Thorough historical analysis will reveal the manipulation of fundamental rights by governments as a way of curbing of movements of social uprising, misrepresenting the true essence and aim to dignify the human person in its fullness, this practice rooted in the political system and reiterated throughout the time, especially in the current social context. A humanização da pena de prisão marcou a transição entre a cárcere funcionando como uma sala de espera para a aplicação de castigos corpóreos ou mesmo a morte, passando a funcionar como uma sanção propriamente dita. Entretanto, apesar dos esforços do Iluminismo, as penitenciárias não perderam a feição de masmorras, sendo verdadeiros depósitos de seres humanos, os quais acabam sendo privados de saúde, dignidade e respeito, gerando um verdadeiro fator de dessocialização, tendo em vista que inúmeras facções criminosas disputam, por meio de sangue, parcelas do mercado da ilegalidade. Agravando o problema, o Brasil enfrenta, nos últimos quatorze anos (2000 a 2014) o encarceramento em massa, tanto que a população prisional praticamente dobrou neste período. Além disso, cerca de 40% dos encarcerados são presos provisórios, ou seja, ainda não foram condenados de forma definitiva. Diante deste quadro, a audiência de custódia, instituto caracterizado pela apresentação pessoal do preso a uma autoridade competente para resolver seu status libertatis foi erigida como uma possível solução à crise do sistema penitenciário, o qual foi declarado, no ano de 2015 pelo STF, um estado de coisas inconstitucional. Diante da mora legislativa em implementar tal instituto, os Tribunais de Justiça e, posteriormente, o CNJ, amparados pela Convenção Americana de Direitos Humanos, editaram resoluções administrativas determinando a realização das audiências de custódia. Logo, a presente dissertação objetiva abordar os fundamentados do instituto, sua origem histórica, as principais questões procedimentais e, por fim, responder à seguinte pergunta: Quais as consequências jurídicas da não realização da audiência de custódia? / The humanization of the prison sentence marked the transition between the jail functioning as a waiting room for the application of corporal punishment or even death, starting to function as a sanction itself. However, despite the efforts of the Enlightenment, penitentiaries did not lose the feature of dungeons, being real deposits of human beings, which end up being deprived of health, dignity and respect, generating a true factor of desocialization, since countless criminal factions They dispute, through blood, parcels of the illegality market. Aggravating the problem, Brazil faces, in the last fourteen years (2000 to 2014), mass incarceration, so much that the prison population has practically doubled in this period. In addition, about 40% of those incarcerated are provisional prisoners, that is, they have not yet been definitively condemned. Because of this situation, the first appearance hearing, an institute characterized by the prisoner\'s personal presentation to a competent authority to resolve his libertatis status, was established as a possible solution to the crisis in the penitentiary system, which was declared, in the year 2015 by the STF, an Unconstitutional state of affairs. In view of the legislative delay in implementing such an institute, the Courts of Justice and, subsequently, the CNJ, under the American Convention on Human Rights, issued administrative resolutions determining custody hearings. Therefore, the present dissertation aims to address the institute\'s grounds, its historical origin, the main procedural issues and, finally, answer the following question: What are the legal consequences of not holding a custody hearing?

Essas forças serão aqui representadas pelo poder coercitivo do Estado – instituído e circunscrito à lei pela dimensão da validade das normas – e pela mídia – poder não-instituído, livre e dotado de credibilidade e confiança pela população, no plano da facticidade. Tem-se então uma zona conflituosa e tensa entre facticidade e validade. É dentro dela que se pode investigar como certos direitos fundamentais protegidos pela constituição podem ser violados num ambiente chamado por alguns de ¨Idade Mídia¨. Entre o tempo processual reflexivo, ritualizado e protocolar da justiça e o fetiche da velocidade verificado nas mídias atuais, encontra-se a sociedade. Atualmente, o público goza do inédito acesso à informação ao mesmo tempo em que a crítica se dissipa no ar, dificultando o esclarecimento e a formação do senso crítico para se ¨pensar contra os fatos¨. Com base na perspectiva ontológica derivada das teses contratualistas, dos sistemas de vigilância, disciplina e controle social chega-se à identificação das classes perigosas e à construção do real pela mídia. Esse é o ambiente justificador do novo herói pós-moderno, o jornalista opinativo e investigativo, que, em nome do ¨jornalismo verdade¨, corre-se o risco de agir à margem de princípios e garantias fundamentais previstos no texto constitucional. Para se evitar um quadro de violência e violação constantes, num momento em que a cooperação parece ter chegado ao fim, necessário se faz reconfigurar essa tensão. Para isso, este trabalho se utiliza do edifício teórico construído por Habermas, cuja base é uma reconstrução da filosofia prática com vistas a uma ação comunicativa. / Fundamental rights, for the central position they occupy in democracies, are constantly affected by different forces. These forces are represented here by the coercitive power of the state – institutionalised and limited by the validity of the rules - and the media - not institutionalised, free and endowed with credibility and trust by the population, in terms of facticity. Then, you have an area of conflict and tension between facticity and validity. It is inside this area that can investigate how certain fundamental rights protected by the Constitution can be violated in an environment called by some of ¨ Media Age ¨. In between the procedural time reflective, ritualistic and ceremonial of justice and the fetish of speed, seen in the media today, there is society. Currently, public enjoys the unprecedented access to information at the same time the critical dissipates in the air, making the enlightenment and the formation of critical sense very difficult ¨to think against the facts ¨. Based on the ontological perspective derived from the contractualist theories, from systems of surveillance, discipline and social control we come to the identification of the dangerous classes and the construction of reality by the media. This is the environment justifying the new post-modern hero, the opinionated and investigative journalist who, on behalf of ¨true journalism¨, act in disagreement with the basic principles and guarantees laid down in the Constitution. In an attempt to avoid a situation of constant violence and violation, at a time when cooperation seems to have come to an end, reconfiguration this tension is needed. To do this, you can get hold of the theoretical edifice built by Habermas whose base is a reconstruction of the philosophical practice in the gateway of communicative action.

Le consentement du patient en droit de la santé / The medical consent in compared right

Le recours aux soins est chose quotidienne pour l'ensemble des individus. Ces derniers sont effectivement soumis dans leur quotidien à la contrainte médicale émanant du "droit-créance" à la protection de la santé prévu à l'alinéa 11 du Préambule de la Constitution de 1946. Néanmoins, parallèlement à ce développement de l'accès aux soins, s'est dégagé le droit subjectif à la santé qui interdit toute atteinte à la santé de l'individu. Ces deux acceptions du droit à la santé interagissent au point que la première devienne une véritable contrainte pour la seconde. Il est donc indispensable de trouver des solutions afin qu'un équilibre puisse s'établir entre ces deux conceptions. Le consentement aux soins du patient constitue valablement une conséquence de la conception subjective du droit à la santé. Consacré par la loi du 04 mars 2002, relative aux droits des patients, le droit au consentement ne dispose d'aucun rattachement à une norme fondamentale opératoire, pour l'heure. Il se trouve en réalité souvent atteint par le recours imposé aux soins. Cette étude s'attache donc à démontrer que le droit au consentement aux soins présente une effectivité relative et qu'il est alors indispensable de le rattacher à des droits fondamentaux préexistant / The appeal(recourse) to the care is daily thing for all the individuals. The latter are actually subjected(submitted) in their everyday life(daily paper) to the medical emanating constraint of "right-claim"("right-debt","law-claim") in the protection of the health planned in the paragraph 11 of the Introduction of the Constitution of 1946. Nevertheless, in a parallel to(at the same time as) this development of the access to healthcare, got free the subjective right(law) for the health which forbids any infringement(achievement) on the health of the individual. These two meanings of a word of the right(law) for the health interact to the point that the first one(night) becomes a real constraint for second. It is thus essential to find solutions so that a balance can become established between these two conceptions(designs). The consent in the care of the patient establishes(constitutes) validly a consequence of the subjective conception(design) of the right(law) for the health. Dedicated by the law of March 04th, 2002, relative to the rights of the patients, the right(law) for the consent arranges no fastening with an operating fundamental standard, for the moment. He(it) is in reality often reached(affected) by the appeal(recourse) compulsory for the care. This study thus attempts to demonstrate that the right(law) for the consent in the care presents a relative effectiveness and that it is then essential to connect him(it) with pre-existent fundamental right

This work will focus the issue using the theories of justice, especially the one developed by John Rawls (and others built after it), to analyze the necessary limitations on the power the State has to tax based on constitutional intention to build a free, fair and equitable society. Considering the need for development of the citizen as an autonomous individual, with the same value as others and the right to a plan of life, the ability to pay is understood as an important limit to the taxing power of the state on a democratic context. Beyond the individual's financial ability to bear the tax burden, fiscal capacity rises as a metacapacity for its instrumental profile to acquire liberties and features, which can characterize a free individual, of equal value and much more able to contribute to the community. / A inserção da tributação no contexto dos direitos fundamentais traz à tona a necessidade de equilíbrio entre os valores liberdade e igualdade, na perspectiva do cidadão e do Estado. Este trabalho abordará o tema utilizando o olhar das teorias de justiça, em especial a elaborada por John Rawls (e de outras a partir dele), para analisar as necessárias limitações ao poder de tributar do Estado com base na intenção constitucional de construir uma sociedade livre, justa e igualitária. Considerando a necessidade de desenvolvimento do cidadão como indivíduo autônomo, com valor igual aos outros e com direito a um plano de vida, a capacidade contributiva é entendida como fator estabelecedor de importantes limites ao poder de tributar do Estado no contexto democrático. Para além da aptidão financeira do indivíduo em suportar o ônus tributário, a capacidade contributiva se ergue como metacapacidade por seu cunho instrumental à aquisição de liberdades e funcionalidades que podem caracterizar um indivíduo livre, de valor igual e mais capaz de contribuir com a coletividade.

We traced the political and economic foundations of constitutionalism, which resulted in Constitution as a legal document, culminating the study of this point in the current framework of neoconstitutionalism. The understanding of some aspects of the theory of fundamental rights was also necessary, especially, on the double character of these rights. We further study the Constitution of 1988 in what is most pertinent to fundamental social rights and identify the conformation of a Democratic and Social State of Right. Following the research, we also study the international system for the protection of human rights, albeit briefly, but sufficient to highlight how the right to housing is treated at such a normative level. In the Brazilian constitutional order, it was found that the right to housing is expressly affirmed in several provisions, from the original text of the Constitution, through programmatic norms and through an institution of subjective public law. In this normative framework, considering the duty to promote the dignity of the human person, the prevalence of human rights and the constitutional normativity of the right to housing, we reach with the research the understanding that the Brazilian State has a duty to promote and not violate this right, which integrates the vital minimum. Hence it is demandable of the State that does not act in such a way as to interrupt the exercise of such right, in addition to the duty to promote public policies to guarantee adequate housing for all those who need it. We also analyze some recent decisions of the Brazilian Judiciary on the right to housing / Com esta pesquisa buscamos conhecer a normatividade constitucional ao direito fundamental social à moradia, o que requereu estudar o perfil social do Estado brasileiro para contextualizar as estratégias de positivação desse direito na Constituição de 1988. Percorremos os fundamentos políticos e econômicos do constitucionalismo, que resultaram na Constituição como documento jurídico, culminando o estudo desse ponto no quadro atual do neoconstitucionalismo. A compreensão de alguns aspectos da teoria dos direitos fundamentais também foi necessária, especialmente, sobre o duplo caráter desses direitos. Aprofundamos o estudo da Constituição de 1988 no que mais pertinente aos direitos fundamentais sociais e identificamos a conformação de um Estado Democrático e Social de Direito. Seguindo na pesquisa, também estudamos o sistema internacional de proteção dos direitos humanos, ainda que brevemente, mas suficiente para destacar como o direito à moradia é tratado em tal nível normativo. Na ordem constitucional brasileira, foi apurado que o direito à moradia está positivado, expressamente, em vários dispositivos, desde o texto original da Constituição, por meio de normas programáticas e por meio de instituição de direito público subjetivo. Nesse quadro normativo, considerando o dever de promoção da dignidade da pessoa humana, a prevalência dos direitos humanos e a normatividade constitucional do direito à moradia, alcançamos com a pesquisa o entendimento de que o Estado brasileiro tem dever de promover e não violar tal direito, que integra o mínimo vital. Daí ser exigível do Estado que não aja de modo a interromper o exercício de tal direito, além do dever de promover políticas públicas para garantir moradia adequada a todas as pessoas que necessitarem. Finally, it discusses the first manifestations, in the national legal scenario, on such ?damage?, showing the viability of its acceptance and the repair forms according to the critical analysis of jurisprudence. / A disserta??o objetiva analisar a viabilidade do reconhecimento de um novo conceito de danos ? pessoa, intitulada ?danos ao projeto de vida?, cuja contribui??o seminal ? do jurista peruano Carlos Fernandez Sessarego. Para tanto, ? apresentado o pensamento filos?fico, com ?nfase nas escolas humanista e existencialista, deste conceito, bem como o explora sob a ?tica pol?tico-jur?dica a partir do reconhecimento dos direitos humanos, os quais, mais tarde, se tornaram direitos fundamentais. Brazilians judicial labor procedure is ineffective. It often doesnt realize the complainants rights (at least, not entirely), and when it does, it takes so much time and causes so many privations to the complainant, that much of its utility is lost. This is due to the way in which the system is read by its operators, in a conservative and restrictive way, which still takes into account only the text of the law and ignores the values and principles that inform the system. This leads to the non achievement of the fundamental rights of the workers and the denial of access to justice. Thus, this study is an attempt of insurgency against the way in which the labor procedure law is applied and against the logic of our legal system, a perverse logic, which seems to always favor the debtor and discourage the compliance of the labor law. Our goal is to look for new ways to apply the procedural technique, in order to extract better results from the system, which is especially necessary regarding labor procedure law, because of the nature and importance of the rights that it protects - fundamental rights, thus defined by the Constitution. This is, in fact, an important subject in our study: the demonstration of the fundamentality of the labor rights, in the hope that, once recognized like that, they will be respected, as occurs with the rights recognized as fundamental. The fundamentality of the labor rights and of the right to access the justice (which we designate as the fundamental right to effective judicial protection - subject that also received special emphasis, as well as the vision of the process as a public service provided by the State, as well as its meaning and consequences) generate the necessity of a rapid and effective judicial process, one that, in a short time, offers the employee the full restoration of his violated labor rights. Thats what we tried to build, analyzing institutes such as the provisory injunction, the definitive and provisory execution, the abuse in the use of the process and many more, trying to present new ways to read them and use them, in order to increase the effectiveness of the process. What we tried to show, finally, was how a new vision of the procedural law generates a different application of its institutes, one that fulfills its objectives and protects the worker. What we tried, in other words, was to see how the judicial labor process can help the effectiveness of the labor law, whose restoration is the reason of the judicial system and an obligation of the State. / Brazilians judicial labor procedure is ineffective. Direitos fundamentais e deveres dos pacientes com implante coclear: revisão jurídica para (re)habilitação auditiva / Fundamental rights and obligations of patients with cochlear implants: legal review for hearing (re)habilitation

A preocupação com a inclusão social da pessoa com deficiência é crescente. Especificamente quanto ao deficiente auditivo, o rol normativo está em desenvolvimento, porém ainda não supre todas as necessidades da sociedade. No contexto do serviço de implante coclear o Centro de Pesquisas Audiológicas (CPA) do Hospital de Reabilitação de Anomalias Craniofaciais (HRAC) da Universidade de São Paulo (USP), popularmente conhecido como Centrinho, que já realizou mais de 1.500 cirurgias de implante coclear (IC), constatou-se um grupo de pacientes implantados que não realizam a (re)habilitação auditiva por meio da terapia fonoaudiológica após a cirurgia do IC, ou ainda, não respeitam a periodicidade desse processo, comprometendo o desenvolvimento do deficiente auditivo. A falta ou negligência com o processo de terapia fonoaudiológica da (re)habilitação auditiva enseja na consequente violação de direitos fundamentais do deficiente. Toda equipe interdisciplinar de profissionais responsáveis pela indicação e adaptação do IC assumem papel fundamental no processo de (re)habilitação do deficiente auditivo, devendo acima de tudo zelar pela ética e humanização com o paciente e seus familiares. Como o IC é de elevado custo (tecnologias duras) incluso no procedimento de alta complexidade contemplado pelo Sistema Único de Saúde quem paga é a própria sociedade (através dos recursos públicos), por esse motivo é fundamental que o beneficiário dessa intervenção não apenas reivindique seus direitos, mas também cumpra com seus deveres. Apesar dos recentes avanços normativos do IC, a regulamentação existente é vulnerável frente à complexidade do processo de habilitação e reabilitação auditiva por meio do IC, deixando margem para violações, omissões e abusos. Diante desse cenário todos acabam sendo prejudicados, o Estado, a sociedade e o próprio beneficiário da prótese auditiva. O escopo do presente estudo é analisar criticamente o panorama jurídico em nível nacional das regulamentações voltadas ao implante coclear no processo de (re)habilitação auditiva. Os materiais e métodos utilizados serão os de levantamento bibliográfico, jurídico-doutrinário e revisão jurídica. / Concern about the social inclusion of people with disabilities is growing. Specifically regarding the hearing impaired, the normative roll is in development, but it still does not supply all the needs of society. In the context of the cochlear implant service, the Center for Audiological Research (CAR) of the Hospital of Rehabilitation of Craniofacial Anomalies (HRCA) of the University of São Paulo (USP), popularly known as Centrinho, which has already performed more than 1,500 cochlear implant surgeries, a group of implanted patients who did not perform auditory (re)habilitation by means of phonaudiologic therapy after cochlear implant surgery were found, or did not respect the periodicity of this process, compromising the development of the hearing impaired. Failure or negligence with the audiological (re)habilitation process leads to a consequent violation of the fundamental rights of the handicapped. Every interdisciplinary team of professionals responsible for the indication and adaptation of the cochlear implant assume a fundamental role in the process of (re) habilitation of the hearing impaired, and above all must care for the ethics and humanization with the patient and their relatives. Since the cochlear implant is of high cost hard technologies included in the procedure of high complexity contemplated by the Unified Health System who pays is the company itself (through public resources), for this reason it is fundamental that the beneficiary of this intervention not only claim their rights, but also fulfill your duties. Despite the recent normative advances in the cochlear implant, the existing regulations are vulnerable to the complexity of the process of habilitation and auditory rehabilitation through the cochlear implant, leaving room for violations, omissions and abuse. Faced with this scenario, all of them end up being harmed, the State, society and the beneficiary of the hearing aid itself. The scope of the present study is to critically analyze the legal framework at the national level of the regulations aimed at the cochlear implant in the (re)habilitation process. The materials and methods used will be those of bibliographical, legal-doctrinal and legal review.
