This is qualitative research conducted in Provisional Detention Center Dr. Luis Cesar Lacerda de São Vicente, São Paulo, and ten prisoners as subjects and a health care professional who works in the prison unit. With detainees, the instrument used was a semi-structured interview and the professional, open interview with script. Data collection occurred during the months from July to December 2011. The results revealed that the profile of inmates does not differ from that found in other studies. Of the ten inmates, four are in the range of 20 to 30 and the remaining six between 31 and 40 years. The low education level was confirmed, as two did not complete primary school and eight complete elementary school. Regarding marital status, three singles and seven are married. Regarding the number of children, three prisoners have no son, four even has two sons, two of three to four children and only one inmate have five or more children. The color self-declared also confirmed, with browns and blacks add nine prisoners and one white. Seven inmates are from Baixada Santista and three from other cities in the state of São Paulo. Seven primary and three are repeat offenders, and still, eight and two regularly receive visits any visit. A professional is female, 50 years old and worked for nine years and six months in SAP, throughout this period in the town of São Vicente. The analysis of data was based on two main themes: life in prison and the inmate health care. The everyday prison is marked by idleness, power relationships and coping strategies. In health care the inmate was found that prisoners are assisted minimally, because there is a shortage of health professionals, such as doctors and nurses, and the distribution of drugs is only regulate when it comes to TB, HIV and mental illness. In other cases, there is delay in treatment and medication from the prison unit and are usually family members who bring drugs. With regard to food, this is general dissatisfaction, although it is an important component to maintaining health. The research sought to show a clip from the reality experienced by prisoners regarding health care in the town of São Vicente. / Compreender como se processam as relações na vida cotidiana do cárcere e avaliar a situação da atenção à saúde do detento no CDP de São Vicente/SP foi o principal objetivo desse estudo que teve como objetivos específicos conhecer as condições de vida dos detentos no CDP de São Vicente/SP; verificar como se detectam as doenças antes e durante o processo do encarceramento no CDP de São Vicente/SP; conhecer as ações desenvolvidas pelos profissionais de saúde e formas de tratamento das doenças dos detentos; Identificar quais as queixas dos detentos do CDP de São Vicente/SP em relação à atenção à saúde do detento. Trata-se de pesquisa qualitativa realizada no Centro de Detenção Provisória Dr. Luiz Cesar Lacerda de São Vicente, São Paulo, tendo como sujeitos dez presos e uma profissional da área da saúde que atua na unidade prisional. Com os detentos e com a profissional de saúde, o instrumento utilizado foi a entrevista semiestruturada. A coleta de dados ocorreu durante os meses de julho a dezembro de 2011. Os resultados revelaram que o perfil dos detentos não difere do encontrado em outros estudos. Dos dez detentos, quatro estão na faixa dos 20 aos 30 e os seis restantes entre 31 e 40 anos. A baixa escolaridade foi confirmada, pois dois não concluíram o ensino fundamental e oito completaram o ensino fundamental. Quanto ao estado civil, três são solteiros e sete casados. No que diz respeito ao número de filhos, três presos não tem filho, quatro tem até dois filhos, dois de três a quatro filhos e apenas um detento têm cinco ou mais filhos. A cor auto-declarada também se confirmou, sendo que pardos e negros somam nove presos e apenas um branco. Sete detentos são da Baixada Santista e três oriundos de outras cidades do Estado de São Paulo. Sete são reincidentes e três primários, e ainda, oito recebem visitas regularmente e dois nenhum tipo de visita. A profissional é do gênero feminino, 50 anos de idade e, trabalha há nove anos e seis meses na SAP, todo esse período no CDP de São Vicente. A análise dos dados se deu a partir de dois eixos temáticos: a vida no cárcere e atenção à saúde do detento. O cotidiano prisional é marcado pela ociosidade, relações de poder e estratégias de sobrevivência. Na atenção à saúde do detento foi constatado que os presos são minimamente assistidos, pois há falta de profissionais de saúde, como, médico e enfermeiro e, a distribuição de medicamentos só é regular quando se refere à Tuberculose, doenças mentais e HIV. Nos demais casos, há demora no atendimento e medicação por parte da unidade prisional e geralmente são os familiares que trazem os medicamentos. No tocante à alimentação, essa constitui insatisfação geral, embora seja um componente importante para a manutenção da saúde. A pesquisa buscou evidenciar um recorte da realidade vivida pelos presos quanto à atenção à saúde no CDP de São Vicente.

Despite the Swedish Prison and Probation Service (SPPS) are a pioneer on the global arena regarding the area of corrections, generally little is known of what they do in Sweden as well as internationally. This study will explore the SPPS implementation of prison development in Somalia, which will be done through interviews with seconded personnel and others within the Swedish government that have connections to the prison development in Somalia. The findings were able to answer the research questions for this thesis, namely what the SPPS are doing internationally, what they are doing in Somalia and lastly if they have seen any results in Somalia. In the analysis, the middle power theory was used through an abductive approach to see if the SPPS fulfilled the criterions for the theory namely moral power, multilateralism and conflict management. It is concluded that the SPPS work in Somalia have been effective. They have contributed considerably to the local development and the seconded personnel has also learnt lessons for life which they can use also in their further carriers. Through their contacts, which they have established, they might also contribute further bilaterally even in the event of a withdrawal from the United Nations.

La recherche porte sur la formation universitaire à distance adaptée à des personnes détenues, dispositif qui se situe à l’intersection de plusieurs domaines d’activités, universitaire et carcérale. Cette étude vise à analyser plusieurs étapes d’un processus d’innovation pédagogique. Une première consiste à appréhender le terrain de la prison dans une démarche ethnographique constituée de pratiques d’accès aux activités de cours. Une seconde est conduite de façon à épouser les spécificités sociales et pédagogiques d’un tel terrain. Une troisième analyse les méthodes et les procédures de distribution de la parole dans des interactions enseignant-étudiants. Le corpus a été constitué lors d’activités de cours en prison.Celles-ci ont été recueillies sous forme d’enregistrements sonores et visuels, eux-mêmes explorés à l’aide de l’analyse de conversation. Une quatrième porte sur une collection de propositions techno-pédagogiques développées tout au long de la démarche de terrain. Cette recherche propose une façon d’accéder aux activités sociales en prison. Elle ouvre un champ exploratoire quant à l’étude de l’interaction pédagogique en prison, sa portée sociale et pédagogique, qui va bien au-delà des murs de la prison. / The research focuses on distance learning adapted to prisoners. This activity is situated between two areas of activities, university and prison. The aim is to analyze a pedagogical innovation process, in various stages. The first stage use an ethnographic approach to understand prison fieldwork through classroom activities observations. A second stagematch pedagogicals and socials specificities of this field. A third stage considers methods and procedures of organization of talk in teachers-students interactions. The corpus has been constituted through classroom activities in prison and it relies on audio and video recordings, which are explored using Conversation Analysis and of technopedagogicals proposals throughout field approach. This study proposes an other way to access to social activities in prison. It opens on an exploratory field study of educational interaction in prison, social and educational reach beyond the prison enclosure.

Cette thèse a pour objet la mise en place d'ateliers de philosophie auprès élèves adultes incarcérés. Notre dispositif pédagogique initie des discussions philosophiques sur des dilemmes moraux. En prison, l'enseignement a pour objectif principal de préparer le détenu à la sortie et de lui permettre de comprendre le monde dans lequel il vit. C'est dans cette optique que s'inscrit notre travail de recherche. Notre question centrale est : Dans quelle mesure le recours à la discussion de dilemmes moraux entre adultes incarcérés peut-il participer à leur développement moral ? Notre première hypothèse porte sur la mobilisation de la dimension rationnelle dans le jugement, afin de favoriser l'accès des détenus à un stade de développement moral plus avancé qu'auparavant. La seconde hypothèse concerne la nécessaire prise en compte de la dimension émotionnelle et affective dans la formulation des jugements moraux, car elle interfère avec les approches rationnelles. Sur le plan méthodologique, nous recourons à une méthode qualitative, l'analyse de contenu. A partir de la retranscription des discussions sur les dilemmes moraux, nous procédons au codage des unités de sens des verbatim, en lien avec les valeurs orientant la théorie des stades de développement moral de Kohlberg. Ensuite, nous appliquons la méthode de l'analyse de contenu afin d'accéder à la compréhension fine des arguments des apprenants. Puis nous appréhendons, sur l'ensemble des discussions, le niveau de développement moral des détenus, et dressons leur profil d'éducabilité morale. Ce travail réflexif sur le dilemme vise l'éducabilité morale du sujet, en se fondant sur le postulat d'une éducabilité toujours possible. Les résultats de cette recherche, en évaluant le potentiel l'éducabilité morale des détenus, pourrait permettre de rendre une décision sur le plan judiciaire. Notre recherche montre également qu'il est impossible de rattacher certaines argumentations à la grille de Kohlberg.En effet, la théorie des niveaux de développement moral ne prend pas en compte la primauté des valeurs familiales, idéalisées chez les personnes détenues. Nous postulons donc l'existence d'un nouveau stade de développement moral, de niveau post conventionnel, qui pourrait être nommé «stade du respect inconditionnel des valeurs familiales». Il aurait, comme principe directeur, la préservation absolue des membres de sa famille / This thesis's subject is the setting up of philosophy workshops aimed at inmates serving some time in jail. Our educational project allows them to learn and exchange on philosophical topics related to moral dilemmas. In prison, the teacher's main role is to prepare the inmates for their release and teach them how to understand better the world in which they live. Our research founds its framework for this purpose. The issue raised in this particular work is «To what extent can the use of discussions on moral dilemmas between inmates take a part in their moral development and/or behaviour ?». Our first hypothesis deals with the mobilisation of the rational dimension in their own judgement, in order to give them the opportunity to develop and increase their previous state of moral behaviour. The second hypothesis takes into account the emotional and affective dimension as regard the wording of moral judgements, as it might alter the rational approaches. On the methodological aspect, we focus on the qualitative side that is to say on the content analysis. Starting from the transcript of the discussions on moral dilemmas, we proceed to the coding of the units of meaning of the verbatim, in connection with the values guiding the theory of the stages of moral development of Kohlberg. Then, we apply the content analysis method to reach the sharp understanding of the learners' arguments. At last, from the whole discussions, we grasp the level of the prisoners' moral development and draw their profile of moral educability. This reflexive work on the dilemma aims at the subject's moral educability, based on the premise of a still possible educability. The outcomes of this research, by assessing the potential of the moral educability of the detainees, could alter a decision making on the judicial level. Our research also shows that some arguments can't be related to Kohlberg's grid. Indeed, the theory of moral development levels does not take into account the presence of family values, idealized for detained people. We therefore postulate the existence of a new stage of moral development, of a postconventional level, which could be called "stage of unconditional respect for family values". It would have, as a guiding principle, the absolute preservation of one's family members

This thesis seeks to evaluate the compatibility of the legal and institutional policies about F-Type Prisons applied by Turkish State with the European and the United Nations Based Agreements and Conventions which stipulate certain standards for the penitentiary system in the high contracting party states. It tries to make two level analysis: On the one hand, the relevant Turkish codes and the institutional settings of the penitentiary system in Turkey, namely internal dynamics, are examined in order to chart the ground for the F-Type Prison reforms. On the other hand, the thesis attempts to depict the European and the United Nations based documents as well as the formal reports of the monitoring bodies of them about F-Type Prisons in Turkey.

A social capital perspective on prison theatre and change : a case study at the youth centre, Westville Correctional Facility, Durban.

This dissertation explores the effects of a Prison Theatre project conducted at the Youth Centre at Westville Correctional Centre in 2010. It explores the relationship between change and increased levels of Social Capital that staff and offenders attribute to the performances. The centre houses male offenders between the ages of 18 and 25. The project was of particular interest because it involved offenders, correctional staff and management. The plays were made using a problem-posing methodology that involved the audience in proposing solutions. These were documented and circulated to management, staff, and offenders. The plays addressed three topics. The first topic was chosen by the cast, and the other two topics were chosen by the management. The topics were: Increasing self-esteem in the Youth Centre (Chosen by offenders); No smoking policy (Chosen by management); Sexual assault (Chosen by management). I interviewed the cast, a sample of the audience, and correctional staff and managers. The data was analysed in terms of levels and elements of Social Capital (Putnam, 1995) and included Negative Social Capital. I have not found other examples of research in the field of Prison Theatre that have made use of concepts related to Social Capital to analyse the impact of theatre projects. This research therefore establishes a new area of focus for the field of Prison Theatre. The findings proved that the theatre project was an effective means of increasing communication between members of different gangs and between correctional staff and offenders in a non-threatening manner. This provided opportunities for changes in relations of power and increased problem solving in the correctional environment. As a result two systemic changes occurred. The staff provided feedback on offenders‟ requests and complaints and designated smoking areas were created. The findings demonstrate how notions of Social Capital can explain how theatre affects change in a correctional context because it focuses on social dynamics rather than systemic issues. Towards safer and more congruent prison environments for male Aboriginal prisoners: a South Australian study.

This thesis presents the first empirical study into the accommodation needs of Australian Aboriginal prisoners in prison custody. The over-representation of Aboriginal people in the Australian prison system is increasing and the continuing deaths of Aboriginal peoples in prison custody by suicide are an important national issue. Previous prison studies have not addressed all of the issues surrounding this problem. Although the varying and differing accommodation needs of Aboriginal prisoners have been recognised since the 1800s, there is a limited understanding of the relationship between the prison environment and the rates of suicide among Aboriginal prisoners. The aim of the thesis is to investigate the issues and present findings which may contribute to the creation of prison environments which reduce stress levels, and may in turn decrease rates of suicide among Aboriginal prisoners. The research investigates the prison environment for the Aboriginal prisoner from a people-environments approach, locates the act of suicide among a series of behaviours which may occur in response to an environment incongruent with the needs of users. These responses are influenced by a complex of personal, environmental and institutional factors. Data for the research was gathered by studying five South Australian prisons and conducting a series of interviews with 55 male Aboriginal prisoners incarcerated within them. The prisons were documented using observations, interviews with staff and prisoners, photographic surveys and environmental walkthroughs. Both the accommodation standards, and the responsibility to provide those standards by the Department for Correctional Services (South Australia), are examined. The needs and preferences of the subject group were investigated using a three-stage interview process which included gathering personal and incarceration profiles, a forced choice experiment employing photographic sets and a number of drawing exercises to elicit design preferences. The results present a picture of the Aboriginal prison population in South Australia and their design needs. It shows that there are commonalities among the Aboriginal prisoner population in that they are relatively young, have relatively large numbers of children and are dependent on other family members for stability outside the prison environment. Aboriginal people display non-complaint and resistance behaviours and are consequently segregated at an alarming rate in South Australian prisons. The research identifies that prison environments in South Australia are often incongruent with the needs of Aboriginal prisoners. The thesis presents the argument for prison environments to move from being designed within philosophies of segregation and separation to recognising the importance of Aboriginal domiciliary practices, lifestyles structured around the social group and the need to maintain connections to country for all Aboriginal prisoners. The need for prison environments to take into account the identity and spirituality of Aboriginal prisoners is highlighted. Cette thèse porte sur les limites du pouvoir étatique de restreindre les droits des détenus. Afin d'explorer cette question, l’auteur identifie les spécificités de ces limitations qui peuvent influencer la justification de leur application. Ces spécificités rendent la justification des limitations en milieu pénitentiaire plus facile par rapport à celles des citoyens libres. La thèse propose des barrières juridiques améliorées contre les limitations non-justifiées.L’auteur propose une théorie originale sur la nature juridique des limitations aux droits des détenus. Il décrit aussi les normes pertinentes développées par l’ONU et le Conseil de l’Europe (la Cour européenne et le Comité pour la prévention de la torture) ainsi que les normes nationales encadrées par la législation et la jurisprudence. Une analyse critique de ces normes est menée afin de comprendre leurs défauts et de prévenir la commission d’erreurs à l’avenir.La doctrine populaire selon laquelle les détenus conservent tous les droits sauf ceux qui sont incompatibles avec l'emprisonnement est rejetée car elle s’avère peu protectrice du point de vue juridique. En revanche, d’autres axes d’amélioration des clauses limitatives existantes en droit pénitentiaire sont proposés. Il s’agit de la construction de garanties procédurales contre l’abus de limitations non-justifiées et notamment du renforcement du rôle du contrôle judiciaire ainsi que de l’application du principe de proportionnalité. L’application légitime de ce principe est plus complexe en monde libre qu’en milieu fermé ; elle requiert sans doute non de s’appuyer non seulement sur des arguments juridiques et logiques, mais encore sur des arguments empiriques. / This thesis focuses on the limits of the State’s power in restricting prisoners’ rights. In order to explore this issue, the author identifies the specificities of these limitations which can influence the justification of their use. Due to these specificities, it is easier to justify the limitations of prisoners’ rights than to those of free citizens. It is on this basis that the thesis suggests to improve legal barriers against the unjustified limitations of prisoners' rights.The author develops an original theory pertaining to the legal nature of limitations applied to prisoners' rights. Furthermore, he describes the standards developed by the UN and the Council of Europe (the European Court and the Committee for the Prevention of Torture) which apply to these limitations, as well as the relevant national standards defined by legislations and/or jurisprudence. A critical analysis of these standards is conducted with the purpose of understanding their flaws and preventing them in the future.The popular view according to which detainees retain all their rights, with the sole exception of those that are incompatible with imprisonment is rejected as not providing sufficient legal protection. This thesis presents alternative ideas for improving restrictive prison law clauses. Particular attention is paid to the construction of procedural safeguards against the abuse of unjustified limitations, including strengthening the role of judicial review and the principle of proportionality. In a security context, it is more complicated to apply this principle legitimately as it might require not only legal and logical arguments, but also empirical data.

Motivation i en arbetsmiljö präglad av säkerhet : En kvalitativ studie om varför kriminalvårdare väljer att arbeta innanför murarna

Syftet med denna uppsats är att kartlägga motivationsfaktorer bland anställda inom Kriminalvårdens anstaltsverksamhet. För att undersöka detta utformades en huvudfrågeställning som besvarades med hjälp av tre delfrågor om vad som motiverar individer att ta anställning hos Kriminalvården, om denna motivation förändras över tid samt hur kriminalvårdarna reflekterar kring arbetsmiljön utifrån ett motivationsperspektiv. För att samla in det empiriska materialet genomfördes sex stycken semi-strukturerade intervjuer med kriminalvårdare på anstalter med säkerhetsklass ett. Det resultatet genererade var att motivationen förändras över tid. Vid början av anställningen är det faktorer som inkomst och framtida karriärmöjligheter samt viljan att testa något nytt som motiverade. Efter en tid inom yrket hade motivationen skiftat till att klienterna och sina arbetslaget som utgör den främsta motivationsfaktorn, arbetsmiljön väger in på så vis att kriminalvårdarna behöver utföra sitt arbete på ett säkert sätt då detta skapar en god sammanhållning. I slutsatsen framkommer även att en motivation till att ta anställning som kriminalvårdare är att det kan vara en språngbräda för framtida yrken. Arbetsmotivation grundar sig i en avvägning och kombination av flera olika faktorer. / The purpose of this study is to identify the motivational factors among Prison Officers working in a high security prison. To investigate this purpose, a key issue was formulated and answered with the help of three sub-questions regarding why Prison Officers choose to take employment in the prison service, if their motivation changes over time and which views they have towards the working environment from a motivation perspective. In order to collect data, six semi-structured interviews were carried out with Prison Officers in a high security prison. The results of these interview showed that motivation among Prison Officers changes over time. Initially it was the need to have an income, the possibility of future career opportunities as well as wanting to test new career paths that drove their motivation. Later, motivation shifted to it being their colleagues and the clients who contribute to their work motivation. The work environment also has an impact on Prison Officers’ motivation as safety at work it is an important factor in creating good cohesion. The study also shows that one reason for becoming a Prison Officer can be that it provides a springboard for future work opportunities. Also, work motivation is based on a balance and a combination of several factors.
