The legal role of the bill of lading, sea waybill and multimodal transport document in financing international sales contracts

The legal nature of the bill of lading as a negotiable document of title has allowed it to provide the basis of a system in which bankers provide credit for the financing of international sales contracts on the strength of the security afforded by the goods represented in the bill. The sea waybill has appeared as a substitute for the bill of lading and, despite its nature as a nonnegotiable document, it can be employed in a manner which allows it to provide collateral security to banks. Multimodal transport documents which may be issued in negotiable or non-negotiable form assume the same legal role as the bill oflading or sea waybill respectively. The inclusion of specific articles in the 1993 Revision of the UCP relating to non-negotiable sea waybills and multimodal transport documents affirms their acceptability to banks financing international sales contracts under documentary letters of credit. / Law / LL.M.

Ce travail porte sur la modélisation et la résolution de problèmes d’optimisation robuste et multi-objectifs du transport multimodal. Après une synthèse des travaux de la littérature et des concepts de base de l’optimisation robuste et l’optimisation multi-objectif, nous proposons un nouveau modèle d’optimisation multi-objectif du transport multimodal des produits agricoles marocains vers des clients européens. L’objectif est de déterminer la meilleure stratégie d’exportation qui minimise simultanément le coût total de transport multimodal et l’overtime maximal en prenant en considération des contraintes réalistes. Nous proposons également des nouvelles approches de résolution avec une application sur un réseau de transport multimodal réel.Nous avons étudié une autre problématique du transport multimodal avec localisation de terminaux intermodaux. Outre la version déterministe, une optimisation robuste qui tient compte des incertitudes sur les capacités, les coûts d’utilisation et les coûts de transport. Deux approches hybrides ont été proposées pour la résolution du problème.Dans ces contributions, des modèles et des méthodes sont présentés, des remarques et des interprétations sont tirées à propos de l’impact de la périssabilité des produits et de la robustesse sur les flux, le choix des ports, des trajets et des modes de transport. / Because of the importance of multimodal transport for goods importation and exportation from Morocco to international customers, our goals are modeling and solving multimodal freight transportation problems by more focusing on some issues confronted by our country. After presenting the required mathematical background on robust and multiobjective optimization and surveying the literature works on multimodal transport problems, its variants and solution approaches; and instead of testing them only on traditional benchmarks; we dealt with new variants and methods. A multi-objective mathematical model is proposed to optimize the multimodal transport of agricultural products from Morocco to Europe. To solve this model adapted to a real network, two multiobjective version algorithms are presented in order to optimize simultaneously the total transportation cost and the over-time.Given the complexity of the global logistics chain by various operations and several stakeholders, the data of the problem may sometimes be ignored or uncompleted. That’s why we have developed a mathematical model for multimodal terminal location problem by integrating uncertainties of the transportation costs, the capacities and the using costs of terminals. A population based simulated annealing and a hybrid method combining an exact and a metaheuristic approaches are proposed to effectively solving the problem. The test is then performed on a real intermodal network. These contributions are concluded by remarks and highlights about the impact of perishability and robustness on flows, location strategies of ports, the choice of paths and transportation modes.

Les réseaux de transport se sont amplifiés par l’accroissement du nombre des véhicules et des stations ainsi que l’apparition de nouvelles notions essentiellement la multimodalité et l’intermodalité. Ainsi, la tâche de gestion des réseaux de transport collectif est devenue très complexe et difficile pour les régulateurs. Pour faire face à ces difficultés, on note le développement des systèmes d’aide à la décision comme solution efficace de régulation de la circulation. Ils permettent de transmettre en temps réel les informations concernant le trafic sur les réseaux de transport.Notre travail se base sur la conception d’un système de régulation des réseaux de transport multimodal. Il peut se révéler comme un outil primordial pour apporter des solutions efficaces et en temps réel à la problématique de la congestion routière. Il peut communiquer l’information nécessaire à l’usager afin de prendre sa décision de déplacement avec ou sans sa voiture. Le système proposé est une approche hybride entre une modélisation par graphes du réseau et un système multi-agents. Ceci sera appuyé par une approche évolutionniste pour la génération d’une solution de régulation optimale. Ce choix est justifié par le caractère ouvert, distribué et complexe des réseaux de transport multimodal / Transport networks have been amplified by the increasing number of vehicles and stations and the emergence of new concepts essentially multimodal and intermodal. Thus, the task of managing public transport systems has become very complex and difficult for regulators.To cope with these difficulties, there is the development of systems decision support as an effective solution to traffic control. They can transmit real-time traffic information on transport networks. Our work is based on designing a control system of multimodal transport networks. It may be as an essential tool for effective solutions and real-time to the problem of traffic congestion. It can provide the necessary information to the user in making its decision to move with or without his car. The proposed system is a hybrid between a graph modeling the network and a multi-agent system. This will be supported by an evolutionary approach for generating an optimal control solution. This is justified by the open, distributed and complex network of multimodal transport

De nos jours, les informations liées au déplacement et à la mobilité dans un réseau de transport représentent sans aucun doute un potentiel important.Ces travaux visent à mettre en œuvre un Système d’Information de Service d’Aide à la Mobilité Urbaine (SISAMU).Le SISAMU doit pouvoir procéder par des processus de décomposition des requêtes simultanées en un ensemble de tâches indépendantes. Chaque tâche correspond à un service qui peut être proposé par plusieurs fournisseurs d’information en concurrence, avec différents coûts, temps de réponse et formats. Le SISAMU est lié à un Réseau informatique Etendu et distribué de Transport Multimodal (RETM) qui comporte plusieurs sources d’information hétérogènes des différents services proposés aux utilisateurs de transport. L’aspect dynamique, distribué et ouvert du problème, nous a conduits à adopter une modélisation multi-agent pour assurer au système une évolution continue et une flexibilité pragmatique. Pour ce faire, nous avons proposé d’automatiser la modélisation des services en utilisant la notion d’ontologie. Notre SISAMU prend en considération les éventuelles perturbations sur le RETM.Ansi, nous avons créé un protocole de négociation entre les agents. Le protocole de négociation proposé qui utilise l’ontologie de la cartographie se base sur un système de gestion des connaissances pour soutenir l'hétérogénéité sémantique. Nous avons détaillé l’Algorithme de Reconstruction Dynamique des Chemins des Agents (ARDyCA) qui est basé sur l’approche de l’ontologie cartographique. Finalement, les résultats présentés dans cette thèse justifient l’utilisation de l’ontologie flexible et son rôle dans le processus de négociation / Nowadays, information related on displacement and mobility in a transport network represents certainly a significant potential. So, this work aims to modeling, to optimize and to implement an Information System of Services to Aid the Urban Mobility (ISSAUM).The ISSAUM has firstly to decompose each set of simultaneous requests into a set of sub-requests called tasks. Each task corresponds to a service which can be proposed different by several information providers with different. An information provider which aims to propose some services through our ISSAUM has to register its ontology. Indeed, ISSAUM is related to an Extended and distributed Transport Multimodal Network (ETMN) which contains several heterogeneous data sources. The dynamic and distributed aspects of the problem incite us to adopt a multi-agent approach to ensure a continual evolution and a pragmatic flexibility of the system. So, we proposed to automate the modeling of services by using ontology idea. Our ISSAUM takes into account possible disturbance through the ETMN. In order to satisfy user requests, we developed a negotiation protocol between our system agents. The proposed ontology mapping negotiation model based on the knowledge management system for supporting the semantic heterogeneity and it organized as follow: Negotiation Layer (NL), the Semantic Layer (SEL), and the Knowledge Management Systems Layer(KMSL).We detailed also the reassignment process by using Dynamic Reassigned Tasks (DRT) algorithm supporting by ontology mapping approach. Finally, the experimental results presented in this thesis, justify the using of the ontology solution in our system and its role in the negotiation process

Les autoroutes de la mer : aspects juridiques / Motorways of the sea : legal aspects

Dans une perspective de réalisation du marché unique européen, la libéralisation des différents secteurs d'activités en Europe dont celui des transports au courant des années 1990, entraîne le développement des différents modes et une surcroissance du transport routier avec certes de réels avantages en terme de développement économique, de compétitivité et d'emploi, mais aussi de sérieux inconvénients : congestion des grands axes routiers et augmentation du taux d'émissions de C02. Encourager l'intermodalité et promouvoir le développement des modes alternatifs à la route, rééquilibrer les différents modes de transport, constituent désormais l'une des principales priorités de l'Europe. Sous les auspices du Livre Blanc de 2001 relatif à la politique européenne des transports, les autoroutes de la mer naquirent sous un jour insuffisamment éclairé, et, actuellement, elles essaient de se frayer un véritable chemin. Elles présentent néanmoins des caractéristiques essentielles : considérées à la fois comme des infrastructures et des services de transport, elles constituent des lignes régulières de transport maritime à haute fréquence et à haute qualité de service, assurant des liaisons entre deux ou plusieurs ports d'au moins deux États membres de l'Union Européenne. Issues de la nouvelle politique européenne des transports, elles répondent aux impératifs de décongestion des grands axes routiers saturés, de sécurité routière, de développement durable et de protection de l'environnement, favorisant ainsi le développement et la croissance du marché intérieur. Or, l'absence d'un statut juridique initial applicable aux autoroutes de la mer a de réels impacts sur l'émergence de ce concept, qui évolue en s'adaptant aux nouvelles contraintes, en relevant de nombreux défis. Le bilan actuellement mitigé des autoroutes de la mer en Europe conduit à s'interroger sur les perspectives de leur pérennisation. Dès lors, notre réflexion est orientée vers deux aspects juridiques essentiels. D'une part l'impact réel de l'absence d'un régime juridique initial sur l'émergence des autoroutes de la mer et sur les mécanismes de financement qui l'accompagnent. D'autre part, la détermination d'un cadre juridique favorable au développement des autoroutes de la mer dans une perspective d'assurer leur meilleure intégration dans la chaîne logistique globale, et leur émergence comme véritable alternative durable, crédible et efficace à la route intégrale. / With the prospect to achieve the European single market, liberalization of various sectors in Europe including transport in the 1990s decade, leads to the development of different means of transport and the increase of road transport activities, certainly with real benefits such as economic development, competitiveness and employment; but also serious drawbacks : congestion of highways and increase in C02 emissions. Encouraging intermodality and promote the development of road alternatives, adjusting the balance between means of transport, is considered as one of European Union key priorities. Under the auspices of 2001 White Paper European transport policy, Motorways of the Sea concept were insufficiently informed, and currently, looking for his own way. Nevertheless they do present essential characteristics: both transport infrastructures and services, Shipping line services which are regular, frequent and of good quality , inbound to two or more sea ports to at least two states member of European Union. From the new European transport policy, they meet the requirements : road safety, sustainable development, safe environment, promoting growth in European Union internal market. However, the absence of an initial legal status applicable to the Motorways of the Sea has a real impact on the emergence of this concept, which evolves by adapting to new constraints, raising many challenges. The current mixed picture of Motorways of the Sea in Europe raises questions about the prospects for their sustainability. Our focus is directed towards two key legal aspects. On one hand the real impact of the absence of an initial legal status on the emergence of motorways of the sea and the funding mechanisms that accompany it. On the other hand, the determination of legal framework favourable to the development of Motorways of the sea which will contribute to a better integration into the global Supply Chain and emerge as truly sustainable alternative, credible and effective to the integral road transport.

L’objectif de ce travail consiste en la modélisation des flux de véhicules d’un grand et dense réseau de transport multimodal. Le travail s’organise en deux parties: un aspect théorique et un aspect développement. L’étude théorique met l’accent sur la façon dont un réseau multimodal peut être modélisé et comment sa performance en termes d’offre peut être optimisée. Pour ce faire, trois études principales sont réalisées: la prévision et la régulation des flux de trafic sur les grands réseaux de surface, la multimodalité véhiculaire dans les grands réseaux de surface prenant en compte les nouvelles formes de mobilité, et enfin l’impact de l’information sur le coût des itinéraires. La partie développement consiste en la conception d’un simulateur de flux de trafic pour réguler le trafic multimodal véhiculaire. Le simulateur développé devrait aider les opérateurs de transport et les collectivités territoriales dans leurs stratégies de gestion des flux de trafic / The objective of this work consists on the modeling of traffic flow of a large multimodaltransportation network. The work is organized in two parts: a theoretical study part anda development part. The theoretical study emphasizes on how a multimodal network canbe model and how its performance in terms of supply can be optimized. To do so, threemain studies are discussed: the traffic flow prediction and regulation on large surface net-works, the vehicular multimodality in big surface networks taking into account new forms ofmobility, and finally the impact of the information on the cost of the itineraries. The devel-opment part consists on the conception of a traffic flow simulator to regulate the vehicularmultimodal traffic. The developed simulator should assist transport operators and territorialcommunities in their traffic flow management strategies

The 4th Symposium on Management of Future Motorway and Urban Traffic Systems (MFTS) was held in Dresden, Germany, from November 30th to December 2nd, 2022. Organized by the Chair of Traffic Process Automation (VPA) at the “Friedrich List” Faculty of Transport and Traffic Sciences of the TU Dresden, the proceedings of this conference are published as volume 9 in the Chair’s publication series “Verkehrstelematik” and contain a large part of the presented conference extended abstracts. The focus of the MFTS conference 2022 was cooperative management of multimodal transport and reflected the vision of the professorship to be an internationally recognized group in ITS research and education with the goal of optimizing the operation of multimodal transport systems. 鹿特丹規則自1996年開始草擬,歷經大小數十次會議,迄2008年12月11日於聯合國第63屆大會第67次會議於紐約審議通過,該規則首次確立「海運加」(海運階段加上海運前後其他運送方式階段)之適用範圍,較諸傳統海上運送公約之適用範圍,變化甚鉅。「海運加」制度將鹿特丹規則之適用範圍擴大到傳統海上運送階段以外之其他領域,包括與海上運送連接之陸上運送,鐵路、公路、內陸河道運送甚至航空運送都包括在內。 因此,為因應鹿特丹規則適用範圍之延伸,鹿特丹規則創設了「海運履行輔助人」制度,意指「凡從貨物到達裝載港至貨物離開卸載港期間履行或承諾履行運送人義務之履行輔助人」。內陸運送人僅在履行或承諾履行其完全在港區範圍內之服務時方為海運履行輔助人。海運履行輔助人一方面承擔鹿特丹規則中運送人之義務及賠償責任,另一方面則同時享有運送人之抗辯及賠償責任限制。 我國雖然尚未加入鹿特丹規則,但該規則已明確規定,只要海上貨物運送契約之裝、卸載港或收、交貨地所在國已經批准、接受或核准公約,抑或該當事人適用或援引該公約,則將使其他任一當事人,不論其所在國是否批准、接受或核准該公約,同樣受到鹿特丹規則之約束。因此,我國海商法未來之修正方向,應深入了解並正確把握鹿特丹規則之原則及要領,以維持我國海運在國際市場上之競爭力。
