Bureaucracies, communities and networks : interagency cooperation for Homeland Security In Monterey County

Approved for public release; distribution is unlimited. / The federal government has undertaken a massive reorganization in order to create the Department of Homeland Security, and a parallel debate over how to organize homeland security functions has arisen at the State and Local government levels. In a time of severe budget constraints and rapidly changing threats, governments at all levels recognize the need for multiple government agencies, the private sector and nongovernmental organizations to work together in order to provide effective homeland security. The effort to improve cooperation, especially at the "first responder" level, has become a major priority in the homeland security arena. How then can local governments improve interagency cooperation for homeland security? A recent conference of government officials and homeland security experts concluded that the central coast of California has one of the best emergency preparedness systems in the country. This thesis examines the high level of interagency cooperation that has arisen among public safety agencies in Monterey County, California in order to determine what factors have contributed to their success and how they might be applied in other situations. The author proposes that theories from multiple disciplines can provide insight into the likelihood and ability of organizations to cooperate. / Major, United States Army

As a primary method for analyzing data are used standard methods of financial analysis. The remedy solution is based on the combination of the results of the financial analysis and used in practice concept of change management above crisis conditions -- "V Concept". Thesis conclusion lies in discovering of insolvency of Technistone, a.s. company. The proposed solution mainly consists in the debt reorganization.

A reestruturação do setor elétrico brasileiro, iniciado em meados da década de 1990, deve ser vista dentro de uma perspectiva histórico-estrutural, envolvendo em uma mesma análise a privatização, a crise do setor elétrico e a garantia à cidadania. Para entender as reformas ocorridas no setor, é necessário evidenciar um pouco da trajetória histórica do setor, vocação hidrelétrica, as opções político-econômicas para a reestruturação em curso e as respostas dadas pelo governo à crise elétrica brasileira. O que se nota, a priori, é que a crise do setor elétrico foi deflagrada tanto por fatores estruturais, de ausência ou de baixos investimentos no setor durante a década de 1990, como pelo processo de privatização engendrado na mesma década. A privatização também foi acompanhada de baixa capacidade técnica das agências reguladoras em realmente regular e fiscalizar as novas concessionárias de energia elétrica, geração e distribuição. Tal deficiência é evidenciada pelos constantes aumentos tarifários. O objetivo desse trabalho é, portanto, estudar o modelo de privatização e regulamentação do setor elétrico, apontando suas limitações e conseqüências, sugerindo mudanças legais que prevejam dificuldades, mecanismos para melhor atuação das empresas e órgãos envolvidos, sugerindo condutas que possam impedir que a sociedade seja afetada por falta de planejamento adequado. / The reconstruction of the brazilian eletric sector, initiated in the 1990 decade, should be regarded within a historic-strutural view, involving, in an identical analysis, the eletric sector privatization and its crisis, and, additionally, the guarantee for citizenship. To understand the reforms occurred in the sector, is necessary to evidence some of the historical trajectory of the sector, the hydroelectric vocation, the political-economic choises to the current reconstrution, and the answers given by the government to the brazilian eletric crisis. What is noticied, is that the crisis in the eletric sector was deflagrated by structural factors, concerning to low investments the sector during the decade, as well as by privatization process, itself, engendred in the regularting agencies in actually ruling and supervising the new concessioners of eletric energy, including generation and distribution, obviously. The objective by this work is, hence, to study the model of privatization an regulamentation of eletric sector, indicating your limitations and results, suggesting legal changes that generate difficulties, mechanisms for the best performance of enterprises and envolved companies, suggesting conducts that to impede that the society to be affect by lack of adequate projection, utilizing all the juridical framework and internationals experiences in the same sector.

A presente dissertação de mestrado tem por escopo a análise do administrador judicial na recuperação judicial e na falência, de acordo com a Lei nº 11.101/05. Entre as grandes mudanças advindas com a introdução da citada lei, está a figura do administrador judicial, em substituição à do antigo comissário da concordata e do síndico na falência. Não obstante serem aplaudidas muitas das alterações já incorporadas há quase 10 (dez) anos, o regime jurídico do administrador judicial não é isento de problemas e lacunas, ainda não discutidos na sua totalidade pela doutrina e jurisprudência pátria. De fundamental importância o entendimento desta figura jurídica para que as demais inovações constantes da lei sejam aplicadas de forma completa e eficaz, atingindo-se, assim, seus fins primordiais. Para tanto, iniciamos com um breve estudo das soluções possíveis para as empresas em crise, com base na Lei nº 11.101/05, traçando os seus pontos mais significativos e que tenham relação com o tema proposto (capítulo 1). Apresentamos uma breve análise histórica da figura do agora denominado administrador judicial, com base na legislação e na doutrina brasileira (capítulo 2). O estudo prossegue analisando a natureza jurídica do administrador judicial. Serão analisados também os pressupostos legais, impedimentos e o critério discricionário do juízo para a sua nomeação, com a confrontação do direito comparado. Discorremos sobre os deveres e as atribuições do administrador judicial, instituídos pela Lei nº 11.101/05, tanto na recuperação judicial como na falência, inclusive para a hipótese de prosseguimento da atividade negocial na falência. Estudamos a responsabilidade do administrador judicial segundo a legislação e jurisprudência pátrias, especialmente nas esferas cível, penal e tributária. Também tratamos das hipóteses e respectivas consequências da substituição e destituição do administrador judicial, disciplinadas na Lei nº 11.101/05, e os critérios legais para a sua remuneração (capítulo 3). A dissertação termina com as considerações finais em relação ao estudo realizado (capítulo 4). / This masters degree thesis examines the role of the judicial administrator in reorganization (judicial recovery) and bankruptcy procedures, according to Law 11.101/05. Among the important changes brought by the enactment of this law is the figure of the judicial administrator, substituting the former trustee in moratorium (concordata) and bankruptcy procedures. Although it is acknowledged many improvements introduced by the new regime almost ten years ago, the role of the judicial administrator is not exempt from problems and gaps, which so far have not been fully discussed by the doctrine and jurisprudence. It is of fundamental importance to understand this legal figure for the other innovations contained in the law to be completely and effectively applied, to reach the main goals of the law. For this purpose, we start with a study of the possible solutions available to distressed companies, based on Law 11.101/05, tracing out its most significant points that are related to the theme (chapter 1). Then we present a brief historical analysis of the figure now called the judicial administrator, in light of Brazilian legislation and doctrine (chapter 2). The study continues with the analysis of the legal nature of the judicial administrator (chapter 3). In this chapter, we also analyze the legal prerequisites, impediments and discretionary criteria for appointing people to this position, in light of comparative law. We examine the duties and powers of judicial administrator, as established by Law 11.101/05, both in reorganization and bankruptcy, including the possibility of continuing the companys business activity during the bankruptcy process. Another aspect examined is the potential liability of the judicial administrator according to the nations legislation and jurisprudence, especially in the civil, criminal and tax areas. We also cover the situations and respective consequences of the replacement and removal of the judicial trustee in accordance with Law 11.101/05, and the legal criteria for his remuneration (chapter 3). The dissertation concludes with final remarks regarding the study (chapter 4).

The choice fell on Mälardalen University due to its accessibility and significant size. By interpreting the empirical material, the underlying causes will be brought to the surface. The result will aim to explain how a change process might occur in a large organization and how internal and external influences were reflected in the strategic path.</p><p>Method:</p><p>The empirical data collected for this thesis was obtained through qualitative semi-structured interviews with organizational members on a managerial level. One focal organization was used for a case study. The theoretical framework had a knowledge base, based on some theories by Henry Mintzberg. After the collection of primary data additional theories were added.</p><p>Results:</p><p>The reorganization at Mälardalen University was an emergent process where the solutions and impacts were altered and adjusted along the way. In this reorganization the process has been evolving and progressing within a frame created by a few predetermined desires and plans. It also became evident that strategy for Mälardalen University is a way to achieve a position where they can benefit from their competitive advantages. The position is the goal and the way in which to get there is not as important. This has opened up the process to be as emerging as it has been. This emergent process has been allowed to progress in changing directions where decisions are taken as the solutions are found, muddling their way through the process.</p>

Sie ist in sechs Themenbereiche gegliedert: Land- und Forstwirtschaft, Natur- und Umweltschutz, Hochwasserschutz, Infrastrukturmaßnahmen, Bodenordnung und Bodenmanagement sowie Minderung von Bergbaufolgen. Plasticity and Macular Degeneration: the Reorganization of Adult Cortical Topography

This study evaluated whether cortical reorganization occurs in response to macular degeneration (MD), a progressive disorder of the retina that results in central vision loss. Past research has observed the ability of V1 to adapt to retinal damage, demonstrating that deafferented cortex is activated by the stimulation of intact retinal areas. It is still unclear, however, if and to what degree cortical reorganization is associated with specific forms of macular degeneration. This study evaluated the retinal health of MD participants (both age-related and juvenile) as well age-matched controls with computerized microperimetry. Contrast-reversing stimuli were then presented to different parts of the visual field while participants were scanned with functional magnetic resonance imaging (fMRI). For MD participants, stimulation of peripheral retinal areas elicited activation in deafferented cortex. This activation occurred for retinal areas adapted for eccentric viewing (preferred retinal locations), but not in preserved retina at the same eccentricity. These findings add to the scientific knowledge of plasticity in sensory systems by supporting an experience driven understanding of cortical reorganization. They could also have a meaningful impact on how macular degeneration is treated by informing the design of therapeutic training regimes.

Įvairios ekonominės ir kitokios priežastys lemia didėjančias verslo koncentracijos pasaulines tendencijas. Viena iš priemonių verslui koncentruoti yra bendrovių reorganizavimas jungimo būdu. Reorganizavime dalyvaujančių arba reorganizuotų bendrovių turtas, teisės ir pareigos pereina po reorganizavimo veiklą tęsiančiai bendrovei, o kitos bendrovės automatiškai pasibaigia be likvidavimo. Bendrovių reorganizavimas yra sudėtinga ir ilgai trunkanti procedūra, susijusi su akcininkų, kreditorių, darbuotojų bei kitų asmenų interesais. Europos Sąjungoje pirmiausia buvo harmonizuoti valstybių narių nacionaliniai teisės aktai, reglamentuojantys vietinius bendrovių jungimus reorganizavimo būdu. Vėliau, išsprendus nacionalinių teisės skirtumų sąlygotas problemas, buvo priimti svarbūs teisės aktai, atveriantys kelią peržengiančių vienos valstybės ribas bendrovių jungimųsi galimybėms. Siekiant padidinti Europos Sąjungoje veikiančių bendrovių konkurencingumą, inicijuoti teisės aktų pakeitimai, kurie supaprastina reorganizavimo jungimo būdu procedūrą ir taip leidžia sumažinti bendrovėms tenkančią administracinių kaštų naštą. Kita vertus, svarbu įvertinti, kaip tokie pakeitimai daro įtaką akcininkų bei kitų susijusių asmenų teisėtiems interesams. Reorganizavimo metu taikomos taisyklės turi užtikrinti pakankamą šių asmenų teisių apsaugą, tačiau per griežti reikalavimai gali lemti, kad bendrovės vietoj reorganizavimo pasirinks kitą, labiau palankų jungimosi būdą. / Global tendencies of increasing business concentration are influenced by various economical and other reasons. One of the ways to concentrate business is a corporate reorganization through merger. All assets, rights and liabilities of merged companies are transfered to surviving company after reorganization, whereas other companies automatically cease to exist without liquidation. Corporate reorganization is a complex and long procedure involving interests of shareholders, creditors, workers and other persons. Firstly, national legislation of member states, governing local reorganization through merger of companies, had been harmonized in European Union. Later, after issues concerning the differences of national legislation were solved, important legal acts were enacted, which made possible cross-border mergers of companies. In order to increase the competitiveness of companies operating in European Union, some amendments were initiated to simplify the corporate reorganization through merger procedure and thus reduce the administrative costs for companies. However, it is important to evaluate the impact of such amendments for legitimate interests of shareholders and other concerned persons. The rules which apply in merger procedure should provide enough safeguards to protect the rights of these persons, although too strict requirements can lead to situations, where companies would rather choose other more favourable ways to merge.

The research study looks at the financial sector of Zimbabwe as it responded to the challenges posed by the trade liberalisation, which had been embraced by the government of Zimbabwe. In mis effort, particular focus was made to one of the financial institution in Zimbabwe, Zimbank (The Zimbabwe Banking Corporation) which found itself having to craft and implement a turnaround programme in order to adapt to me new environment The study looks at the challenges it experienced and the impact mis had on its stakeholders, particularly die customer. The liberalisation of the financial services sector in Zimbabwe brought about a new period which saw a lot of barriers of entry being removed. This resulted in the formation of new banks and increased the level of competition in that sector. A two pronged approach was adopted to the research (desk and field research) to gamer data on the effects of die turnaround programme. The data collected and analysed revealed that me turnaround programme saw me bank (Zimbank) surviving the competition as it came up with innovative products mat added convenience to its customers. A clear link was established between die turnaround programme and the provision of better services to the customers. However, it was also established mat the bank still has to do a lot to keep its customers aware of the strategic moves being taken by it When die turnaround programme was adopted, its customers were not so much aware of what was happening.
