Social Partners’ Responses to Employment of Migrant Workers in the course of the ‘Lisbon Strategy’ and the ‘Europe 2020’ : Has there been any change in the social partners’ responses from the Lisbon to the EU2020? The case studies in Sweden, the UK and at European level

The research is aimed at investigating how the common EU social and economic strategies, namely the 'Lisbon strategy' and the 'EU 2020', have been influential as a 'EU incentive' in European social partners having drawn the matter of employment of migrant workers both at Member state level and at European level by looking into their respective changes in responses towards the matter in the course of the two strategies. The research has found that there have been changes made in the European social partners' responses regarding the problematic matter of migrant workers' employment, namely precarious working conditions and lower employment rates than native workers, at all levels. To be specific, the trade unions have begun to emphasize more proactive protection of migrants at workplace than before. However, there is little evidence that it was the result of either the Lisbon or the EU2020. It was rather much more because of the evolving European economic market circumstance that has been getting liberalized more actively as the single market goes on, featured by the problematic side of the increase of posted workers and agency workers. Especially, the research is also aimed at shedding a light on how the Lisbon and the EU2020 have been articulated in the two different economic, social and employment models, namely the Nordic model and the Western model by investigating the Swedish case and the UK case in the study of Member state level social partners.

The relevance and effectiveness of Nedlac as a social dialogue Forum : the Marikana crisis

Far from signalling the end of social dialogue, the Marikana massacre underscores the importance of refining and adapting existing peak-level negotiating fora such as the National Economic, Development and Labour Council (Nedlac). To ensure social dialogue remains an integral component of the South African policy-making and national decision-making system, social partners rely on a system of consultation and dialogue to build on a shared national vision. Dialogue is accepted as a means of consolidating a young, democratic but deeply divided South African society. It’s also a medium through which to enhance participation in policy formulation and decision-making. The study reaffirms the critical role that social dialogue plays in a developing economy such as South Africa using the case study of the Marikana massacre to illustrate this point. However, through an analysis of official documents and media reports, as well as selected interviews, the study highlights that the effectiveness of social dialogue through a statutory structure such as Nedlac, is at risk of collapse due to the low levels of commitment of the social partners involved in the Council’s processes. The enhanced maturity of collective bargaining in creating a platform for engagement between labour and business is also emphasised through the outcomes of the research. EU:s hot mot den Svenska modellen

Den Svenska modellen har gått från en omfattande lagregleringsreform på 70-talet, till ett stadigt tillstånd där bland annat rättigheter så som förenings- och förhandlingsrätt, rätten till information samt fredsplikt skyddas genom kollektivavtal. Sveriges medlemskap i Europeiska unionen innebär att staten har överfört beslutsmakt till unionen och dess institutioner, vilket gör att unionen har en överstatlig karaktär där unionsrätten går före nationell rätt vid en konfliktsituation. Genom Sveriges medlemskap i Europeiska unionen har den Svenska modellen och framför allt kollektivavtalens ställning fått en annan betydelse. En av orsaken till detta att de svenska kollektivavtalen inte uppfyller unionens krav vid implementering av direktiv, då direktiven skall omfatta alla arbetstagare och arbetsgivare. Kollektivavtalen i Sverige binder endast de parter som avtalet är slutet mellan. Då kollektivavtalen inte kan användas som ett implementeringsinstrument måste Sverige implementera direktiv från unionen genom lagstiftning, som då inbegriper alla parter på arbetsmarknaden. Det medför en ökad lagstiftningsprocess, som innebär att beslutsbefogenheterna tas från arbetsmarknadsparterna och ges till staten. Inom många länder i Europa används så kallade allmängiltiga kollektivavtal. Dessa kollektivavtal förklaras allmängiltiga av en myndighet i berört land, och inbegriper alla på arbetsmarknaden inom exempelvis en region. Denna typ av kollektivavtal återfinns inte Sverige. Det är dock en av mina slutsatser i denna uppsats, att använda sig av allmängiltiga kollektivavtal i Sverige skulle kunna innebära en upprätthållning av den Svenska modellen och kollektivavtalens status.

Is Flexicurity Suitable For Turkish Labour Market Or Not?

Standard employment definitions have begun to change with the impact of globalization and new concepts such as part-time work, freelance, on-call work, temporary work, fixed-term labour contracts have started to be demanded in the labour market. These new definitions which were determined in order to keep pace with new competitive market environment paved the way of new trends in various countries. Flexicurity is one of these trends which is mostly favoured in European Union agenda. The purpose of this thesis is to study whether flexicurity is suitable for Turkish labour market or not while analyzing structure of it as well as Turkish labour market legislations with perceptions of social partners on flexicurity, which has been started to be argued with the accession process of Turkey to the European Union. The thesis observes that there is no homogenous system of flexicurity for European welfare states and if Turkey is analyzed in this framework it takes place in the Mediterranean Welfare Systems of flexicurity paradigm. Some policy recommendations necessary to make flexicurity suitable for Turkish labour market are also given in order to contribute to the conclusion part.

Social partners and momentary affect in the oldest-old: The presence of others benefits affect depending on who we are and who we are with.

yes / Links between social relationships and emotional well-being in old age are well documented, but little is known about daily life fluctuations in momentary affective experiences of the oldest-old while interacting with specific social partners. We examined associations between the presence of different types of social partners and moment-to-moment fluctuations in affect in the oldest-old, taking into account individual differences in gender, neuroticism, depressive symptoms, chronic health conditions, and loneliness. Participants (N = 74, M age = 88.7 years, range = 84–102 years, 68% women) provided self-reports concurrently on the presence of social partners and subjective affective states 6 times a day for each of 7 consecutive days (3,071 occasions, in total). Relative to being with other people, time spent alone was associated with lower positive affect in the oldest-old. Being with other family members and friends was associated with more positive affective experiences. Compared with men, women reported more negative affective experiences when they were with their spouses than when their spouses were not present. Individuals with more chronic health problems reported more negative affective experiences when they were with their spouses than not. Participants higher in neuroticism reported more positive affective experiences when they were with their friends, compared with times when their friends were not present. Finally, lonelier individuals reported more positive affective experiences when they were with their spouses than when they were not. These findings suggest that affective experience is a function of individual differences and the type of social partners oldest-old adults interact with in everyday life. We discuss how our findings can be generalized to oldest-olds of different marital statuses, taking into account the proportion of widows in our sample as well as measurement specifics.

Negli ultimi decenni, l’affermazione del paradigma della società della conoscenza e le recenti politiche di sostegno all’apprendimento lungo tutto l’arco della vita, hanno evidenziato la questione dello skillmismatching tra competenze formate e fabbisogni professionali espressi dal mercato del lavoro. La finalità della ricerca è stata quella di ricostruire il frame culturale, valoriale e normativo entro cui si colloca l’emergenza del fabbisogno formativo dei lavoratori e di tracciare il percorso storico-evolutivo dell’analisi dei fabbisogni formativi (aff) come strumento, come costrutto e come pratica. L’indagine empirica, di tipo qualitativo, ha coinvolto i vari stakeholders che concorrono a definire, direttamente e indirettamente, la dinamica della domanda/offerta di formazione continua e delle politiche formative a sostegno dell’occupazione. Oltre alla ricerca sul campo, il lavoro di ricerca ha prodotto una mappa delle pratiche di analisi dei fabbisogni formativi condotte nell’ultimo decennio (nazionali ed internazionali), una rassegna metodologica delle tecniche di analisi dei fabbisogni formativi e quattro studi di caso sulle pratiche di analisi dei fabbisogni formativi come strumento di policy (Stati Uniti, Canada, Europa, Italia). / In recent decades the success of the paradigm of the knowledge society and the recent policies of support for lifelong learning highlighted the question of skillmismatching between skills and vocational needs expressed by the labor market and also the value of human capital for competitive advantage of the whole society. The aims of the research was to reconstruct the frame of culture, values and normative into which fits the emergency of training trying to trace the historical-evolutionary of training needs analysis (Tna) as a tool, as a constructs and as a practice. The empirical research was qualitative and considered various stakeholders wich to help define, directly and indirectly, the dynamics of supply/demand of continuing training of workers and training policies to support employment. Are trade unions winners or losers in EU policymaking? : A study of ETUC’s and BusinessEurope’s relative influence in the EU consultation of social partners under article 154 TFEU

This thesis investigated the influence imbalance between worker’s and employer’s interest in the EU policymaking. It is assumed that worker’s interests are disadvantaged, and this study is therefore examining the consultation of social partners under article 154 TFEU that considers social policy and can be used as a most-likely case for worker’s influence.The study is conducted by identifying conflicts between ETUC and BusinessEurope in their consultation replies and compare the different opinions with the Commission’s legislative proposal to find out which organisation that succeeded in influencing the Commission within each conflict.The results from this shows that each consultation generated between 0 to 6 conflicts and that most of the conflicts were won by BusinessEurope. This strengthens the assumption that there is an influence imbalance in EU legislation that makes the employer’s organisation BusinessEurope more influential than the trade unions ETUC.

En transférant aux pouvoirs publics la capacité de décider l'emploi de la Participation des employeurs à l'effort de construction (PEEC), la loi de mobilisation pour le logement et la lutte contre l'exclusion du 25 mars 2009 a transformé en profondeur l'organisation du 1 % logement. L'objet de la recherche est de mettre en lumière les facteurs à l'origine d'une telle inflexion. Pour cela, l'analyse s'efforce d'explorer le passé de l'institution afin d'en extraire les éléments à même d'éclairer cet épisode récent. Elle montre que les mécanismes à l'origine de la transformation du 1 % logement – processus ancien et graduel dont la réforme de 2009 constitue la dernière manifestation en date – alimentent deux dynamiques qui influent historiquement sur la forme du gouvernement et la production des règles relatives à l'emploi des fonds du 1 % logement. La dégradation de la légitimité de l'institution, conséquence de l'impuissance des syndicats à développer une capacité de représentation dans le secteur du logement, entraîne une remise en cause de la présence des acteurs paritaires à la tête de l'institution. L'émergence au sein de l'Etat d'une volonté de reprendre en main le dispositif, effet indirect du tournant opéré pendant les années 1980 dans la conduite de l'action publique, se traduit par le transfert sur le 1 % logement d'une part croissante du coût de la politique du logement en substitution au budget de l'Etat. Les accords collectifs de groupe / The group agreements

D’abord cantonnés au secteur industriel, les groupes de sociétés se sont progressivement développés dans l’ensemble des secteurs d’activités et sont devenus en quelques années des acteurs incontournables de la vie économique et sociale. Le regroupement d’entreprises sous la domination d’une société-mère s’est accompagné d’une recherche d’unité dans les modes de gestion et les statuts sociaux déployés dans chaque entreprise les composant. C’est dans ce contexte que s’est développée la négociation d’accords de groupe. De simple expérimentation issue de la pratique, la négociation collective de groupe est devenue un véritable niveau de négociation collective reconnue par le législateur. L’accord de groupe est désormais consacré comme une norme créatrice de droits et d’obligations entre employeurs et salariés du groupe, mais sa place dans la hiérarchie des normes n’a pas été précisée. Cette situation génère de nombreuses interrogations quant à sa portée et à ses limites : chaque apport du législateur à la construction du régime juridique des accords de groupe soulève de nouvelles difficultés avec lesquelles les partenaires sociaux doivent composer. La présente étude tentera de mettre en évidence les solutions proposées par les partenaires sociaux pour affiner et sécuriser le régime juridique applicable aux accords de groupe. / Originally confined to the industrial sector, corporate groups have gradually developed in all sectors and have become in just a few years key players in economic and social life. The business combination under supervision of parent company was accompanied by a search for unity in management methods and employees’ status. The negotiation of group agreements has developed in this context. Simple hands-on experience at the beginning, group collective bargaining has become a real level of collective bargaining recognized by the legislator. The group agreement is now set out as a standard which establishing rights and obligations between employers and employees of the group, but its place in the hierarchy of norms has not been specified. This situation generates many questions about its scope and its limits: each legislator’s contribution to the group agreements’ legal regime raises new difficulties that the social partners have to deal with. This study will attempt to identify the solutions proposed by the social partners in order to refine and secure the group agreements’ legal regime.
