Por meio da análise de conteúdo dos processos penais, julgados na cidade de São Paulo entre os anos de 1990 a 2002, mostrou-se como são produzidos tipos ideais de relações familiares e quais são os estereótipos e preconceitos acionados na construção das imagens das vítimas e dos acusados. De modo a dar inteligibilidade aos crimes, essas construções articulam representações simbólicas de relações de poder, afeto, responsabilidade, concebendo a família como palco de relações autoritárias e de complementaridade. O que se evidencia é a complexa relação entre o papel da Justiça Criminal em punir exemplarmente os filhos que cometeram os crimes e a tendência em absolver e relativizar o grau de culpabilidade dos acusados ao reconhecerem implicitamente e/ou estrategicamente que mais importante do que punir um filho suspeito de parricídio é levar em conta as reivindicações e o julgamento sobre o autor do crime feito pelos próprios parentes das vítimas e dos acusados / Abstract: This thesis focuses on the logic of judicial discourse in parricide cases. It deals with the socio-cultural elements, moral values and social roles attributed to parents and sons by lawyers, prosecutors and judges involved in this kind of criminal lawsuit. The work analyses parricide cases in the city of São Paulo (Brazil), between 1990 and 2002, revealing the construction of ideal familiar relationships and the stereotypes and prejudices employed to portray the victims and the accused. These images connect symbolic representations of power, affection and responsibility, producing a notion of family as a place characterized by authoritarian and complementary relationships. This research stresses the complex relation between the role played by the criminal justice, as the responsible for punishing exemplarily the sons, and the inclination to absolve or mitigate the sentences, admitting that more important than punishing the accused is to acknowledge the demands and judgments of the suspect relatives and of the suspect him/herself / Doutorado / Antropologia Social / Doutor em Ciências Sociais

Esta pesquisa visa a apresentar as construções discursivas sobre crimes de parricídio em reportagens das revistas semanais brasileiras Veja, IstoÉ e Época, num período compreendido entre os anos de 1970 e 2002, totalizando 10 matérias analisadas. A partir dos referenciais teóricos propostos pelas Ciências da Linguagem, Teorias da Enunciação e Análise do Discurso de orientação francesa, buscou-se depreender como as referidas reportagens viabilizam determinados efeitos de sentido, respaldadas por uma vontade de verdade, na terminologia de Michel Foucault. Intentou-se, ainda, verificar de que forma a instância enunciadora mobiliza estratégias para construir sua identidade, em vista do princípio constitutivamente heterogêneo do discurso. As análises efetuadas denotam que, a despeito de as matérias terem sido veiculadas em momentos diversos, ao longo de 32 anos, têm em comum o fato de identificarem a mencionada predisposição de verdade ao lugar do pai, enquanto metáfora das injunções de que emana a própria organização da sociedade. / This research aims to present the discursive constructions on crimes of parricide as they appeared in articles published by the Brazilians weekly magazines Veja, IstoÉ and Época, between 1970 e 2002. In all, 10 articles were analysed. Taking into account the theoretical background of the Sciences of Language, Enunciation and French Discourse Analysis, we attempted to infer how these articles undertake certain sense effects based on a will to truth, as referred by Michel Foucault. The analysis is also intended to examine the enunciative instances strategies in building its identity, in consideration of discourse heterogeneous characteristic. Despite of being published in different moments along 32 years, the articles are similar in basing that will to truth on the name of the father, as a metaphorical construction of the injunctions which organizes the society itself.

Le « Corps asiatique » De Yang Seog-il, Fils du Japon post-colonial : questions sur la subjectivité et le parricide dans la littérature zainichi contemporaine et intertexte avec la littérature maghrébine d’expression française / A son of post-colonial Japan, Yang Seog-il’s “Asiatic body” : questioning subjectivity and parricide tendancy in the contemporary Zainichi literature with an intertext of the French literature of North African immigrants

Cette thèse, située dans le contexte post-Colonial au Japon, s’articule autour d’un concept crée par Yang Seog-Il, écrivain contemporain zainichi : le « corps asiatique ». Après avoir circonscrit le champ d’analyse couvert par ce terme, notre étude formule la problématique suivante : par quels moyens ce « corps asiatique » s’affronte, dans la littérature de Yang -Dite zainichi-, au dépassement de l’ère coloniale et post-Coloniale au Japon ? Au cours de cette étude, nous recourrons à l’intertexte de la littérature maghrébine d’expression française (de Azouz Begag en particulier) lu comme dans un miroir. La première partie cartographie les contextes socio-Historiques de ces deux populations diasporiques, formées de décolonisés -Zainichi au Japon et Français issus de l’immigration maghrébine en France- apparues au siècle dernier, ainsi que le processus de formation des catégories littéraires associées à ces populations. Ensuite, nous entrons dans la profondeur du corpus, en abordant la manifestation de la subjectivité des (ex-) colonisés en tant que corps asiatique, à l’aide de l’épistémologie de Mikhaïl Bakhtine. La troisième partie enfin, est consacrée à une nouvelle lecture de ces œuvres, en établissant un lien entre le thème littéraire du parricide et le « corps asiatique ». Fils du Japon post-Colonial, Yang Seog-Il désire éliminer et dépasser un père tant filial que symbolique. Cependant, sa tentative de dépassement qui se veut passer par la féminisation de ce « corps asiatique » nous invite à effectuer une ultime lecture sous l’angle de la critique féministe post-Coloniale, pour en dévoiler les restes de rapports de domination. / In the context of post-Colonial Japan this dissertation attaches itself to explore the concept of a contemporary writer, a so-Called Zainichi: Yang Seog-Il’s “Asiatic body”. Having defined the field of interpretations covered by this term, our central question will be: in Yang Seog-Il’s literature how is the “Asiatic body” engaged in a process of overcoming this colonial and post-Colonial era? While reading Yang’s works, we shall use as an intertext and a mirror, some literary cases of contemporary francophone North African descendant writers (especially Azouz Begag’s texts). The first part shall map the socio-Historical context of these two diasporic populations (the Decolonized Zainichi in Japan and the Descendant from North African immigrants in France), that appeared in the last century, and in the same time, the birth of their so-Called post-Colonial literature. In the second part, we intend to make an in-Depth interpretation of our corpus, in taking up the manifestation of subjectivity of the (ex) colonized as the “Asiatic body”, using the Mikhaïl Bakhtine’s epistemology. The third part at last is devoted to a new reading of the literary works we are interested in: by establishing a link between the parricide as a literary theme and the “Asiatic body”, the wish of the son of post-Colonial Japan, Yang Seog-Il, to eliminate the father appears to renegotiate symbolical aspects that must be analysed. Hence, the feminization of the “Asiatic body” undertaken by Yang has to be read under the light of a feminist post-Colonial criticism that might uncover new themes of domination.

SOUS LE SPECTRE DU PÈRE: POÉTIQUE ET POLITIQUE DE LA DÉPENDANCE ET DU SEVRAGE DANS LE ROMAN POSTCOLONIAL AFRICAIN

This thesis analyzes the major theme of ‘postcolonial genealogy’ in portraying the African bending under the weight of colonial history in Le vieux nègre et la médaille, Une vie de boy of Ferdinand Oyono and Le Chercheur d’Afriques of Henri Lopes. Being a product of a colonial Genesis, the African character runs behind the colonizer’s mirror through his Civilizing Mission. René Girard’s ‘double bind’ theory explains how this cultural assimilation is, in Le vieux nègre et la médaille and Une vie de boy, a dead end because the colonizer needs a subordinate and not an equal. The cohabitation of a black housewife with the French Commander in Le Chercheur d’Afriques should be seen as simply an allegory of postcolonial Africa’s dependency on the West. The consequences of the feminization of the African continent are enormous in the post-colonial imaginary. While the colonizer had conquered Africa with his Herculean body, in Oyono’s novels, his Fall is obtained through the aesthetics of Bakhtinian ‘rabaissement’ which degrades his ‘grotesque body’ to that of the colonized. The colonizer and the colonized are neutralized and leveled in their perishable bodies, thus, making futile the Civilizing Mission that operated by ranking races. Power is never total. It is always imperfect, and can never destroy a subjectivity that resists it. In Oyono’s novels, the Fall of the colonial Father is also obtained through the inquisitive gaze that the colonized return back to the colonizer, and through their ‘subversive mimicry’ that parodies his codes. In Une vie de boy and Le Chercheur d’Afriques, the ‘son-Father’ relationship between the hero and the colonial Father, is also symbolic of the ‘Africa-West’ rapports. Living under the specter of the Father, the son has to negotiate his survival between weaning and parricide. The biological miscegenation in Le Chercheur d’Afriques is a metaphor of the ‘rhizome identity’ of the postcolonial African who renounces both the Fathers of Negritude and those of the Civilizing Mission. / Thesis (Ph.D, French) -- Queen's University, 2011-06-24 12:43:30.006
