Begripliga avgöranden : En undersökning av begripligheten i sex kammarrättsdomar

Syftet med den här uppsatsen är att undersöka begripligheten i sex domar från Kammarrätten i Jönköping. Jag undersöker texterna med hjälp av Klarspråkstestet för domar, och belyser sedan testresultatet med textanalys. I textanalysen undersöker jag texterna med avseende på innehållskomponenter, textens yttre struktur, agentivitet, syntax och ordval. Ett annat mer allmänt syfte i denna del av min undersökning är också att utvärdera Klarspråkstestet för domar. Jag kompletterar även min analys av texten med intervjuer. Ett delsyfte i denna del av undersökningen är att ta fram en frågelista som Kammarrätten i Jönköping kan använda för liknande intervjuundersökningar i framtiden. Resultatet av Klarspråkstestet, textanalysen och intervjuerna visar att det finns begriplighetsproblem i de sex domarna. Problemen finns på olika nivåer i texten och berör framför allt texternas innehåll, yttre struktur, syntax och ordval. Min undersökning visar också att Klarspråkstestet för domar fångar upp dessa problem, men att det främst är vissa frågor i testet som har relevans. Det räcker därför inte att se till den samlade poängen på testet för att kunna bedöma textens begriplighet, utan det kräver en djupare tolkning av vad svaren visar.

Svensk behörighet vid omedelbara omhändertaganden enligt LVU i gränsöverskridande situationer inom EU

According to article 8 in the Brussels II regulation a Member State has jurisdiction in matters of parental responsibility over a child who is habitually resident in that State at the time the court is seised. This includes compulsory care of children by the State. Furthermore, article 20 in the Brussels II regulation states that the regulation should not prevent the courts in Member States to make provisional measures in urgent cases in respect of persons or assets in that State, even if a court in another Member State has jurisdiction as to the substance of the matter. This thesis examines the jurisdiction of the Swedish social services and courts in cases regarding compulsory care of foreign children in Sweden. An immediate taking into care under the Care of Young Persons Act constitutes a provisional measure under article 20 in the Brussels II regulation. The provision does not require that the child is habitually resident in the Member State that is taking the measures. Some Swedish courts have despite this concluded that the child must be habitually resident in Sweden for social services and courts to have jurisdiction when it comes to immediate taking into care. This is due to a problematic wording in the provision. Sweden has extensive responsibilities for children according to both the UN Convention on the Rights of the Child and the Charter of Fundamental Rights of the European Union. The purpose of this thesis is to examine if the Swedish social services and courts, in making decisions of immediate taking into care of foreign children in Sweden, are meeting those obligations. The methods used in the thesis are the legal dogmatic method, the empirical method and the European legal method. The findings in this thesis demonstrate that it is possible to interpret the provision regarding the immediate taking into care of children in two different ways. In as far as the Swedish social services and the courts make the most favourable interpretation for the child Sweden meets its obligations under the convention and the charter. However, compulsory care is a huge interference in a child’s life and it is of great importance that legislation of that kind charter the power of the authorities in a clear and unambiguous way. This is particularly important in cases regarding compulsory care due to the risk of what a negative decision could mean for a child’s health and safety. Therefore, the conclusion of this thesis is that it is necessary and urgent that the problem is addressed at a legislative level both from a children’s safety perspective and a legal security perspective.

Att (o)synliggöra ett behov – en analys av kammarrättens bedömningar avseende kontaktperson enligt 9 § 4 LSS. / Making needs (in)visible – an analysis of verdicts from the Swedish Court regarding contact person (LSS).

Föreliggande studie riktar fokus mot att analysera kammarrättsdomar gällande insatsen kontaktperson enligt 9 § 4 LSS. Studien syftar till att undersöka hur begreppet socialt isolerad beskrivs i kammarrättsdomar avseende insatsen kontaktperson enligt 9 § 4 LSS samt hur kammarrättens språkbruk kan ses som en form av maktbruk. I studien utgör det teoretiska ramverket av Norman Faircloughs kritiska diskursanalys med fokus på den tredimensionella modell som Fairclough konstruerat. Materialet består av 85 kammarrättsdomar som avkunnats mellan åren 2004 och 2021. Materialet analyseras först utifrån en tematisk analys för att besvara frågan om vad kammarrätten tillskriver begreppet socialt isolerad. Resultaten påvisar bland annat att tillgången till anhöriga/familj, fritidsaktiviteter och sysselsättning är centrala i bedömningen om den enskilde kan anses vara social isolerad eller inte. Utifrån den tematiska analysen väljs sedan tre rättsfall ut för en närmare analys utifrån Faircloughs tredimensionella analys. Ett resultat av analysen påvisar att det förekommer olika diskurser som kammarrätten i sin bedömning sammanväver till en kombinerad diskurs. Slutligen framkommer även att kammarrätten genom sin diskurs framhäver dess auktoritära roll i samhället. / The present study take aim towards an analyse of verdicts from the Swedish Court of appeal regarding persons who are entitled the support from a contact person through The Swedish Act concerning Support and Service for Persons with Certain Functional Impairments (LSS). The study seeks to answer how the Court of appeal define the term socially isolated in their verdicts regarding contact person (LSS) and how their language can be seen as a form of power. The theoretical framework for this study is Norman Fairclough´s critical discourse analysis with a particular focus on the three-dimensional model that Fairclough describes. The empirical data consists of 85 verdicts which have been presented by the Court of appeal during the years 2004 to 2021. The verdicts are initially analysed with a thematical analyse procedure. Findings suggest that family, leisure activities and employment/schooling are a central part in the Court of appeal verdicts to define if a person with impairments is socially isolated or not. From the thematical analysis three verdicts are chosen to be analysed with the help of Fairclough´s critical discourse analysis. The analysis suggest that different types of discourses are present in the verdicts which the Court of appeal then summarise in to one combined discourse. Lastly the analysis also suggests that the Court of appeal through discourses establish an authorial role in society.
