Previous issue date: 2006-11-27 / This work is about the benefit of reclusion-aid foreseen in the General Regime of
Social Security. For a better comprehension of this benefit, it was analyzed the
Social Welfare as a whole, from the beginning of its development to its modern
aspect. The Social Welfare arose with the Constitution of 1988, as a tool of the
Social Order in search of social justice and well being, becoming concrete through
the subsystems of health, social assistance and social security. In the chapter that
describes the Social Security, it is studied the characteristics of this subsystem, as
well as the protection that it gives to the family of the insured, which includes the
benefit of reclusion-aid. Through a historical summary of this benefit, it is
demonstrated that the reclusion-aid is not new in our judicial system; it has been
appearing in welfare laws since the 1950 s and became a constitutional rule with
the Constitution of 1988. Despite the criticism against the benefit, it is among the
several protection measures enacted by the constitutional legislator in accordance
with the aims of the Social Security. The benefit is studied with the analysis of the
protected risk, the influence of the work activity to establish the conception of
risk/necessity and the alterations brought by Law 10666/03. There are still some
comments about the alterations brought by the Constitutional amendment no.
20/98, which limited the benefit for the dependents of the insured with low income,
considering the constitutional principles of uniformity and equivalence of benefits,
selectivity, and distributiveness. Some law cases about this question were also
taken into account. In the end, there are some brief considerations about collective
protection, through the public civil action in issues of social security, highlighting
the importance of this tool, especially for the maintenance of the equity of the
group of insured and dependents, in a way that similar issues can be decided
uniformly / Trata-se de estudo sobre a prestação previdenciária do auxílio-reclusão no
Regime Geral de Previdência Social. Visando à plena compreensão da presente
prestação, partiu-se do estudo do histórico do desenvolvimento da seguridade
social, até a conformação obtida nos tempos modernos. A seguridade social foi
erigida na Constituição de 1988, como instrumento da ordem social, na busca dos
objetivos da justiça social e do bem comum, que se concretiza por meio dos
subsistemas da saúde, da assistência social e da previdência social. Em capítulo
destinado à previdência social, estudamos as características desse subsistema,
bem como a proteção que destina à família do segurado, classe na qual se
enquadra o benefício do auxílio-reclusão. A partir de breve histórico da
prestação, demonstramos que o auxílio-reclusão não constitui novidade em nosso
ordenamento jurídico, tendo sido erigido à categoria de norma constitucional com
a Constituição de 1988. Consignamos as críticas que o benefício recebe.
Estudamos o benefício com a análise do risco protegido, a influência que o
exercício da atividade laboral traz para fins de configuração do risco/necessidade,
as alterações perpetradas pela Lei n. 10.666/03. Por fim, dedicamos
considerações às alterações trazidas pela Emenda Constitucional n. 20/98, que
limitou o benefício aos dependentes do segurado de baixa renda, fazendo uma
análise à luz dos princípios constitucionais da isonomia, seletividade e
distributividade, e trazendo ainda à baila os posicionamentos jurisprudenciais
sobre a questão.
Em capítulo próprio, a fim de facilitar a compreensão do benefício do auxílioreclusão,
dissecamos a norma da prestação em antecedente e, no conseqüente,
identificando os diversos critérios (material, temporal e espacial, pessoal e
quantitativo). Por fim, traçamos breves considerações sobre a tutela coletiva, por
meio da ação civil pública de questões previdenciárias, ressaltando a importância
dessa via, mormente para fins de manutenção da equidade do grupo dos
segurados e dependentes, de modo que às questões a eles afetas sejam
decididas uniformemente

In this manner, my work invites viewers to embrace the disconcerting and unsettling aspects of the in-between, all the while establishing an unsettling connection to reality through the lens of nostalgic objects and imagery.

Previous issue date: 2011 / FAPEMAT - Fundação de Amparo à Pesquisa do Estado de Mato Grosso / Este estudo dedica-se a conhecer a trajetória de privação de liberdade de alguns adolescentes da cidade de Sinop/MT, que foram transferidos para o Centro Socioeducativo de Cuiabá/MT. O estudo reflete sobre alguns processos vivenciados pelas classes marginalizadas da sociedade, e tem como elementos norteadores da investigação, os espaços e a realidade dos fenômenos sociais que permeiam os atores pesquisados. Conhecer essa realidade é requisito básico para poder compreender seus valores, suas culturas e sua subjetividade, nos espaços de inserção social. A pesquisa se desenvolve por meio de narrativas e depoimentos de adolescentes em situação de privação de liberdade, estabelecendo a relação entre o texto e o contexto explorados. Para tanto, principia-se com a depreensão do cenário onde se deu sua internação (Sinop/MT), anterior à transferência para Cuiabá/MT. Posteriormente, discute sua trajetória de privação de liberdade, bem como seus desafios, no contexto do Centro Socioeducativo. A pesquisa se concentra nas teorias que contemplam as discussões sobre os temas: igualdade e liberdade; liberdade e autonomia; relações de igualdade e liberdade negativa e/ou positiva; privações de liberdade e vulnerabilidade social. Através do recurso de entrevistas, o estudo assinala suas trajetórias, para discutir como esses adolescentes e a sociedade constroem um caminho de possibilidades e impossibilidades, diante da constituição de políticas públicas de processos de inclusão social. / This study is dedicated to knowing the trajectory of deprivation of liberty of some adolescents in the city of Sinop/MT, which were transferred to the Center of Socio Education of Cuiabá/MT. The study discusses some of the processes experienced by the marginalized classes of society, and is the guiding elements of research, space and reality of social phenomena that pervade the actors interviewed. To know this reality is a basic requirement in order to understand their values, their culture and subjectivity, in the spaces of social inclusion. The research is developed through narratives and interviews of adolescents in situations of deprivation of liberty, establishing the relationship between text and context explored. To do so, begins with the apprehension of the scene where he gave his internment (Sinop/MT) previous to the transference to Cuiabá / MT. Later, we discussed the trajectory of deprivation of liberty and its challenges in the context of the Center of Socio Education. The research focuses on theories that include discussions on the themes: equality and liberty, liberty and autonomy, relationships of equality and negative liberty and/or positive; deprivation of liberty and social vulnerability. Through the use of interviews, the study points out their careers, to discuss how these adolescents and society construct a path of possibilities and impossibilities, ahead the constitution of public politics of processes for social inclusion.

Entre le XVIIIe et le XIXe siècle, la littérature européenne redéfinit fondamentalement son rapport au récit de voyage : les notions d’apprentissage et de formation, telles qu’elles apparaissent au temps des Lumières et du Bildungsroman, s’érodent et laissent peu à peu la place à des variations excentriques ou parodiques. En 1795, le Voyage autour de ma chambre de Xavier de Maistre exalte ainsi les vertus didactiques d’une réclusion contemplative. La mode du récit de voyage voit ainsi lui succéder, d’une part, des excursions sans profit pédagogique, et, d’autre part, des retraites riches en enseignement, malgré l’abolition de toute trajectoire physique. À la suite de Xavier de Maistre, plusieurs dizaines d’imitateurs composent à leur tour un répertoire peu exploré de la littérature française : le voyage de chambre. Après les révolutions qui frappent l’Europe et l’Amérique à la fin du XVIIIe siècle, un nouveau modèle de personnage, l’homme immobile, émerge ainsi dans la littérature. Caractérisé par sa présence problématique dans une société en pleine mutation, il occupe l’espace narratif en spectre, refusant de s’engager dans l’action tandis qu’il explore les nouvelles possibilités de vie dans un espace privé. Des textes essentiels de la littérature du XIXe siècle abordent ainsi, sur un mode euphorique ou dysphorique, ces nouvelles modalités narratives : la fiction américaine de la Nouvelle-Angleterre relate la pénible transition d’un âge spirituel vers un âge politique, caractérisée par un climat léthargique qu’observent avec stupeur, tour à tour, Charles Brockden Brown, Washington Irving, Edgar Allan Poe, Nathaniel Hawthorne ou Hermann Melville. Dans les marges de cette littérature inquiète, le mouvement transcendantaliste propose un retour heureux à la solitude. Inspired by Xavier de Maistre’s book, dozens of imitators follow his path throughout the XIXth century and write their own accounts of room travel, a little studied phenomenon in French literature. After the revolutions that hit Europe and America in the late eighteenth century, a new model of character, the immobile man, appears in literature. Characterized by his problematic presence in a fast-changing society, which is undergoing some very profound changes, he occupies the narrative space like a ghost, refusing to engage in social action, as he would much rather investigate the new opportunities of living in his own private space. Essential 19th-century texts—be they euphoric of dysphoric—hint at these new narrative modalities: American fiction from New England, for example, tells the painful transition from a spiritual age to a political age, characterized by a lethargic climate alternately depicted by Charles Brockden Brown, Washington Irving, Edgar Allan Poe, Nathaniel Hawthorne or Hermann Melville. On the margins of this troubled literature, the transcendentalist movement advocates a more favorable return to solitude. In France, Joris-Karl Huysmans’s A rebours, through its author’s determination in the search for unity, certainly marks an important milestone among all the narratives of reclusion.
