The impact of 9/11 on the South African anti-terrorism legislation and the constitutionality thereof.

This paper aimed at analysing what was South Africa's response to its international obligations regarding the 9/11 events and how does such response comply with the country's constitutional framework. This study gave a brief outline of the most significant legislative changes in a number of countries and then concentrate on the South African anti-terrorism legislation. It identified the provisions of the Act that have been discussed most controversial throughout the drafting process and analysed whether they comply with constitutional standards. Particular emphasis was laid on the possible differences between the South African Act and comparative legislation that derive directly from the apartheid history of the country.

L'éloignement des étrangers dans la jurisprudence de la Cour européenne des droits de l'homme / The removal of foreigners in the jurisprudence of the European court of human rights

L’objectif de ce travail est de traiter la problématique de l’éloignement des étrangers sous l’angle des droits de l’homme en Europe. En effet, la Convention européenne des droits de l’homme permet de limiter le droit des Etats d’expulser, d’extrader, ou de reconduire à la frontière les étrangers. La Cour européenne des droits de l’homme exige que toute mesure d’éloignement prise à l’encontre de l’étranger respecte les droits fondamentaux énumérés dans la Convention européenne des droits de l’homme. Ces exigences découlent de l’interprétation dynamique et évolutive des articles de ce texte, offrant une protection aux étrangers contre tout renvoi vers des destinations où ils risquent de subir des mauvais traitements. De même, l’expulsion des étrangers délinquants ayant des liens d’attachements dans l’Etat d’accueil peut constituer une violation de leur droit à une vie privée et familiale. Le juge européen octroie également des garanties procédurales aux mineurs étrangers et aux demandeurs d’asile en leur maintenant le droit à un recours effectif. Toutefois, le juge européen limite l’application de certains articles quand la mesure d’éloignement est nécessaire pour la sauvegarde de l’ordre public et la sécurité nationale. A ce titre, le juge refuse d’appliquer le droit à un procès équitable en cas d’extradition ou d’interdiction de territoires, en particulier à ceux suspectés de terrorisme. Afin de réconcilier l’intérêt des Etats et la protection les droits fondamentaux de l’étranger frappé par une mesure d’éloignement, les juges de la Cour européenne des droits de l’homme examinent ce contentieux au cas par cas. En somme, les solutions européennes permettent de modifier le statut interne de l’étranger en situation d’éloignement et de combler les défaillances du droit international en la matière. / The objective of this study is to address the issue of removal of foreigners from the human rights perspective in Europe. Indeed, the European Convention on Human Rights limits the right of member States to expulse, extradite or deport foreigners. The European Court of Human Rights requires that any order of removal against a foreigner must respect the fundamental rights enshrined in the European Convention on Human Rights. This requirement stems from the dynamic and evolving interpretation of the articles of the Convention, which provide protection against the sending of foreigners towards destinations where they risk being subjected to ill- treatment. Likewise, the removal of unlawful non-citizens with strong bonding ties in the host Member State may constitute a violation of their right to a private and family life. There are also procedural protection such as the right to an effective remedy, granted by the European Court to foreign minors and asylum seekers. However, the European Court limits the application of certain articles of the Convention when removal is necessary in order to maintain public and national security. As such, the judge refuses to recognize the right to a fair trial for those extradited or banned from entering a member State if suspected terrorism. In order to strike balance between the interests of States and the protection of fundamental rights of foreigners affected by a removal order, the judges of the European Court of Human Rights examine the situation case by case. In summary, the European approach enables the transformation of the internal status of foreigners subject to removal, and thus corrects the deficiencies of international law in the matter.

A Ação Democrática Mato-Grossense (ADEMAT) no sul de Mato Grosso : da ação política à articulação paramilitar (1963-1985)

A Ação Democrática Mato-Grossense (ADEMAT) foi uma subsidiária do Instituto Brasileiro de Ação Democrática (IBAD) fundada em 1963 na cidade de Campo Grande (MT) e posteriormente em outros doze municípios deste estado. Entre seus anos de funcionamento dispôs de um quadro de sessenta e duas pessoas apenas nas cidades de Campo Grande e Cuiabá. No ano de sua fundação publicava uma coluna semanal no jornal O Matogrossense em Campo Grande, de caráter anticomunista, tendo veiculado vinte e uma edições. Após o golpe de 1964 realizou atividades repressivas constituindo-se em um grupo de ação paramilitar. O objetivo desta dissertação é analisar as práticas discursivas e repressivas da ADEMAT entre os anos de 1963 e 1985. Desse modo, é explorado quem foram os integrantes dessa organização, como se deu sua ação discursiva através da utilização da imprensa campo-grandense, quais redes de vínculos existiam entre seus membros e outras organizações, como a Associação dos Criadores do Sul de Mato Grosso (ACSMT) e a Associação Comercial e Industrial de Campo Grande (ACICG). Nos anos posteriores ao golpe analisa-se que tipo de atividades foram exercidas pela ADEMAT: sua atuação no fornecimento de informações ao comando da 9ª Região Militar, a perseguição política aos adversários e sua participação na indicação de cargos públicos vinculados ao aparelho repressivo. Para tanto foram utilizadas fontes periódicas, entrevistas, biografias e documentos do Serviço Nacional de Informações (SNI). / The Ação Democrática Mato-Grossense (ADEMAT) was a subsidiary of Instituto Brasileiro de Ação Democrática (IBAD) founded in 1963 in the city of Campo Grande (MT) and posteriorly in other twelve towns of this state. During its operation years, it disposed of a board of around sixty-two people only in the cities of Campo Grande and Cuiabá. In the year of later foundation, it used to publish a weekly column on the newspaper O Matogrossense in Campo Grande anti-communist, having conveyed twenty-one editions. After the 1964 coup, it practiced repressive activities constituting itself in a paramilitary action group. The objective of this dissertation is to analyze both discursive and repressive practices of ADEMAT between 1963 and 1985. That way, it is explored who were the members of this organization, how was its discursive action through the using of the campo-grandense press, what networks linking existed among its members and other organizations, like The Associação dos Criadores do Sul of Mato Grosso (ACSMT) and the Associação Comercial e Industrial of Campo Grande (ACICG). In the posterior years of the coup, it is analyzed which kind of activities were exercised by ADEMAT: like acting on the information supply for the command of the 9th Military Region, the political persecution towards the opponents and its participation on the indication of public posts linked to the repressive apparatus. For this purpose, are used periodic sources, interviews, biographies and documents of the National Service of Information (SNI).

For in such a way, the proposal was developed from the analysis of the systems of protection and monitoring of the Amazonian (SIPAM/SIVAM), where we search to inquire as these systems have contributed for the definition and implantation of these politics. For the Amazonian, with its natural wealth, threats and vulnerabilities, the perspectives of integration, security and national defense and of sustainable development constitute great challenges to be faced, where the efficient use of the technology is a basic reference that must be incorporated in the strategies and public politics in these areas. One is about a strategical project, conceived with vision of future, protection and development of the . The objective SIPAM/SIVAM the defense and the guarantee of the Brazilian sovereignty in the Legal Amazonian, beyond the systematization and accomplishment of the governmental actions in the region, by means of the intensive use of technological apparatus. In turn, they reflect the priority that the Amazon region has in terms of defense and security for the Country, and symbolize the strategy of the State to protect it. The SIPAM/SIVAM if finds in a boarding line in which the guarantee of the national sovereignty also involves the care with the development of the local population, inside of a proposal educative and integrator. Like conclusion we affirm that of the SIPAM/SIVAM creates a new paradigm for the public administration, where the organizations work with a shared set of information, beyond starting to act of integrated form. Thus, when searching permanently the rationalization of efforts and resources, trying an unknown form of institution relationship where infrastructure and products are shared, the SIPAM/SIVAM creates a new premise for the Brazilian public administration and contributes to give a new direction to the development of the Amazonian. / O objetivo deste trabalho é o estudo das correlações existentes entre o uso estratégico da informação e a articulação e implementação de políticas de defesa e segurança nacional na Amazônia Legal. Para tanto, a proposta foi desenvolvida a partir da análise dos sistemas de proteção e de vigilância da Amazônia para a definição e implantação dessas políticas. Para a Amazônia, com suas riquezas naturais, ameaças e vulnerabilidades, as perspectivas de integração, segurança e defesa nacional e de desenvolvimento sustentável constituem grandes desafios a serem enfrentados, em que o uso eficaz da tecnologia é uma referência básica que deve ser incorporada nas estratégias e políticas públicas nessas áreas. Trata-se de um projeto estratégico, concebido com visão de futuro, de proteção e desenvolvimento da Amazônia Legal, uma área vital para o País. O SIPAM/SIVAM objetiva a defesa e a garantia da soberania brasileira na Amazônia Legal, além da sistematização e efetivação das ações governamentais na região, por meio do uso intensivo de aparato tecnológico. Por sua vez, refletem a prioridade que a região amazônica tem em termos de defesa e segurança para o País, e simbolizam a estratégia do Estado para protegê-la. O SIPAM/SIVAM se encontra em uma linha de abordagem na qual a garantia da soberania nacional na Amazônia, além do empreendimento estratégico-militar, envolve também o cuidado com o desenvolvimento da população local, dentro de uma proposta educativa e integradora. A guisa de conclusão afirmamos que o SIPAM/SIVAM cria um novo paradigma para a administração pública, em que as organizações trabalham com um conjunto compartilhado de informações, além de passar a agir de forma integrada. Assim, ao buscar permanentemente a racionalização de esforços e recursos, experimentando uma forma inédita de relacionamento interinstitucional em que infra-estrutura e produtos são compartilhados, o SIPAM/SIVAM cria uma nova premissa para a administração pública brasileira e contribui para dar uma nova direção ao desenvolvimento da Amazônia.
