O Programa foi investigado do ponto de vista dos gestores e professores do Centro Universitário do Leste de Minas Gerais (UNILESTE-MG), instituição privada localizada na cidade de Coronel Fabriciano, na Região Metropolitana do Vale do Aço. A política afirmativa, expressa em textos legais, e a luta do Movimento Negro pela conquista do acesso ao ensino superior, principalmente a partir dos anos 90, são os principais referenciais legais, políticos e históricos desta pesquisa. Os anos 90, marcados pelo processo de privatização, com destaque para o setor educacional, marcaram também o início do debate acerca da necessidade de reformas no ensino superior. O ProUni surge neste contexto, buscando atender as demandas de acesso à universidade. This program was investigated by managers and teachers of the Centro Universitário do Leste de Minas Gerais ( UNILESTE-MG ) private institution situated in the city of Coronel Fabriciano in Vale do Aço. The affirmative politic expressed in legal texts, is a struggle of the black movement to get acess to college, mainly from 90th. These are the mainly legal references politc and historic of this survey. O texto gira no eixo que intenta também debater sobre como a categoria negro foi colocada dentro do discurso da política de cotas através de autores acadêmicos. Esse debate traz a discussão sobre a crença na democracia racial como símbolo da identidade nacional, ao mesmo tempo em que deixa nas margens a discussão sobre a representatividade do espaço do negro. A questão é consideravelmente complexa, sendo que, os estigmas estão sempre reiterando. Parto para a análise de documentos marcantes para o discurso, bem como analiso a realidade dos efeitos dessas discussões a alunos e professores dentro da Universidade. / The present research revisits the debate about the affirmative action politics of race in Brazil from its initial debates, and goes through its implementation until present discussions about this issue. The text also aims at debating how the category “black” was placed within the discourse of the quotas policy by academic authors. This debate brings the discussion about the belief on racial democracy as a symbol of national identity, a situation which, at the same time, leaves the discussion about black people representativity on the margins. The issue is considerably complex, and the stigmas are always being reiterated. The research is grounded on both the analysis of documents that are relevant to the discourse, as well as the reality of the effects of these discussions on students and teachers within the university.

The affirmative action in the educational area with a view to promoting equity and social inclusion of disadvantaged and discriminated populations are endorsed by this initiative. On the assumption that the dynamics of the relationships experienced in the University context, if marked by prejudices and discrimination, can influence the education of indigenous students and the effectiveness of the affirmative policies, this study was developed in order to understand the dynamics of in(ex)clusion perceived by indigenous students from the Federal University of Tocantins (UFT). The research occurred in two steps: the investigative documentary research and the fieldwork. The technique used for the evaluation of the interviews was the analysis of the contents, from which came the six thematic categories which constitute the dynamics of the in(ex)clusion. They are: 1) aspects of the indigenous identity; 2) walking in both worlds; 3) dynamics of relationships at the University; 4) the importance of attending College; 5) the causes of dropouts; and 6) militant profile and the expectation of professional performance. The dynamics of in(ex)inclusion perceived by indigenous students is inextricably linked to the particular cosmology of each indigenous people, resulting from experiences before the admission of these subjects at the University. Furthermore, such dynamics is marked by prejudices, discrimination and hostility from non-indigenous, which constitute elements more of exclusion than of inclusion. We were also able to see, based on reports from indigenous students and on other studies, that the quotas policies for admissions in IESP alone do not guarantee the professional training of indigenous students and their inclusion. The contribution of this study stays in the theoretical and empirical field, in the expansion of knowledge about management of inclusion and diversity, specifically in public policies of affirmative actions towards a College education for the indigenous students, because there are a limited number of systematized and published information about selection, admission, permanence and education of indigenous students. / A política educacional brasileira tem se pautado no pressuposto de que a escola é o principal mecanismo para o desenvolvimento de uma sociedade democrática e igualitária. As ações afirmativas na área educacional com vistas a promover a equidade e a inclusão social das populações mais desfavorecidas e discriminadas encontram respaldo nesta iniciativa. Partindo do pressuposto de que a dinâmica das relações vivenciadas no contexto universitário, se marcadas por preconceitos e discriminação, pode influenciar a formação dos estudantes indígenas e a efetividade das políticas afirmativas é que se desenvolveu este estudo, com o objetivo de compreender a dinâmica de in(ex)clusão percebida pelos estudantes indígenas da Universidade Federal do Tocantins (UFT). A realização da pesquisa ocorreu em duas etapas investigativas: a pesquisa documental e a de campo. A técnica utilizada para a análise das entrevistas foi a de conteúdo, a partir da qual se chegou a seis categorias temáticas, que vêm a formar os elementos constitutivos da dinâmica de in(ex)clusão: 1) Aspectos da Identidade do Indígena; 2) O Caminhar em Dois Mundos; 3) Dinâmica das Relações na Universidade; 4) Significado em Cursar o Ensino Superior; 5) As Causas de Evasão; e, 6) Perfil Militante e Perspectivas de Atuação Profissional. A dinâmica de in(ex)clusão percebida pelos estudantes indígenas apresenta-se indissociável à cosmologia particular de cada um dos povos indígenas, fruto de vivências anteriores à entrada destes sujeitos na universidade. Ademais, tal dinâmica é marcada por preconceitos, discriminação e hostilidade por parte dos não-indígenas, sendo constituída muito mais por elementos de exclusão do que de inclusão. Pudemos constatar também, com base nos relatos dos estudantes indígenas e em outros estudos, que a política de cotas voltadas para o ingresso em IESP por si só não garantem a formação profissional dos estudantes indígenas e sua inclusão. A contribuição deste estudo se dá no campo teórico e empírico, na ampliação do conhecimento sobre gestão inclusiva e da diversidade, especificamente em políticas públicas de ação afirmativa voltadas para a formação superior de estudantes indígenas, vez que há um número restrito de informações sistematizadas e publicadas que tratem sobre a seleção, o ingresso, a permanência e a formação de estudantes indígenas.

Based on the constitutional dictates and on the international order, the present study aims to analyze the accessibility of people with disabilities in the labor market, focusing on public policies designed to enforce the right to work in such a minority group. In this purpose, a critical examination will be made around the concept of disability, where will be investigated the merits, the inconsistencies and the symbolic significance of the legislation regulating this matter. In this regard, it will be emphasized the need for thoroughly knowledge about the disabilities and their functionality, in order to achieve a fair and equitable distribution of benefits. In order further to promote effective social inclusion of the disabled, a brief reflection about the Critical and Constitutional Hermeneutics will be made, emphasizing the need for release of the individuals from tradition, exacerbated dogmatism, as well as from the prejudices that prevent the realization and enjoyment of fundamental rights equally, identifying their actual recipients. In this opportunity, where new methods of interpretation will be addressed, given the inadequacy of traditional legal hermeneutics to solve the new demands of modern society (net, multifaceted, technology, etc.). Finally, it will highlight the role of the judiciary, the role of the prosecutor as well as the Public Defender in favour of disabled people´s interests, especially concerning the labor issue. / Lastreado nos ditames constitucionais e da ordem internacional, o presente estudo se propõe a analisar a acessibilidade das pessoas com deficiência ao mercado de trabalho, com enfoque nas políticas públicas desenvolvidas para efetivar o direito ao labor de tal grupo minoritário. Em consonância com esse objetivo, será feito um exame crítico em torno do conceito de deficiência, no qual serão averiguados os méritos, as incongruências e a carga simbólica da legislação que disciplina a matéria. Nesse sentido, será ressaltada a necessidade do conhecimento criterioso acerca das deficiências e de suas funcionalidades, para uma justa e equânime distribuição de benefícios que possa ter gênese e guarida. Com o intuito, ainda, de promover a efetiva inclusão social dos deficientes, será feita uma breve reflexão acerca da Hermenêutica crítica e constitucional, ressaltando a necessidade da libertação do indivíduo da tradição, do dogmatismo exacerbado, bem como, dos preconceitos que impedem a concretização e a fruição dos direitos fundamentais de forma igualitária, com identificação de seus reais destinatários.
