La protection des données personnelles contenues dans les documents publics accessibles sur Internet : le cas des données judiciaires

Les bouleversements engendrés par les nouveaux moyens de communication des données publiques de même que les multiples possibilités offertes par le réseau Internet, telles que le stockage des informations, la mémoire sans faille et l'utilisation des moteurs de recherche, présentent des enjeux majeurs liés à la protection de la vie privée. La diffusion des données publiques en support numérique suscite un changement d'échelle dans le temps et dans l'espace et elle modifie le concept classique de publicité qui existait dans l'univers papier. Nous étudierons les moyens de respecter le droit à la vie privée et les conditions d'accès et d'utilisation des données personnelles, parfois à caractère sensible, contenues dans les documents publics diffusés sur Internet. Le cas particulier des données accessibles dans les banques de données judiciaires exige des solutions particulières : il s'agit de trouver l'équilibre nécessaire entre le principe de transparence judiciaire et le droit à la vie privée. / The upheavals generated by the new means of disseminating public data, together with the multiple possibilities offered by the Internet, such as information storage, comprehensive memory tools and the use of search engines, give rise to major issues related to privacy protection. The dissemination of public data in digital format causes a shift in our scales of time and space, and changes the traditional concept ofpublic nature previously associated with the "paper" universe. We will study the means of protecting privacy, and the conditions for accessing and using the personal information, sometimes of a "sensitive" nature, which is contained in the public documents posted on the Internet. Novel School-Based Strategies to Improve Participation in the School Breakfast Program, Diet Quality, and Cognitive Performance in Adolescents

<p>Observational evidence links breakfast skipping, a behavior frequently observed among adolescents, with other poor health related behaviors that perpetuates a lifestyle associated with poor weight management and decreased cognitive performance. Furthermore, evidence suggests that both the consumption of breakfast and the quality of breakfast consumed may influence both weight and cognitive performance related outcomes. In an effort to improve the prevalence of breakfast consumption and the quality of breakfasts consumed among adolescents, recent initiatives have sought to increase participation in the federal School Breakfast Program (SBP). </p><p>The main objectives of this dissertation were to determine: 1) whether the habitual consumption of breakfast influences perceived appetite following the consumption of breakfast and whether habitual breakfast consumption influences post prandial appetitive sensations following the consumption of breakfasts varying in macronutrient distribution; 2) the feasibility of consuming an egg-based, ‘Breakfast in the Classroom’ (BIC) program in 8th grade students and whether the daily consumption of egg-based breakfasts improve School Breakfast Program participation, the quality of breakfasts consumed, and snacking behavior in 8th grade students; and 3) whether differences in cognitive performance exist between 6th-8th grade students who consume school breakfast, students who consume breakfast at home only, and students who skip breakfast following the initiation of a higher-protein Breakfast in the Classroom program. </p><p>This dissertation is organized into chapters that consist of published manuscripts or manuscripts formatted for submission to peer-reviewed journals. Chapter 2 consists of comprehensive review of the evidence linking breakfast consumption and composition to obesity and cognitive performance with an emphasis on the recent advances in school breakfast programs and future directions. Chapter 3 evaluates whether the habitual consumption of breakfast influences perceived appetite following the consumption of breakfast and whether habitual breakfast consumption influences postprandial appetitive sensations following the consumption of breakfasts varying in macronutrient distribution. Chapter 4 examines the feasibility of implementing an egg-based BIC program and subsequent effects on SBP participation, the quality of breakfasts consumed, and evening snacking in 8th grade students. Chapter 5 examines differences in cognitive performance between 6th-8th grade students who consume school breakfast, students who consume breakfast at home only, and students who skip breakfast following a higher-protein BIC. Chapter 6 summarizes the main findings and presents considerations for future research.</p><p>Collectively, the findings from this dissertation demonstrate:1) consuming 30 grams of protein at breakfast improves appetite and satiety compared to a breakfast containing 15 grams of protein, independent of habitual breakfast consumption in overweight adolescent females; 2) implementing a universally-free ‘Breakfast in the Classroom’ program that serves two additional eggs to a traditional school breakfast served via a traditional SBP is feasible and improves SBP participation, the quality of breakfast consumed, and reduces unhealthy evening snacking; and 3) students who consume breakfast at school, as part of a higher-protein BIC program, perform better on tasks assessing cognitive flexibility and executive function in middle school students when compared to students who skip breakfast, regardless of key behavioral and/or socioeconomic factors. Thus, this work suggests increasing protein content of school breakfasts using a universally-free distribution program is feasible and may provide benefits on overall diet quality and cognitive performance for 6th-8th grade students. <br></p>

Le désir d'éternité : réflexion autour de la notion de plénitude chez Charles Taylor

Ce mémoire engage une réflexion sur la plénitude dans la pensée de Charles Taylor, et plus particulièrement dans son maître ouvrage L’âge séculier. L’idée de plénitude y est intimement liée à celles de modernité, de croyance et d’incroyance. C’est que, pour Taylor, comprendre la modernité implique de saisir le changement qui nous a permis de passer d’un contexte dans lequel il était impensable de ne pas croire en Dieu à un contexte dans lequel la croyance n’est qu’une option. Ce changement tourne essentiellement autour d’une modification de notre représentation de la plénitude. Qu’est-ce que la plénitude pour notre auteur ? Elle est la condition à laquelle tend tout homme et implique une réponse, tacite ou pas, à la question du sens de la vie. Mon principal objectif sera de saisir la nature de la plénitude telle que la conçoit Taylor. Je montrerai que la double définition de la plénitude dans L’âge séculier génère une certaine tension entre la plénitude conçue comme un événement unique et comme une aspiration constante vers le sens (qui correspond aussi au bien). Je proposerai une résolution de cette tension à travers une compréhension de la plénitude qui vise à en restituer l’unité fondamentale, l’idée étant de saisir la plénitude comme événement unique et comme aspiration constante au sens, non pas séparément, mais dans leur relation. Ce modèle d’interprétation, fourni par l’idée d’éternité, que l’on retrouve aussi dans L’âge séculier, me conduira à établir une coïncidence entre la poursuite de la plénitude et le désir d’éternité. Tous deux ont le même but fondamental : à travers l’inscription de moments qualitativement privilégiés et uniques, constitutifs de la vie, dans la totalité de cette vie, ils visent à en dévoiler le sens et à lui conférer une certaine pérennité. À plus forte raison, ce que j’entends montrer à travers la coïncidence entre plénitude et éternité, c’est que la quête de plénitude n’engage pas nécessairement la perspective religieuse déployée dans L’âge séculier, mais plutôt une forme de transcendance que l’on pourrait qualifier de « temporelle ». / This M.A. thesis unfolds a reflexion upon the concept of fullness as developed by Charles Taylor, especially in his book A Secular Age, in which the idea of fullness is intrinsically connected with modernity, belief and unbelief. For Taylor, the understanding of modernity implies a grasping of the change that allowed the transition from a context where unbelief in God was considered inconceivable to a context where belief remains only an option. That change consists essentially in a modification of our very representation of fullness. What is fullness for Charles Taylor? It is the condition to which any human being tends towards, and which implies an answer, unspoken or not, to the question of the meaning of life. My main goal will be the understanding of the nature of fullness as conceived by Charles Taylor. I shall show that the twofold definition of fullness in A Secular Age generates a tension between fullness conceived as a unique event, and fullness conceived as a constant aspiration towards meaning (which identifies with goodness). I shall suggest a resolution of this tension through an understanding of fullness which aims to restore its fundamental unity – the idea being to grasp the notion of fullness as a unique event and as the constant aspiration to meaning not separately, but in their relationship with one other. This interpretation model, provided by the idea of eternity, which is also present in A Secular Age, will allow me to establish a coincidence between the pursuit of fullness and the desire of eternity. Both of them share the same fundamental aim: through the inscription of qualitatively privileged and unique moments, constituents of life, in the very totality of this life, they aim to reveal its meaning and to bestow permanence to it. Moreover, I will argue from this coincidence between fullness and eternity that the quest for fullness doesn’t necessarily imply a religious perspective as unfolded in A Secular Age, but can lead rather to a form of transcendence that one can qualify as « temporal ».

Hydropsdiagnostik mit Tieftonmodulation von Distorsionsprodukt-Otoemissionen

Ein tieffrequenter lauter Suppressorton verlagert das Corti-Organ periodisch in Richtung Scala vestibuli und Scala tympani. Simultan registrierte DPOAE (Distorsionsprodukte otoakustischer Emissionen) werden in beiden Richtungen unterschiedlich supprimiert. Bei Vorliegen eines endolymphatischen Hydrops (EH) ist die Beweglichkeit der Basilarmembran eingeschränkt, so daß keine oder eine nur geringe Modulation des DPOAE-Pegels entstehen kann. In dieser Arbeit wird die diagnostische Aussagekraft von Messungen tieftonmodulierter DPOAE bei zwei Patientenkollektiven mit Verdacht auf EH im Vergleich mit einem Normalkollektiv (n = 22) geprüft: bei Patienten mit M. Menière (n = 23) und Patienten mit Ohrdruckgefühl ohne Schwindelsymptomatik (n = 8). Bei den M. Menière-Patienten sind die ipsilateralen Modulationstiefen (MD) im Median hochsignifikant geringer als die des Normalkollektivs. Dies wird als Hinweis auf einen EH gewertet. Bei Primärtonpegeln mit L2 = 20 dB SL ergibt sich für den Grenzwert der MD mit 6 dB die Sensitivität von 64% und die Spezifität von 90%. Die kontralateralen MD der M. Menière-Patienten sind im Median signifikant geringer als die des Normalkollektivs. Für Primärtonpegel mit L2 = 20 dB SL liegen 33% der Werte unter dem Grenzwert, von diesen Ohren ist die Hälfte symptomfrei. Auch im kontralateralen Ohr kann ein – eventuell asymptomatischer – Hydrops vorliegen. Die Ergebnisse der Patienten mit Ohrdruckgefühl ohne Schwindel zeigen im Median hochsignifikant geringere MD als die der Normalhörenden und unterscheiden sich nicht signifikant von den Werten der ipsilateralen Ohren der M. Menière-Patienten. Das Ohrdruckgefühl kann auf einen cochleären Hydrops hinweisen und die weitere Entwicklung eines EH ankündigen. Bei den Verlaufsuntersuchungen zeigen die MD beider Patientenkollektive, deren Symptomatik sich während dieses Zeitraums änderte, Variabilitäten: mit Zunahme der Heftigkeit der spezifischen Symptome nimmt die MD ab und umgekehrt. Die Tieftonmodulation scheint den Zustand der Cochlea widerspiegeln zu können. Im Vergleich mit den in der Klinik gängigen Verfahren zur Hydropsdiagnostik wie der ECochG oder dem Glyceroltest erweist sich das in dieser Arbeit angewandte objektive Verfahren als vorteilhaft: es ist schnell durchführbar, nicht belastend und nicht invasiv. Es eignet sich als Screeningverfahren und kann zur Verlaufskontrolle eingesetzt werden. / The cochlear partition is moved periodically towards scala vestibuli and scala tympani by a low-frequency high-level suppressor tone. Simultaneously recorded DPOAEs (distortion product otoacoustic emissions) are suppressed differently in both directions. This modulation of the DPOAE level may be reduced or even missing if the displacement of the basilar membrane is inhibited by endolymphatic hydrops (EH). In this thesis the diagnostic significance of the low-frequency modulation of DPOAEs is tested in two patient groups with suspected EH: patients with Menière’s disease (n = 23) and patients with aural fullness without vertigo (n = 8), compared to a control group of normal hearing adults (n = 22). In the patients with Menière’s disease the ipsilateral modulation depths (median) are high significantly lower than in the control group. This can be interpreted as a sign of EH. At primary tone levels with L2 = 20 dB SL and a limiting value of 6 dB modulation depth (MD), a sensitivity of 64% and a specificity of 90% are found. The contralateral MDs of the patients with Menière’s disease (median) are significantly lower than in the control group. At primary tone levels with L2 = 20 dB SL, 33% of the MDs are below the limiting value, half of these ears are symptom-free. So in the contralateral ear a possibly asymptomatic hydrops may be present as well. The patients with aural fullness without vertigo show high significantly lower MDs (median) than the normal hearing adults and no significant difference to the ipsilateral MDs of the patients with Menière’s disease. Aural fullness can be a sign of cochlear hydrops and may indicate the further development of EH. During the course of disease the MDs of both patient groups vary when symptoms change: with increasing intensity of the specific symptoms the MD is reduced and vice versa. Low-frequency modulation seems to reflect the state of the cochlea. Compared to the generally used clinical tests for the assessment of EH like ECochG or the glycerol test, the objective method presented in this thesis is advantageous: it is fast, not straining and non-invasive. It is suitable for screening and can be used to monitor the course of disease.

[pt] A índole escatológica da Igreja, como reflexão teológica, é muito pertinente, visto que trata da relação entre a estrutura visível da Igreja e aquela realidade pensada como meta última da atividade eclesial. A escatologia do Vaticano II trouxe à tona essa reflexão, quando salientou que a tensão escatológica entre o já e o ainda não faz parte da natureza do Novo Povo de Deus, e que, por isso mesmo, a Igreja é sinal e instrumento desta plenitude da esperança no meio da humanidade. Sendo um sinal, ela se torna, para o mundo, sacramento visível da unidade de gênero humano, com Deus e consigo mesma. Nossa pesquisa deseja enfocar a posição do Concílio Vaticano II acerca dessa situação-missão da Igreja, pois, para os Padres conciliares, a salvação prometida pelo Senhor já começou em Cristo, mas ainda não se consumou, porque o tempo da restauração de todas as coisas dar-se-á somente quando tudo estiver no Pai pelo Filho no Espírito. Então, neste instante, o homem e com ele toda a criação chegará à sua restauração final. Enquanto isso não acontecer, a Igreja é impelida a levar adiante a obra de santificação da humanidade, como missão imputada por Cristo na unidade do Espírito Santo. Esse trabalho quer, portanto, demonstrar como essa salvação de Cristo continua por meio da ação eclesial, que instrui seus filhos sobre o sentido da vida temporal, enquanto esperança dos bens futuros e compromisso com o Reino de Deus. / [en] The eschatological nature of the Church as theological reflection, it is very relevant, since it is the relationship between the visible structure of the Church and that dream reality as the ultimate goal of ecclesial activity. The eschatological nature of Vatican II brought up this discussion when he emphasized that the eschatological tension between the already and not yet is in the nature of the new people of God, and that, therefore, the Church is sign and instrument of fullness of Hope in the midst of humanity. As a sign, it becomes the world visible sacrament of the unity of mankind with God and with herself. Our research focuses on the position of Vatican II about the situation, the Church s mission, as for the Fathers, the salvation promised by the Lord already begun in Christ, but not yet consummated, because the time of the restoration of all things give will be only when all; the man and with him the whole creation reach its final restoration in Christ. In the meantime the church is compelled to carry on the work of sanctification of humanity as mission charged by Christ in the unity of the Holy Spirit. This work therefore want to show how the salvation of Christ continues through the action of the Church, instructing their children about the meaning of temporal life, as hope of eternal life and commitment to the Kingdom of God.

La relation entre les peintures chinoise et occidentale apparait comme une rencontre entre l’eau et l’huile. Mélanger les deux étant impossible, comment, dès lors, un artiste entre deux cultures, peut-il faciliter leur dialogue et devenir un passeur ? Cette recherche tente d’associer la technique des matériaux occidentaux avec l’expression du pinceau et de l’encre liés au concept du plein et du vide afin d’explorer des oppositions complémentaires, en créant une réalité diluée dans un contraste harmonisé. La réflexion s’est concrétisée par des peintures en trois formats : la série, le rouleau et l’album, intitulées Musée en peinture. Formats qui permettent d’aborder aussi bien les questions de l’écoulement du temps, de la circulation du regard, de la dynamique spatiale, que celles de l’extension et de la suggestion. Ces peintures interrogent le phénomène du musée en portant un regard ironique, critique et empathique sur les spectateurs et leurs travers. Elles témoignent aussi de la conversation avec les maîtres anciens et d’un cheminement dans les musées. La réalisation de ce musée des musées consiste en un processus de transfert de la photographie vers la composition photographique, puis vers la peinture. Ce processus se rapproche de la structure cinématographique, à partir du montage filmique d’Eisenstein, et de la notion de continuité et de discontinuité de Raoul Ruiz. Avec la boîte de Poussin numérique, on joue à la fois le rôle de peintre, de metteur en scène et de documentariste. Exploré, le passé se mue en espace, en reconstituant le passage du monde réel au monde virtuel, du ça-a-été de Roland Barthes à la notion du ça n’a pas été. / The relationship between Chinese and Western painting appears as a meeting of water and oil. Mixing the two seems impossible, so how can an artist create a dialogue between two cultures and media, effectively becoming a cultural conduit ? This research attempts to combine the techniques of Western materials with the expression of Chinese brush and ink, which is linked to the concept of fullness and tangible versus emptiness and abstract. From here, we explore the complementary opposition, create a “diluted reality” in a harmonized contrast. This reflection, entitled Museum in Painting, is represented in three different formats: the series, the scroll, and the album. These formats allow us to explore ideas of the flow of time, the circulation of the gaze, the spatial dynamics, as well as the topic of Extension and Suggestion. From the satirical, critical, and empathic point of views, we investigate the audience and their quirks, questioning the phenomenon of museum. These works exhibit my intellectual journey through the museum, and the conversation with the old masters. The realization of this museum of museums is a transfer process from photography to digital composition, and then to the painting. It takes the concepts of Eisenstein's film montage and Raoul Ruiz’s continuity and discontinuity to explore its relevance to the cinematographic composition and structure. With the “Digitized Box of Poussin”, we played the role of painter, director and documentary filmmaker to explore the idea of past events becoming a space to re-create a pathway from the real world to the virtual world, from Roland Barthes’ concept of “what happened” to the concept that is put forward that “it didn’t happen”.

Ce travail a pour objectif de vérifier, à partir du thème Marie (souvent compris comme un des obstacles au rapprochement des Églises), la cohérence du mouvement œcuménique contemporain et la consonance des résultats de ces dialogues avec les enseignements officiels des Églises. Le point de départ de la réflexion est une lecture comparée de Redemptoris Mater de Jean-Paul II et du Commentaire du Magnificat de Luther. Cette comparaison est vérifiée ensuite par des dialogues œcuméniques (luthéro-catholiques, mais aussi pentecôtistes-baptistes, catholiques…) dans une perspective d'interpellations réciproques à propos de la compréhension de Marie dans le mystère de l'Église et du salut. La théologie mariale s’avère être un lieu de vérification œcuménique fécond : elle met en exergue les consensus et clarifie les questions encore ouvertes de la recherche œcuménique, en particulier celle de l’instrumentalité de l’Église. / The role of Mary is often understood as an obstacle to reconciliation between Churches. Using this theme, the dissertation has as its objective the verification of the coherence of the contemporary ecumenical movement aswell as to how the results of the various dialogues correspond to the official teaching of the Churches. The starting point is a comparative study of John-Paul II’s Redemptoris Mater and Luther’s Commentary on theMagnificat. This comparison is then examined in the light of results from various ecumenical dialogues (between Lutherans and Catholics as well as Evangelicals, Pentecostals and Catholics…). Out of the dialogues come reciprocal questions concerning how Mary is understood in the mystery of the Church and of salvation. Marian theology shows itself to be a very fertile method of ecumenical verification, revealing both new consensuses and clarifying issues that remain open for ecumenical research, especially in relation to the instrumentality of the Church.

This dissertation deals with the notion of centration in the work of Teilhard de Chardin, the notion being examined with regard to two related aims: 1) to illustrate the logical structure of Teilhard's Christian theory of evolution, and 2) to explain the relation between centration carried out by created beings and centration assigned to God as the focal point of evolution. In other words: to explore the connection between fundamental freedom attributed by Teilhard to created beings and culminating in human beings according to him, and God's freedom demonstrating itself in controlling the universe and directing it to a goal being the fullness of being (pleroma). The first part presents Teilhard's life and the contexts of his work. The second part explains the main notions of Teilhard's theory and metaphysics, such as "consciousness", "spirit", "energy", "centro-complexity", and "matter", and relates them to the notion of centration. Centration is presented here as an activity of the consciousness consisting in the unifying formation of multitude by its interconnection with different types of relations around one centre.
