[pt] A pesquisa sobre os vendedores ambulantes se insere em um contexto mais amplo, em uma sociedade determinada: a sociedade capitalista, onde o cotidiano de trabalho desses sujeitos pode nos revelar as facetas mais obscuras do processo de precarização e informalização do trabalho, cada vez mais presente no mundo contemporâneo. Por entendermos, através de diversas leituras, que a exploração capitalista e a dominação patriarcal caminham de forma conjugada e não podem ser vistas de maneira cindida, a análise do processo de precarização do trabalho se relacionou a uma perspectiva de gênero. Com este propósito, resolvemos focar no trabalho das mulheres em um mercado tão competitivo como o dos ambulantes no transporte ferroviário de circulação de pessoas da Região Metropolitana do Rio de Janeiro. Também utilizamos a categoria território para apreender as relações de poder, e com isso as de gênero, produzidas e reproduzidas pelos ambulantes nesse transporte. Visando alcançar os objetivos da pesquisa foi realizado um trabalho de campo, que teve início em janeiro de 2022 e foi concluído em maio deste mesmo ano. O trabalho de campo consistiu em observação participante e em entrevistas com trabalhadores ambulantes nos cinco principais ramais dos trens urbanos da RMRJ. Foram realizadas 6 (seis) entrevistas semiestruturadas de forma completa, além do depoimento de outros ambulantes dentro e fora do transporte ferroviário. Também foram acessados dados secundários de institutos de pesquisa e realizada revisão bibliográfica. Tudo isso nos possibilitou ferramentas teóricas e metodológicas para analisar as experiências de mulheres trabalhadoras que vivenciam a precariedade em territórios de maioria masculina. / [en] Research on hawkers is inserted in a wide context determined by the capitalist society in which their daily work can reveal to us the most obscure facet of the process of informalization and precarization of labor that is increasingly present in the contemporary world. By means of several readings, we understand that capitalist exploitation and patriarchal domination are tightly connected and cannot be separated, thus, the analysis process of precarization of labor is related to a gender perspective. To this end, we focused on women working in the extremely competitive hawker’s market of rail transport in the Rio de Janeiro metropolitan area. We use the category called territory to seize the power relations and also gender relations produced and reproduced by hawkers in this means of transport. Aiming to achieve the purpose of the research, fieldwork started in January 2022 and ended in May 2022. The fieldwork consisted in observing and participating and interviewing the hawkers in the five principal RMRJ branches of train lines. We did six completed and semi-structured interviews in addition to other hawkers brief inside and outside railroad transportation. We also accessed secondary data from research institutes and we did literature review. All of it gave us theoretical tools and methodology to analyze the experience of women who experience precarity in male majority places.

El presente informe analiza los principales fundamentos de la Resolución N° 1122-2007/TDCINDECOPI, emitida por el Tribunal de Defensa de la Competencia y Propiedad Intelectual del Indecopi, mediante la cual declara responsable a la empresa Ferrocarril Trasandino S.A.C (en adelante, Fetrans) y le impone como medida correctiva el cese del abuso de la posición de dominio, así como una multa ascendente a 165,9 UIT. Ello a propósito del procedimiento administrativo sancionador iniciado de oficio y como consecuencia de la denuncia interpuesta por la empresa Ferrocarril Santuario Inca Machupicchu S.A.C. La sanción impuesta corresponde a la infracción a los artículos 3° y 5° del Decreto Legislativo N° 701 cometida por la empresa Fetrans, al haberse demostrado la negativa injustificada de alquilar el material tractivo y rodante otorgado en concesión por el Estado peruano. El análisis de los problemas jurídicos identificados nos permite afirmar la insuficiencia de la medida correctiva ordenada por el Tribunal, siendo que, con dicho pronunciamiento, se dejó abierta la posibilidad de que se continúe en un mercado con condiciones anticompetitivas, aún cumpliendo con el mandato; por lo que, la reformulación de la misma o la consideración del servicio de alquiler de material de locomotoras y vagones con capacidad de operar en el tramo Sur Oriente peruano (en adelante, el material) por parte del Ositran , resultan alternativas menos gravosas que pudieron haber sido consideradas por la autoridad administrativa o que podrían serlo en posteriores pronunciamientos. En el mismo sentido, el análisis de los requisitos de validez de la resolución previa que habilita el pronunciamiento del Tribunal nos permite afirmar la validez del acto administrativo en esta última instancia. / This report analyzes the main foundations of Resolution No. 1122-2007/TDC-INDECOPI, issued by the Court for the Defense of Competition and Intellectual Property of Indecopi, by which it declares the company Ferrocarril Trasandino S.A.C (hereinafter, Fetrans) and imposes as a corrective measure the cessation of the dominant position, as well as a fine amounting to 165.9 UIT, this in connection with the disciplinary administrative procedure initiated ex officio and as a consequence of the complaint filed by the company Ferrocarril Santuario Inca Machupicchu S.A.C. The sanction imposed corresponds to the violation of articles 3 and 5 of Legislative Decree No. 701 committed by the Fetrans company, having demonstrated the unjustified refusal to rent the tractive and rolling stock granted in concession by the Peruvian State. The analysis of the legal problems identified allows us to affirm the insufficiency of the corrective measure ordered by the Court, being that, with said pronouncement, the possibility of continuing in a market scenario with anti-competitive conditions was left open, even in compliance with the mandate; Therefore, its reformulation or the consideration of the material rental service for locomotives and wagons with the capacity to operate in the Peruvian South East section (hereinafter, the material) by Ositran, are less burdensome alternatives that could have been considered by the authority or could be considered in subsequent pronouncements. In the same sense, the analysis of the validity requirements of the resolution that enables the Court's pronouncement allows us to affirm the validity of the administrative act in this last instance.

[pt] Considerando o investimento do governo federal na expansão da malha ferroviária com o programa de aceleração do crescimento (PAC2) e com o programa de investimento em logística (PIL), vem sendo desenvolvidas no país inúmeras pesquisas envolvendo ferrovias, inclusive na área de materiais, como o lastro ferroviário, objeto de estudo deste projeto. Paralelamente, pesquisas com foco em modelagem computacional vem sendo desenvolvidas a fim de otimizar a avaliação do comportamento dos materiais. O projeto tem como objetivo desenvolver modelos computacionais para avaliar a capacidade do método dos elementos discretos em reproduzir o comportamento mecânico de lastro ferroviário submetido a carregamentos cíclicos, com base em um ensaio triaxial cíclico. O ensaio analisou o comportamento mecânico de duas distribuições granulométricas de lastro ferroviário, sendo a primeira sugerida por Indraratna et al. (2004), referente a alterações para melhorias da normativa australiana, enquanto a segunda, utiliza a normativa brasileira. O modelo computacional foi desenvolvido no software WooDEM (2012). Foram realizadas análises mecânicas do comportamento do lastro ferroviário considerando as coordenadas das partículas em relação ao tempo e a profundidade, a fim de determinar o deslocamento gerado pelo carregamento cíclico. / [en] Considering the federal government s investment in the expansion of the railway network with the growth acceleration program (PAC2) and with the investment in logistics program (PIL), numerous surveys involving railways have been developed in the country, including in the area of materials, such as the rail ballast, object of study of this project. In parallel, research focused on computational modeling has been developed in order to optimize the evaluation of the behavior of materials. This dissertation aims to develop computational models to evaluate the ability of the discrete element method to reproduce the mechanical behavior of cyclically loaded rail ballast, based on a cyclic triaxial test. The study analyzed the mechanical behavior of two rail ballast granulometric distributions, the first being suggested by Indraratna et al. (2004), regarding changes to improve Australian regulations, while the second, uses the Brazilian legislation. The computational model was developed in WooDEM software (2012). Mechanical analysis of the rail ballast behavior was performed considering the coordinates of the particles in relation to time and depth in order to determine the displacement generated by the cyclic loading.

Contribución a la reducción de los costes de mantenimiento de vías de alta velocidad mediante la opitimización de su rigidez vertical

La experiencia adquirida en las líneas de alta velocidad en explotación comercial ha puesto de relieve la importancia de la rigidez vertical de la vía y en particular la conveniencia de limitar su magnitud para minimizar los esfuerzos transmitidos a la estructura y su consecuente deterioro. Sin embargo, la dispersión de soluciones adoptadas para la superestructura de las líneas de nueva construcción en Europa pone de manifiesto que todavía no existe ningún criterio que establezca cual debe ser la magnitud de diseño de la rigidez vertical de una vía. La presente tesis analiza esta problemática para el caso de vías sobre balasto en el ámbito del diseño de nuevos trazados de alta velocidad. El importante papel de la rigidez vertical en el deterioro de la calidad geométrica de la vía, así como en las resistencias al avance de los vehículos, confirman el interés en lograr un valor de este parámetro que optimice los respectivos costes económicos asociados. En base a los conocimientos disponibles se desarrolla una metodología que permite evaluar dicho impacto económico y a su vez establecer un rango de valores de rigidez vertical óptima en función de la magnitud de los principales parámetros característicos de la línea en estudio (material circulante, condiciones de explotación, coste energético, etc.). Los resultados alcanzados indican que, para una vía de alta velocidad con un importante volumen de tráfico y bajo la perspectiva dual señalada, el valor de rigidez vertical óptimo se sitúa entre 70 kN/mm y 80 kN/mm. Por otra parte, se reflexiona sobre como lograr un diseño estructural de la vía que permita alcanzar el valor óptimo de rigidez vertical en función de las características de la infra-estructura de la línea en estudio. Se evidencia que para una vía típica de alta velocidad, la rigidez de la superestructura ferroviaria debe situarse entorno a 60 kN/mm. A su vez, se analiza la incidencia de las dispersiones de rigidez vertical de la vía a lo largo de un trazado, estableciendo un criterio de máxima variación de ese parámetro entre traviesas consecutivas, que permita prevenir un deterioro acelerado de la vía en zonas puntuales y garantizar la validez del modelo desarrollado. Se comprueba que las máximas variaciones admisibles oscilarían entre 20% y 50% según la rigidez vertical de referencia, criterio muy difícil de cumplir en vías excesivamente rígidas, pero que se cumple siempre si la superestructura ferroviaria corresponde al valor óptimo definido en este estudio. / The experience gained since the beginning of commercial operation on high-speed lines has confirmed the importance of the track vertical stiffness parameter and, specially, the need to limit its value to minimize the track stress level and avoid its excessive deterioration. However, the wide range of solutions adopted for the super-structure on the new European high-speed lines confirms that there is still no design criteria that defines clearly what should be the desired vertical stiffness of the track. The aim of this thesis is to approach this issue from the viewpoint of the design of new high speed ballasted tracks. The significance of the track vertical stiffness on the deterioration of its geometrical quality as well as on the energetic consumption of the rolling stock confirms the interest of reaching a value for this parameter that optimise the costs related to both factors. Therefore, this thesis develops a methodology that allows to define a range of this optimum value, based on the most relevant parameters of a given line (rolling stock characteristics, energy cost, running speed, etc.). It is shown that for a high-speed line with a significant traffic volume, the optimum track vertical stiffness threshold, from the mentioned dual perspective, would be situated 70 and 80 kN/mm. In another hand, the study focus on how to reach this optimum value depending on the infra-structure characteristics of the line. It is seen that for a typical high-speed line, the optimum stiffness of the super-structure is about 60 kN/mm. Additionally, an analysis of the influence of track stiffness dispersion along a route is carried out. Based on the results obtained, the establishment of a criteria that limits the maximum variation of this parameter between consecutive sleepers is proposed, as to avoid an accelerated track deterioration on some punctual locations and to guarantee the validity of the developed model. It is shown that the maximum admissible variations would be situated between 20% to 50% depending on the reference stiffness value, a level very difficult to achieve on track with an excessive stiffness, but that is always accomplished if the track super-structure is close to the defined optimum value.

[pt] As ferrovias, como meio de transporte de passageiros tão popular e acessível em diversas partes do mundo, já foram muito exploradas no Brasil, nos séculos XIX e XX, mas, hoje em dia, praticamente se extinguiram no país, onde impera a vasta indústria automobilística. Com uma população de 208 milhões de brasileiros, a baixa incidência do transporte ferroviário compromete a eficiência e a competitividade das atividades econômicas, gerando a denominada produção sacrificada e aumentando o custo Brasil, incluindo os acidentes de trânsito, com consequências onerosas para a máquina pública. Desde 1988, com a nova Constituição, observa-se o fenômeno do vácuo geopolítico de poder público, propiciando vasta margem de atuação à iniciativa privada, no controle e gestão territorial, gerando efeitos opostos e contraditórios, caracterizando-se o chamado paradoxo organizacional. Assim, a pesquisa teve como objetivo verificar os principais entraves da gestão e os motivos de conflitos de interesse para a ativação do sistema de transporte ferroviário de passageiros no trecho Macaé-Campos, à luz do Projeto da EF-118 e de outros fatores agravantes. Analisou-se a mobilidade regional ferroviária não apenas como alternativa possível de transporte de massa, mas como um vetor de desenvolvimento, capaz de impulsionar novos processos de ordenamento territorial e de desenvolvimento tecnológico e econômico, ampliando-se as visões e os desafios de médio e longo prazo, principalmente do ponto de vista da gestão pública regional para o estado do Rio de Janeiro. / [en] Railways, as a means of passenger transportation that is so popular and accessible in various parts of the world, were already widely explored in Brazil in the 19th and 20th centuries, but nowadays they have practically extinguished in the country, where the automotive industry vastly prevails. With a population of 208 million Brazilians, the low incidence of rail transport compromises the efficiency and competitiveness of economic activities, generating the so-called sacrificed production and increasing the Brazil cost, including traffic accidents, with costly consequences for the public finance. Since 1988, with the new Constitution, the phenomenon of the geopolitical vacuum of public power has been observed, providing a wide scope for private initiative in territorial control and management, generating opposing and contradictory effects, characterizing the so-called organizational paradox. Thus, the research had as objective to verify the main obstacles of the management and the reasons of conflicts of interest for the activation of the railway system of passangers in the section Macaé-Campos, in light of the Project of EF-118 and other aggravating factors. Regional rail mobility was analyzed, not only as a possible alternative of mass transport, but as a vector of development, capable of boosting new processes of territorial organization and of technological and economic development, enlarging the visions and challenges of medium and long-term, mainly from the point of view of regional public management for the state of Rio de Janeiro.

La presente tesis que propone un “Tren de Cercanías”, busca desarrollar a nivel de superficie el trazo de la 2da línea férrea de una longitud de 53.00 Km. para el transporte masivo de pasajeros, apoyada en la existente infraestructura ferroviaria del ferrocarril del centro; para intercomunicar a través de ésta doble vía, las urbes periféricas de la ciudad de Lima (Este-Oeste) desde Chosica hasta el Callao de una forma rápida, segura y eficiente; el mismo que servirá como “Alimentador e Integrador” de las principales líneas de transporte urbano de Lima Metropolitana ya existentes y futuras. [pt] Este trabalho trata do problema real de avaliar a capacidade de processamento de pátios ferroviários planos de classificação. Nesses pátios, os vagões são recebidos em trens e movimentam respeitando a disposição dos trilhos e a formação sequencial do trem de saída. Movimentações ineficientes implicam em uma capacidade de processamento inferior à potencial do pátio dado seu layout. O objetivo desta pesquisa é descrever o problema e incitar um método capaz de calcular a capacidade de processamento de pátios ferroviários planos de classificação no horizonte estratégico, indicando se existe ou não a necessidade de um projeto de expansão para garantir atendimento à demanda prevista. O problema foi modelado através de programação linear inteira mista (MILP) baseado na teoria de sequenciamento de produção. O modelo foi aplicado em instâncias de teste, reproduzindo movimentações reais de vagões, e provou avaliar diferentes layouts adequadamente, porém com elevado tempo de execução. A inicialização de algumas variáveis binárias do modelo permitiu um incremento de tamanho nas instâncias, porém ainda inviável para aplicação na prática. / [en] This work deals with the real problem of evaluating the processing capacity of flat rail classification yards. In these yards, the railway cars are received on trains and move respecting the car sequence of the outgoing train. Inefficient movements imply a lower processing capacity than the yard s potential given its layout. The objective of this research is to describe the problem and to incite a method capable of calculating the processing capacity of flat rail classification yards in the strategic horizon, indicating whether or not there is a need for an expansion project to ensure meeting the expected demand. The problem was modeled using mixed integer linear programming (MILP) based on production scheduling theory. The model was applied to test instances, reproducing real railway car movements, and proved to evaluate different layouts properly, but with a high execution time. The initialization of some binary variables of the model allowed an increase in the size of the instances, however it is still unfeasible for practical application.

El Sector Transportes tiene como misión principal la integración interna y externa del país, es decir, mejorar el servicio en transporte de todos los peruanos como el traslado de personas, mercancías, mejorar el sistema agrícola, interconexiones, comunicación, desarrollo económico y social. Para cumplir con la misión del sector transportes es importante realizar un continuo seguimiento en las inversiones que están en ejecución, las cuales hacen sinergia con los planes estratégicos institucionales del sector. Ante ello se desarrolla a líneas generales las pautas de seguimiento y gestión para la Ejecución de Inversiones desarrolladas por el Ministerio de Transportes y Comunicaciones 2021. En ese sentido, el presente documento expone mi experiencia laboral como Analista Financiera en la Dirección de Inversión Privada del sector Transportes, en la cual realizo el seguimiento y monitoreo de acuerdo a la programación multianual de inversiones del presente año fiscal para las concesiones viales, puertos, aeropuertos primer y segundo grupo, ferrocarriles, Línea 2 y disponibilidad de predios de las concesiones asignadas. La información presentada se enfocará en el proyecto de rehabilitación y mejoramiento del Ferrocarril Huancayo Huancavelica a cargo de la Dirección General de Infraestructura en Servicio de Transporte (DGIST-MTC).

Inca Rail SA es una empresa privada perteneciente al grupo económico de Carlyle Perú que fue constituida en el año 2006, la cual se dedica al transporte terrestre de pasajeros por las vías férreas y presta servicios generales vinculados al sector turismo. Actualmente posee una participación en el mercado del 21% y el servicio está enfocado en un 90% a turistas extranjeros mientras que los nacionales solamente alcanzan un 10%. Debido a la pandemia por la COVID-19, el sector turismo fue el más afectado debido a que la llegada de los turistas extranjeros se ha reducido por las medidas extremas tomadas por los gobiernos a través del cierre de fronteras a nivel mundial y nacional ocasionando una disminución significativa de las ventas en la empresa para los periodos 2020 y 2021. El objetivo de la presente consultoría de negocios es analizar el problema clave y brindar las soluciones respectivas con un plan de implementación. Después de efectuar reuniones con los ejecutivos de la empresa se identificaron tres problemas claves: (a) Insatisfacción laboral; (b) Inadecuada comunicación interna y externa; y (c) Disminución significativa de las ventas. Posteriormente a través del análisis se consideró como alternativas de solución: (a) alianza con agencias turísticos internacionales en países de altos índice de inoculación; (b) paquetes turísticos integrales para extranjeros; (c) implementación de la moneda soles en la web de pagos y puntos de venta; (d) descuentos para el turista nacional; (e) paquetes turísticos integrales para turistas nacionales y (f) publicitar en redes sociales los paquetes turísticos. Finalmente, las propuestas planteadas en la presente consultoría buscan que la compañía pueda recuperar los niveles de ventas similares a prepandemia (año 2019) con resultados positivos históricos. Con las medidas planteadas se proyecta que las ventas se recuperen en el 2022 en un 70% y en el 2023 en un 100%, en comparación a niveles prepandemia. It currently has a market share of 21% and the service is focused 90% on tourists, while nationals will only reach 10%. Due to the COVID-19 pandemic, the tourism sector was the most affected because the arrival of foreign tourists has been reduced by the extreme measures taken by governments through the closure of borders at the global and national levels, causing a significant decrease in sales in the company for the periods 2020 and 2021. The objective of this business consultancy is to analyze the key problem and provide the respective solutions with an implementation plan. After implementing meetings with company executives, three key problems were identified: (a) Job dissatisfaction; (b) Inadequate internal and external communication; and (c) Significant decrease in sales. Subsequently, through the analysis, the following alternative solutions will be concluded: (a) alliance with international tourist agencies in countries with high rates of inoculation; (b) comprehensive tourist packages for foreigners; (c) implementation of the soles currency on the payment website and points of sale; (d) discounts for national tourists; (e) comprehensive tourist packages for national tourists and (f) publicize the tourist packages on social networks. Finally, the proposals proposed in this contract seek to enable the company to recover sales levels similar to pre-pandemic (year 2019) with positive historical results. With the proposed measures, it is projected that sales will recover by 70% in 2022 and by 100% in 2023, compared to pre-pandemic levels. In addition, the current value of the flows for the 2022-2024 period is S/80,367,368.52, 17.7% higher than the current flows without the implementation of the measures.

Transferability assessment of railway infrastructure charges: contribution to a conceptual framework.

La evaluación preliminar de los resultados de la Reforma Ferroviaria Europea muestra la lentitud de su implementación y la existencia de insuficiencias en el nivel de competencia introducido en el mercado y en la consecución de los efectos económicos esperados. Una de las causas de este escaso éxito radica en la falta de harmonización de las regulaciones introducidas por la reforma en los diferentes Estados Miembros, así como en la mayor complejidad del sistema derivada de la propia reforma. Esta reflexión, especialmente apropiada para la diversidad actual de las tarifas por uso de infraestructura ferroviaria, ha contribuido a alimentar el debate sobre su posible homogeneización. El resultado preliminar de esta discusión todavía abierta sugiere la conveniencia de promover una mayor harmonización de los cánones de acceso a la red ferroviaria, lo que abre la puerta al concepto de transferibilidad (es decir, en qué medida una política o una práctica pueden ser transferidas de una a otra realidad). De acuerdo con estos antecedentes, esta tesis se ha planteado como objetivo el desarrollo de un marco conceptual para la evaluación de la transferibilidad en el ámbito de la tarifación por uso de la infraestructura ferroviaria. Para alcanzar esta meta, primero se han caracterizado los aspectos económicos y políticos más relevantes para la formulación de los cánones de acceso a la red ferroviaria y se ha revisado el concepto de transferibilidad desarrolado por otras disciplinas como la política comparada o la gestión. A continuación se han propuesto un marco de análisis multinivel y cuatro criterios de transferibilidad (indiferencia a las variaciones de contexto, indiferencia a las influencias externas, compatibilidad horizontal y compatibilidad vertical) y se han particularizado para el ámbito de las tarifas por uso de infraestructura ferroviaria. Además, el marco propuesto ha sido puesto a prueba mediante el desarrollo de seis casos de estudio apoyados en la práctica acual de algunos Estados Miembros. Los casos de estudio han evidenciado su validez como herramienta metodológica para organizar el análisis y formular criterios de transferibilidad efectivos en una fase temprana del proceso de transferencia. Asimismo, la experiencia conseguida a través de ellos ha señalado algunos aspectos del marco que podrían ser ulteriormente afinados, pero que no ponen en duda en ningún caso su habilidad para establecer condiciones necesarias (aunque no suficientes) sobre los objetos transferidos. / A preliminary evaluation of the results obtained so far by the European Railway Reform shows a slow evolution in its implementation and a number of shortcomes as regards the degree of competition introduced in the market and its expected economic effects. One of the causes behind this poor success is found in the failure to harmonize the regulatory aspects of the reform across the Member States, together with the increased complexity derived from the reform itself. This consideration is particularly appropriate in relation to the current diversity of railway infrastructure charges and has recently fostered the debate on whether they should be further standardized. The preliminary outcome of theongoing discussion suggests the convenience of promoting a greater harmonization of track access charges, opening the door to the concept of transferability (i.e. whether one policy or practice can be transferred from one to another reality). In line with this background, this thesis has been aimed at proposing a conceptual framework for the assessment of transferability in the field of railway infrastructure charging. To achieve this goal, the thesis has first characterized the more relevant economic and political aspects intervening in the formulation of track access charges and reviewed the notion of transferability as developed in other disciplines, notably in comparative politics and management science. Building on these bases the thesis has then proposed a multilevel analytical structure and four transferability criteria (indifference to contextual variations, indifference to external influences, horizontal compatibility and vertical compatibility) and particularized them for their use in the field of railway infrastructure charging. Additionally, the framework has been tested through the development of six case studies involving the current practice of European Member States. The case studies, based on a detailed and comparable characterization, have shown the validity of the conceptual structure proposed as a methodological tool able to organize the analysis and formulate effective transferability criteria at an early stage of the transfer process. Moreover, the experience obtained through the case studies has pointed out some aspects of the framework that could be further refined but that do not contest in any case its ability to establish necessary conditions (though not sufficient) on the objects transferred.
