Freedom of testation : a memento of capitalist patriarchy

The South African concept of freedom of testation is one of the most absolute concepts of freedom of testation in westernised legal systems. It is suggested that the South African concept of freedom of testation is a memento of capitalist patriarchy. As the South African legal system practices a nearly absolute concept of freedom of testation, capitalist patriarchy has maintained masculine control of property in South Africa and perpetuated the systems of male dominance prevalent in South Africa. Freedom of testation allows for wealth to pass from one male to another. It also allows entrenched gender roles to continue by excluding women from inheriting. Gabriel Christie's seigneuries : settlement and seigneurial administration in the Upper Richelieu Valley, 1764-1854

Gabriel Christie (1722-1799), a British military officer, acquired a vast estate in Quebec after the Seven Years war, including five timber-rich seigneuries in the Upper Richelieu Valley, our study area. These were inherited by two of his sons in succession: Napier Christie Burton (1758-1835) and William Plenderleath Christie (1780-1845). An examination of the available deeds of concession for our study area shows the legal framework of the tenure and the seigneurs' survey and land granting policies. Seigneurial rents increased between 1785 and 1820, but it was the accumulation of seigneurial arrears, followed by strict collection practices after 1835, which contributed most to social stratification and unrest. A seigneurial monopoly on mill construction and the use of water power was decentralized after 1815 so that manufactures were established by entrepreneurs with capital who acquired a share of the seigneur's rights through patronage. The seigneur's role in regional development--the rise of villages, settlement, and industrial growth--was significant particularly as a system of clientage which helped shape the social structure.

Cette thèse porte sur l’iconographie des Rois mages du Xe au XIIe siècle à travers l’étude de son adaptation sur supports monumentaux dans l’Occident latin, pour déceler la reformulation du thème dans la « société féodale ». Pour ce faire, le premier fil conducteur est la conception du statut royal qu’acquièrent les Mages de l’Évangéliste Matthieu au Xe siècle, analysée parallèlement à celle de la figure dirigeante élaborée sur cette période et décrite par Marc Bloch dans Les Rois thaumaturges (1924) et par Ernst Kantorowicz dans Les deux corps du Roi (1957). L’optique est de définir la place des nouveaux Rois mages dans les intrications de liens « d’homme à homme » dépeintes par Marc Bloch. Le second est la notion d’espace féodal, étudiée en profondeur par Robert Fossier, autour du concept « d’encellulement », et par Alain Guerreau qui applique cette idée à l’espace sacré. La notion d’espace féodal régit à la fois le corpus des décors étudiés, leur intégration dans l’espace ecclésial et la conception de l’espace iconique lui-même. Une analyse phénoménologique fait ainsi apparaître une figure des personnages dans l’« imaginaire féodal », pleinement investis de la fonction royale et de son aura, trouvant leur place dans un système mental que l’analyse de grands ensembles iconographiques permet de définir. En tant que figures universelles abstraites, les Rois mages forment ainsi une projection claire de l’idée de groupe, modulée selon diverses consciences fédératrices, de sa cellule la plus restreinte à l’universalité chrétienne. / This dissertation deals with the iconography of the Three Kings from the Xth to the XIIth century, by means of a study of its adaptation on monumental decoration in Latin Europe, so as to unravel how it was adapted by feudal society. In order to do so, the first question is that of the new royal status acquired in the Xth century by the Magi from the Gospel of Matthew, analyzed thanks to the concept of “ruler figure” that emerged at the time and was depicted by Marc Bloch in Les Rois thaumaturges (1924) and Ernst Kantorowicz in the The King’s Two Bodies (1957). The aim is to define where the newly defined Three Kings stand in the intricate network of “ties between man and man” theorized by Marc Bloch. The second question is that of the notion of feudal space, studied in depth by Robert Fossier, with his concept of “encellulement” (1982), and Alain Guerreau, who applies this idea to the sacred space. The notion of feudal space informs the corpus of studied pictures, their integration in the ecclesial space and the conception of the iconic space itself. A phenomenological analysis reveals the features of the characters in the “feudal imaginary”, fully invested with their royal function and its aura, and finding their place in a mental system whose mode of functioning can be unveiled thanks to the study of great iconographic sets. Being abstract universal figures, the Three Kings constitute a clear picture of the notion of social group, modulated according to various unifying consciences, from the most basic unit to Christian Holism.

From borough villages to abolition of corvee and its results (abstract) The aim of this doctoral thesis lies in its contribution to a complex problem of economic development of Czech landowning towns in the post-White Mountain period. The research is focused on a selected problem of town feudalisation, i. e. analysis of the importance as well as extent of their seignorial activities. Czech historiography has dealt with such a topic rather marginally, because towns used to be understood as a strange element in feudal environment, which on the contrary created conditions for social modernisation. Aristocratic (chamber) or church landed estates used to be studied as a matter of priority. Introductory chapter balances current research on the topic of borough landed estates. General survey of the research in Western Europe is presented first. Seignorial ambitions of towns are part and parcel of a vast outlined study of mutual relation between the town and the country. The topic has already been applicated in archaeology and medievistics. Il existe une continuité dans l’« idée » russe de l’Etat qu’une analogie dans la continuité des systèmes ne reflète pas. De la Russie impériale à la Russie soviétique, l’Etat (Gosudarstvo) n’est pas conçu comme une entité abstraite et autonome. A la dimension césariste du pouvoir correspond la non-émergence, et du concept et de la réalité d’un Etat. Jusqu’en 1917, la conception russe du pouvoir est conditionnée par le discours idéologique – religieux. Après 1917, sa principale caractéristique est d’être subordonnée à l’idéologie, en tant qu’expression de la volonté du Parti communiste. L’Etat soviétique s’impose donc comme un Etat « de fait » et non comme un Etat « de droit ». La prédominance du discours idéologique entrave, à la fois, la constitution d’une culture de l’Etat, qui reste une culture du pouvoir, et la formation d’une culture de l’antériorité et de la supériorité du droit sur l’Etat. Après la désintégration de l’Union soviétique, la référence à la démocratie libérale et à l’Etat de droit devient un outil de la création d’une nouvelle légitimité pour l’Etat postcommuniste. L’entrée de la Russie dans la modernité politique nécessite une rupture avec les postulats idéologiques du passé. Or, la déconstruction du socialisme est un processus beaucoup plus complexe que la construction de la démocratie. Bien qu’ayant subi, sur plusieurs siècles, plusieurs types de transitions – de l’absolutisme de droit divin au socialisme, puis au postcommunisme -, l’Etat russe a donc conservé certains caractères constants et typiques qui en font, encore aujourd’hui, un modèle hybride, en tension entre autoritarisme et démocratie. / There is a continuity as concerns the « idea » of the state that an analogy with the different systems does not reflect. From imperial to Soviet Russia, the state (Gosudarstvo) is not thought of as an abstract and autonomous entity. Until 1917, the Russian conception of power is conditioned by the religious ideological discourse. After 1917, her main feature is one of submission to ideology, in other words the expression of the will of the Communist Party. The Soviet state stands out by its « de facto » nature, rather than a « de jure » state. The supremacy of the ideological discourse hampers both the constitution of a new state culture, which remains focused on power, and the formation of the precedence and the superiority of law over the state. After the disintegration of the Soviet Union, reference to liberal democracy and the rule of law becomes a tool in creating renewed legitimacy for the postcommunist state. Russia’s entry into political modernity demands a rupture with the ideological postulates of the past. The dismantlement of socialism is a much more complex process than the construction of democracy. Despite having been subjected, over centuries, to many types of transition – absolutism founded on divine right to socialism, then postcommunism -, the Russian state has always preserved certain features (be they constant or specific) that make it, and still today, a hybrid model pulling towards both authoritarianism and democracy.
