TITLE: WILLINGNESS TO REWARD OR PUNISH BRANDS AS MODERATORS FOR THE BRAND PERSONALITY DIMENSION OF SOCIAL RESPONSIBILITY MAJOR PROFESSOR: Dr. John H. Summey Social responsibility has received empirical support for its addition to the Brand Personality construct. The objectives of this study were first, to compare and contrast attitudinal reactions to varying descriptions of Social Responsibility as a Brand Personality dimension and second, to examine the data for possible moderation effects with the consumers' Willingness to Reward construct and the Willingness to Punish construct, with the latter as a proposed new construct for how consumers' respond to the Brand Dimension, Social Responsibility. The study tested 4 forms of social responsibility in a between-subjects factorial design. The study found that the subjects in the socially responsible condition had a difference in the Willingness to Reward construct when compared to the subjects in the socially irresponsible condition and the control condition. The study's support for the existence of the new moderator Willingness to Punish was found coupled with confirmatory support for Willingness to Reward as a moderator.

O princípio da coculpabilidade no estado democrático de direito / The principle of coculpability in a democratic state.

Sob a égide de um Direito Penal garantista, calcado, sobretudo, no respeito aos princípios constitucionais, e com o fim de coadunar o mal da pena com o cerne de todo o sistema que é a máxima da dignidade da pessoa humana, novos temas emergem da realidade social, provocando reflexões no sentido de se atualizar o Direito e seus institutos com as necessidades de uma sociedade que está cada vez mais dinâmica em suas relações. Devido à amplitude e importância de seu conceito, a culpabilidade vem sendo objeto de estudo, afinal, de acordo com a sistemática adotada pelo Código Penal brasileiro, este instituto corresponde ao cerne da Teoria do Delito. A partir dos estudos sobre a culpabilidade, surge a teoria da coculpabilidade que, por sua abrangência conceitual, hoje se considera princípio de origem constitucional. A reflexão parte da gritante desigualdade socioeconômica que se vislumbra atualmente dentro do grupo social, a qual se reforça pela omissão do Estado na efetivação das políticas públicas que possibilitam o acesso dos cidadãos aos direitos sociais, e do fato incontroverso que o meio no qual a pessoa vive condiciona a formação de sua personalidade e, consequentemente, a eleição de seus comportamentos. Atrela-se a isso o caráter seletivo que o sistema penal assume quando se verifica na realidade fenomênica sua utilização equivocada como mecanismo corretor de problemas como a incapacidade estatal de cumprir os deveres constitucionais no que atine à concreção do bem comum. A coculpabilidade, então, coloca o Estado e a sociedade para dividirem a culpabilidade pelo crime com a pessoa do delinquente, uma vez que se constate no caso concreto que esta foi privada do acesso aos seus direitos fundamentais por negligência estatal; essa divisão de responsabilidade pelo delito se dá na limitação do direito de punir. O reconhecimento do princípio da coculpabilidade como vigente no Estado Democrático de Direito apresenta-se um tanto controverso ainda na jurisprudência e na doutrina penal brasileira. Tem por objeto a presente pesquisa analisar o alcance de referido princípio e sua aptidão de atenuar ou mesmo excluir a pena, situando-o na Teoria do Delito como mecanismo eficaz para a concreção do Direito Penal mínimo. / Under the aegis of a criminal garantista law, trampled, especially in respect to constitutional principles, and consistent with the end of the of the penalty with the evil core of the whole system which is the maximum of human dignity, new themes emerge from the social reality, causing reflections in order to update the law and its institutions to the needs of a society that is increasingly dynamic in their relationship. Due to the breadth and importance of its concept, culpability has been the object of study, after all, according to the system adopted by the Brazilian Penal Code; this corresponds to the core Theory of Crime institute. Based on the studies on the guilt arises the co culpability theory which in conceptual comprehensiveness, today it is considered a constitutional principle of origin. The reflection part of whopping socioeconomic inequality that can be seen today within the social group, which is reinforced by the omission of the state in the fulfillment of public policies that enable citizens\' access to social rights, and the incontrovertible fact that the way in which a person lives affects the formation of his personality and therefore the election of their behaviors. It attaches itself to the selective character the penal system assumes that when there is in fact phenomenalistic use as mistaken a mechanism broker problems such as the inability to meet the state constitutional duties concerning the concretion of the common good. The co culpability then puts the state and society sharing culpability by crime with the person of the delinquent, since it is found in this case was deprived of access to their fundamental rights by state neglect, this division of responsibility for the crime occurs on limiting the right of punishing. The recognition of the principle of co culpability as existing in a democratic state has become somewhat controversial even in Brazilian criminal jurisprudence and doctrine. Aims at the present research to analyze the scope of this principle and its capacity to mitigate or even delete the sentence, placing it on the Theory of Crime as an effective mechanism for the concretion of minimal Criminal Law.

O objetivo deste trabalho é analisar decisões da Corte Interamericana de Direitos Humanos que tratem do dever de os Estados investigarem e punirem os responsáveis por violações de direitos humanos. Considera-se que o Sistema Interamericano tem tido um papel de destaque no processo de desenvolvimento de uma norma internacional que determina a responsabilidade criminal individual por violações de direitos humanos. Mesmo com todas as mudanças políticas ocorridas nos países que aceitam a jurisdição da Corte IDH, esta pesquisa identifica que o direito penal tem sido um tema marcante na jurisprudência interamericana, tanto na apuração da responsabilidade estatal quanto na imposição de medidas de reparação. Mesmo assim, quando se comparam diferentes tipos de casos que lidam com a atuação da justiça criminal, paradoxos e lacunas na visão que a Corte Interamericana tem do direito penal começam a emergir. / The aim of this work is to analyze the decisions of the Inter-American Court of Human Rights dealing with the duty of States to investigate and punish those responsible for human rights violations. It is taking into account that the Inter-American System has had a prominent role in the development of an international standard establishing individual criminal accountability for human rights violations. Even with all the political changes in the countries that accept the jurisdiction of the IACHR, this research identifies that the criminal law has been a striking matter in the Inter-American jurisprudence, both in the establishment of state responsibility as the imposition of remedial actions. Still, when comparing different types of cases that deal with the criminal justice, paradoxes and gaps in how the Inter-American Court oversees the criminal law begin to emerge.

In order to accomplish this goal, we started off by researching the origin and organization of the State, from ancient Greece to the beginning of the XXI century. Then, we looked for, in the origin of constitutional law, the fundamental and criminal procedural principles which establish the criminal prosecution of the State and the legal relationship among the branches of Public Law. In the Democratic Rule-of-Law State, the procedural instrumentality of the application of substantive law follows several principles. Among them, human dignity, due legal process, and full legal defense as foundation of law and justice. We found out that, to perform the prosecution, the Democratic Rule-of-Law State has bodies that carry out these important functions. They are: the judicial police, which investigates criminal offenses and their authors; the Public Prosecutor Office, as a permanent safeguard of legality, proposing the criminal action; the lawyer, to defend the rights and guarantees of the accused and finally, the Judiciary, performing judicial functions, applying the law to each specific case, and exercising the State’s right to punish. In this study, we also tried to examine the criminal investigation from the point of view of the procedural legal character, and its legality, in the procedural legal relationship. We carried out a historical study of the evolution of investigation up to the emergence of police inquiry and the judicial police, the latter as the institution in charge of that function, which is constitutional, today. Finally, we sought to establish that the criminal investigation in the processing of police inquiry is essential not only for the prosecution, but as prerequisite for criminal prosecution / O presente trabalho tem por objetivo estudar a persecução criminal, a aplicação dos princípios constitucionais do Estado Democrático de Direito e seus efeitos no sistema jurídico constitucional. Para realizarmos esse objetivo iniciamos pesquisando a origem e a formação do Estado, desde a Grécia Antiga até o século XXI. Em seguida buscamos, na origem do direito constitucional, os princípios fundamentais e processuais penais, que estabelecem a persecução penal do Estado e as relações jurídicas entre os ramos do Direito Público. No Estado Democrático de Direito, a instrumentalidade processual de aplicação do direito material segue vários princípios, entre os quais se destacam a dignidade humana, o devido processo legal e a ampla defesa como pilares do Direito e da Justiça. Verificamos que para executar o direito de punir, o Estado Democrático de Direito possui órgãos envolvidos nessa função como a polícia judiciária, que apura as infrações penais e sua autoria; o Ministério Público, como fiscal permanente da legalidade e titular da ação penal; o advogado, na defesa dos direitos e das garantias do acusado e, ao final, o Poder Judiciário no exercício da função jurisdicional para aplicar o direito ao caso concreto e exercer o direito de punir do Estado. Neste estudo analisaremos também a investigação criminal do ponto de vista da natureza jurídica processual e da legalidade na relação jurídica processual. Realizamos ainda um estudo histórico sobre a evolução da investigação até o surgimento do inquérito policial e da polícia judiciária como órgão encarregado dessa função atualmente constitucional. Por fim, procuramos estabelecer que a investigação criminal no procedimento do inquérito policial é essencial não apenas para a persecução, mas como um pressuposto imprescindível da ação penal

Στην παρούσα μελέτη περίπτωσης ερευνήσαμε τους τρόπους με τους οποίους οι εκπαιδευόμενοι του παραρτήματος του Σχολείου Δεύτερης Ευκαιρίας Πάτρας (2012 – 2013), το οποίο λειτουργεί στο Κατάστημα Κράτησης Πάτρας, συμμετέχουν στη διαμόρφωση της γνώσης, που έχουν τη δυνατότητα να συγκροτήσουν, αλλά και τους παράγοντες που οριοθετούν αυτή τη διαδικασία, και κατ' επέκταση το περιεχόμενο αυτής της γνώσης. Επιπλέον, κρίναμε σκόπιμη και τη διερεύνηση της επίδρασης της λειτουργίας του παραρτήματος του Σχολείου Δεύτερης Ευκαιρίας Πάτρας (2012 – 2013) στο πειθαρχικό έργο του Καταστήματος Κράτησης Πάτρας. Για την επίτευξη του ερευνητικού μας σκοπού, πραγματοποιήσαμε 15 ημιδομημένες συνεντεύξεις με τους εκπαιδευόμενους, που φοιτούσαν στο συγκεκριμένο ΣΔΕ την περίοδο διεξαγωγής της έρευνας, την προϊσταμένη του ΣΔΕ και την υπεύθυνη του Καταστήματος Κράτησης για την εκπαίδευση των κρατουμένων. Στο περιεχόμενο των συνεντεύξεων πραγματοποιήθηκε ποιοτική ανάλυση περιεχομένου. Η ανάλυση έδειξε ότι οι εκπαιδευόμενοι του ΣΔΕ συμμετέχουν στη διαμόρφωση της γνώσης, που έχουν τη δυνατότητα να συγκροτήσουν, μέσα από μία σειρά τρόπων. Ωστόσο, η διαδικασία αυτή φάνηκε να οριοθετείται από ορισμένους περιορισμούς και απαγορεύσεις που επιβάλλονται στους εκπαιδευόμενους, κυρίως από το πλαίσιο της φυλακής. Τέλος, κατά τη λειτουργία του ΣΔΕ, διαπιστώθηκε η εφαρμογή ενός αριθμού πειθαρχικών τεχνικών, οι οποίες επιδρούν θετικά στο πειθαρχικό έργο της φυλακής. / In this present case study we researched the ways in which the students of the department of the Second Chance School of Patras (2012-2013), which operates in the Prison of Patras, participate in the formation of knowledge and have the capability of composing, also the factors which limit this process as well as the content of knowledge. Furthermore, we decided that it was also necessary to research the effects of the operation of the department of the Second Chance School of Patras (2012-2013) on the disciplinary work of the Prison of Patras. To achieve the goal of our research we took 15 semi-structured interviews from the students who attended the Second Chance School at the time the research was conducted, the Head Director of the Second Chance School and the Head Manager of Education of the Prison of Patras. We analyzed the content of the research in detail. The analysis conveyed that the students of Second Chance School took part in the formation of knowledge which they have the capability of obtaining in a variety of ways. However, the procedure seemed to be limited by certain limits and prohibitions which are imposed on the students basically from the framework of the prison. Finally, during the operation of Second Chance School a number of disciplinary techniques were established which had a positive effect on the disciplinary work of the prison.

Este trabalho visou analisar as transformações relativas ao setor de bem-estar social dos Estados nacionais, responsável pelos direitos sociais e econômicos, inseridos na Era da Informação. Para tanto, fez-se um apanhado histórico das razões político-filosóficas que deram causa à construção do Estado Social, desde seus primórdios até sua consolidação como fundamento da cidadania inerente à um Estado Democrático de Direito, momento em que se analisou o conteúdo desse modelo estatal para a formulação de um conceito que propiciasse melhor entendimento do objeto. Posteriormente, tendo Manuel Castells por marco teórico, os esforços se focaram em uma análise ampla das transformações política, econômica e culturais ocorridas a partir da Terceira Revolução Industrial com o advento das novas tecnologias de informação e comunicação, e que criaram a sociedade em rede. Nesse contexto, verificou-se que os Estados-Nação contemporâneos passam por uma crise, em que parte de sua soberania é abalada (sobretudo sua autonomia econômica) pelo poder dos fluxos das redes - é o processo de disfonia estatal - levando-os à condição de Estado Virtual, um estágio em que o Estado deverá optar por um caminho a ser seguido (atualização), o que implicará em grandes modificações para seu setor de bem-estar. Ao final, fez-se uma análise das consequências de uma atualização voltada para a desconstrução do Estado do Bem-Estar Social, a partir dos estudos de Loïc Wacquant sobre os Estados Unidos da América, local considerado, ao mesmo tempo, berço da revolução informacional e das políticas de retração do Estado Social, cujos deslindes terminaram na construção de um outro paradigma: o Estado Penal, caracterizado pela punição dos pobres, abandonados pelo recuo do Estado Social e abraçados pela malha punitiva, em que as novas tecnologias típicas da Era da Informação assumem um novo propósito - as funções de vigiar e punir. / This work aimed to analyze the transformations related to the welfare sector of national states, responsible for social and economic rights, inserted in the Information Age. In order to do so, it was made a historical survey of the political-philosophical reasons that gave rise to the construction of the Social State, from its beginnings until its consolidation as a foundation of citizenship inherent to the Democratic Rule of Law, at which point the content of this state model was analyzed for the formulation of a concept that provided a better understanding of the object. Later, with Manuel Castells as a theoretical framework, the efforts focused on a broad analysis of the political, economic and cultural transformations that occurred since the Third Industrial Revolution started with the advent of new information and communication technologies, and which created the networked society. In this context, it was found that the contemporary nation-states go through a crisis, in which part of their sovereignty is shaken (mainly their economic autonomy) by the power of the networks flows - it\'s the state dysphonia process - leading them to the condition of a Virtual State, a stage in which the State must choose a path to be followed (update), which will result in major changes to its welfare sector. At the end, it was analyzed the consequences of an update turned to the dismantlement of the welfare state, up from the studies from Loïc Wacquant about the United States of America, a place considered at the same time as the cradle of the informational revolution and of the retraction policies of the Welfare State, whose delineations ended in the construction of another paradigm: the Penal State, characterized by the punishment of the poor, abandoned by the retreat of the Welfare State and embraced by the punitive network, in which the typical technologies of the information age take on a new purpose - the functions of discipline and punish.

The objective of this study is to demonstrate that education of prisoners make them less likely to re-offend because it facilitates their re-integration to their community at the end of their prison sentences. As a consequence, the whole society can benefit from the implementation of the right of education of prisoners. The method of study employed involved the analysis of other research and references addressing the problem of education of prisoners in Brazil, the analysis of the constitutional rules and of criminal proceedings in the past and present time, giving a historical view of the evolution of criminal procedural laws in Brazil. Moreover, this research investigates some models of public administration which put into practice education polices and techniques as a means to integrate prisoners in society. Finally, it highlights the need to support the agents who will be directly dealing with the education of prisoners and offers alternatives / O presente trabalho acadêmico busca estudar a importância do direito à educação dos presos e as conseqüentes perspectivas das normas processuais penais e de execução penal em relação a esse direito constitucionalmente previsto pela Constituição brasileira. Afirma a importância, no atual Estado Democrático de Direito, de obedecer aos ditames da Constituição Federal de fornecer indistintamente a qualquer pessoa o direito à educação fundamental. Desenvolve, por meio de pesquisas bibliográficas, estudos acerca da educação na norma constitucional brasileira atual e suas raízes históricas, bem como sua interligação com o direito processual penal e de execução penal, além de discorrer sobre a própria evolução dos princípios do direito processual penal na Constituição brasileira vigente. Busca apontar os fins do processo penal e a necessidade da plena observância do princípio da dignidade da pessoa humana em relação à educação, demonstrando, ainda, como é importante educar os prisioneiros que estão atualmente descontando pena privativa de liberdade em regime fechado, para com isto facilitar a sua ressocialização. Estuda as decisões jurisprudenciais e seus embasamentos teóricos em relação ao instituto da remição pelo estudo e sua aplicabilidade em face do ordenamento jurídico. Crime and Punishment in the Eyes of Cesare Beccaria An Analysis of an Enlightenment Penal Law Reform The Ph.D. dissertation is centred around a relatively concise, but extremely influential book: Cesare Beccaria's treatise On Crimes and Punishments (Dei delitti e delle pene). This work, first published in 1764, sums up in a clear, yet intellectually penetrating way all the main Enlightenment principles of a complex penal law reform. In its time, the book was not only of great philosophical importance and it not only changed the way western societies perceived crime and punishment, but it also served as a concrete guideline for various penal law reformers. It is therefore by no means an overstatement to say that it caused a true paradigm shift in both legal and moral philosophy. The main aim of the thesis is to give a legal-philosophical account of Beccaria's thoughts on crime and punishment, to examine their historical as well as moral background and show the actual impact they had on the legislation of many different, mainly European states.
