Job and family stress amongst firefightersOosthuizen, Rudolf M. 30 November 2004 (has links)
Firefighters providing emergency services to the public are involved with some of the most tragic aspects of the boundary between life and death, often in a context over which they have little or no control. The outcome of this may be that stress at work and at home are without doubt the reason that highly qualified and loyal firefighters give themselves over to alcohol or drug abuse, extramarital relationships and suicidal thoughts. The general aim of the research is to evaluate job and family stress amongst firefighters in the South African context, and to use the results in developing a developmental/counselling programme for firefighters and their families.
The research is quantitative and qualitative, consisting of a survey design and a phenomenological design. Three measuring instruments were used, namely the Biographical questionnaire, the Experience of Work and Life Circumstances questionnaire, and the Stress questionnaire. Task characteristics, organisational functioning, physical working conditions and job equipment, career and social matters, remuneration, fringe benefits and personnel policy were identified as causes of job stress originating within the work situation.
Interviews were conducted to determine how these firefighters experience job and family stress. Marital dysfunction and divorce, limited time with the family, problems with children, alcohol and drug abuse, lack of exercise, suicide, anger aimed at family members, physical and emotional exhaustion, lonely marital partners, unavailability to help the family when needed and depression were identified as causes of family stress arising outside the work situation.
The main recommendation is to implement a developmental/counselling job and family stress programme. The programme can be instituted to enhance the wellness and psychological health of firefighters and their families, or for counselling of firefighters and their families who are experiencing job and/or family stress. La présente thèse porte sur l'affirmation d'une compétence pénale de la construction européenne. Elle vise à répondre à la question principale, comment au cours du développement du processus de l'intégration on arrive à la reconnaissance d'un pouvoir de l'ensemble communautaire dans le domaine pénal et quelles sont les dimensions concrètes dudit pouvoir.Dans la Première partie, on révèle que les deux facteurs essentiels de la reconnaissance d'une compétence de type communautaire, relative à la problématique pénale, ont d'abord conduit à un effet d'encadrement de la souveraineté pénale des Etats membres. Ce phénomène se manifeste sur deux plans: d'un côté, les principes d'application du droit communautaire et le fonctionnement propre du système de l'intégration, jouent le rôle d'un facteur puissant de l'encadrement de la souveraineté pénale des Etats. D'autre part, au cours du développement de la construction européenne, se pose la question de mettre le dispositif de l'intégration en service de la lutte contre la criminalité transfrontalière, qui résulte dans la création du Troisième pilier en tant que cadre européen spécifique en matière pénale, vu le manque de volonté à consacrer explicitement une compétence communautaire dans le domaine étudié.La Deuxième partie est ciblée sur la reconnaissance même d'un pouvoir de l'ensemble européen pour intervenir en matière pénale, en fonction des deux facteurs essentiels - l'application effective du droit de l'intégration et la nécessité de mettre le dispositif communautaire en service de la lutte contre la criminalité transfrontalière. Elle cherche également à clarifier la nature et les conditions d'exercice de cette compétence. Sur ce plan sont d'abord étudiées les deux sources d'affirmation d'une compétence pénale de l'ensemble européen et les expressions concrètes de la communautarisation du domaine pénal. Ainsi est démontré le lien dialectique entre le développement de la construction communautaire en tant qu'une nouvelle forme de régulation publique et la reconnaissance d'un pouvoir du niveau européen d'agir en matière pénale. En deuxième lieu, le cadre juridique de la compétence pénale de l'Union européenne sous l'emprise du Traité de Lisbonne est profondément analysé. Cela permet de révéler la nature de la compétence pénale du système de l'intégration et de tirer des conclusions sur l'originalité de la construction européenne en tant qu'une forme de fédération de type nouveau.De cette manière on arrive à établir, que l'affirmation d'une compétence de type communautaire en matière pénale est une émanation de la nature particulière de la construction européenne, une fonction de l'approfondissement du projet communautaire et de la consolidation du système de l'intégration en tant qu'une nouvelle organisation du pouvoir public. / The present thesis focuses on the assertion of Community competence in criminal matters. It aims not only to answer the question as to how the European integration process allows room for the recognition of a power of the European system in the field of criminal law, but also to shed light on the various aspects of the above-mentioned competence.The first part of the study revolves around the problem how the two essential factors leading to the recognition of a Community competence in criminal law brought about an effect of framing criminal sovereignty as towards the Member States of the European construction. This phenomenon manifests itself in two aspects. On the one hand, the principles of the application of European law alongside the functioning of the European integration system together play a very important role in limiting the sovereignty of the Member States in the field of criminal law. On the other hand, the important matter of using the set of legal tools of the European integration to combat cross-border criminality, resulted, despite the lack of common will to make explicit conferral of competence in the field of study, in the establishment of the Third Pillar as a specific European legal framework in criminal matters.It is the recognition of power of intervention of the European integration system in criminal law matters that is analysed in the second part of the present study. This recognition is conditioned by two main factors - the effective implementation of European integration law and the need to use the integration legal tools to combat cross-border criminality. It also made a constructive attempt to clarify the nature and the conditions of the exercise of the abovementioned competence. In this aspect, the two sources of the assertion of a Community competence in criminal matters and the precise legal expressions of this process are examined in the first place. Thus, the dialectical interconnection between the development of the European legal construction as a new form of public regulation and the recognition of the power of the European community to intervene in criminal matters is demonstrated. In a second step, the legal provisions of European competence in the field of criminal law according to the Treaty of Lisbon are analysed in depth. This shows the legal understanding of European competence in the field of criminal law and allows a positive conclusion on the originality of the European integration system as a federation of an unseen kind to be drawn. In this respect, the present study establishes that the assertion of a Community-based competence in the field of criminal law is an emanation of the peculiar nature of the European construction, a function of the deepening of the European project and of the consolidation of the integration system as a new form of public power.

Text in Afrikaans with summaries in Afrikaans and English / For many years divorce has been viewed exclusively as a legal problem that had to be addressed by the courts in our adversarial system of litigation. Divorce, however, also entails social problems which are not addressed in our legal system. It appears further that our adversarial legal system tends to heighten the conflicting interests of individual family members at divorce and to encourage animosity and irreconcilability.
In an attempt to ameliorate the harsh consequences of the adversarial legal system at divorce, two no-fault grounds for divorce were introduced to enable divorcing spouses to make the decision about the termination of their marriage themselves. This greater freedom that no-fault divorce afforded parties quickly led to a demand for a new system of dispute resolution at divorce. The Hoexter Commission consequently, recommended the establishment of a family court with a social component where mediation services are offered. In both Australia and New Zealand the introduction of no-fault divorce was attended by the establishment of family courts where mediation services are offered. In mediation the parties involved, with the assistance of an impartial third, may sort out and find solutions to all their divorce-related problems. It also appears that mediation has always played a prominent role in the resolution of family disputes in the indigenous communities of South Africa.
Owing to financial restrictions, South Africa is still without a family court. So far, only the Mediation in Certain Divorce Matters Act 24 of 1987 has emanated from the recommendations of the Hoexter Commission. This Act, which provides for the institution of enquiries by the office of the family advocate to determine the best interests of children at divorce, professes in its title to have introduced mediation as an alternative system of dispute resolution at divorce. From the contents of the Act it is apparent, however, that it provides for mediation only in a very limited sense. Consequently, it is necessary to amend this Act to make provision for real, comprehensive and accessible mediation services for the public in all family law disputes. This amendment could best be achieved by regulating existing private and community mediation services and integrating them into the formal legal process. / Egskeiding is baie jare lank as 'n regsprobleem beskou wat in ons adversatiewe stelsel van

skuldlose egskeidingsgronde in 1979 ingevoer wat aan gades wat wil skei, groter inspraak
en seggenskap in die hele proses gegee het. Hierdie groter vryheid wat skuldlose
egskeiding meegebring het, het spoedig 'n behoefte aan 'n nuwe stelsel van
dispuutbeslegting by egskeiding geskep. Die Hoexterkommissie het gevolglik aanbeveel
dat 'n gesinshof met 'n maatskaplike komponent ingestel word waarby onder andere
bemiddelingsdienste beskikbaar meet wees. In sowel Australie as Nieu-Seeland het die
invoering van skuldlose egskeiding inderdaad gepaardgegaan met die instelling van
gesinshowe waar bemiddelingsdienste beskikbaar is. In die bemiddelingsproses kan
mense self, maar met die bystand van 'n onpartydige derde, al hulle probleme by
egskeiding uitsorteer en oplos. Dit blyk verder dat bemiddeling nog altyd 'n prominente rol
by die beslegting van gesinsgeskille in inheemsregtelike gemeenskappe in Suid-Afrika
gespeel het.
Weens finansiele beperkings is Suid-Afrika nog steeds sonder 'n gesinshof. Al wat tot
dusver uit die Hoexterkommissie se aanbevelings voortgevloei het, is die Wet op
Bemiddeling in Sekere Egskeidingsaangeleenthede 24 van 1987 wat daarvoor voorsiening
maak dat die kantoor van die gesinsadvokaat by egskeiding ondersoeke na die beste
belange van kinders kan instel. Alhoewel die titel van die Wet voorgee om vir bemiddeling
as 'n alternatiewe stelsel van dispuutbeslegting by egskeidng voorsiening te maak, blyk dit
uit die inhoud van die Wet dat dit bloot vir 'n baie beperkte vorm van bemiddeling voorsiening maak. Dit is gevolglik nodig dat hierdie Wet gewysig word om by alle
familieregtelike kwessies vir ware, omvattende en toeganklike bemiddelingsdienste aan die
publiek voorsiening te maak. Die geskikste wyse waarop dit bewerkstellig kan word, is om
bestaande private en gemeenskapsbemiddelingsdienste te reguleer en in die formele

Cross-border taking of evidence in civil and commercial matters in Switzerland, South Africa, Botswana, Namibia, Nigeria, and UgandaSchleiffer Marais, Prisca Christina Leonie 30 July 2013 (has links)
The thesis investigates the extent to which cross-border taking of evidence in civil and com-mercial matters in relation to Switzerland, South Africa, Botswana, Namibia, Nigeria, and Uganda is allowed. Such evidence-taking is not only governed by the domestic law of the state seeking evidence abroad and that of the state where the relevant means of proof are located, but also by public international law, and more specifically by the concept of sovereignty. The ad-missibility of the cross-border taking of evidence under public international law depends on whether or not evidence-gathering in civil litigation is regarded as a judicial act, which violates sovereignty when performed on foreign territory, or as a purely private act. In the first case, the evidentiary material has to be obtained through channels of international judicial assistance. Such assistance can either be rendered based on the basis of an international treaty, or through courtoisie internationale. No international judicial assistance is necessary in cases of a so-called “transfer of foreign evidence”, provided no compulsion is applied which infringes the sovereignty of the foreign state.
The thesis analyses the taking of evidence abroad based on the Hague Evidence Convention, and the Hague Procedure Convention. It further expounds how evidence located in Switzer-land, Botswana, Namibia, Nigeria, and Uganda can be obtained for the benefit of civil proceed-ings pending abroad in the absence of any relevant international treaty. The thesis also exam-ines under what conditions a litigant in civil proceedings in the aforementioned countries may request evidence to be taken on foreign soil. The position of cross-border taking of evidence in civil and commercial matters in the said countries is assessed, and suggestions are made on how such status quo may be improved. The thesis makes an attempt to establish the basic prin-ciples for a convention on evidence-taking in civil and commercial matters between South Af-rica, Botswana, Namibia, Nigeria, and Uganda. The development of such principles, however, is only possible once the similarities and differences in the procedure for the taking of evidence and the means of proof in the relevant laws of the aforesaid countries have been identified. / Public, Constitutional, and International / LL.D.

(International Commercial Law) / This essay seeks to look at the role of express submission to jurisdictjon under the Brussels I Regulation,lthe Brussels I (recast) Regulation2 and the Hague Convention on Choice of Court Agreements.3 The express submission to jurisdiction under the three instruments mentioned in the previous sentence refers to the situation in which parties to an international commercial contract include in their contract a court of their choice to govern any disputes that may arise between them. This designated court may or may not be situated in a country that is a member of the three instruments mentioned above. The purpose of this thesis is to determine what will occur when the court chosen is from a country that is not a member of either of the three instruments mentioned. We will first look at express submission and the role it plays in determining which court has jurisdiction. This section on express submission will provide the definition of express submission in the context of a contract which incorporates a choice-of-forum agreement between the parties who are engaged in an international commercial transaction. The thesis will view the role of submission in a common-law and civil-law country in light of express submission by contract. Finally, a distinction will be made between an exclusive and non-exclusive jurisdiction clause. A brief discussion ofthe Brussels Convention4 (The Convention) will be provided in order to present the fact that the Convention only applies when a choice-of-forum agreement in a contract has assoned thejurisdiction to a court of a country which is a member of the Convention. The Convention would not apply when a choice-of-forum agreement in a contract has assigned jurisdiction to the court of a country which is not a member to the Convention. ln order to determine whether the position has changed since the enactment of the Brussels I Regulation (Regulation) with regard to choice-of-forum agreements that designate jurisdiction to the court of a country in a nonmember state of the Regulation, provisions relating to express submission clauses will be discussed. A further discussion will be provided to ascertain whether the enactment of the Council Regulation (EC) No 4412001 of 22 December 2000 on jurisdiction and the recognition and enforcement ofjudgments in civil and commercial matters.

Fictionalized Indian English Speech and the Representations of Ideology in Indian Novels in EnglishMuthiah, Kalaivahni 08 1900 (has links)
I investigate the spoken dialogue of four Indian novels in English: Mulk Raj Anand's Untouchable (1935), Khushwant Singh's Train to Pakistan (1956), Rasipuram Krishnaswami Narayan's The World of Nagaraj (1990), and Rohinton Mistry's Family Matters (2002). Roger Fowler has said that literature, as a form of discourse, articulates ideology; it is through linguistic criticism (combination of literary criticism and linguistic analyses) that the ideologies in a literary text are uncovered. Shobhana Chelliah in her study of Indian novels in English concludes that the authors use Indian English (IndE) as a device to characterize buffoons and villains. Drawing upon Fowler's and Chelliah's framework, my investigation employs linguistic criticism of the four novels to expose the ideologies reflected in the use of fictionalized English in the Indian context. A quantitative inquiry based on thirty-five IndE features reveals that the authors appropriate these features, either to a greater or lesser degree, to almost all their characters, suggesting that IndE functions as the mainstream variety in these novels and creating an illusion that the authors are merely representing the characters' unique Indian worldviews. But within this dialect range, the appropriation of higher percentages of IndE features to specific characters or groups of characters reveal the authors' manipulation of IndE as a counter-realist and ideological device to portray deviant and defective characters. This subordinating of IndE as a substandard variety of English functions as the dominant ideology in my investigation of the four novels. Nevertheless, I also uncover the appropriation of a higher percentage of IndE features to foreground the masculinity of specific characters and to heighten the quintessentially traditional values of the older Brahmin generation, which justifies a contesting ideology about IndE that elevates it as the prestigious variety, not an aberration. Using an approach which combines literary criticism with linguistic analysis, I map and recommend a multidisciplinary methodology, which allows for a reevaluation of fictionalized IndE speech that goes beyond impressionistic analyses.

Le Lebanese Atomic Energy Commission (LAEC) poursuit un programme de développement des techniques analytiques pour compléter l’analyse par faisceau d’ions (IBA). Il a décidé de s’équiper d’un spectromètre de masse couplée à l’imagerie 2D puis récemment 3D avec l’acquisition d’un spectromètre de masse IONTOF V™ équipé de deux colonnes ioniques délivrant des faisceaux d’agrégats de bismuth et d’argon. Dans ce cadre, mon sujet de thèse a porté sur l'optimisation de l’instrument nouvellement acquis pour l’analyse d’échantillons contenant des composés organiques. Les premiers sujets de recherche sont la mise au point du protocole d’analyse quantitative de médicaments en utilisant la technique « cluster-SIMS-imaging » et l’analyse de la météorite Paris pour localiser la matière organique et déterminer sa composition. Dans les deux cas une approche multi-technique a été utilisée : IBA au LAEC, µ-Raman et µ-IR autour des équipements de Soleil et µPIXE réalisée auprès de l’accélérateur AGLAE (Centre de recherche et de restauration des musées de France, C2RMF).L’analyse de médicaments a été initiée au Liban en collaboration avec un fabricant local de produits pharmaceutiques (Mediphar Laboratories) dans le but d’établir de nouveaux procédés de contrôle qualité de produits finis. Mon étude a montré la complexité du dosage de médicament due à la présence de plusieurs molécules actives (Principe Actif, PA) et de substances organiques et minérales inactives (excipients) mélangées dans des conditions secrètes. Les effets de matrice sont dominants et modifient l’émission ionique conduisant à des erreurs systématiques importantes. Cette complexité a été analysée avec l’étude du Fludinium™ possédant deux PAs. Les résultats de cette étude ont permis d’obtenir la première courbe d’étalonnage du rapport des deux PAs et de quantifier ceux-ci dans les conditions du médicament commercial. Le protocole pour effectuer cette courbe d’étalonnage et les contrôles « qualité » ont été déterminés. Ceux-ci incorporeront une analyse en profil pour contrôler l’homogénéité des échantillons et l’obtention d’étalons produits par le fabricant en suivant ses processus de fabrication. En effet, les expériences ont montré que la réalisation du médicament en laboratoire à partir de ses éléments (PAs et excipients) ne donnait pas la même réponse ionique que le médicament commercial. L’analyse de la météorite Paris a été initiée par une collaboration avec une équipe de l’Institut d’Astrophysique Spatial d’Orsay impliquée dans l’exobiologie et la recherche des premières molécules pré-biotiques dans des échantillons extraterrestres. Le but des recherches est de caractériser la matière organique représentant quelques pourcents en poids dans une matrice minérale complexe, sans utiliser des méthodes chimiques pouvant induire une modification de ces molécules. Cette étude a démontré l’intérêt de l’approche multi-technique centrée autour de la spectrométrie de masse couplée à l’imagerie ionique pour déterminer les éléments principaux de la matrice minérale et organique. L’analyse par µPIXE avec une cartographie micrométrique a permis d’attribuer les distributions d’ions moléculaires et agrégats des spectres de masse aux différents composés minéraux. Ces attributions se poursuivent avec la constitution d’une base de données de spectres de référence. La composante organique a été extraite et les premières hypothèses de composition ont été envisagées autour des HAPs (Hydrocarbure Aromatique Polycyclique), MOI (Matière Organique Insoluble) et analogues de carbone amorphe produits par irradiation UV de glaces dont les compositions en gaz représentent différentes hypothèses pour les nuages interstellaires. Les protocoles d’analyses multi-techniques établis (incorporant un suivi de l’échantillon par spectrométrie de masse et imagerie ionique) permettent le démarrage d’analyse d’autres échantillons extra-terrestres collectés sur terre ou dans l’espace. / The Lebanese Atomic Energy Commission (LAEC) is incorporated in a development program of the analytical techniques in order to complete the Ion Beam Analysis (IBA). It was decided to get a mass spectrometer coupled to 2D and recently to 3D imaging, by acquiring an ION TOFVTM system equipped with two ionic columns delivering bismuth and argon cluster beams.In this context, my thesis is focused on the optimization of the instrument, recently purchased, for the analysis of samples containing organic compounds. The first subjects of research are the development of a protocol for quantitative analysis of drugs using the « cluster-SIMS-imaging » technique and the Paris meteorite analysis to determine its composition and to localize the organic matter. In the last case a multi-techniques approach was used : IBA in LAEC, µ-Raman et µ-IR around the Soleil synchrotron equipments and µPIXE carried with the AGLAE accelerator (Centre de recherche et de restauration des musées de France, C2RMF).The drug analysis was initiated in Lebanon in collaboration with a local pharmaceutical manufacturer (Mediphar Laboratories) in order to establish new processes for quality control of the final products. My study showed the complexity of the drug quantification which is due to the presence of several active ingredients (AI) and inactive organic and minerals components (excipients) mixed in secret conditions. Matrix effects are dominant and modify the ionic emission leading to significant systematic errors. This complexity has been analyzed with the study of FludiniumTM with two active ingredients. The results of this study allowed to obtain the first calibration curves of the ratio between the two AIs and to quantify them in the commercial drug. The protocol to perform the calibration curve and the « quality» controls were determined. These incorporate a profile analysis to control the homogeneity of the samples and the obtaining standards produced by the pharmaceutical manufacturer following the same process used for the commercial drug. Indeed, the experiments have shown that the preparation of the drug in the laboratory from its elements (AIs and excipients) doesn’t give the same ionic emission as for the commercial drug.The Paris meteorite analysis was initiated by a collaboration with the Institut d’Astrophysique Spatiale d’Orsay team involved in the exobiology and the research of the first prebiotic molecules in the extraterrestrial samples. The work objective is to characterize the organic matter representing few percents in mass in a complex mineral matrix, without any chemical extraction that can induce a modification of these molecules. This study has demonstrated the interest of the multi-techniques approach centered on the mass spectrometry coupled to the ionic imaging for the determination of the main mineral and organic elements of the matrix. µPIXE analysis coupled to the micrometric mapping permits to attribute the distribution of molecular ions and clusters of the mass spectra with different mineral compounds. These attributions continue with the creation of the data base of standard spectra. The organic component was determined and the first hypotheses were considered concerning PAHs (Polycyclic Aromatic Hydrocarbon), IOM (Insoluble Organic Matter) and analogues of amorphous carbon produced par UV irradiation of ices with a gas composition representing different hypotheses for the interstellar clouds. The establish protocols for multi-techniques (incorporating a follow of the sample by mass spectrometry and ion imaging) permits to start the analysis of other extra terrestrial samples collected on earth or in space.

Envisager dans sa globalité, à l’aune des caractéristiques d’un système juridique et des modèles pénaux existant, les éléments du champ pénal de l’Union européenne peuvent alors s’agencer comme les pièces d'un puzzle qui prend progressivement forme et dont l'image générale se dessine peu à peu. Le champ pénal de l’Union européenne n’est plus qu’une compilation de normes. Il constitue désormais un système juridique : un ensemble d'éléments en interaction, évoluant dans un environnement déterminé, structuré en fonction des finalités qu’il est destiné à satisfaire, agissant sur son environnement et se transformant avec le temps sans perdre son identité. Son idéologie pénale à dominante répressive n’a rien de particulièrement original ; sa physionomie, en tant que système pénal, en revanche, reproduit l'atypisme proprement unioniste / Defined by the Europe court of human rights (ECHR), the EU extend its scope of action beyond the definition of « penal » as found in the EU law.
