Cette étude comparative entre les systèmes français et koweïtien, est d’une potentielle grande richesse, tant du point de vue de la recherche juridique, que de celui de la pratique professionnelle. D’autant plus qu’en France, la motivation des décisions judiciaires et en particulier, des arrêts de la Cour de cassation est une obligation essentielle et le contrôle de la motivation, une mission première pour garantir le droit à un procès équitable. Actuellement la motivation des arrêts de la Cour de cassation est l’objet d’un projet de réforme dans le cadre plus général de celui de la Cour de cassation. Ce projet est suivi avec intérêt au Koweït, pays très influencé par la procédure civile française sous le contrôle d’une juridiction supranationale. Il n’y a de douter que le Koweït inclura dans sa trajectoire juridictionnelle tout progrès issu de la réforme en cours. / This study that compares the French legal system and the Kuwaiti legal system is a valuable study with multiple aspects to its legal research and professional applications. For France, the rulings of its "Court" and overseers is necessary for a just trial. Now, they both are a study subject for a project to alter the role of the “Court” in a general way. This project is of utmost importance to the Kuwaiti judicial system as it affected by its history with the French civil law. In addition, it is important as well for the respected and known place as the highest court in the judicial system. (Compared with the European court for human rights). In the shadow of the MQ-1 Predators : The Right to a Fair Trial and the way onto the CIA’s infamous ‘Kill List’Greeves, Leo-David January 2024 (has links)
This thesis aims to analyse the Central Intelligence Agency’s (CIA) potential violation of the right to a fair trial in placing alleged terrorists on the infamous ‘kill list’ without due process. The CIA has operated a targeted killing program using Armed Unmanned Aerial Vehicles (AUAV) over ‘areas outside active hostilities’, such as Yemen, since 2002. Due process is inherent to modern democratic societies and shapes their rule of law. The doctrinal legal analysis makes use of the key principles of due process to analyse the relevant Presidential Policy Guidance, its compliance with International Covenant on Civil and Political Rights (ICCPR) Art. 14, and a case study. These key principles and analyses will result in a clear overview of the program’s violations of the right to a fair trial. Concluding that the CIA’s AUAV program for targeted killing, particularly in Yemen, constitute extrajudicial executions.

The objective of this thesis is to assess the impact and influence of South Africa's
Constitutional Court in the first two years of our democracy. To achieve this objective,
some of the definitive and controversial cases already decided by the Court have been
selected and analysed in an attempt to glean some jurisprudential perspectives of the
Court.
It focuses on the work of the Court over the past two years. It deals with the evolution
of South Africa into a democracy, and analyzes the South African legal system prior to
the beginning of the process of transformation. It briefly surveys the evolution of our
constitutional system, dating back from the pre-1910 colonial period and provides a
broad outline of the legal system in the post-April 1994 period of transformation.
It analyzes the Court from the point of view of, inter alia, its composition, jurisdiction and
powers. The Court is also contrasted with courts in other jurisdictions which exercise
full judicial review.
The Court's emerging jurisprudence is examined. A review is made, inter alia, of the
Court's understanding of, and approach to, the questions of the values underpinning
the post-apartheid society and its constitutional system, and constitutional
interpretation.
The right against self-incrimination and South African company law and the two relevant
Constitutional Court cases are discussed.
The collection of evidence by the State and the constitutionality of provisions relating
to search and seizure and the taking of fingerprints are looked into.
The Court's approach to statutory presumptions and criminal prosecutions; some aspects of our appeals procedures; an accused's right to be assisted by a lawyer at
state expense; the question of a fair trial and access to information; capital punishment;
corporal punishment; committal to prison for debt; and the certification of constitutions
is analyzed.
Two of the cases in which the provinces clashed with the national government on the
distribution of posers between provinces and the national government are discussed.
The conclusion is that the Court has, overall, hitherto acquitted itself well in the handling

Cette recherche aborde un sujet complexe, qui est en plein débat doctrinal en droit de l'arbitrage international: L'arbitrage commercial international et les garanties procédurales.
Au fait, l'arbitrage commercial international revêt le mode traditionnel des règlements de litiges du commerce international et des relations économiques internationales. À cause de l'hybridité de sa nature (contractuelle et juridictionnelle), il est le plus souvent préféré par les parties aux tribunaux étatiques. Cette faveur vis-à-vis de ce mode de règlements de litiges internationaux s'explique par le développement de l'économie internationale, par la globalisation du marché, par la conclusion de nombreuses conventions internationales en la matière, par la création des centres d'arbitrage, enfin par la modernisation des lois et règlements nationaux. En revanche, il est constaté que l'arbitrage souffre d'un déficit de prévisibilité et de certitudes pour les acteurs du commerce international. Que l'on songe seulement à la multiplication des rattachements législatifs et des contrôles judiciaires: conflits de lois, conflits entre les règles de conflits, etc. Nous avons démontré que la solution aux difficultés de la méthode conflictualiste serait l'harmonisation de la procédure arbitrale internationale et que ce mode de règlement de différends débouche de plus en plus sur le rapprochement entre traditions juridiques différentes (Common Law et droit civil).Toutefois, ce mouvement de convergence est loin d'être achevé. Beaucoup d'autres pratiques arbitrales continuent de garder l'empreinte de la diversité des procédures étatiques et celle des grands systèmes juridiques mondiaux. / This research work tackles a complex subject, which is in the heart of a doctrinal debate in
International arbitration Law: International Commercial Arbitration and procedural safeguards. In fact, International Commercial Arbitration is a traditional method of dispute resolution in International Trade and International Economic Relations. Parties to a dispute would rather prefer this mode of dispute resolution to state courts because of its hybrid nature (contractual and judicial).One can explain this preference for this method of international dispute resolution by the development of the international economy, the market globalization, the conclusion of numerous international conventions in the domain, the creation of arbitration centers, the modernization of national laws and regulations. By contrast, one can note that arbitration lacks predictability and certainty for parties in International Trade. One can just think of the multiplication of legislative attachments and judicial controls: conflicts of laws, conflicts between methods of conflicts of laws, etc. We have demonstrated that the solution to the difficulties of the conflictualist method would be the harmonization of the International Arbitral Procedures and that this method of dispute resolution would lead, more and more to the approximation between different judicial traditions (Common law and Civil Law). However this convergence movement is far from being achieved. Many other arbitral practices do still keep the imprint of diverse state procedures and of major legal systems worldwide.

70 Abstract This diploma thesis is focused mainly on the judgment by acknowledgement and judgment by default which are institutes of the civil procedural law, which purpose is mainly to increase the efficiency of the legal proceedings. The aim of the thesis is to offer a complete overview of the current legal legislation and its practical usage. At the same time this thesis attempts to cope with problems, which the current legislation suffers with, and offers convenient conceptual solutions. This piece of work is divided into five chapters. The first chapter generally concerns the judgment by acknowledgement and clarifies the conditions in details that are essential to meet for its issuance. It concurrently distinguishes the judgment issued on the basis of actual acknowledgement by defendant and a judgment issued on the basis of legal fiction of acknowledgement of claim. The second chapter is dedicated to the institute of judgment by default. In the first subchapter the individual preconditions for the judgment by default issuing are being discussed in details, whether the formal or the material ones. This subchapter is divided according to these individual preconditions. Si le respect du droit à un procès équitable devrait occuper une place éminente au sein de toute société démocratique, cette exigence revêt un caractère axiomatique au sein d'une juridiction tournée vers la lutte contre l'impunité et la protection des droits de l'homme, telle que la Cour pénale internationale. Le peu de jugements rendus depuis plus de dix ans par la Cour permanente pourrait laisser penser qu'une telle étude est encore prématurée. Cette analyse met au contraire en exergue la densité de son activité et la singularité de ses procédures. Sacralisé par la Cour européenne des droits de l'homme, le droit à un procès équitable se décline en règles qui régissent non seulement les relations entre les parties mais aussi les rapports des individus avec la juridiction. Si la notion de droit à un procès équitable est familière des juristes, son interprétation pose un certain nombre de difficultés nouvelles. L'hybridité structurelle et normative de la Cour pénale internationale influencera nécessairement la réception que celle-ci réservera au principe, mais également l'interprétation unique qu'il conviendra de donner à ce droit fondamental. Prenant acte du caractère novateur de cette juridiction, cette thèse n'omettra pas d'envisager le droit à un procès équitable sous le prisme singulier de la victime, nouveau visage du procès. In view of the few judgments rendered in over ten years of this permanent Court's existence, this study might seem somewhat premature.Rather, this analysis purports to shed light on the diverse nature of the Court's activities and the unique character of its procedures. Enshrined by the European Court of Human Rights, the right to a fair trial is expressed in the form of regulations that govern not only the relationships between the parties, but also the interaction of individuals with the Court. The concept of the right to a fair trial may be familiar to legal experts trained in different legal traditions. Still its interpretation is fraught with challenges that are new and specific to this permanent Court. The structural and normative hybridity of the ICC will inevitably influence not only the treatment of this concept, but also the unique interpretation that this fundamental right deserves. Against the backdrop of the innovative nature of this Court, it would be remiss of the author of this thesis not to consider the right to a fair trial through the unique prism of the victim, the new face in the trial. Often excluded from the judicial debate on the fairness of the proceedings, this analysis will nevertheless endeavour to place this stakeholder back in the heart of the concerns over the conduct of a fair trial.

La Pologne est un ancien État communiste qui a signé la Convention européenne des droits de l'homme en 1991 et l'a ratifiée en 1993. Le droit de recours individuel a été reconnu en 1993. Le changement de régime a exigé de revoir le système juridique polonais, dont les principes du procès équitable, afin de pouvoir se conformer aux exigences de la Convention. La France a signé la Convention en 1950, l'a ratifiée en 1974. Le droit de recours individuel a été reconnu en 1981. C'est un des plus anciens signataires de la Convention et actuellement un acteur majeur de la société internationale dont l'attachement aux droits de l'homme constitue un élément caractéristique de sa politique extérieure. Cette étude comparative détermine si les exigences concernant les tribunaux et le procès, ainsi que les droits garantis en matière pénale, imposés par l'article 6 de la Convention, sont respectés dans les deux États. D'un côté, cela permet de voir les différences et les similitudes entre la France et la Pologne qui peuvent sembler différentes à cause de leur histoire et de leur tradition de respect des droits de l'homme, mais qui également se ressemblent dans les mécanismes de protection des droits de l'homme mis en place et rencontrent les problèmes similaires, comme par exemple la durée excessive de la procédure ou le non-Respect du principe de l'égalité des armes.D'un autre côté, cela permet de vérifier si les organes internes ont bien appliqué et, le cas échéant, réparé les violations de la Convention, notamment par les réformes de la loi interne. / Poland is a post-Communist state which signed the Convention in 1991, and ratified it in 1993. The right to the individual application was established in 1993. The change of the regime required to reform the Polish legal system, including the principles of fair trial, to comply with the requirements of the Convention. France signed the Convention in 1950, and ratified it in 1974. The right to the individual application was established in 1981. It is one of the oldest members of the Convention and at the moment one of the major actors of the international society, whose attachment to human rights is one of the characteristics of its foreign policy. This comparative study sets out to determine whether the requirements concerning the courts and the trials, and the rights guaranteed in criminal matters imposed by the article 6 of the Convention are respected in both states. On the one hand, this enables us to see the differences and the similitudes between France and Poland. These two states can seem to be different because of their respective histories and traditions when it comes to the respect of human rights. However, in the final analysis, they deal with similar problems, as, for example, the excessive length of proceedings, or non-Respect of the principle of equity of arms. On the other hand, this enables us to verify if the judgements of the European Court of Human Rights have been entirely implemented by the two states, and, where necessary, if the infringements of the Convention were repaired, including the reforms of the internal law.

Inscrits dans le contexte actuel de mondialisation, le développement et la promotion remarqués des modes amiables de règlement des différends (MARD) témoignent d’une nouvelle appréhension de la production normative où le justiciable est placé au cœur du droit, l’entente se substitue à l’autorité, la discussion et le dialogue prévalent. Tandis que le temps économique ne semble plus cadrer avec le temps judiciaire dans ce contexte concurrentiel qui exige des réactions rapides, les MARD répondent à une demande concrète des entreprises. Placées au centre de ce processus vivant et complexe, les entreprises adaptent leur stratégie de gestion des conflits en faisant appel à des moyens qui servent le mieux leurs intérêts. La prévention des risques est une priorité, la gestion de l’aléa, un défi quotidien et l’adaptation au contexte évolutif à l’espace et au temps, la marque de l’efficience des instruments normatifs adoptés. Les MARD laissent ainsi entrevoir la résurgence de la question de la légitimité du droit et de la justice étatique. On a qualifié ce phénomène de justice douce mais s’agit-il d’une forme de justice fut-elle alternative ? La réponse à cette question dépend de la compréhension globale que nous avons de ce phénomène. Cette réflexion se propose ainsi de le définir bien plus que comme la seule mise en œuvre de modes consensuels de traitement des différends, mais, véritablement comme l’expression d’un ordre juridique en développement. Approuvé par ses principaux usagers, les MARD deviennent un outil efficace de justice équitable. La notion de justice est alors envisagée, non pas dans son sens organique, mais substantiel, la justice pouvant être aussi consensuelle. / As part of the current context of globalisation, the development and promotion of the alternative dispute resolution (ADR) clearly show a new approach in the production of norms, whereby the litigant is positioned at the very heart of the rule of law, and where mutual understanding replaces authority, and discussion and dialogue prevail. While economic time no longer correlates with judicial time in the competitive framework, which by its very nature demands rapid reactions, the ADR process meets concrete corporate needs. At the core of this active and complex process of globalisation, corporations adapt their conflict management strategies through ways which best serve their interests. Risk prevention is a priority, risk management a daily challenge and the adaptation to the evolving context, in space and time, the sign of efficiency of the normative tools used. Thus, ADR and its involvement in the globalisation process, raises anew the issue of the legitimacy of law and court justice. This phenomenon has been qualified as negotiated or consensual justice, but is it at its core a form of justice, even an alternative one? The answer to this question mainly depends on the overall understanding of the ADR phenomenon. That is why this thesis proposes to view it as more than just a simple implementation of a consensual dispute resolution tool as it is often depicted, but more genuinely as the expression of a developing legal order. Approved by its main users, the ADR process has become an instrument of fair and effective justice and has captured the concept of justice in its essence rather than in its structure.

This thesis deals with a description and analysis of the EU law and policy on Schengen visas. The EU visa policy is analysed in its historical development and its place in the framework of Schengen acquis. Separately, important visa policy measures are analysed including the typology of visas, exceptions from visa obligation, visa reciprocity, visa facilitation and processes of visa liberalisation. Different phases of the visa procedure are studied with focus on the questions whether there is a right to be issued a Schengen visa when the conditions are met and the right of appeal. The relevant legislation subject to analysis is above all the Visa Code, the regulation on visa lists and the relevant jurisprudence of the Court of Justice. By way of illustration, the implementation in the Czech legal order is used and jurisprudence of the Czech higher courts is quoted to show to what extent the EU visa procedure and visa refusal matches the requirements of the administrative law theory on the administrative procedure and decision in general. The relevant rules are assessed as to the extent they match with principles of legitimacy, influence of legal certainty, effectiveness and proportionality. Edh et un domaine dans lequel l’œuvre interprétative de la Cour Edh se fait l’un des laboratoires les plus intéressants pour la comparaison juridique. La « règle de la preuve unique ou déterminante » fixe un standard de garantie minimale, selon lequel la condamnation ne peut pas se fonder, exclusivement ou principalement, sur des éléments de probatoires dont l’administration n’a pas respecté, au niveau interne, les droits que la Convention reconnaît à l’accusé.
