[pt] Aquilo que Martin Heidegger considera o niilismo moderno e a consu-mação da metafísica constituiriam, segundo ele, dois dos grandes fundamentos do pensamento nietzschiano e do que seria uma época moderna. A filosofia de Nietzsche é a que melhor reflete os rumos da metafísica, no sentido do resgate de sua essência no mundo grego, e da descoberta, aí, de seu caráter eminentemente niilista. Isto pressupõe uma consumação, um esgotamento da metafísica, mas também o descortinar de um outro início a partir do significado do ser. Hei-degger desenvolve seu argumento com base no que diz ser os cinco títulos cen-trais da metafísica nietzschiana; são eles: vontade de poder, eterno retorno do mesmo, transvaloração de todos os valores até aqui, além-do-homem e o próprio niilismo. Torna-se inevitável, porém, em meio ao aprofundamento de tais temas, a descoberta de que as conclusões sobre a filosofia de Nietzsche aca-bam por falar muito do próprio pensamento heideggeriano e, indo mais à fundo, de sua história de filiação à ideologia nazista. / [en] What Martin Heidegger considers nihilism and the consummation of the methaphysics would constitute, according to him, two of the big fundamen-tals of nietzsche s thinking and the modern era. Nietzsche s philosophy reflect the course of metaphysics on its way from the recovery of its greek world essence, as eminently nihilist. This assumes a consummation, a fulfillment os metaphys-ics, but also the unveiling of another beginning based on the meaning of the being. Heidegger develops his concepts according to what he calls Nietzsche s main five titles; they are: will power, eternal return of the same, transvalu-ation of all values, beyond man and the nihilism itself. Becomes inevitable, however, with the deepening of such issues, the discovery that the conclusions about Nietzsche reveal s a lot of the heideggerian s thinking itself, and, going further, ist history of affiliation with the Nazi ideology.

[pt] A tese ora apresentada traz a investigação sobre a representação imagética de conteúdo nos filmes de Leni Riefenstahl frente ao percurso das categorias sígnicas peirceanas. Por meio desta fundamentação semiótica de extração peirceana, investiga-se a questão sígnica, que serve de ponte entre a observação histórica e a premissa de que o conteúdo conceitual nazista está esteticamente representado nos filmes de Leni Riefenstahl. À identificação, na filmografia de Leni Riefenstahl, do filme que antecede sua colaboração com Hitler, e dos filmes que abrangem seu relacionamento, tanto com o partido Nacional Socialista quanto com figuras proeminentes do nazismo, segue-se a observação de cada um destes casos em particular. Visando a contextualização de seus filmes, procede-se à verificação da trajetória de Leni Riefenstahl em sua articulação com o contexto cinematográfico, cultural e político da Alemanha desde os anos que antecedem a era nazista, bem como o período nazista até o final da Segunda Guerra Mundial. Buscamos articular elementos próprios do campo do Design à áreas correlatas, como o cinema, que possam contribuir para uma nova perspectiva da pesquisa teórica neste campo. Os filmes de Riefenstahl nos proporcionam um conteúdo rico em possibilidades interpretativas ainda pouco exploradas pela teoria do Design ou à luz da semiótica peirceana. A filmografia em questão inaugura tendências que influenciaram a cultura imagética contemporânea e a produção cinematográfica ocidental do século XX. / [en] This thesis now presented brings the investigation about the imagery representation of content in the films of Leni Riefenstahl throughout the course of Peircean signical categories. Applying Semiotic from Peircean extraction, the sign issue was investigated, which serves as a bridge between the historical observation and the premise that nazistic conceptual content is represented aesthetically on films of Leni Riefenstahl. By identifying within the filmography by Leni Riefenstahl the film before her collaboration with Hitler, and of films from the period covered by her relationship with the National Socialist Party and with prominent figures of Nazism, follows the note of each one of these cases in particular. Seeking contextualization of her films, was verified the trajectory of Leni Riefenstahl in articulation with the film, cultural and political context of Germany from the years before the Nazi era and the Nazi period until the end of World War II. We seek to articulate elements within the field of Design with related areas, such as the cinema, that can contribute to a new perspective of theoretical research in this field. Riefenstahl s films give us content rich in interpretive possibilities still little explored by the theory of the Design or in the light of the Peircean semiotics. The Filmography in question inaugurates trends that influenced the contemporary imagery and culture to Western film production of the 20th century. / [de] Diese Doktorarbeit untersucht den Inhalt die Bilder-Darstellung in den Filmen von Leni Riefenstahl Nach der Peirces Zeichenkategorien. Durch diese Semiotik Peirceanischen Extraktion Grundlage untersuchen wir die Frage mit der Marke fungiert als Brucke zwischen der historischen Beobachtung und die Pramisse, die der konzeptionellen Inhalts Nazi in Filmen von Leni Riefenstahl asthetisch dargestellt. Die Ermittlung, Leni Riefenstahl Filmographie, der Film, der seine Zusammenarbeit mit Hitler vorausgeht und die Filme, die sich uber ihre Beziehung, sowohl die Nationalsozialistische Partei mit prominenten Persönlichkeiten des Nationalsozialismus, insbesondere die Beobachtung von jedem dieser Falle folgt. Kontextualisierung von ihren Filmen suchen, prufen wir die Flugbahn des Leni Riefenstahl in Artikulation mit den Film, kulturellen Kontext und Deutschland Politiker seit den Jahren vor der Zeit des Nationalsozialismus, als auch der NS-Zeit bis zum Ende des zweiten Weltkriegs. Wir versuchen, Elemente der Bereich Design in verwandten Bereichen, wie z. B. Kino, artikulieren, die zu einer neuen Perspektive der theoretischen Forschung auf diesem Gebiet beitragen können. Riefenstahl Filme geben uns einen Inhalt reich an interpretative Möglichkeiten durch die Theorie des Design oder im Lichte der semiotischen Peirceanischen noch wenig erforscht. Dem betreffenden Filmographie weiht die Trends, die zeitgenössische Bildsprache und Kultur zur westlichen Filmproduktion des 20. Jahrhunderts beeinflusst.

[pt] Esta dissertação tem por objetivo analisar a vida de Dietrich Bonhoeffer dentro do contexto da Alemanha no início do século XX. A sua vida se desenrolou como um homem que foi movido pela fé e a recepção de um chamado divino no mundo. Nos primeiros capítulos o leitor é situado nos anos iniciais de Dietrich Bonhoeffer, seu nascimento e a sua família. Em seguida são relatados sua formação teológica e seus primeiros passos no ministério pastoral. O texto continua com à ascensão do partido nazista e sua consolidação no poder, assim como o uso do aparelhamento do Estado alemão para aliciar as igrejas de diferentes confissões para a prática da doutrinação nazista. É abordado a teologia do Reich, a sua forma e a movimentação política, como o induzimento ao alemão comum a entender a raça ariana como superior a outros grupos e uma visão deturpada do evangelho. É exposta a resistência de Dietrich Bonhoeffer tratada em três frentes amplas que estão diluídas pela dissertação. Uma resistência teológica: que com seus sermões nos diferentes púlpitos, na rádio, na rua, dentro da sua família, e até no encarceramento contribuíram ao enfrentar Hitler e o nazismo. Procurou abrir os olhos dos alemães para realmente enxergar o mal que o nazismo representou. Uma resistência eclesiástica: por não aceitar que diversas confissões, incluindo a sua igreja, o parágrafo ariano no luteranismo. Como única saída se desligou da igreja, aceitando o convite do pastor Niemöller para dirigir um seminário totalmente à margem do Estado Alemão, para iluminar as jovens mentes a resistir ao mal que a imperava. Uma resistência política: Bonhoeffer levou informações para os seus aliados na Inglaterra através do bispo George Bell que foi o seu contato. Também participou de uma operação para a retirada dos judeus da Alemanha para à Suíça. Ele estava envolvido em um círculo de resistência com a finalidade do assassinato de Hitler. Como cidadão expressou sua atividade política daquilo que acreditava ser o certo e o ético a se cumprir como cristão. Por último é apresentado a sua prisão, os anos finais que contribuíram para o amadurecimento teológico e o crescimento da sua fé. A sua morte é tratada no texto como um martírio moderno, mesmo com a existência de contornos políticos. / [en] This Thesis aims to analyze the life of Dietrich Bonhoeffer within the context of Germany in the early twentieth century. His life unfolded as a man who was moved by faith and the reception of a divine call in the world. In the first chapters the reader is placed in the early years of Dietrich Bonhoeffer, his birth and his family. Then his theological formation and his first steps in the pastoral ministry are reported. The text continues with the rise of the Nazi party and its consolidation in power, as well as the use of the apparatus of the German State to entice churches of different confessions to practice Nazi indoctrination. The theology of the Reich, its form and political movement are addressed, as well as the induction of the common German to understand the Aryan race as superior to other groups and a distorted view of the gospel. Dietrich Bonhoeffer s resistance is treated on three broad fronts that are diluted by the thesis. A theological resistance: that with his sermons in different pulpits, on the radio, on the street, within his family, and even in prison, he contributed to facing Hitler and Nazism. He sought to open the eyes of Germans to really see the evil that Nazism represented. An ecclesiastical resistance: for not accepting that several confessions, including your church, the Arian paragraph in Lutheranism. As the only way out, he left the church, accepting Pastor Niemöller s invitation to lead a seminar completely outside the German State, to enlighten young minds to resist the evil that reigned there. A political resistance: Bonhoeffer took information to his allies in England through Bishop George Bell who was his contact. He also participated in an operation to remove Jews from Germany to Switzerland. He was involved in a resistance ring for the purpose of assassinating Hitler. As a citizen, he expressed his political activity of what he believed to be the right and ethical thing to do as a Christian. Finally, his imprisonment is presented, the final years that contributed to his theological maturity and the growth of his faith. His death is treated in the text as a modern martyrdom, even with the existence of political contours.

[pt] As obras dos dois artistas alemães Anselm Kiefer e Georg Baselitz e sua importância na retomada da arte germânica e européia no cenário da arte mundial são objetos de estudo deste trabalho. Ao reviverem suas próprias histórias de vida em sua prática artística, esses artistas transformam as reminiscências do passado em motivo (Leitmotiv) para a criação. Assimilando e explorando suas experiências vitais para transformá-las em matéria constituinte de suas poéticas, efetuam o resgate de um pathos tipicamente romântico. O olhar para a história comum, o nazismo, o comunismo, o período pós-guerra e a divisão da Alemanha e suas consequências pontuam suas obras. A semelhança estética entre suas poéticas faz-se presente em seu caráter monumental, no impulso pictórico, expressivo e brutal, bem como na qualidade gestual de suas obras. Também coincidem no regaste da figuração e de um simbolismo que alude a questões sociais, políticas e históricas, partindo de uma vivência pessoal. / [en] This paper studies the artistic creations of German painters Anselm Kiefer and Georg Baselitz and their importance in the retrieval of German and European art in the context of world art. Looking back at their own life stories and their artistic performance, these two painters made recollections of the past into the Leitmotif of creation. Assimilating and exploring their own vital experiences in order to turn them into the subject matter of their poetics, they effected the retrieval of a typically romantic pathos. A review of their common experiences with Nazism and Communism, the post-war period and the division of Germany and its consequences underscore their work. The aesthetical resemblance of their poetics also appear in the monumental character, the expressive and brutal painting impulse, as well as the spontaneous quality of their work. There also is a coincidence in the retrieval of figurative art and symbolism regarding social, political and historical questions, seen from a personal living perspective.

[pt] Com o fim da II Guerra e a queda do III Reich, ganha ímpeto um ataque jusnaturalista ao positivismo jurídico sob o fundamento de que ele foi o pensamento jurídico predominante na Alemanha da República de Weimar e que continuou sendo durante o regime nazista. Desta forma, o positivismo teve responsabilidade tanto pela queda da república quanto pelo funcionamento genocida do regime de Hitler. Iniciando-se com um artigo de Gustav Radbruch, tais ataques prosseguiram nas vozes de diversos antipositivistas e neoconstitucionalistas como Fuller, Dworkin, Alexy e, mais recentemente, David Dyzenhaus, jurista com quem a presente tese procura debater. Contra estes argumentos, pretende-se aqui refutá-los a partir das categorias fantasmagoria e hostilidade, extraídas do pensamento político-jurídico de Thomas Hobbes. A primeira procura demonstrar que o pensamento jurídico nazista era calcado em uma forma transcendental e eseencialista de pensar, implicando uma concepção do direito como algo já dado e que deveria ser realizado. A segunda determinava que, para realizar esta fantasmagoria, a forma jurídica poderia ser completamente afastada, de modo que o regime nazista, na verdade, seria antipositivista. Com isto, tanto a partir da teoria de Hobbes quanto de exemplos históricos, a presente tese procura afastar tal mito sobre o positivismo, afirmando que, ao contrário, o pensamento jurídico nazista era mais próximo do jusnaturalismo, e que as teses antipositivistas e neoconstitucionalistas de abertura do direito à moral, ao contrário do que pretendem, podem acabar por fornecer meios de ascensão de regimes autoritários, de modo que uma interpretação formal do direito deve ser vista como mais adequada do que uma jurisprudência de princípios. / [en] With the end of World War II and the fall of the Third Reich, a jusnaturalist attack on legal positivism gained momentum on the ground that it was the predominant legal thought in the German Weimar Republic and continued to be so during the Nazi regime. In this way, positivism was responsible both for the fall of the republic and for the genocidal functioning of the Hitler regime. Starting with an article by Gustav Radbruch, such attacks continued in the voices of several antipositivists and neo-constitutionalists such as Fuller, Dworkin, Alexy and more recently David Dyzenhaus, a jurist whose arguments this thesis intends to debate. Against these arguments, the objective here is to refute them with the help of the concepts of phantasmagoria and hostility, extracted from the political-juridical thought of Thomas Hobbes. The first concept seeks to demonstrate that Nazi legal thinking was modeled on a transcendental and essentialist way, implying a conception of law as an a priori that should be realized. The second concept determined that in order to realize this phantasmagoria, the legal form could be completely removed. Thus, the Nazi regime, in fact, would be anti-positivist. Thereby, both with the help of Hobbes s theory and historical examples, this thesis aims to dispel such a myth about positivism, stating that, on the contrary, Nazi legal thought was closer to natural-law, and that the anti-positivist and neo-constitutionalist theses, contrary to what intend or claim, may ultimately provide help to authoritarian regimes seize power. Thus, a formalist law interpretation must be seen as more appropriate than an interpretation based on principles.
