Le rôle de l'économie en droit du contrat. / The role of economy in the contract law

La présente étude entend montrer comment les objectifs définis par la science économique peuvent contribuer à l'évolution du droit du contrat. Dans un premier temps, nous montrerons pourquoi et comment la conception du contrat doit évoluer en suivant les évolutions des théories économiques. Nous démontrerons que le contrat, en tant que cadre juridique des relations économiques, ne peut effectuer sa fonction principale, qui est d'assurer l'efficience des relations économiques, que si sa conception est fondée sur les résultats obtenus en science économiques. Nous proposons alors une nouvelle conception qui repose sur l'approche relationnelle du contrat. Dans un second temps, nous montrerons comment la quête de la justice sociale a pu faire évoluer la conception de la justice contractuelle. Le sens de cette évolution est, d'une part, de l'indifférence du droit à l'égard de la question de l'équilibre contractuel vers les interventions, directes ou indirectes, dans ce domaine et, d'autre part, de la justice commutative au sein d'un seul contrat isolé vers la promotion de la justice sociale en intervenant dans les relations contractuelles. / The present study aims to show how the objectives defined by the economic science may contribute to the evolution of the contract law. First, it shows why and how the conception of contract should be changed following the evolution of economic theories. We demonstrate that the contract, as a legal framework for the economical relations, may fulfil its principal function, which is to assure the efficiency of the economic relations, only if its conception is based on the economic findings. Thus, we propose a new conception which is based on the relational approach to contract. Then, we will show how the quest for social justice has changed the conception of contractual justice. The direction of this evolution is, on the one hand, from indifference of law regarding the contractual balance towards the direct or indirect interventions, and, in the other hand, from commutative justice in one isolated contract to the promotion of social justice by intervening in the contractual relations.

Leftover women's choices in marriage and childbearing: navigating through the complexities of state law, social attitudes, and parental expectations

In recent years, unmarried women in China face great pressure to marry when they reach their late 20s and beyond. These women are referred to as leftover women, a terminology that plays into the notion that they fail to sell themselves in the marriage market at the best timing. Based on interviews and focus groups with leftover women in China, this dissertation situates their choices in the complexities of social and legal orders in today’s China to make sense of their decisions. Starting with a postcolonial critique of current literature on leftover women, this dissertation revisits leftover women’s decisions and demonstrates how their choices are made after evaluating all the available options rather than decisions made out of false-consciousness. I discuss how societal and parental expectations interact with state law to affect leftover women’s choices in marriage and childbearing. To understand how leftover women navigate through multiple levels of social ordering, I investigate the legal consciousness of these women when they judge which level(s) of social ordering they should follow. My analysis of leftover women’s strategies in engaging with state law challenges the assumption that ordinary Chinese people’s reluctance to use the formal legal system is a result of their lack of legal knowledge. My interviewees’ emphasis on family relations and public attitudes regarding marriage and childbearing complicates and contributes to feminist relational theory by questioning its strong attachment to autonomy. Building on postcolonial feminist legal thoughts, I advocate that feminist relational theorists need to distance themselves from autonomy in order to understand the choices made by women who prioritize familialism over individualism. To unsettle feminist relational theory’s unconditional attachment to autonomy, I elaborate on leftover women’s understandings of the relationship between the self and the family and other people in their social networks. This elaboration is achieved by investigating the impact of societal and parental expectations, as well as leftover women’s participation in constructing the notions of filial piety and motherhood. This dissertation offers a detailed discussion of leftover women’s choices in marriage and childbearing by demonstrating their navigation through multiple levels of social ordering. It also provides a postcolonial analysis of the approach of “blaming culture,” which has been used by many scholars who study leftover women, as well as other issues concerning marginalized populations in authoritarian states such as China. At the same time, this dissertation illustrates a way of analyzing women’s choices without focusing on autonomy, which is of great importance for research on women whose culture prioritizes familialism over individualism. This dissertation also contributes to the areas of legal consciousness and legal pluralism by explaining ordinary people’s reluctance to separate state law and non-state social ordering. This is a timely empirical study aiming to serve as a springboard to invite future research on law and emotions, and law and family relations, relationships and legal consciousness, and postcolonial analysis of the impact of patriarchal Confucian culture and Chinese legal culture in general. / Graduate / 2022-06-02

Cette thèse de doctorat propose de comprendre la spécificité rituelle des pratiques funéraires au début du XXIe siècle. Les analyses rituelles classiques (interactionnistes et structuro-fonctionnalistes) nous ont conduit à nous intéresser au processus rituel plutôt qu’au rituel lui-même et à cheminer par l’entremise d’une approche de l’action rituelle, plutôt que par celle des fonctions ou des symboles. Pour restreindre la part de réalité sociale étudiée, nous avons considéré que, parmi les différentes transformations funéraires, le phénomène de la crémation était une porte d’entrée pour comprendre cette spécificité. Cette thèse poursuit un double objectif :1) Le premier objectif est descriptif. Dans la trajectoire du mourir, à partir d’une perspective relationnelle, nous avons exploré le processus funéraire, notamment celui ayant pour perspective la crémation comme mode de transformation du corps, en le décomposant comme une chaîne opératoire du mourir. Nos données sont recueillies par la méthode de la participation observante de pratiques au sein du milieu funéraire. L’exemplarité du phénomène crématiste, en tant que pratique réunissant les attributs de l’évolution récente funéraire à partir des années 1980, a dirigé notre sélection vers un échantillon diversifié dans deux contextes socioculturels (France et Québec) et deux agglomérations (Strasbourg et Montréal) où le taux de crémation est historiquement élevé. 2) Le second objectif consiste à comprendre la spécificité de la ritualisation funéraire à partir de ces données, en s’intéressant à l’action rituelle en train de se faire dans le processus funéraire, c’est-à-dire expliquer la mise en forme et en acte de relations sociales. Par-delà une lecture socioanthropologique de l’organisation des relations contextuelles de ritualisation, une lecture psychosociologique des actions rituelles complète l’interprétation. Notre compréhension de la spécificité du processus rituel funéraire fait apparaître la complexité relationnelle de cette pratique sociale : d’une part, en tant qu’actions interagies par et dans des relations interindividuelles, faisant appel à des ressources réflexives (habilitantes) et permettant la réduction de l’état de dissonance provoqué par la mort; d’autre part, en tant qu’actions enserrées par et dans les règles des systèmes sociaux. La mise à jour de la prépondérance de ces caractéristiques relationnelles dans la ritualisation funéraire actuelle a pour vocation de comprendre à la fois la diversification des pratiques funéraires et leur normalisation. / This doctoral thesis aims to understand the specific ritual burial practices in the early twenty-first century. The classic ritual analyses (structural-functionalist and interactionist) led us to focus on the ritual process rather than on the ritual itself, so we adopted a ritual action perspective. To reduce the focus on the social reality studied, we posit that among the various transformations of funerals, the phenomenon of cremation is a gateway to understand this specificity. This thesis has two objectives: 1) The first is descriptive. In the path of dying, from a relational understanding, we explored the funeral process, notably the cremation, as a mode of body transformation as an operational chain of dying. Our data was collected through the method of observing participation in funeral practices. The phenomenon of cremation, as a practice combining the attributes of the recent funeral evolution from the 1980s, led to our selection of a diverse sample in two sociocultural contexts (France and Quebec) and two cities (Strasbourg and Montreal) where the cremation rate is historically high. 2) The second objective is to understand the burial ritual from this data, focusing on the ritual surrounding the funeral process, while explaining the setting, form and act of social relations. In addition to a socio-anthropological reading of the organisation of the contextual relations behind ritual, a psychosocial reading completes the interpretation of the ritual actions. Our comprehension of funerary rituals shows the complexity of this social practice. In one hand as actions, through interpersonal relations, appeal to reflexive resources (enabling) and allow the reduction of dissonant state caused by death. On the other hand, as actions surrounding the rules of the social system. This new data on the preponderance of these relational features within the current funeral rituals, aims to understand both the diversification of funeral practices and their standardisation.

This has inspired an increasing call for shopping centres landlords to play a substantial role in community development. This study explores the relationship between shopping centres landlords and the communities in which they reside-in with regards to corporate social responsibilities. The study is based on the premise that Corporate Social Responsibility (CSR) initiatives are seen as mandatory by shopping centres landlords as to ask what their contributions are to achieving sustainable development and improving the lives of people living in the local communities. In this regard, the study examines the role that shopping centres landlords play in bringing development to their various communities through CSR. The focus is on three shopping centres: Empangeni Sanlam Centre, Esikhawini Mall and Richards Bay Boardwalk Inkwazi Shopping Centre within uThungulu District Municipality. Relational theory and transactional model theory are used to develop a model for shopping centres landlords to embrace CSR as a tool to community development. This study employs a survey method which was conducted among the management of the centres and residents of Empangeni, Esikhawini and Richards Bay. The results of the study indicate that CSR initiatives embarked upon by shopping centres landlords through their management team are not communicated to the local community residents. This brings a gap in communication between the landlords and the local community residents. The practical implications of this finding showed that the model proposed for this study is promising in solving communication problem hindering CSR initiatives implementation.

Le contrat de franchise organise la transmission d'un savoir-faire et prépare la réitération d'un succès commercial. Compte tenu de la nature complexe de la prestation caractéristique, les parties au contrat deviennent au fil du temps des véritables partenaires, si bien que le contrat de franchise acquiert une dimension relationnelle. Malgré cette spécificité, le droit français appréhende encore le contrat de franchise en utilisant le modèle cognitif classique offert par la théorie générale du contrat. Une telle démarche risque d'ignorer la réalité des problèmes que les partenaires peuvent rencontrer, ce qui peut conduire à l'application de solutions inadaptées. La proposition d'une analyse relationnelle vise à réduire un tel risque. En se fondant principalement sur les travaux de la doctrine nord-américaine, l'analyse relationnelle séduit de plus en plus les juristes français notamment parce que les raisonnements proposés sont souvent compatibles avec le droit positif. En envisageant le contrat de franchise grâce à la grille de lecture fournie par l'analyse relationnelle, il devient possible d'appréhender l'intégralité du contexte dans lequel ce contrat s'insère et de proposer des règles de droit en harmonie avec les besoins et préoccupations des partenaires contractuels. / The franchise agreement organizes the transmission of trade secrets and business plans. Given the complex nature of this performance , the contracting parties over time become true partners , so that the franchise agreement acquires a relational dimension. Despite the existence of a relational dimension, French contract law still rule the franchise agreement using the standard cognitive model offered by classic contract theory. Such an approach risks ignoring the real problems that partners can meet , which may lead to the application of inappropriate solutions. The proposal for a relational analysis aims to reduce such a risk. Based largely on the work of the North American contract law doctrine , the relational analysis is attracting more and more French scholars especially because the proposed arguments follow the French legal system's evolution. The relational analysis allows us to understand the franchise agreement's context and propose solutions in harmony with the needs and concerns of contractual partners.

This scientific essay is researching how we can understand the interplay between the private and the professional identities of teachers in school-age educare. This paper is based on our early working experiences, compared to our present-day experiences. The methods we have used are the scientific essay and participant observations. The theoretical framework consists of Isaiah Berlin’s concepts of liberty, Louis Althusser’s concept of interpellation and Jonas Aspelin’s relational concepts: closeness, distance, interhuman and social approaches. The study shows that it is possible to identify a contradiction between the private and the professional identities in the Swedish curriculum and, also, that it is possible to find agency in that conflict, through conscious and intentional didactic movement between closeness and distance. / Denna vetenskapliga essä är en undersökning av hur fritidshemslärarens yrkesroll kan förstås utifrån samspelet mellan privatpersonen och den professionella personen. Framställningen bygger på gestaltningar ur våra tidigare yrkeserfarenheter, vilka vi jämför med våra erfarenheter idag. De metoder vi har använt är vetenskaplig essä och deltagande observation. Teoriramen består huvudsakligen av Isaiah Berlins frihetsbegrepp, Louis Althussers tankar om interpellation och Jonas Aspelins relationella begrepp: närhet, distans, mellanmänskligt och socialt förhållningssätt. Essän visar att det är möjligt att identifiera en motsättning mellan privatpersonen och den professionella personen i läroplanen och även att det är möjligt att finna en agens i denna motsättning genom en medveten, didaktisk rörelse mellan närhet och distans.

An educational psychological analysis of latchkey children

The purpose of this study was to explore the impact of the latchkey situation on children's relationships. A literature study on the concept `latchkey' children was conducted and it was established that there are only a few studies conducted on the phenomenon. However, most of the literature consulted established that self-care has a negative and positive impact on children's relationships with the self, their parents, siblings, peers and educators. To confirm the findings from the literature study an empirical study was conducted by means of collecting data from three `latchkey' children, three educators and four parents. The empirical research confirmed the findings of the literature study that a latchkey situation has indeed a negative impact on children's relationships with the self and others. The empirical study did, however, not confirm the positive impact of a latchkey situation on children's relationships with the self, parents, siblings, peers and educators. / Educational Studies / M.
