This legal study approaches the problems of legal entity’s participant’s civil liability under the legal entity’s obligation. In the first part of this work a historical evolution of a legal entity and its participant is being revealed, author introduces to the variety of the theoretical doctrines of a legal entity, a conception and main features of legal entity are presented. Hereafter, a conception of a juridical person’s participant is analyzed, also the peculiarities of the participant’s legal status is passed in review in light of the limited and unlimited liability. This study also presents general conditions upon which the liability of legal person’s participant may arose. Thereinafter the problematical aspects of the limited liability juridical person’s participant liability under the juridical persons’ obligation are being discussed, attention is paid to the advantages and drawbacks of the limited liability and also to the doctrine of piercing the corporate veil in Lithuanian and foreign jurisprudence and judiciary practice. This work also reveals the positive and negative features of unlimited liability in the context of social and economical life, brings up problems concerning unlimited liability legal entity’s participant liability under legal entity’s obligation in exaction, insolvency and liquidation procedures. Finally, conclusions and suggestions to the legislator and judicial bench are being brought up.

This scientific research has been made on the regulation of similar institute to material liability of the employees in the national law of five old European Union member states (Belgium, United Kingdom, France, Sweden and Germany), comparing it to the regulation of material liability of the employees in Lithuania. It is very important as this is one of first more detailed researches in Lithuania made on this issue. The similarities and the differences of the regulation are being pointed out through the analysis of the main questions of material liability of the employees such as conception, sources of law, applying conditions, limitation of the liability, and the cases when unlimited liability of the employees is being applied.

This thesis details the hydrodynamic research conducted at Delta Marsh as part of the Restoring the Tradition marsh rehabilitation project. Research has indicated that the hydraulic and hydrologic controls on the marsh can have considerable impacts on its ecological function, but the impacts of these controls had not previously been studied. Field hydrography and two-dimensional numerical modelling (using MIKE 21) provided insight into many aspects of the physical behaviour of Delta Marsh. Eighty five percent of the inflow to Delta Marsh from Lake Manitoba passes through Clandeboye Channel, and these discharge signals propagate as far west as Cadham Bay. Inflow to the marsh disperses quickly, and accounts for a small fraction of the water that exits the marsh during subsequent outflow. Thus, Portage Diversion water that enters the marsh through the lake can remain there even if there is a net loss in marsh volume over the season. Wind friction across Lake Manitoba has the greatest impact on short-term fluctuations in marsh volume and on the composition of marsh water, followed by the Portage Diversion and the natural inflows to Lake Manitoba. Expansions to flood diversion infrastructure will considerably impact the composition of Delta Marsh waters. Three methods of wetland discharge estimation were developed and tested. The most promising method was the regressed slope Manning method (RSMM), which estimates two-directional channel discharge as a function of the water surface elevations at both ends of a channel. When used in conjunction with the velocity index method, the RSMM can multiply the amount of reliable discharge data collected per research dollar. Thanks to its simple formulation, the RSMM is likely applicable outside of wetland settings, as well. / February 2016

Existen necesidades en las personas, relacionados por un lado a proteger sus portátiles de la mejor manera mientras se trasladan de un lugar a otro, y, por otro lado, la posibilidad de alimentar de energía a sus portátiles en cualquier lugar. Del mismo modo, está identificada la necesidad para cada persona de contribuir con la preservación del medio ambiente dejando de usar o reemplazando muchos productos cotidianos contaminantes por otros con menor o nulo grado de contaminación. Con el presente proyecto se ha logrado conocer las frustraciones que se tiene al no poder tener un producto que satisficiera las necesidades antes señaladas a través del uso del método de exploración y la técnica del periodista; lo que dio como resultado un manifiesto interés por adquirir un producto con las características de Loadtop, es así, que hemos decidido perseverar en nuestra propuesta de valor y en la forma en cómo brindamos el producto. / There are needs in people, related, on the one hand, to protecting their laptops in the best way while they move from one place to another, and, on the other hand, the possibility of supplying power to their laptops anywhere. In the same way, the need for each person to contribute to the preservation of the environment is identified by ceasing to use or replacing many polluting everyday products with others with less or no degree of contamination. With this project it has been possible to know the frustrations that one has when not being able to have a product that meets the needs mentioned above through the use of the exploration method and the journalist's technique; which resulted in a clear interest in acquiring a product with the characteristics of Loadtop, it is thus, that we have decided to persevere in our value proposition and in the way in which we provide the product. / Trabajo de investigación

Inspiré par la réflexion quant aux nouvelles formes d’organisation du travail de la nouvelle économie, ce mémoire s’intéresse à la question des heures supplémentaires non formellement rémunérées chez une frange de travailleurs hautement qualifiés, les concepteurs de jeux vidéo. Très innovantes pour les employeurs, ces formes d’organisation, en particulier l’organisation par projets, ne sont pas sans poser des problèmes aux travailleurs. À l’instar des travailleurs du savoir qui sont souvent prêts à investir de longues heures au travail, les concepteurs de jeux vidéo travaillent fréquemment en heures supplémentaires. Or ces heures supplémentaires sont non seulement non rémunérées, mais elles sont aussi longues et fréquentes. Comment en vient-on à faire accepter aux concepteurs cette situation, sans toutefois exiger d’eux qu’ils travaillent en heures supplémentaires? Pour explorer cette question, les discours de 53 concepteurs de jeux vidéo montréalais ont été analysés. Les résultats de cette recherche dévoilent une explication basée sur un système informel de récompenses et de châtiments qui induit chez la majorité des concepteurs de jeux interrogés une propension à travailler en heures supplémentaires non rémunérées. / Inspired by the reflection made on the new forms of work organization system brought by the new economy, this M. Sc. Thesis is interested in unlimited overtime informally compensated for, among a highly skilled group of workers: video game developers. Innovative from employer’s standpoint, these types of organization system, in particular the project-based system does generate problems for the workers. Like the knowledge workers who are willing to invest long hours of work, the video game developers frequently work overtime. Not only is this overtime unpaid, but also it is long and frequent. How does management come to make the developers consent to such a demand, without requiring them to work overtime? To explore this question, we analyzed the interviews done with 53 designers from the Montreal’s video game industry. Indeed, interviews revealed that a majority of game developers make unlimited unpaid overtime on a regular basis. The results of this research offer an explanation based on an informal system of rewards and punishments.

We aim to demonstrate that there is a story behind a set of apparently unrelated stories and that what bundles these stories is not only the symbolic description or records of an important period of the history of Brazil, but also, despite its incipient literary load, the path a man must necessarily follow in order to accomplish his journey under the absurdity of the world. When we think about writing and surviving in Cartas da prisão [Letters from prison], by Frei Betto, we try to identify, in this tug-­‐of-­‐war, in what measure would there be a movement of dynamic balance of the origin of the author in the denial of death. For the high degree of subjectivity we aim for here, Roland Barthes' concept of Neutral has proved to be an efficient methodology, having provided us with the attribute of the impasse and, therefore, the right to news paths, the access to surprising answers and, above all, a sparkling creative-­‐critical-­‐aesthetic experience, to use an expression of Barthes himself. The lucidity that ties Sisyphus to his destiny under the huge rock of his condemnation or Camus to his human rebellion in face of the race condemnation is of the same order of the one that connects Betto to literature and which represents his only real possibility of achieving true freedom: through consciousness / A presente dissertação representa a busca por uma narrativa. O que propomos demonstrar aqui é que há uma história por detrás de um conjunto de histórias aparentemente desconexas. E que o feixe dessas histórias não se refere unicamente à descrição simbólica ou ao registro de um importante período histórico brasileiro, mas, também, a despeito de sua incipiente carga literária, à trajetória que obrigatoriamente um homem deve traçar em sua travessia sobre o absurdo do mundo. Quando imaginamos escrita e sobrevivência em Cartas da prisão, de Frei Betto, procuramos identificar em que medida se dava, nesse jogo de forças, o movimento de equilíbrio dinâmico da origem do autor na negação da morte. Pelo alto grau de subjetividade da proposta, o conceito de Neutro, de Roland Barthes, mostrou-­‐se metodologia efetiva, pois que nos forneceu o atributo do impasse e, em consequência disso, o direito a novos caminhos, o acesso a respostas surpreendentes e, sobretudo, a experiência estético-­‐crítico-­‐criativa cintilante , para aplicar a expressão do próprio Barthes.
