristas mostra-se extremamente relevante, vez que esses atos estão cada vez mais audaciosos e têm prejudicado um número maior de comunidades. Os assuntos relacionados ao terrorismo não conhecem fronteiras, especialmente no que diz respeito às questões sobre as conseqüências desses seus atos no meio ambiente. O mundo não pode ficar inerte a tais acontecimentos. The environment is essential to a healthy quality of life and is intertwined to the right to health and life, which is a third generation human right. Thus, we deal with the right to a balanced and healthy environment as a fundamental right of man. The environment reflects common and higher values and constitutes a common interest of all society. Hence, to establish those responsible for environmental harm resulting from terrorist acts has been shown to be of extreme relevance, given that these acts are increasingly audacious and have been harming a greater number of communities. Terrorism-related issues know no borders, especially as regard the consequences of these acts for the environment. The world cannot remain inert to such events. To this end, the State exercises a fundamental role, bearing in mind it has a duty to repress and prevent terrorism and the greater duty to conserve the environment for present and future generations.

Creating a new declaration of rights : a critical reconstruction of earth jurisprudence's global legislative framework

This thesis aims to critique the Universal Declaration of the Rights of Mother Earth and its underlying moral justification in order to provide a stronger and improved version of both. In Chapter 1 I explore what sort of moral justification is necessary to establish the Universal Declaration on firm grounds and explore its relation to environmental ethics and rights discourse. I argue that a non-anthropocentric perspective is necessary to justify the Universal Declaration’s rights. In Chapter 2 I explore the underlying justification of the Universal Declaration as discovered in the works of Cormac Cullinan and Father Thomas Berry. I argue that their ethical framework is indeterminate, has many ambiguities and uncertainties, and, among other problems, it does not provide a clear action-guiding framework. In Chapter 3 I develop an alternative justification for the Universal Declaration. I argue against many predominant moral theories, that in light of our best scientific and moral understanding we should expand the realm of moral concern to include all living beings, a moral theory I call Life’s Imperative. In Chapter 4 I illustrate that Life’s Imperative is a much stronger, more coherent justification for the Universal Declaration, one that coheres with both our best understanding of the natural world and our relation to it, and to an environmental ethic reflective of that relationship. Unfortunately many of the weaknesses in the current implicit justification of the Universal Declaration have also led to it enshrining rights that are themselves problematic. In order to address these issues, I revise its rights to accord with the stronger justification that I established in Chapter 3. The end result of doing so is a revised version of the Universal Declaration
