Magister Legum - LLM (Mercantile and Labour Law) / Traditional Knowledge (TK) has previously been considered a 'subject' in the public domain,
unworthy of legal protection. However, the last few decades have witnessed increased
discussions on the need to protect the knowledge of indigenous peoples for their economic
sustenance, the conservation of biodiversity and modern scientific innovation. Questions
remain as to how TK can best be protected through existing, adapted or sui generis legal
frameworks.
Based on an examination of the formal knowledge-protection mechanisms (i.e. the existing
intellectual property system), this mini-thesis contends that these existing systems are
inadequate for protecting TK. As a matter of fact, they serve as veritable platforms for
incidences of biopiracy. It further argues that the many international initiatives designed to
protect TK have so far failed owing to inherent shortcomings embedded in them.
Furthermore, a comparative assessment of several national initiatives (in New Zealand, South
Africa and Kenya) supports an understanding that several domestic efforts to protect TK have
been rendered ineffective due to the insurmountable challenge of dealing with the
international violations of local TK rights. It is therefore important that on-going international
negotiations for the protection of TK, including the negotiations within the World Intellectual
Property Organisation's Intergovernmental Committee on Intellectual Property and Genetic
Resources, Traditional Knowledge and Folklore (IGC), do not adopt similar approaches to
those employed in previous initiatives if TK must be efficiently and effectively protected.
This mini-thesis concludes that indigenous peoples possess peculiar protection mechanisms
for their TK within the ambit of their customary legal systems and that these indigenous
mechanisms are the required anchors for effective global protections.

A regulação das patentes farmacêuticas no Brasil: entre saúde pública, política e direito / The regulation of pharmaceutical patents in Brazil: between public health, politics and lawEduardo Ribas De Biase Guimarães 26 April 2013 (has links)
O objetivo geral da tese é aprofundar a reflexão sobre a regulação e o exame de qualidade de patentes farmacêuticas no Brasil, em um contexto de implantação de dispositivos legais conhecidos como TRIPS-Plus ao redor do mundo. Para isso, são discutidos os mecanismos jurídicos e políticos de proteção à saúde relacionados à propriedade intelectual. Analisam-se especificamente do ponto de vista sociológico as experiências de anuência prévia para pedidos de patentes envolvendo produtos e processos farmacêuticos da Agência Nacional
de Vigilância Sanitária (Anvisa) e o uso do subsídio ao exame técnico. Em termos metodológicos, consideram-se as ações do Governo brasileiro entre 1996 a 2012, propostas de mudança da Lei de Propriedade Industrial brasileira e controvérsias ligadas a algumas modalidades de reivindicação, como polimorfos, patentes de seleção e segundo uso médico. As técnicas de pesquisa utilizadas também incluem o levantamento de material de imprensa, textos de leis, documentos e decretos relativos a medicamentos e propriedade intelectual, assim como de pedidos de patentes e de decisões judiciais concernindo à temática. Optou-se ainda por realizar entrevistas com gestores, examinadores de patentes, juristas e membros de ONGs. As conclusões indicam que as práticas regulatórias ligadas ao setor saúde não podem ser reduzidas ao simples corpo de regras formais presentes neste domínio, mas sim entendidas como agenciamentos entre atores, tipos distintos de saberes e de ferramentas de intervenção. A regulação dos direitos de propriedade intelectual relativos a produtos e processos
farmacêuticos no Brasil está ligada a um processo, onde se verifica a disputa em torno de diferentes projetos e visões de mundo de grupos com maior ou menor poder para direcionar
este processo. Os dispositivos da anuência prévia e do subsídio ao exame técnico apresentam-se como elementos reguladores da propriedade intelectual de medicamentos e de impacto
sobre exame de qualidade de patentes farmacêuticas, contribuindo para a consideração de questões de saúde pública ao longo da concessão destas patentes. / The general aim of the thesis is to improve the reflection on the regulation and the quality of examination of pharmaceutical patents in Brazil, in the context of implementation of legal
provisions known as TRIPS-Plus around the world. For this, we discuss the legal and political mechanisms to protect health related to intellectual property rights. It examines specifically
from a sociological point of view the experiences of the prior consent for patent applications involving pharmaceutical products and processes of the National Health Surveillance Agency (ANVISA) and the use of the patent opposition mechanism (subsídio ao exame técnico). In terms of methodology, it considers the actions of the Brazilian Government from 1996 to 2012, the proposals to change the Brazilian Industrial Property Law and the controversies linked to some types of patent claims, such as polymorphs, selection patents and second medical use. The research techniques also include the analysis of press materials, texts of laws, decrees and documents related to medicines and intellectual property, as well as patent applications and judgments. Interviews with managers, patent examiners, lawyers and members of NGOs were also conducted. The conclusions indicate that the regulatory practices related to the health sector can not be reduced to a simple body of formal rules present in this area, but rather understood as assemblages between actors, different types of knowledge and intervention tools. The regulation of intellectual property rights related to pharmaceutical products and processes in Brazil is linked to a process in which there is a dispute around the different projects and worldviews of groups with more or less power to drive this process. The devices of the prior consent and the patent opposition appear as regulatory elements of the intellectual property rights of drugs and of impact on the quality of examination of pharmaceutical patents, contributing to the consideration of public health concerns along the granting of these patents.

Neste trabalho, apresentamos uma extensão da análise bayesiana objetiva feita em Fonseca et al. (2008), baseada nas distribuições a priori de Jeffreys para o modelo de regressão linear com erros t-Student, para os quais consideramos a suposição de heteoscedasticidade. Mostramos que a distribuição a posteriori dos parâmetros do modelo regressão gerada pela distribuição a priori é própria. Através de um estudo de simulação, avaliamos as propriedades frequentistas dos estimadores bayesianos e comparamos os resultados com outras distribuições a priori encontradas na literatura. Além disso, uma análise de diagnóstico baseada na medida de divergência Kullback-Leiber é desenvolvida com a finalidade de estudar a robustez das estimativas na presença de observações atípicas. Finalmente, um conjunto de dados reais é utilizado para o ajuste do modelo proposto. / In this work , we present an extension of the objective bayesian analysis made in Fonseca et al. (2008), based on Jeffreys priors for linear regression models with Student t errors, for which we consider the heteroscedasticity assumption. We show that the posterior distribution generated by the proposed Jeffreys prior, is proper. Through simulation study , we analyzed the frequentist properties of the bayesian estimators obtained. Then we tested the robustness of the model through disturbances in the response variable by comparing its performance with those obtained under another prior distributions proposed in the literature. Finally, a real data set is used to analyze the performance of the proposed model . We detected possible in uential points through the Kullback -Leibler divergence measure, and used the selection model criterias EAIC, EBIC, DIC and LPML in order to compare the models.

Mapeamento da suscetibilidade a eventos perigosos de natureza geológica e hidrológica em São Carlos - SP / Susceptibility mapping of geological and hydrological dangerous events in São Carlos - SPCahio Guimarães Seabra Eiras 07 July 2017 (has links)
Com a urbanização crescente no Brasil, o mapeamento de eventos perigosos mostra-se cada vez mais necessário para que se reduzam transtornos socioeconômicos nos municípios brasileiros. O objetivo principal da pesquisa foi elaborar mapas de suscetibilidade a eventos perigosos de natureza geológica e hidrológica, para a área urbana e de expansão urbana (148,97 km²) do município de São Carlos – SP. A análise foi feita em ambiente de SIG (Sistemas de Informação Geográfica), e combinou abordagens qualitativas e quantitativas de mapeamento de eventos perigosos, propostas pelo Working Group Committee on Risk Assessment (1997). Como método, analisou-se a freqüência dos eventos históricos em função da área (km²) dos condicionantes cartografados nos mapas temáticos (probabilidades iniciais). Os condicionantes foram analisados isoladamente e combinados, na forma de classes de terreno. O inventário dos registros históricos (482 registros) dos eventos foi feito com os dados de jornais, defesa civil e imagens de satélite entre os anos de 1965 a 2016. Foram elaborados os mapas de suscetibilidade para: movimentos de encosta, erosão pluvial, solos colapsíveis e enchentes/inundações. O método utilizado mostrou-se eficiente, visto que os objetivos da pesquisa foram alcançados. Foi possível validar os mapas de suscetibilidade, com as características do meio físico observadas em trabalhos de campo e dados de ensaios geotécnicos. Os eventos mais críticos para o município são as enchentes/inundações e alagamentos, erosões pluviais e movimentos de encostas causam pequenos transtornos, principalmente em consequência do relevo suave da região. Apesar da base cartográfica estar na escala 1:10.000, os mapas são apresentados na escala 1:20.000, com o objetivo destes serem impressos em papéis no formato A1. / With the increasing urbanization in Brazil, hazardous events mapping has become increasingly necessary to reduce socioeconomic disorders in Brazilian citys. The main goal of the research was to elaborate susceptibility maps to dangerous events of geological and hydrological nature, for the urban area and urban expansion (148,97 km²) to the city of São Carlos - SP. The analysis was done in a GIS environment (Geographic Information Systems), and combined qualitative and quantitative approaches of hazardous events mapping, proposed by the Working Group Committee on Risk Assessment (1997). The frequency of historical events was analyzed according to the area of the conditioners mapped on the thematic maps (prior probabilitys). The conditioners were analyzed separately and then combined, in the form of land classes. The inventory of historical records (482 records) of events was done with acquired data from newspapers, civil defense and satellite images between the years 1965 to 2016. Susceptibility maps were developed for slope movements, water erosion, collapsible soils and floods. This method proved to be efficient, since the research objectives were achieved. It was possible to validate the susceptibility maps, with the characteristics of the physical environment observed in field work and geotechnical data. The most critical events in São Carlos are floods, rainfall erosions and slope movements cause minor damage, as a result of the region\'s soft relief. Although the cartographic base is in the 1:10.000 scale, the maps are presented in the 1:20.000 scale, with the purpose of being printed on A1 format paper.

This article describes and analyzes the national standard established for the prior consultation proceedings in mining and its relationship with environmental law. These procedures have been created in order to comply with the liability contracted by the Peruvian State in 1995, after the ratification of ILO Convention 169. The article reviews the main elements of Peruvian prior consulting process, including key aspects such as the identification of indigenous peoples, as well as defining the moment at which consulting should be made in the mining area. Finally, the author stresses the no consultations in mining projects at the time and the implications of that fact. / El presente artículo busca describir y analizar el estándar nacional establecido para el desarrollo de procesos de consulta previa en el ámbito de la minería y su relación con la legislación ambiental. Estos procedimientos han sido establecidos con el objeto de cumplir con la obligación que el Estado Peruano asumió en el año 1995, tras la ratificación del Convenio 169 de la OIT. Se pasa revista a los principales componentes del proceso de consulta peruano, incluyendo aspectos cruciales como la identificación de los pueblos indígenas, de las medidas de consultar así como la definición del momento en el cual realizar la consulta en el ámbito minero. Finalmente se destaca la no realización de consultas en los proyectos mineros hasta la fecha y las implicancias de dicho hecho.

El presente artículo explora la disputa vigente sobre el principio queindica que se requiere el consentimiento libre, previo e informado(CLPI) de un pueblo indígena para autorizar la extracción industrialen su territorio. A partir de los aportes de la obra de Tsing acerca delas conexiones globales, el trabajo analiza cómo es que los actoresinterconectados en redes se empeñan en llevar adelante ampliosproyectos de colaboración (como el reconocimiento de los derechosindígenas) empleando estrategias de persuasión. Se discutenlos esfuerzos realizados por el movimiento indígena transnacionalpara promover el concepto del CLPI, así como tres ejemplos en losque diferentes actores buscan apropiarse y recaracterizar el CLPIpara que calce en sus propias metas.En este trabajo propongo examinar cómo los proyectos gubernamentalesglobales rivales son promovidos y disputados por las redesdescentralizadas que unen a actores que operan a diferentes escalas.Sostengo que la noción de Tsing de «paquetes itinerantes» ofreceuna manera útil de conceptualizar los medios por los cuales loselementos de estos proyectos son difundidos, traducidos, acogidosy adaptados en diferentes localidades alrededor del mundo. Analizoestas dinámicas en relación con el cuestionamiento al modelo degobernanza basado en el principio de que se necesita el consentimientolibre, previo e informado (CLPI) de un pueblo indígenapara autorizar acciones que puedan impactar sobre un territorio o derechos indígenas. A través de la promoción de diferentes versionesde CLPI, los actores interconectados en red están disputandola naturaleza y la forma de la responsabilidad social empresarial,la autoridad del Estado y la relevancia de la gobernanza indígena.Propongo explorar las implicaciones de las diferentes estrategias deempaquetamiento para la disputa entre modelos rivales de gobernanzay para su propensión a ser acogidos en los sitios locales. / In this paper, I propose to examine how rival global governmentalprojects are asserted and contested by decentralized networks thatlink actors operating at different scales. I argue that Tsing’s notionof «travelling packages» provides a useful way of conceptualizingthe means by which elements of these projects are diffused, translated,taken up, and adapted into different localities around theworld. I explore these dynamics in relation to the contestation of agovernance model based on the principle that the free, prior andinformed consent (FPIC) of an indigenous people is required toauthorize actions that may affect upon indigenous territory or indigenousrights. Through the assertion of different versions of FPIC,networked actors are contesting the nature and shape of corporatesocial responsibility, the authority of the state, and the significanceof indigenous governance. I propose to explore the implicationsof different packaging strategies on the contestation between rivalgovernance models and on their propensity for uptake in local sites.

Identity and Professional Trajectories of Eastern European Immigrant Women in the United StatesJanuary 2014 (has links)
abstract: The immigration process changes personal narratives and professional trajectories and challenges identities and individual beliefs. Yet there is currently limited research on European women immigrants' transitions in the United States. This study examines personal and professional trajectories, in the United States, of Eastern European immigrant (EEI) women with prior educational attainment in their country of origin. This study examines the following issues: personal/social learning, developmental and professional experiences prior to and post migration, and social lives after the women's arrival in the United States. The study discusses the results of in-depth interviews with eight EEI women living in Arizona and California and recounts these women's life stories, gathered through open-ended questions that focused on areas of their personal and professional lives, such as childhood, marriage, immigration, education, family relations, socio-economic status, employment, child- rearing, and other significant life events. These areas impacted the women's creation of personal beliefs and their ability to develop new identities in the United States.
