German text / Die vorliegende Arbeit schlägt eine Brücke über den Graben zwischen dem normativ-ethischen
Anspruch an die Lebenslänglichkeit einer Ehe und Gottes gnädigem Handeln gegenüber dem
scheiternden Menschen. Anhand des Umgangs der Kirchen und Glaubensgemeinschaften mit
Ehescheidung und Wiederheirat wird dieser Graben aufgezeigt. Es ergibt sich, dass die bestehende
Spannung jeweils durch die einseitige Betonung von Norm oder Gnade aufgelöst wird.
Die Grundlage für die Diskussion bilden das massgebende Eheverständnis sowie die Bestimmung
des Verhältnisses zwischen theologischer Ethik und dem Konzept der Gnade als Handlungsprinzip
Gottes. Darum werden in dieser Forschungsarbeit zuerst die theologiegeschichtlich
gewachsenen Eheverständnisse und die unterschiedlichen Normen- und Gnadenverständnisse
der römisch katholischen Kirche, der evangelischen Kirchen und der evangelikalen Gemeinschaften
in Bezug auf den Umgang mit Scheidung und Wiederheirat untersucht. Aufgrund
der herausgearbeiteten Übereinstimmungen und Unterschiede wird anschliessend anhand eines
von der Vergebung ausgehenden Denkansatzes der Graben zwischen normativer Ethik und dem
Konzept der Gnade überbrückt, die Spannung aber nicht aufgehoben. Daraus werden mögliche
Auswirkungen im Umgang mit Scheidung und Wiederheirat für die Kirchen und Gemeinschaften
abgeleitet. / The present thesis bridges the gap between the normative-ethical standard of lifelong marriage
on the one hand and God’s grace for men‘s failures on the other hand. Considering the practices
of churches and communities with regard to divorce and remarriage, this gap is demonstrated.
It is found that the associated tension is eliminated by an unilateral choice of either the
normative aspect or the principle of grace. The basis for the discussion is provided by the relevant
understanding of marriage and the determination of the relationship between theological
ethics and grace as the principle of God's action towards mankind. Therefore, this thesis investigates
the evolution of the theological understanding of marriage during history and the different
understandings of norms and grace in the Catholic Church, the Protestant Church and the
Evangelical Free Communities with regard to their handling of divorce and remarriage. Considering
the resulting similarities and differences, I propose – building on the fact of God’s forgiveness
– how to bridge the gap between normative ethics and the concept of grace without
eliminating the obvious tension. Finally, possible consequences for how to handle divorce and

Skolverket menar att populärkultur, däribland dataspel, är användbara verktyg för att nå elevernas livsvärldar i religionskunskapsundervisningen. Den här uppsatsen undersöker den religionsdidaktiska potentialen hos Mass Effect-spelen i gymnasieskolan utifrån följande frågeställningar: Får rätt och fel handling något utrymme i Mass Effect? På vilket sätt? Vad är rätt och fel i spelkontexten? Kan Mass Effect fungera som stödstruktur för att arbeta med stoff och förmågor som är en del av religionskunskapens etikundervisning och i sådana fall på vilket sätt? Spelkontexten utforskas genom en analys av hur spelens Paragon/Renegade-system bedömer olika handlingar. Systemet jämförs med plikt-, konsekvens- och dygdetiska förhållningssätt; dessa är etiska modeller som tas upp av styrdokumenten. En av spelens beslutssituationer granskas också utifrån en beslutsmodell och styrdokumentens etiska modeller bidrar här med teoretisk och kursplanemässig förankring. Undersökningen visar att flera av de områden som ska ingå i gymnasieskolans etikundervisning kan beröras genom att låta olika element i Mass Effect-spelen möta ämnets stoff. Processen verkar ur ett didaktiskt perspektiv både berikande för spelkontexten och illustrerar komplexiteten hos etiska modeller och fattandet av etiska beslut. Resultatet är i linje med varför styrdokumenten rekommenderar användandet av populärkultur och arbetssättet förespråkas även utifrån tidigare forskning. / According to the Swedish National Agency for Education, popular culture, in which computer games are included, is a useful tool for connecting with the students and their worlds when teaching the subject of religion. This essay explores the potential of the Mass Effect-games to serve as an instrument when teaching the subject of religion, aiming to answer the following questions: Does right and wrong play a part in Mass Effect? How? What is right and wrong in the context of the game? Can Mass Effect be used as a framework when teaching the ethical content of the religious subject and if so, how? The context of the games is explored through an analysis of how their reputation system, here called the Paragon/Renegade-system, judges different actions, and through a breakdown of one of the decisions in the games, using a model designed for analyzing ethical issues. This context is then compared with ethical models appearing in the syllabus for the subject of religion and the knowledge and abilities that the subject should offer the students opportunities to develop. The research shows that much of the core content of ethical studies can be addressed using the various elements of the Mass Effect-games. On the basis of other studies, this kind of work is also encouraged.

Ce travail a pour but de montrer quelles logiques de la finalité sont en jeu dans le travail du manager. Nous avons distingué deux façons d’aborder la finalité. La première, proche des notions d’objectif, d’intérêt, d’utilité, constitue le soubassement des façons d’aborder classiquement le travail du manager. Nous avons fait émerger, en nous appuyant sur la pensée d’Aristote, Thomas d’Aquin, et Spaemann, une conception alternative de la finalité, qui diffère de l’objectif et de l’intérêt en ce qu’elle n’est pas construite. Ce concept de finalité permet de voir autrement trois dimensions essentielles du travail du manager : le management par objectif, le faisceau d’exigences contradictoires dont le manager est le point focal, et le dilemme qui se pose à lui entre éthique et efficacité. Enfin, une enquête de terrain permet de montrer que cette logique alternative de la finalité, rattachée à l’éthique des vertus, trouve une certaine place dans le discours des managers de la FDJ, aux côtés du conséquentialisme, qui consacre l’acception utilitaire de la finalité, et du déontologisme qui évacue le recours à la finalité. / This thesis aim is to show which notion of purpose is at stake in the manager’s work. It differentiates two ways to address the concept of purpose. The first one, close to the notions of objective, interest, utility, forms the foundations of a classical vision of the manager’s work. However, a second one, based on Aristotle, Thomas Aquinas and Spaemann’s philosophies, arose. This alternative conception differs from objective and interest as it is not elaborated by the subject. It allows a different view on three essential dimensions of the manager’s work: the management by objectives, the body of contradictory requirements that built up on the manager and the dilemma between ethics and efficiency. Finally, a field survey showed that this alternative conception of purpose, linked to virtue-based ethics, has a certain place in the FDJ’s managers’ message, together with consequentialism, which expresses the utilitarian conception of purpose, and deontological ethics, which evacuates any purpose.

An investigation into whether the weekly national newspapers reported unethically on South Africa's 2014 general elections: a critical discourse analysis of the City Press, Sunday Times and The Mail and GuardianNaidoo, Viloshnee 11 1900 (has links)
Text in English / This thesis investigates whether or not the press reported unethically on South Africa’s 2014 General Elections in the weekly national newspapers the City Press, Sunday Times and the Mail & Guardian. This study was undertaken on the basis of the ongoing contention between the press and the state which has resulted in polarised positions between both institutions amid accusations of press bias. It has given voice to measures to regulate the press through a Media Appeals Tribunal (MAT) and proposed state regulation. This could negatively impact free speech, public interest and ultimately democracy. This researcher contends that this will not be in the best interest of South Africa. Through this study, it is argued that an ethical press that executes a libertarian duty to society, integrating a watchdog role over the state, while simultaneously overseeing its social responsibility to society, upholds the welfare of society and democracy and should therefore not be regulated by the state. The elections thus forms an important platform for the press to demonstrate unbiased ethical reportage to the state in the wake of being regulated and prove its fundamental role in society’s interest and democracy.
Therefore, to determine whether the election coverage was ethical or unethical, the problem investigated whether the press, that is, the print medium in the form of the newspaper, reported truthfully, in a balanced manner and independently for South Africa’s 2014 General Elections, upholding its watchdog and social responsibility roles. This was done through a Critical Discourse Analysis (CDA) of the front-page news reports of the aforementioned national newspapers for the cross sectional time-frame of 13 April to 11 May, 2014. This study argues that language is the most important channel of communication for the exchange of ideas and can be used as an instrument to calculatedly manipulate message and reinforce a particular viewpoint. Hence, it contends that CDA can effectively be utilised as a conceptual framework for language analysis to determine unethical press coverage by journalists.
The study identifies and applies two significant theoretical models that is, the Libertarian and Social Responsibility models for the elections which further serves as a form of triangulation to verify the results of the CDA. The study challenges the conventions of a distinct libertarian or a social responsibility model for the press, arguing that both models are not mutually exclusive for the elections. The analysis shows that the press apply both social responsibility and libertarian roles simultaneously in election reporting. It further maps out the incorporation of the developmental journalism model where the press upholds the best interests of both the electorate and the state ethically, without the requirement of a state-regulated media. / Communication Science / M.A. (Communication Science)

A critical analysis of exclusionary clauses in medical contractsLerm, Henry 25 May 2009 (has links)
This thesis examines the validity of exclusionary clauses in medical contracts, more especially, hospital contracts in which the healthcare provider exonerates itself against edictal liability arising from the negligent conduct of its staff, resulting in the patient suffering damages. In assessing whether these types of clauses should be outlawed by our courts, this thesis attempts to synthesize six major traditional areas of law, namely, the law of delict, the law of contract, medical law and ethics, international and foreign law, statutory law and constitutional law into a legal conceptual framework relating specifically to exclusionary clauses in medical contracts in South Africa. This thesis highlights systemic inconsistencies with regard to the central issue, namely, whether these types of clauses are valid or not, especially, given the fact that the practice of exclusionary clauses or waivers in hospital contracts has hitherto traditionally been assessed within the framework of the law of contract. The alignment of the various pre-existing areas of statutory and common law with the Constitution highlights that an inter-disciplinary and purposive approach under the value-driven Constitution, brings about a less fragmented picture in assessing the validity of these types of clauses. This approach accords with the new solicitude of the executive, the judiciary, the legislature and academia to transform the South African legal system not only in terms of procedural law but also substantive law. This has resulted in the alignment with constitutional principles and the underlying values to test the validity of these types of clauses, alternatively, contracts. Whereas pre-constitutionally the assessment of disclaimers in hospital contracts was done against the stratum of antiquated principles, namely, freedom of contract and the sanctity of contract, ignoring values such as reasonableness, fairness and conscionability, post-constitutionally, because the values that underlie the Bill of Rights and which affects all spheres of law, including the law of contract, concepts such as fairness, equity, reasonableness should weigh heavily with the decision-maker. In this regard, broader medico-legal considerations, normative medical ethics and the common law principles of good faith, fairness and reasonableness play a fundamental role in the assessment of contractual provisions, including the practice of disclaimers or exclusionary clauses in hospital contracts. This thesis critically examines how these types of clauses or contracts ought to be adjudicated eventually against the background of such alignment. It concludes that the entering into a hospital contract, in which the patient exonerates a hospital and its staff from liability flowing from the hospital or its staff's negligence causing damages to the patient, would be inconsistent with the Constitution and invalid. In the old order in which traditional divisions of law have been encouraged, a fragmented approach resulted in legal in congruencies which, in turn, created turbulence and a lot of uncertainty. This approach is apposite to that which the new constitutionally based legal system, aims to achieve. The rights in the Bill of Rights which are interconnected and which influences all spheres of law, including contract law, offers a fairer basis upon which, the validity of contracts, or contractual provisions, can be measured than, the pure contract approach. In this regard, although contracts or contractual provisions in the past may have been unfair and unreasonable, the courts, however, refused to strike them down purely on this basis. The law of contract, as a legal vehicle for adjudicating the validity of exclusionary clauses or waivers in hospital contracts, is therefore not ideal. This is primarily due to the antiquated approach the South African courts have always taken in this area of law. The law of delict, statutory law and medical law, standing alone, also does not provide a satisfactory answer. What is needed is an integrated approach in which the traditional areas of law are united and wherein constitutional principles and values, give much guidance and direction.
