La nouvelle prédominance du mode partenariat public-privé dans la production de tramways au Canada

Afin de comprendre pourquoi tous les nouveaux projets de tramways en cours de développement au Canada sont réalisés en mode partenariat public-privé (PPP) plutôt que grâce au mode traditionnel (gestion publique) utilisé par le passé, cette recherche porte sur trois projets de tramways présentement en cours de réalisation (Edmonton, Ottawa et Toronto). À l’aide de trois études de cas, nous explorons l’argumentaire entourant chacune des décisions menant au choix du mode de gouvernance PPP ainsi que la forme prise par ce PPP. Nous démontrons que dans tous les cas, il est possible d’observer les mécanismes du transfert de politique, tant volontaire que coercitif. Nous croyons que le transfert de politique peut donc fournir un élément de réponse à notre question. De plus, l’argumentaire utilisé par les acteurs locaux pour justifier le choix du mode PPP, bien que semblable sur plusieurs points, comporte tout de même une combinaison de justifications unique à chacun des cas, ce qui nous laisse croire que le PPP est un instrument de politique polyvalent. Ces constats démontrent l’intérêt de prendre en considération les transferts de politique au niveau municipal et non seulement les transferts qui prennent place entre les États nationaux. To understand why all new light rail projects under development in Canada are carried out in public-private partnership (P3) rather than through the traditional mode (public administration) that prevailed in the past, this research explores three light rail projects currently underway in Edmonton, Ottawa and Toronto. We study the arguments surrounding each decision leading to the choice of P3 governance. We show that in all cases, it is possible to observe the mechanisms of policy transfer, whether voluntary or coercive. Moreover, the argument used by local actors to justify the choice of P3, although similar in several respects, still forms a unique combination of justifications for each case, which leads us to believe that P3s are a versatile policy instrument. These findings demonstrate the importance of taking into account policy transfer at the municipal level and not only transfers that take place between national states.

Para entender como trabalha essa pressão institucional, estudaremos o Poder Público para encaixá-lo como stakeholder e como força atuante no modelo de Porter, além de trazer um histórico sobre essa interação. Metodologia - Para isso selecionamos o caso do Porto Maravilha, uma Parceria Público Privada de reurbanização, já que nela temos a relação de uma concessionária como partícipe privada em um contrato com o Poder Público. Além disso, existem na área empreendimentos independentes que também podem ser analisados perante a relação do público com o privado. O estudo segue o método qualitativo, com viés exploratório. Foram entrevistados empresários que tem projetos na região do Porto maravilha, além da concessionária Porto Novo e sua contratante que representa o Poder Público. Utilizamos entrevistas semi-estruturadas, onde refletimos sobre as experiências onde o Estado se fez presente, identificando o papel que este assumiu como stakeholder de cada empresa. Resultado - A influência do Poder Público dentro das empresas resta notória em diversos aspectos. Ao final, contribuímos para o entendimento de como o Governo brasileiro se relaciona com as empresas, criando substrato para empresários tomarem decisões estratégicas conhecendo melhor uma das forças presentes no ambiente institucional: o Poder Público enquanto contratante, parceiro ou stakeholder. Contribuições Práticas - Concluímos com uma lista de ações práticas, elaborada a partir da pesquisa, como indicação para as empresas adotarem para melhor comportamento estratégico perante o Poder Público. Originalidade – A maior parte dos trabalhos sobre Parcerias Público-privadas toma o partícipe público como foco. Além disso, não é recorrente o estudo estratégico empresarial tomando o Poder Público como stakeholder / Objective - It is a research on the relations between the private initiative and the State, aiming, from a vision within the company, to understand the Public Power as a stakeholder for the assembly of a strategy that considers this force organizations. In order to understand how this institutional pressure works, we will study the Public Power to fit it as a stakeholder and as an active force in the Porter model, in addition to bringing a history of this interaction. Methodology - For this we selected the case of Porto Maravilha, a Public Private Partnership for redevelopment, since in it we have the relation of a concessionaire as private participant in a contract with the Public Power. In addition, there are independent ventures in the area that can also be analyzed in relation to the relationship between the public and the private sector. The study follows the qualitative method, with exploratory bias. Entrepreneurs with projects in the Porto region were interviewed, as well as the concessionaire Porto Novo and its contractor representing the Public Power. We used semi-structured interviews, where we reflected on the experiences where the State was present, identifying the role it assumed as a stakeholder of each company. Findings - The influence of the Public Power within the companies is notorious in several aspects. In the end, we contribute to the understanding of how the Brazilian Government relates to companies, creating a substrate for entrepreneurs to make strategic decisions, knowing better one of the forces present in the institutional environment: the Public Power as contractor, partner or stakeholder. Practical Implications - We conclude with a list of practical actions, elaborated from the research, as an indication for companies to adopt for better strategic behavior before the Public Power. Originality - Most of the work on Public-Private Partnerships takes public participation as the focus. In addition, the strategic business study is not recurrent taking the Public Power as stakeholder

The introduction of this thesis themed "Local Action Group Rakovnicko and its importance for the regional development" focuses on the questions of the beginning a development of European's cooperation. In context of entry Czech Republic into the European Union handles this thesis about the birth of native regional policy and actual conditions of pumping European funds. Separate theme is the meaning of method LEADER for the development of rural regions in the Czech conditions and community effort to establish the cooperation with private sector based on local partnership. The Local Action Group Rakovnicko tries to apply the mentioned method and forms for small communities needed background and conditions. The aim of this thesis is to create a project for small town of Jesenice, which is focused on the development of tourism.

The research discusses the concept of education as a non-exclusive service and how this logic has fostered the construction of a model of management for results in public schools, with reference to the experience developed in the Pernambucano Gym. The methodology of the research seeks the relationship between the universal - the mode of capitalist production and characteristics of this historical juncture - and the singular, educational policy. But because it is an educational policy, the investigation generalizes the analysis, because the policy reaches all the Pernambuco state schools. The method is based on historical materialism and dialectical, with the due readings to think the social in the contemporary context. It is understood that the Marxist analysis is making a radical critique of capitalism and without celebrations. It is a benchmark that takes a historical role in building a social reality stocktaking. The corpus of the survey consists of documents produced by the state government of Pernambuco, which establish the legal basis for the implementation of management for results from 2004 to 2014 in two phases. At first, the emphasis is on public-private partnership between the Institute of Co-responsibility for Education and the State Government. In the second phase, the establishment of responsibility mechanisms of the school director, in order to consolidate the managerialism in the management of Pernambuco education. In addition to document analysis, which attempts to grasp the general lines that signal the intent of the study educational policy, refers to the semi-structured interview, trying to understand how the results to management model, the logic of public-private partnership, has been applied concretely in everyday school life. / Esta investigação examina a parceria público-privada na gestão da escola pública no estado de Pernambuco, a qual se insere no contexto da reforma do aparelho do Estado, cujo fundamento constitui as recomendações postas no Plano Diretor da Reforma do Aparelho do Estado (1995). A pesquisa discute a concepção de educação como um serviço não exclusivo e como essa lógica tem fomentado a construção de um modelo de gestão para resultados nas escolas públicas, tendo como referência a experiência desenvolvida no Ginásio Pernambucano. A metodologia da pesquisa busca a relação entre o universal – o modo de produção capitalista e as particularidades da presente conjuntura histórica – e o singular, a política educacional. Por se tratar de uma política educacional, a investigação generaliza a análise, pois a referida política atinge a totalidade das escolas públicas pernambucanas. O método fundamenta-se no materialismo histórico e dialético, com as devidas releituras, para pensar o social no contexto contemporâneo. Compreende-se que a análise marxista é a que faz uma crítica radical e sem celebrações ao capitalismo. Trata-se de um referencial que assume um papel histórico na construção de uma análise da realidade social. O corpus da pesquisa constitui-se de documentos produzidos pelo governo estadual de Pernambuco, que estabelecem as bases legais para a implantação da gestão para resultados no período de 2004 a 2014, em duas fases. Na primeira, a ênfase encontra-se na parceria público-privada entre o Instituto de Corresponsabilidade pela Educação e o Governo do Estado. Na segunda fase, na constituição de mecanismos de responsabilização do diretor escolar, com o fim de consolidar o gerencialismo na gestão da educação pernambucana. Além da análise documental, que busca apreender as linhas gerais que sinalizam a intencionalidade da política educacional estudada, recorre-se à entrevista semiestruturada, na tentativa de compreender como o modelo de gestão para resultados, na lógica da parceria público-privada, tem sido aplicado, concretamente, no cotidiano escolar.

The work obeyed a Qualification Project, previously approved by an Examining Board formed by professors of the course. The work begins in the problematic of the rearrangement of public services as a whole, despite the State s lack of capacity in accomplishing the necessities of new investments, what determines the search of the efficiency by the co-production of public resources. Another issue of this problematic is the necessity of the legitimacy of the co-production strategy. The academic study is justified by its theory, economical and social importance of the co-production, as well as the problematic surrounding the subject, once the theme public-private partnership is recent and an issue not yet resolved in practical terms as an effective instrument for the public administration in the country and in Santa Catarina. The aim of this research is to propose a partnership model for the co-production of the public resources that can accomplish with the fundamental principia of the public law and public administration, in terms of efficiency and legitimacy of the State, as to better accomplish with the citizen s interests . The theory revised approached subjects as Administrative Law, Public Administration, Public Services and Public-Private Partnership, Legitimacy and Efficiency, Accountability, Social Responsibility, Environmental Sustainability, among others. The methodological procedures pointed as a method the documental analysis and, incidentally, the case study of the Partnership Programs of Santa Catarina. In a complementary way, were also researched the recent partnership programs of Brazil and of the states of São Paulo, Minas Gerais, Goias e Ceará, evaluating them in the juridical ordainment as partnerships of the PPP s type, among other analysis instruments. Therefore, the objects and subjects of the research are the programs of Public-Private Partnerships of Santa Catarina, of Brazil, and of other states, whose data were collected in documental sources. For the Santa Catarina s case, semidirected interviews were used. The data treatment used the content analysis, including the exam of the juridical ordainment and of the partnership models, using a comparative analysis of the partnership legislation of Santa Catarina, Brazil and other states, in face of the revised theory, to the Law and Public Administration and other countries experiences, and in relation to other categories defined in the research. The study reveals that the majority of Santa Catarina s partnership models, as well as the others evaluated models, don t present mechanisms that assure efficiency or legitimacy conditions. Therefore, from the data analysis, the research made possible the elaboration of the propose Models of Public-Private-Citizen Partnership PPC , which constitutes an environment for the emancipatory citizenship and for the business social responsibility, guided by a Citizenship Counsel, webbed with other communitarian centers, supported by a Citizenship Found. / A presente Dissertação visa atender às exigências de conclusão do Mestrado Profissional em Administração, do Centro de Ciências da Administração da Universidade do Estado de Santa Carina, no âmbito da linha de pesquisa a qual o autor está vinculado. O trabalho obedeceu a um Projeto de Qualificação, previamente aprovado por Banca Examinadora composta por Professores do Curso. O trabalho parte da problemática do redimensionamento dos serviços públicos como um todo, além da falta de capacidade do Estado em atender às necessidades de novos investimentos, o que determina, entre outras alternativas, a busca da efetividade por meio da co-produção do bem público. Outra questão da problemática é a necessidade de legitimidade da estratégia de co-produção. O estudo acadêmico é justificado pela importância teórica, econômica e social da Co-produção, bem como da problemática em torno do assunto, haja vista que o tema parceria público-privado é recente e uma questão ainda não resolvida em termos práticos como um instrumento efetivo para a gestão pública no país e em Santa Catarina. A Pesquisa tem como objetivo "propor um modelo de parcerias para a co-produção do bem público que possa atender aos princípios fundamentais do Direito Público e da Administração Pública, em termos de efetividade e de legitimidade do Estado, a fim de melhor realizar os interesses dos cidadãos". A fundamentação teórica abrangeu temas como Direito Administrativo, Administração Pública, Serviços Públicos e Parceria Público-Privada, Efetividade e Legitimidade, Accountability, Responsabilidade Social e Sustentabilidade Ambiental, entre outros. Os procedimentos metodológicos apontam como método a análise documental e, incidentalmente, para o estudo de caso do Programa de Parcerias de SC. De forma complementar, foram também pesquisados os recentes programas de parcerias federal e dos estados de São Paulo, Minas Gerais, Bahia, Goiás e Ceará avaliando no ordenamento jurídico as parcerias do tipo PPP´s, entre outros elementos de análise. Assim, os objetos e sujeitos da pesquisa são os programas de Parcerias Público-Privadas catarinense, federal e de outros estados brasileiros, cujos dados foram coletados por meio de fontes documentais. Para o caso de SC, foi utilizado entrevista individual semi-dirigida. O tratamento dos dados compreendeu a análise de conteúdo, incluindo o exame do ordenamento jurídico e dos modelos de parcerias, compreendendo uma análise comparativa da legislação de parcerias catarinense, federal e dos demais estados, frente ao arcabouço teórico, aos princípios do Direito e da Administração Pública e experiências de outros países, e em relação às categorias definidas na Pesquisa. A Pesquisa revela que os modelos de parceria catarinense, bem como os demais modelos avaliados, na sua grande maioria, não apresentam mecanismos que assegurem efetividade ou condições de legitimidade. Assim, a partir da análise dos resultados, a Pesquisa possibilitou elaborar uma proposta de "Modelo de Parcerias Público-Privada-Cidadã - PPC", constituindo ambientes da cidadania emancipatória e de responsabilidade social empresarial, instrumentalizados pelo Conselho da Cidadania, em rede com centros comunitários, com o suporte de um Fundo da Cidadania

Countries that have faced this type of problem found as an alternative for its development the private partner, which over time took acting in different ways in this process. Many experiments have been adopted in the search for improvement and investment feasibility for the provision of public services. The present study is a quick account of this evolution and hold more specifically in the new mode of contracting through the Public- Private Partnership, in which the public seeks to improve the efficiency and effectiveness of their services through this modality. Discusses the processes involved for modeling studies, using or not the Expression of Interest Procedure as well as the framework and analysis of convenience and opportunity through Value for Money. Presents and analyzes the experience of the State of Cearà in the preparation, implementation and monitoring of the project implanted Arena CastelÃo, identifying their strengths and weaknesses.

Construction socio-spatiale héritée du XIXe siècle ayant connu un déclin dans la seconde moitié du XXe siècle, les quartiers de gare centrale dans les villes occidentales sont un support récent et privilégié de l’action collective urbaine. Les projets urbains que ces gares cristallisent présentent des programmations récurrentes reposant sur la mixité fonctionnelle et une orientation tertiaire affirmée. Cette thèse interroge le retournement de valeur symbolique et économique de ces espaces autrefois dévalorisés et aujourd’hui prisés. Quelles sont les modalités de la fabrique urbaine, comment se noue l’interaction nécessaire entre des acteurs publics ne pouvant intervenir seuls sur ces secteurs fortement contraints (notamment techniquement), et des acteurs privés parfois réticents à s’engager sur des marchés qu’ils jugent risqués ? En adoptant une approche inductive et qualitative, ce travail de recherche analyse la conception et la mise en œuvre de deux projets urbains aux avancements contrastés en raison de leviers d’action ou, au contraire, de points de blocages différents, dans deux anciennes villes minières devant négocier le tournant de la désindustrialisation (Saint-Étienne et Liège). Au terme de l’analyse, l’hypothèse d’une valeur assurantielle de la gare dans ces projets urbains est validée : en tant que ferment métropolitain vecteur de fortes potentialités, la gare centrale desservie par un train à grande vitesse est la condition de possibilité permettant d’enclencher non seulement la décision des acteurs publics mais aussi celle des acteurs privés, au premier rang desquels les promoteurs immobiliers, acteurs clés à l’interface entre l’action publique et l’investissement privé / The railway station areas of the 19th Century were a reflection of the Industrial revolution. Following a period of decay after the Second World War, the urban renewal of these areas is now one of the main concerns of local governments in European cities. In addition to a new railway station served by high speed trains, these urban projects are often based on functional diversity, including a business district.This thesis addresses the reversal of urban value in these specific urban areas, exploring how they have moved from repelling to attractive places. How do public and private actors interact, when the former cannot act alone in places constrained by physical barriers due to a lack of funding, and the latter are not inclined to invest in what they consider to be risky places?Our approach is both inductive and qualitative. The comparison of two projects in French and Belgian shrinking cities (Saint-Etienne, near Lyons, and Liège, near Brussels) allows us to understand what the levers for action are, and conversely what the bottlenecks are that slow down the implementation of the urban project around the station.As the result of our analysis, the railway station appears to be a positive and necessary factor for the reversal of urban value in these areas. It is a kind of insurance – in the same way as metropolitan areas create potentiality in the productive economy – both for public actors, as the railway station facilitates their mobilisation, and private ones, especially property developers, who are key elements in the relationship between public action and private investment

These findings demonstrate the importance of taking into account policy transfer at the municipal level and not only transfers that take place between national states.

This thesis is dedicated to modern management approaches to Public Sector organizations with a special focus on projects of Public Private Partnership. This topic is one of the latest issues not only in the Czech Republic but also in numerous European countries. The public sector and its organizations are going through total modernization in these countries. This results in higher quality and more effective Public Services for citizens. I view this problem from 2 perspectives and ask the following questions which reflect the main hypothesis of this thesis: which modern approaches (tools, methods) are the most often used (intended to be used) including their contributions to higher quality and more effective management of organizations of municipalities in the Czech Republic, how is the principle of Public Private Partnership perceived and used in organizations of municipalities in the Czech Republic (Water sector) including barriers which hinder its use. It has been proven that for achieving higher quality and more effective results in the Public Sector, it is not only suitable but even systematically necessary to use modern tools of organization and management. These tools are nowadays commonly applied in the Public Sector. At the same time it has also been proven that Public Private Partnership can significantly support management in the Public Sector through its own implementation of modern tools. Further widening the use of modern tools of management and cooperation between the Public and the Private Sector is sustained through the spreading of knowledge. This is based on sharing ?good praxis?, transparent legislation and appropriate (procedural) methodology for implementation.

Cette thèse analyse les tendances mondiales dans le financement de grands projets d'infrastructure dans le secteur des transports, en identifiant les caractéristiques distinctives du financement dans les pays développés et en développement. Un nouveau mécanisme de financement est proposé dans le contexte de contraintes budgétaires strictes grâce à l'utilisation d'un certain nombre d'effets économiques indirects découlant de l'amélioration de l'accessibilité des différents territoires en matière de transport. Comme le sujet de l'analyse, il y avait un projet de la construction d'un chemin de fer à grande vitesse en Russie Moscou-Kazan. / This paper analyzes global trends in financing large infrastructure projects in the transport sector, identifying the distinctive features of financing in developed and developing countries. A new financing mechanism is proposed in the context of strict budgetary constraints through the use of a number of indirect economic effects arising from improved transport accessibility of individual territories. As the subject of the analysis, there was a project of the construction of a high-speed railway in Russia Moscow-Kazan.
