The thesis deals with procedure of asylum and additional protection granting in the Czech Republic. The thesis focuses on characteristic features of the process; primarily the proceeding the application of protection and asylum granting by official authorities. To a certain extent, the thesis copes with substantive law; it defines terms of refugee and asylum law. It enumerates and characterizes the mentioned terms in connection with the process of the asylum and protection granting in the Czech Republic. Impact of the European Union law on the Czech internal law is also discussed.

La communauté internationale et le droit international sont confrontés à un défi majeur : trouver une solution mettant un terme au conflit israélo-palestinien. L’étude du conflit israélo-palestinien à la lumière du droit international montre les nombreuses difficultés relatives à l’émergence d’un Etat palestinien. En effet, ce dernier est une source de violation du droit international du fait notamment des manquements aux droits fondamentaux qui ne cessent de sévir sur ce territoire. Les violations commises à l’encontre du droit international remontent à l’époque du mandat britannique et sont finalement caractérisées par l’impunité des entités qui les ont commises. Cela permet donc de mettre en évidence les lacunes où même les faiblesses du droit international, plus précisément celles de l’ONU qui se trouve en difficultés face à un manquement constant à ces principes et à ces décisions. On a cherché à pallier à cette situation infernale par l’usage de techniques qu’offre le droit international dont l’objectif est de mettre un terme à un conflit. Il existe une technique qui paraît être la plus appropriée pour le conflit israélo-palestinien, il s’agit de la fameuse technique de la négociation. Cependant le processus de paix ayant débuté en 1990 se trouve aujourd’hui presque oublié.Malgré tout cela, la création d’un Etat palestinien se trouve être la base de la solution du conflit israélo-palestinien. Cette présente étude cherche à démontrer, sur la base de la définition de l’Etat selon le droit international, que la Palestine dispose d’une part, d’éléments avérés, mais imparfaits, permettant à cette dernière de constituer un Etat selon le droit international, et d’autre part que cette dernière ne peut accéder au rang d’Etat dans la mesure où certains éléments nécessaires à la constitution d’un État demeurent contestables. Ce qui manque à la Palestine pour se constituer en Etat c’est l’effectivité. / The international community and the international law are facing a great challenge: find the solution to end the Israeli-Palestinian conflict. The study of the Israeli-Palestinian conflict in light of international law shows many difficulties related to the emergence of a Palestinian state. Indeed, this conflict is a source of violation of international law specifically a violation of human rights that continues to strike in this area. Violations against international law go back to the time of the British mandate and are finally characterized by the impunity towards the entities that have committed them. Therefore, this allows us to highlight the weaknesses of international law, more specifically those of the United Nations that is confronted with the constant breach of its principles and decisions. We have tried to overcome this infernal situation by using the techniques offered by the international law that aims to put an end to a conflict. There is a technique that seems to be the most appropriate for the Israeli-Palestinian conflict known as the negotiation. However, the peace process that began in 1990 is now almost forgotten.Despite all this, the creation of a Palestinian state is the base to the solution of the Israeli-Palestinian conflict. This present study aims to demonstrate, based on the definition of the State under international law, that Palestine has, on one hand, confirmed elements/components that are imperfect, allowing the latter to constitute a State under international law, and on the other, that it can’t achieve statehood to the extent that certain elements necessary for statehood remain questionable. What Palestine is missing is effectiveness.

Summaries in German and English / The Geneva model of discourse analysis is a linguistic tool developed by Eddy Roulet and his team in Geneva. It was first presented in its modular approach in 1999. This dissertation examines whether the Geneva model can be applied to New Testament texts and whether this application yields results for exegesis. I first explain the model with its five basic modules and twelve organization forms, giving examples from German texts as well as simple New Testament examples. Then I apply the model to two New Testament texts (Rom 6:1,11 and John 8:31,42), summarizing the results in relation to exegesis at the end of each analysis. In the final chapter I discuss which parts of the Geneva model should generally be applied to New Testament exegesis, explaining its potential and its limitations and suggesting some areas in which the Geneva model could be complemented by other approaches. / Das Genfer Modell ist ein von Eddy Roulet und seinem Team in Genf entwickelter linguistischer Ansatz zur Diskursanalyse. Er wurde 1999 erstmalig in seiner modularen Auspragung vorgestellt. In der vorliegenden Arbeit wird untersucht, ob dieses Modell auf neutestamentliche Texte angewendet werden kann und ob diese Anwendung einen Ertrag fur die Exegese bringt. Ich erlautere dazu das Modell mit seinen funf Grundmodulen und zwolf Modulverbindungen zunachst an deutschen und einfachen neutestamentlichen Beispielen. Sodann wende ich das Modell auf zwei neutestamentliche Texte an (Rom 6:1-11 und Joh 8:31-42). Am Ende jeder Anwendung fasse ich die Ergebnisse fur die Exegese dieser Texte zusammen. The International Criminal Tribunal for Rwanda's approach to serious violations of humanitarian law

On October 1, 1990 the Rwandan Patriotic Front launched a war from and with the support of the Republic of Uganda against Rwanda. This war was accompanied by unspeakable violations of International Humanitarian Law. Both conflicting parties violated the basic rules protecting the civilian population in situations of armed conflicts. The United Nations Security Council, acting under Chapter VII of its Charter, passed resolution 955 of November 8, 1994 establishing the International Criminal Tribunal for Rwanda to prosecute alleged responsible of such violations. This study investigates the background of the ICTR and questions the nature of the conflict that prompted the Security Council to establish another ad hoc international criminal tribunal after the one established for the former Yugoslavia. It further inquires into its jurisprudence and reflects critically on the ICTR's approach to serious violations of IHL under Article 3 Common to the Geneva Conventions and Additional Protocol II. / Jurisprudence / LL. Divided only by the 17th parallel : a study of similarities between American and Vietnamese soldiers in selected works

This dissertation undertakes a comparative study of certain works of literature concerning Vietnamese and American troops during the United States’ involvement in Southeast Asia in the 1960s and 1970s. My assumption was that during war it is possible to conclude that enemy forces behave in the same manner in order to reach the identical goal, that of victory over the ‘other’ side. I sought to ascertain how under the selfsame conditions they could be considered as enemies. Divided only by the 17th Parallel: A Study of Similarities Between American and Vietnamese Soldiers in Selected Works By close reading of six texts, three from Vietnamese and three from American perspectives, I have attempted to extract their similar views from each in order to create a context in which the likeness of each side is demonstrated. This was achieved by exploring four themes: those of landscape, time, conflict and ghosts. It was discovered that the protagonists’ behaviour was the same and that rather than being the others’ adversary their true enemies were found within their own ranks. The results indicate that a wider perspective should be adopted on war than one which regards it as a simplistic binary consisting of two opposing sides. Contrary to any supposition that enemies must remain separated, there is more than enough evidence for one to conclude that they actually occupied mutual psychological territory. Protection against torture in international law

This limited scope dissertation deals with the protection against torture in international law. The mechanisms which have been established over the years to protect individuals against torture are analysed. The principles of international customary law dealing with torture and the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (UNCAT) have been examined against the failure by States to honour their obligations under the Treaty and other legal normative rules. This required deep exploration of the definition of torture and how States can compromise the rule of law by manipulating the definition of torture as contemplated by the Treaty or other instruments. Examples from the former US government highlight the ways in which domestic laws can be used and are continued to be used to allow the use of torture. Measures by South Africa in joining the international community in the fight against torture are also discussed as a case study. While all efforts have been made by the South African system to adopt desirable frame works on the protection of individuals against torture, the lack of education on torture remains the down fall of the system. The dissertation clearly explains that universal jurisdiction applies in respect of torture and this is recognised by both treaty law and customary law. Indeed despite all the current measures in place the use of torture persists. The research clearly reveals that countries hide behind their own laws to perpetrate acts of torture. It is then recommended that proper implementation of the legal structures, informed of the objectives of the structures, is essential in completely eradicating torture. / Public, Constitutional, and International Law / LLM

L’évolution et la cohérence de la province de Vienne, qui compte cinq diocèses en 450, six vers 580 et quatre vers 800, dépendent de l'histoire politique car les changements de souveraineté et les décisions royales et impériales peuvent aussi bien permettre aux métropolitains d'accroître leur influence que contrarier leurs desseins viennois. Cela n'empêche pas la constitution d'un cœur provincial formé des cités de Vienne, Genève, Grenoble et Valence. La métropole accueille des administrations et des sépultures royales, bénéficie d'évêques actifs et impliqués à la fois dans les affaires de l'Église et du siècle et possède une topographie religieuse très complète qui la différencie de ses suffragantes. Cette hyperconcentration viennoise semble à la fois la cause et la conséquence de l'élaboration d’une province ecclésiastique où les évêques jouent un rôle fondamental.Souvent issus des vieilles familles sénatoriales gallo-romaines, les prélats exercent jusqu’au début du VIIIe siècle de nombreuses prérogatives au nom des souverains et occupent dans leurs cités une place considérable, aussi bien de leur vivant qu'après leur mort. Avec l'arrivée au pouvoir des Carolingiens, le milieu épiscopal s'ouvre socialement et géographiquement, ce qui se traduit par une modification des traditions funéraires. Les institutions ecclésiastiques, le recrutement du clergé et dans une certaine mesure le culte des saints révèlent cependant la survivance d’une certaine romanité à l’échelle provinciale. De même, les évêques gardent partout la main sur la vie régulière, la gestion des reliques et des saints, la création des paroisses et probablement la construction des églises rurales. Les moines, les aristocrates et les chanoines disposent en conséquence d’une marge de manœuvre très souvent limitée. The metropolis hosts administrations and royal sepulchers, enjoys active bishops devoted both in the Church and the century activities, and possesses a very complete religious topography which differentiates it from its suffragans. This hyper concentration of Vienne seems at the same time the cause and the consequence of the development of an ecclesiastical province where the bishops play a fundamental role.The prelates, often coming from the old Gallo-Roman senatorial families, carry out until the beginning of the VIII century many prerogatives on behalf of the sovereigns and occupy in their cities a considerable place, as well during their lifetime as after their death. When the Carolingians came to power, the bishops’ circle opens socially and geographically, which results in a modification of the funerary traditions. The bishops, who benefit from the cultural policy undertaken under the Pippinides, as the genuine work of Adon of Vienne points it out, remain attached to a Carolingian outlook of the common weal. From the end of the IX century onwards, the bishops of Geneva seek to move away from their archbishops, fervent supporters of the Bosonides, while getting closer to the Rodolpohiens and then to the emperor.The Church of Vienne obtains rapidly a chapter cathedral, houses big monasteries, Old Testament relics, a sumptuous chief-reliquary and one of the rare imitations of the Holy Sepulchre attested before the XI century. The other Churches appear less original and less structured. The ecclesiastical institutions, the recruitment of the clergy and to a certain extent the worship of the saints reveal however the survival of a certain Roman tradition on a provincial scale. Thus, the bishops keep full control of the regular life, the handling of the relics and the saints, the creation of the parishes and probably the construction of the rural churches. The monks, the aristocrats and the canons have consequently very often a limited room for maneuver. This feature is particularly evident in Vienne where the archbishops hold personally or almost entirely their diocese.

Au Xe siècle, l’Eglise savoyarde se trouve dans une situation catastrophique. Désorganisé par les différentes invasions, le clergé séculier peine à se redresser. Pour remédier à cette situation, l’épiscopat décide l’installation de moines venus des grandes abbayes. C’est ainsi que l’on note l’apparition de nombreux prieurés sur les terres diocésaines. Ces maisons religieuses s’installent durablement et prennent une place importante dans la vie des paroisses qui les accueillent. Leurs destins diffèrent, mais certains prieurés réguliers sont toujours conventuels à l’époque moderne. Les différents évêques en dénombrent cinq, dont quatre sont fondés autour du Xe siècle. Il s’agit des prieurés de Bellevaux en Bauges, de Peillonnex, de Talloires et de Contamine. Cette étude porte sur le rôle que jouent ces institutions dans le contexte de la Contre-Réforme catholique, instaurée dans le diocèse au cours des dernières décennies du XVIe siècle. Elle s’articule autour de trois grandes parties. La première retrace l’évolution des prieurés depuis leur fondation jusqu’à l’instauration de la Réforme à Genève. La seconde partie relate l’histoire des différents monastères au cours de trois siècles de l’Ancien Régime. La troisième et dernière partie est plus thématique. Elle tente de définir la place qu’occupent les prieurés conventuels dans la vie politique, religieuse et économique du diocèse de Genève-Annecy aux XVIe, XVIIe et XVIIIe siècles. / In the 10th century, the Church from Savoy is in a very poor state. Weakened by various invasions, the secular clergy struggles to recover. Monks from major abbeys are sent by the episcopate influencing the creation of priories on the diocesan land. These religious houses settle permanently and play an important role in the life of the parishes hosting them. While regular priories had to face different fates, some of them are still conventual in the modern era. The different bishops count five conventual priories, but only four of these were founded around the 10th century. These are the priories of Bellevaux en Bauges, Peillonnex, Talloires and Contamine. This study focuses on the role of these institutions in the context of the Catholic Reformation introduced in the diocese during the last decades of the 16th century. The study is based on three main points. The first point traces back the evolution of the priories from their foundation until the introduction of the Reform movement in Geneva. The second part concentrates on the story of the monasteries over three centuries under the Ancien Regime. The last part is more thematic as it outlines how the conventual priories influence the political, religious and economic life of the Annecy-Geneva's diocese in the 16th, 17th and 18th centuries.

Cette thèse se donne pour objet de tester, dans le contexte spécifique du droit français, la véracité et la pérennité des critiques féministe puis genrée de la définition du réfugié consistant à dénoncer la non-prise en compte des persécutions subies par les femmes et les minorités sexuelles dans le cadre de l’élection audit statut. Et c’est un constat mitigé qui ressort de l’étude car, en dépit des nombreuses pressions internationales et européennes invitant à une analyse genrée de la notion, ces critiques héritées des années 1980 apparaissent, dans une large mesure, encore d’actualité. Certes, le phénomène d’exclusion des persécutions liées au genre qu’elles dénonçaient s’est quelque peu affaibli, en ce que les persécutions subies par les femmes et les membres des minorités sexuelles ne sont, par principe, plus exclues du champ de la définition du réfugié. Mais il n’existe cependant toujours pas de volonté, politique ou juridictionnelle, visant à les intégrer pleinement dans l’analyse. En effet, les efforts consentis pour leur prise en compte se révèlent encore insuffisants, laissant demeurer des obstacles subtils à leur intégration, des obstacles d’autant plus délicats à identifier et à surmonter. / The purpose of this thesis is to test, in the specific context of French law, the veracity and durability of feminist and gendered review of the refugee definition, which consists in denouncing the failure to take into account persecutions suffered by women and sexual minorities in the election process. It is a mixed conclusion that emerges from the study because, despite the numerous international and European pressures calling for a gendered analysis of the concept, these criticisms inherited from the 1980s still appear, to a large extent, to be relevant. Admittedly, the exclusion of gender-related persecution that they denounced has somewhat weakened, because persecutions suffered by women and members of sexual minorities are no longer excluded, as a matter of principle, from the scope of the refugee definition. However, there is still no political or jurisdictional will to fully integrate them into the analysis. Indeed, the efforts made to take them into account are still insufficient, leaving subtle obstacles to their integration, obstacles that are all the more difficult to identify and overcome.
