In Brazil, the agreement was approved by Legislative Decree No. 451 of 14th November 2001 and promulgated by Decree No. 5.722 of 13th March 2006. The Multilateral Agreement on Social Security (AMSS) coordinates the various national laws that deal with Social Security, without creating a common law or rule for the member states, apart from creating a procedure for recognition of pension contributions on time worked in any of the member states. This research discusses the guarantee of the right to social security benefits to workers who move with their families within the MERCOSUL countries, and it also aims to examine the advances in the field of social security in the context of regional integration from the point of view of social security protection; to discuss the strengths and weaknesses of social security protection under the Multilateral Agreement on Social Security and to present the standards for access to benefits through the agreement. The research is qualitative and the data was collected in databases and through bibliographical research. The research is organized into three chapters which discuss: regional integration and the establishment of MERCOSUL; the international agreements regarding international Social Security; the international organizations relating to Social Security, as well as the operational standards of MERCOSUL’s Multilateral Agreement on Social Security. / A pesquisa aborda a proteção previdenciária dos trabalhadores dos países signatários do Acordo Multilateral de Seguridade Social do MERCOSUL, este que foi assinado em 15 de dezembro de 1997 e entrou em vigor em 1º de junho de 2005. No Brasil, o referido Acordo, foi aprovado pelo Decreto Legislativo n.º 451, de 14 de novembro de 2001 e promulgado pelo Decreto n.º 5.722, de 13 de março de 2006. O acordo Multilateral de Seguridade Social (AMSS) coordena as distintas legislações nacionais que tratam sobre Seguridade Social, sem criar um direito ou regra comum aos Estados Partes, apenas cria um procedimento para reconhecimento do tempo de contribuição previdenciária no trabalho realizado em qualquer dos Estados Partes. A pesquisa objetivou discutir a garantia do direito a benefícios previdenciários aos trabalhadores que circulam com suas famílias nos países integrantes do MERCOSUL, tem como objetivo, também, analisar os avanços na área da seguridade social no contexto da integração regional sob o ponto de vista da proteção previdenciária; discutir os avanços e limites da proteção previdenciária prevista no Acordo Multilateral de Seguridade Social e apresentar as normas vigentes para o acesso aos benefícios através do Acordo. A pesquisa é qualitativa e os dados foram coletados em bases documentais e através de pesquisa bibliográfica, organizada em 3 capítulos discorrendo sobre a integração regional e a construção do MERCOSUL, os acordos internacionais de Seguridade Social os organismos internacionais de Seguridade Social assim como as normas operacionais do Acordo Multilateral de Seguridade Social do MERCOSUL.

Conselho Nacional de Desenvolvimento Científico e Tecnológico / O trabalho identifica quais os fatores sistêmicos e domésticos que influenciam na formulação da política externa brasileira para o setor financeiro, com foco no período posterior à crise financeira de 2008. Para esse fim, a pesquisa analisa os atores domésticos que atuam no processo decisório de formulação da política externa para o setor financeiro, assim como seus interesses. Os órgãos federais ? nomeadamente o Ministério da Fazenda, o Banco Central e o Ministério das Relações Exteriores ? são os atores mais influentes nesse processo. O setor privado, apesar de dispor de capacidades políticas, delega a sua participação ao governo, assumindo uma postura reativa. Por sua vez, a sociedade civil tem pouca influência nesse processo. O cenário internacional tem papel de destaque nesse processo, pois restringe as ações do país, de acordo com a posição na hierarquia de poder. Após a estabilização econômica brasileira e a crise que abalou os mercados do Norte, o Brasil encontra-se mais livre em sua atuação internacional. Com isso, há um processo de repolitização da política externa para o setor financeiro, em que, no plano internacional, o Brasil coopera com outros países emergentes para demandar a redistribuição de poder decisório; e no plano doméstico, atores que antes não exerciam grande influência passam a ter. / The present research identifies systemic and domestic factors that exert influence on the decision making of the Brazilian foreign policy for the financial sector, mainly after the 2008 financial crisis period. To fulfill this aim, the research analyzes the domestic actors who are active in the foreign policy formulation process, as well as their interests. Brazilian federal agencies - including the Ministry of Finance, the Central Bank and the Ministry of Foreign Affairs - are the most participative actors in this process. Despite having political power, the private sector delegates its involvement to the government, assuming a reactive stance. On an opposing way, civil society has little influence in this process. The international order has an important role in this process because it restricts the country actions, according to its position in power hierarchy. After Brazilian economic stabilization and the 2008 financial breakdown which plunged North markets into crisis, Brazil has more freedom to act in the international field. As a result, there is a process of re-politicization of foreign policy for the financial sector, in which, at the international level, Brazil cooperates with other emerging countries demanding the redistribution of decision-making power, and domestically, actors who had not previously had great influence now emerge

Durante o estudo, verificou-se que, além dos aspectos jurídico-burocráticos, outras variantes influenciam este processo. Dessa forma, a problemática que se pretendeu solucionar e explicar, extrapolou o processo burocrático de contratação em si, exigindo também um estudo das relações internacionais entre estes sujeitos. Temas paradoxais como soberania nacional e a lógica sistêmica da interdependência entre os Estados fizeram-se necessários para a compreensão do processo. A fim de demonstrar algumas particularidades políticas do processo de contratação de operação de crédito, focaram-se aspectos dos setores de governança e de educação. Foi constatado que duas ordens jurídicas atuam sobre estes contratos, a doméstica e a internacional. Disso podem decorrer indagações sobre a legitimidade ou não de algumas cláusulas incidentes nestes contratos, em especial, as condicionalidades para reformas e ajustes estruturais nos modelos políticos nacionais / Abstract: In the present study the act of contract and concession processes provided by external financings of the Multilateral Financial Institutions for the entities of international right public was approached. During the study, it was verified that, beyond the legal-bureaucratic aspects, other variants influenced this process. Consequently, the problematic that it was intended to solve and to explain surpassed to the bureaucratic process of act of contract itself, demanding also, a study of the international relations between those entities, Paradox subjects as national sovereignty, systemic logic of the interdependence between the states was made necessary for the understanding of the process. In order to demonstrate some political particularities of the contract of operation for credit process, the education and governance sectors were highlighted. It was noted that the domestic and international juridical order acts on those contracts. Environmental protection and the World Trade Organization Klára Šmídlová Abstract The theme of this diploma thesis is the relationship of the World Trade Organization (WTO) to the environmental protection. In its three chapters, this paper carries out an analysis of the historical aspects of this relationship and also of the questions, which are being solved in the present. The first chapter outlines the evolution of the relationship between the international trade and the environmental protection since 1947 when the General Agreement on Tariffs and Trade was concluded. The second part of the paper focuses on the analysis of the provisions of the particular WTO agreements, which approach the issue of the environmental protection in different ways. The case law established by the WTO bodies during solving of the disputes between the member states is especially emphasised in analysis of the provisions of the WTO agreements. Finally, the last chapter is devoted to the research of the relationship between the WTO and multilateral environmental agreements, above all those making use of the trade measures to achieve their goals.

As the number of preferential trade agreements has been growing steadily, the on-going clash between regionalism and multilateralism will be a key topic throughout the research. Fair trade movements have been becoming more popular over the fast few years as some organizations have strived to raise consumers awareness regarding the great disparities among the profit margins of the producers or farmers in developing countries in comparison to those of the merchants and distributors in developed countries. Even though quantitative data will be used in order to portray the growing economic inequalities present in today s world, arguments will also be supported on grounds of ethics and morals relating to social justice.

The Mauritius Convention on Transparency and the Multilateral Tax Instrument: models for the modification of treaties?

The investment treaty network and the tax treaty network comprise more than 3,000 treaties each. The provisions of these treaties generally are highly customized on the basis of the investment flows and economic interests of the contracting States. The number of treaties in force and their customization potentially turn the amendment of these treaty networks in their entirety into a cumbersome and long process. To modify the treaty networks in a swift and coordinated manner, the investment treaty makers and the tax treaty makers almost contemporaneously developed the idea of implementing treaty changes through a single multilateral convention. On 10 December 2014, the United Nations adopted the Convention on Transparency in Treaty-based Investor' State Arbitration, also known as the Mauritius Convention. In addition, on 24 November 2016, the Multilateral Convention to Implement Tax Treaty Related Measures to Prevent Base Erosion and Profit Shifting (BEPS), commonly referred to as the Multilateral Tax Instrument, was concluded under the aegis of the Organisation for Economic Co-operation and Development (OECD). The Mauritius Convention and the Multilateral Tax Instrument share the object and purpose of modifying an extensive number of treaties. However, due to their novelty, little research has been done until now on their common characteristics and differences. The article aims at filling this gap by comparing both multilateral conventions. It also aims at drawing lessons from the analysis of both multilateral conventions that might be of benefit for future modifications of an extensive number of treaties through a single instrument.

Esse trabalho analisa as condições que tornaram possível, e aceitável, a percepção de que favelas diferentes, mas contíguas entre si, fossem apreendidas como uma unidade territorial nomeada do Complexo do Alemão. Tal perspectiva remete a fins da década de 1970 e início dos anos 1980, período reconhecido pela literatura urbana carioca como aquele no qual a solução para o problema da favela, por parte do poder público, passa a ser um conjunto de intervenções diversas, às quais se convencionou nomear de urbanização, em detrimento da política de remoção. Dentre outros elementos, essa reorientação da ação governamental, por um lado, vai desencadear uma abundante produção de informações sobre esses territórios, através da montagem de um quadro técnico qualificado que buscava todo o tempo responder a questão que veio a se colocar para o governo municipal com essa mudança: como urbanizar? Por outro, reflete, também, a influência das transformações na agenda urbana interacional na gestão da cidade do Rio de Janeiro, bem como na de outros municípios do país. A investigação desses aspectos levantou uma dúvida sobre o caráter realmente transformador das políticas de urbanização inicialmente levadas a cabo por um prefeito, Israel Klabin, que era um homem de negócios de sucesso e íntimos de atores econômicos e políticos, nacionais e internacionais. Com entrevistas, pesquisa documental e em jornais da época, propõe-se entender as politicas de urbanização sob a ótica da governamentalização desses territórios, ou, em outras palavras, como uma tecnologia de gestão da população e dos espaços favelados. / This thesis analyses the conditions that made possible and acceptable the perception that different favelas, but contiguous in each other, were perceived as a territorial unit named Complexo do Alemão. This perspective brings to the late 1970s and early 1980s, period recognized by the urban carioca literature as the period in which the solution to the favela problem, by the public authorities, becomes a set of many interventions, which was conventionally named as urbanization, in detriment of the removal policy. This reorientation of the public authorities, by one side, triggers an abundant production of information about this territories, through the assembly of a qualified technical condition, that seeked at all times to answer the question that was put to the municipal government with this change: how to urbanize? On other hand, reflects, between other motivations, the influence of the transformation in the international urban agenda in the urban management of the city of Rio de Janeiro, but also in other cities of the country. The investigation of these aspects raised a doubt on the real transformer character of the urbanization policies initially carried out by a mayor, Israel Klabin, that was a successful businessman and close to economic and political actors, national and international. With interviews, documental research and in newspapers of the period, it proposes to understand the urbanization policies by the perspective of the governmentalization of these territories, or, in other words, as a management technology of the population and slum areas of favela.

L'objet de cette thèse est d'expliquer les raisons apparentes et profondes de la lenteur de cette candidature en s'appuyant sur la situation de l'Algérie et sur les modalités de fonctionnement du système commercial multilatéral. / The WTO exists and Algeria has applied to be a member. This application process has been going on for over 23 years and has not reached a conclusioon yet. The aim of this thesis is to explain the reasons both obvious and hidden for the slowness of the process based on the situation of Algeria and on the working rules of the multilateral trade system.
