A Feasibility Study of Benchmarking for Performance Audit of Construction ProcurementChang, Li-Tsung 20 June 2006 (has links)
In recently years, government procurement for public construction has accounted for approximately 400 billion New Taiwan Dollars per year. However, many problems have arisen after the first year of the new Government Procurement Law. Evaluation systems for the auditing of construction performance are inadequate, poorly controlled, and are needed for further research. Benchmarking and ¡§balanced-scorecard¡¨ are evaluated for construction performance measurement at present. and, the benchmarking method in this research, is based on its economy, efficiency and effectiveness. A road construction project is used as an example for performance auditing. Some conclusions are listed in the summary.
This research program attempts to analyze the reasons of failure by historical documentary analysis using the questionnaire method & statistical analysis using the quantitative approach. The steps taken generally include a historical system analysis, the gathering of government documentation, and the comparion of the Budget Examination System of other countries. By employing an integrated research design, this research also analyzes the key factors influencing the malfunction and the implementation of the example road construction project.
Finally, it is hoped that the results of this research could contribute to the government¡¦s budget examination, performance auditing and the actual budget system, and could also provide the decision- makers with some political inspiration.

As organizações do setor público são normalmente associadas a processos lentos, burocráticos e que geram resultados insuficientes. Em função disso, têm crescido as exigências relativas ao desempenho dos órgãos do setor público. A aplicação dos conceitos Lean é uma alternativa para reduzir as perdas do setor púbico e aumentar a eficiência no uso dos recursos. Nesse contexto, este estudo tem como objetivo analisar e propor melhorias no processo de contratação de obras de uma universidade pública, com foco na eliminação das perdas, através da utilização do Mapeamento do Fluxo de Valor (MFV), bem como identificar barreiras para a aplicação do MFV e das melhorias identificadas por meio dessa ferramenta. A estratégia de pesquisa adotada foi o estudo de caso aplicado ao processo de contratação de uma obra na Universidade Federal de Mato Grosso (UFMT). Com base no MFV, foram propostas melhorias no processo, sinalizando para uma possível redução do lead time de 1.242 dias para 380 dias. Através da aplicação do MFV, também foi possível identificar barreiras para implantação dos princípios lean, como a falta de padronização dos procedimentos, falta de visão sistêmica do fluxo do processo por parte dos gestores, deficiência na capacitação dos servidores, falta de foco no cliente final e dificuldades de adaptar conceitos a práticas. Pelos resultados obtidos, é possível afirmar que os procedimentos administrativos, no contexto de obras em uma universidade pública, podem ser melhorados com a aplicação do MFV. / Public organizations are usually associated to slow bureaucratic processes with little result. Therefore, there is a growing demand for higher performances in the public sector. Using lean concepts is an alternative to reduce the losses in the public sector and enhance the efficiency of recourse use. The research herein presented is aimed at analyzing and proposing improvements in the bidding process for construction works within a public university, focusing on loss elimination, through the use of Value Stream Mapping (VSM). Besides, we intend to identify obstacles to using VSM and the benefits that come from the use of such tool. We have done a case study about the bidding process for construction works within the Federal University of Mato Grosso (UFMT). Based on VSM, we suggested improvements to the process through a possible reduction of the lead time from 1242 days to 380 days. By using VSM, it was also possible to identify obstacles to the lean principles, such as the lack of procedural standardization, the fact that managers do not have a systemic view of the process stream, employees’ need for training, lack of focus on the end client and difficulties to adapt concepts into practices. From the results, we can affirm that administrative procedures in a public university can be improved by using VSM.

Abstract
Promotion of private participation is catalogized as concession model of construction means. The process is the authority to select the private sector that has the best professional knowledge and capability and to transfer the properties to the selected private sector and confer the private sector the concessionary. The private sector then is responsible to finance, construction, operation during the concessionary period. The revenue of the operation and the ancillary business that concessioned by the government will cover the cost of operations and construction. After the concession period, the rights and operations will be transferred to authority.
The spirit of private participation is in the process of the private participation. The involvement of private sector injects the flexibility and energy that the government lack of. The private sector also shares the cost of construction that is some financial burden of the government.
For this kind of approach, the private sector needs more flexibility and own operations freedom and shares most of the risks. As for the supervision of the government, in general, the less the better. Because the private sector makes its own construction and operations strategies and sales management.
In other words, the private sector shall has the independence. The interference of the government shall be limited to minimum, even for the public interest, to prevent the incompatibility of the two sectors and the negative effect of the promotion of the public construction..
However, the supervision logic is excluding the cases that the government financing most of the cost and the interest of the public. This paper argues that the public construction with private participation approach shall be case dependent, from the administration point of view.
For the high public interest and high financing project, The government based on his authority and responsibility shall be supervised intensively to ensure the quality and safety of the public construction.
One of the issues that the paper raised is the supervision role of the authority. This paper argues how the authority to be a good supervisor. How the authority does his responsibility and accomplish his mission and take appropriate measures to ensure the good quality of the public service continuously.
For research methodology, the reference analysis is adopted. The theory and system of private participation are discussed. As for case study, reference and interview are adopted. The supervision and management of private participation of Kaohsiung mass rapid transit by government is analysed to bridge the theory and practice. The characteristics of this project is low self-financing rate. The government financing the rest part of the cost, which is about 80%of the cost. In this project the government also guarantees the forced buy out price, which states clearly in the tri-party contract. This make the financial risk is all on government. The way of taking risk is more likely the OT approach. From the interview, the implementation of the project reveals that anti-supervision game, multi-supervision and management system. Also the different sectors has different understanding of the project.
The legal position of the supervision role of the authority is the legitimate to supervise and take appropriate actions. The public sector acts according to laws and safeguards the public interest. The authority has the righteous to supervise, the legal stance. Another role of the authority is also the party of the contract to protect his interest in his investment, which is stemming from the contract, the legal rights from the private sector.
During the construction and operations period, the authority shall review and supervised. The legal measures for authority includes the supervision of operations, the restrictions of concessionary, the dispositions of the assets of the construction and operations, The review of the operations fare and changes. The rights stemming from contracts includes setting the standards of the operations facility, the review of the design drawings and schedules and construction quality and subcontracting, the public tendering of parts of the governments financing. For the combinations of both supervision measures includes financial supervision and the acceptance of important contract subcontracting.
If the delay of schedule, serious construction quality, serious operations problems, and breach of contract happens, the authority, for the public interest, shall coerce request the private sector to amend in due time, stop all or part of construction and operations abolish the permissions of construction and operations or coerce takeover operations or buyout to ensure the project. As for the rights stemming from contract includes risks sharing, the conditions that the intervention of the financing institutions, suspending all or part of the construction or operations, cease of contract, insurance and bond, mechanism of loyalty and fund.
In this study, the legitimate of the supervision role of the authority is discussed and aims to have a robust structure of private participation of public construction system to achieve the goal of promoting public service standard and accelerating development of social economy when promoting privatization of public construction.

Les travaux de géolocalisation et d’étude des ouvrages urbains font intervenirdes opérateurs de lever qui doivent manipuler des instruments de topographie, descartographies et des notions métiers complexes. Les erreurs de géolocalisation et deconception d’ouvrages sont fréquentes lorsque les méthodologies de travail ne sont pasrespectées. Ces travaux de thèse CIFRE, réalisés au sein de la société SIG-IMAGE,identifient dans un premier temps les sources d’erreurs lors des phases d’étude puisproposent un processus de lever topographique optimisé, pour réduire ces erreurs. Ilsmettent en évidence l’intérêt de la Réalité Augmentée pour diminuer les erreurs d’édition etd’interprétation de cartographie d’ouvrages. Un prototype est proposé, évalué et critiqué. Ilcouple un dispositif tactile de RA monoculaire géoréférencé avec un laser de topographie. Ilpermet de dessiner et de consulter des plans techniques sur une représentation 2D tempsréel du chantier. Les expérimentations démontrent que ce couplage n’est valide, au regardde la réglementation française, que pour la consultation de données SIG, ainsi que demodèles CAO dans un environnement très proche. Une autre approche est proposée, elleconsiste à recaler les nuages de points denses issus de scanners de topographie, avec lareprésentation orthoscopique 2D temps réel du chantier. Une synthèse des techniques derecalage image-nuage de points est proposée, et nos travaux s’orientent vers l’exploitationdu recalage 2D-2D. Les interactions dans l’environnement augmenté du chantier dépendentalors de son nuage de points. Elles sont géolocalisées et suivent les paradigmes du Picking-Outlining-Annotating. / In the public construction field, surveyors have to manipulate sophisticatedinstruments and maps to design CAD and GIS sketches describing geolocated facilities tobuild on worksite. Geolocation and design inaccuracies happen during these steps and leadto false technical maps. This Ph.D. thesis explains our research works made on behalf ofSIG-IMAGE Company. We first identify origins of inaccuracies during survey, then wepropose a new and optimized survey method that improves CAD and GIS accuracy on field.We explain to what extend Augmented Reality is able to improve technical mapsinterpretation and edition. We present, evaluate and criticize a prototype that couples atangible AR environment with a laser range finder. It allows one to draw technical sketcheson a 2D tangible real time view of worksites. Experiments have proven that it does not satisfyFrench regulation in terms of accuracy when editing maps. However it is accurate enough todisplay and edit GIS information, as well as CAD maps in a very close area. We then exploreanother approach consisting of matching the scanner’s dense point cloud with the real time2D view of the worksite. We propose a synthesis of alignment practices between point cloudsand images of a same scene. Finally we have chosen to explore 2D-2D registration so thatinteractions in our AR system would be based on the point cloud pre-processed discreterepresentation of the worksite. These interactions will be geolocated and will follow thePicking-Outlining-Annotating paradigm.

This master thesis deals with the determination of the variant prices for the public construction contract. The thesis is divided into the theoretical and practical part. The theoretical part analyses prices, construction contracts and budgets in general. Public construction contract for the residential building in Štěpánov was selected for this thesis. In the practical part the construction contract and the supplier company are briefly described. The price of the construction contract is analysed in the price analysis, where the budgets of the contracting authority and the selected supplier are compared. Based on this analysis, alternatives of material usage are suggested. At the end of the thesis the overall economic evaluation is carried out and the variant price of the contract is determined.

工程採購爭議仲裁程序公正性之研究 / On the fairness of arbitration in process of public construction陳良勇 Unknown Date (has links)
政府採購法下之工程採購較他類採購規模大,契約金額高,且因履約期長,履約之不可預期性增加,常造成履約過程中,對於契約無法明確釐清之事項及責任,在機關為維護公共利益,而廠商為爭取合理利潤,雙方立場不一致情形下,無法有效解決問題,遂產生履約爭議,而須透過履約爭議處理制度來解決雙方之紛爭。而仲裁係履約爭議處理的一種快速有效解決爭議之方式,由雙方當事人各自推舉仲裁人,再共推一名主任仲裁人組成仲裁庭解決雙方之紛爭。然現行情況機關多抗拒仲裁,不信任仲裁,質疑仲裁程序之公正性,進而提出撤銷仲裁判斷之訴訟,但幾乎皆遭法院駁回,機關最終必須接受仲裁判斷結果。本研究針對公共工程採購仲裁爭議案件,以深度訪談實際參與仲裁庭審理過程之機關與廠商兩造,就整個仲裁過程是否以公平公正、符合程序正義,有效合理的解決紛爭,並探究為何機關提起撤銷仲裁判斷之訴訟之原因。研究結果發現機關質疑仲裁制度公正性的原因係對工程採購履約爭議制度不熟悉,且仲裁人在處理過程有代理人之行為,加上機關的律師不若廠商的律師積極、仲裁結果輸多贏少,導致不信任仲裁。而機關除認為仲裁結果不公正外,又為避免遭受圖利廠商質疑遂提起撤銷仲裁判斷訴訟。因此研究建議機關可選任由具工程專業背景之資深公務人員擔任仲裁人,並提供聘任律師合理費用以提升機關參與仲裁之信心與意願。 另公開工程採購爭議仲裁判斷書供社會大眾閱覽、加強仲裁人訓練、推廣仲裁、相關主計、政風及審計等監督單位應尊重採購專業人員之判斷等建議,使當事人更能接受仲裁判斷結果。 / Under Government Procurement Law, the scale and amount of public construction procurement is usually much larger. The increased unexpected factors due to longer compliance period, and different standpoint from both sides could rise the possibility of disputes, which should be solved with a more systematic way. Arbitration, which solves disputes by selecting arbitrators and forming an arbitral tribunal, is a fast and efficient way to deal with disputes from public construction procurement. However, presently, most government agencies distrust arbitration and often file out a revocation of an arbitral, which usually be dismissed by the court. At last, government agencies have to accept the outcome of the arbitration.This thesis studies the cases of public construction procurement disputes. By interviewing both sides of the actual participants, the fairness, effectiveness and justifiability of an arbitral tribunal is carefully examines. The result indicates that the major reasons why government agencies distrust arbitration include the followings: First, government agencies are often unfamiliar with the system of public construction procurement arbitration. Second, arbitrators could assign delegates. Third, attorneys of government agencies could be less aggressive than that of contractors. Forth, government agencies often lose in arbitrations. Moreover, government agencies could file out a revocation of an arbitral preventing being suspected to be in favor to contractors. It is suggested by this study that government agencies could select senior staffs from government agencies with engineering background as arbitrators and provide them with reasonable subsidy. Other suggestions includes: arbitration award be opened for public reference, enhancing arbitrator's training, promoting arbitrator, other divisions of government agencies respect public construction procurement professionalism, et cetera.

The Incorporation of the Tenant into the Public Construction Project : Through the three parameters of communication; Organisational culture, power and trust / Hur hyresgästen involveras i offentliga byggprojektAhmetasevic, Mia, Shamoun, Helena January 2017 (has links)
Public construction projects set the standards for new procedures and perspectives within the industry. A way of improving procedures is through communication and the inclusion of all involved parties. It is therefore the purpose of this report to investigate how communication through organisational culture, power and trust can affect the incorporation of the tenant in the construction process. Two case studies, both having public future tenants and public clients, were chosen to enable the investigation of the three parameters of communication, organisational culture, power and trust. The empirics showed that the tenant was often excluded from the construction process due to their differing cultural background. The results also showed that the tenant was considered to have lower status which was exploited at times. In addition, it was found that although opportunistic behaviour was present in the construction project, it was a greater internal issue within the tenant organisation. In the conclusion the authors recommend construction management to evaluate the consequences of incorporating the tenant in the construction meetings as it could lead to less construction errors. They further recommend the public organisations to oversee their distribution of resources in order to avoid opportunistic behaviour. / Offentliga byggprojekt bidrar med normer för nya tillvägagångssätt och perspektiv inom branschen. Ett sätt att förbättra dessa metoder är genom kommunikation och att inkludera alla inblandade parter. Syftet med denna rapport är därför att studera hur kommunikation genom organisationskultur, status samt förtroende kan påverka inkluderingen av hyresgästen i byggprocessen. Två fallstudier, båda med offentliga framtida hyresgäster och offentliga beställare, valdes för att undersöka de tre parametrarna av kommunikation; organisationskultur, status och förtroende. Empirin visade att hyresgästen ofta uteslöts från byggprocessen på grund av sin skiljda kulturella bakgrund. Resultaten visade vidare att hyresgästen ansågs ha en lägre status vilket de andra parterna utnyttjade. Dessutom visade resultaten att opportunistiskt beteende i byggprojektet var mer tydligt i de interna relationerna inom hyresgästorganisationen än i de externa. I slutsatsen rekommenderar författarna byggprojektledningen att utvärdera konsekvenserna av att inkludera hyresgästen i byggmötena då det kan leda till mindre byggfel. Vidare rekommenderar författarna offentliga organisationer att se över distributionen av resurser för att undvika opportunistiskt beteende.
