Motivação e invalidades do ato administrativo

Such option is justified as the administrative acting must always be guided by the reasons for its acts. We do not see any basis to be otherwise. The single paragraph of article 1st of the Federal Constitution is categorical in saying that all power comes from the people, who exercises it through elected representatives or directly. Thus, based on constitutional device, there must be no darkness or lack of motivation of administrative acts. Documentary research and literature of national and foreign authors, as well as our Court decisions, led us to the result that the motivation must be considered a sublime principle to be pursued by the Administration, as it represents true guarantee to the people, and, if not observed, there could be either a voiding or a validating act, provided that it has been verified in a case and the real consequences in the legal sphere of the people / O objetivo do presente trabalho é abordar, dentro do ordenamento jurídico brasileiro, o dever de motivação dos atos administrativos e a conseqüência de sua inobservância. Tal opção justifica-se, pois o agir administrativo deve sempre ser norteado pela fundamentação de seus atos. Não vislumbramos qualquer embasamento para ser de outra forma. O parágrafo único do artigo 1° da Constituição Federal é categórico ao afirmar que todo poder emana do povo, que o exerce por meio de seus representantes eleitos ou diretamente. Assim, com base em dispositivo constitucional não pode haver qualquer eventual obscuridade ou inexistência de motivação dos atos administrativos. Através da pesquisa documental e bibliográfica, tanto de autores nacionais, como de autores estrangeiros, bem como de julgamentos de ações de nossos tribunais, obtemos o resultado de que a motivação deve ser considerada princípio sublime a ser perseguido pela Administração, pois representa verdadeira garantia dos administrados e caso não seja observada poderá haver ato invalidador ou convalidador desde que haja verificação do caso concreto e a real conseqüência na esfera jurídica dos administrados

Para tanto se faz um comparativo entre Brasil e Espanha no tratamento dado pela doutrina e jurisprudência na definição do espectro de abrangência desse indeterminado conceito jurídico e os espaços de atuação de cada um dos poderes no exercício de suas competências constitucionais. Aponta-se para existência de dois grandes grupos de pensamento: os que advogam pela força do ato administrativo discricionário e os limites de legalidade e legitimidade impostos a sua sindicabilidade pelo Poder Judiciário e os que defendem a implementação judicial de políticas públicas como instrumento de viabilização e concretização dos direitos fundamentais resguardados pela Constituição do País. Os resultados apontaram para um desenvolvimento teórico atual muito complexo e elaborado para o tema e que ainda se está longe do fim desse debate. As conclusões do trabalho conduzem a uma reflexão sobre as mudanças estabelecidas ao longo do tempo na interpretação desse tema e sobre os desafios que ainda existem para a doutrina e jurisprudência na construção desses marcos teóricos. / The present work entitled control of the discretionary policy in the light of the constitution: a vision of its legitimacy and legality in the judiciary aims to analyze the treatment by the judiciary of political discretion of the administrative acts submitted to it. For that we make a comparison between Brazil and Spain in the treatment of the doctrine and jurisprudence in defining the scope of this spectrum of indeterminate legal concept and performance spaces for each of the powers in the exercise of its constitutional duties. They point to the existence of two major groups of thought: those who advocate the power of an administrative discretion and the limits of legality and legitimacy attributed to their control by the judiciary and those who advocate the implementation of judicial policies as a means of enabling and realization of fundamental rights protected by the Constitution of the Country results showed a very complex theoretical development today and prepared for the subject and that is still far from the end of this debate. The conclusion leads to a reflection on the changes over time established in the interpretation of this theme and the challenges that still exist for the doctrine and jurisprudence in the construction of theoretical frameworks.

Pastaruoju metu Lietuvoje norminių aktų leidybos procese pradeda vyrauti poįstatyminiai aktai, kurie papildo ar patikslina įstatymus. Tai neretai sukelia grėsmę pažeisti teisėtumą. Teisėtumo principas reikalauja, kad valstybės institucijos, kurdamos teisės aktus, neviršytų savo kompetencijos, laikytųsi kiekvienai teisės aktų rūšiai nustatytos tų aktų priėmimo ir išleidimo tvarkos (procedūrų) ir subordinacijos pagal juridinę galią: Seimo priimami įstatymai turi neprieštarauti Konstitucijai, o Prezidento dekretai, Vyriausybės nutarimai, kitų valstybės institucijų teisės aktai – Konstitucijai ir įstatymams. Šis principas teisinėje valstybėje reiškia ne tik formos, bet ir turinio teisėtumą - konkretus teisės aktas turi neprieštarauti ne tik aukštesnę juridinę galią turinčiam teisės aktui, bet ir pagrindinėms žmogaus teisėms, jis neturi įtvirtinti įstatymų leidėjo savivalės tų teisių atžvilgiu. Teisė konstatuoti tokį prieštaravimą suteikta Konstituciniam ir administraciniam teismams. / The principle of legality claims that the State Institutions, when legislating the Acts of Law, shall not overstep its competence, shall observe the established procedure for the adoption and promulgation of the Acts of Law of every type and the subordination according to legal power. The Laws being adopted by the Seimas shall be in conformity with the Constitution, but the Decrees of the President, the Resolutions of the Government, the Acts of Law of other State Institutions shall be in conformity with the Constitution and Legislation. This study covers the theoretical and practical aspects for the investigation of the legality of the Statutory Administrative Acts. The conception of the principle of legality, the implementation and protection of this principle in public administration are analysed on the theoretical level. By applying the methods of documentation analyses and comparative investigation the Acts of Law of the Republic of Lithuania as well as foreign countries, regulating the investigation of the legality of the Statutory Administrative Acts, are analysed. The essence, types and process of this investigation are defined. Im Rahmen des im 4. oder 5. Semester zu absolvierenden Berufsfeldprojekts sollen im Berufsfeld Recht und Management (Law and Management - LAMA) des Studiengangs Bachelor Wirtschaftswissenschaften der TU Chemnitz praxisorientiert aufgeworfene Fragestellungen systematisch und eingebettet in einen größeren Kontext dargestellt und mögliche Lösungswege aufgezeigt werden. Zugleich soll das Projekt Gelegenheit zur Vertiefung methodischer Kompetenzen, insbesondere zur Teamarbeit, geben und zu einem kritischen Blick auf die Bedeutung rechtlicher Vorgaben und Konzeptionen für wirtschaftliche Tätigkeiten "im Alltag" befähigen. Mit der Aufgabenstellung der Professur Jura I im WS 2009/10 wurde daher- ausgehend von einem konkreten, aktuellen Fall der Rechtsprechung, aber nicht beschränkt auf eine reine Fall-Lösung - angestrebt, praxisrelevant die potenziell auftretenden rechtlichen Fragen (Baurecht, Umweltrecht, Ladenschluss- und Gaststättenrecht, Verwaltungsverfahren usw.) der Errichtung und des Betriebs einer Tankstelle in einem allgemeinen (wirtschaftlichen) Kontext herauszuarbeiten. This hypothesis deserves a specific treatment, once it is submitted to a peculiar law regime, resultant of its qualification as administrative sanction. Therefore, the administrative act has been contained within the realm of administrative function, drawn afterwards to an overview of the hypotheses of its extinction and under a dogmatic methodological perspective, in order to identify and detach, among the kinds of State declarations with revoking efficiency, that one which has as presupposition the practice of an imputable administrative illicit to the addressee of the act, henceforth called cassation act. Moreover, this work aims to identify, taking the structural focus of the administrative act and the juridical regime that regulates the edition of administrative sanctions, what are the limits to the edition of the State declarations here discussed. To reach this purpose, this study approaches the object, the fundaments, the presupposition and the juridical effects of the cassation act. Finally, this work also treats the control of this kind of administrative act, focusing the actions exerted by the Judiciary / O presente trabalho tem por finalidade compreender uma das hipóteses de extinção dos efeitos dos atos administrativos, qual seja, a que decorre do inadimplemento de deveres pelo destinatário, com o intuito de identificar se, no direito brasileiro, ela merece um tratamento específico, em razão de estar submetida a um regime jurídico peculiar, decorrente de sua qualificação jurídica como espécie de sanção administrativa. Para tanto, localiza-se o ato administrativo no âmbito do exercício da função administrativa e traça-se um panorama das hipóteses de sua extinção, a partir de uma perspectiva metodológica dogmática, a fim de identificar e destacar, dentre as espécies de declarações estatais com eficácia extintiva, aquela que tem como pressuposto a prática de um ilícito administrativo imputável ao destinatário do ato, rotulada então como ato de cassação. [pt] A presente dissertação se propõe a analisar a extensão do controle judicial aplicável às decisões proferidas pelo Conselho Administrativo de Defesa Econômica - CADE (“CADE”), autarquia vinculada ao Ministério da Justiça que detém a competência legal de prevenir e reprimir infrações à ordem econômica. Analisaremos a extensão, e não a viabilidade em si, do controle judicial aplicável às decisões do CADE, pois é princípio assente em nosso Direito, com respaldo no próprio texto constitucional, que nenhuma lesão de direito poderá ser subtraída à apreciação do Poder Judiciário (art. 5º, inciso XXXV, da Constituição Federal de 1988). Por uma questão lógica e programática, iniciaremos o estudo abordando aspectos relevantes da discricionariedade administrativa, que é um dos temas mais apaixonantes do Direito Público e que mereceu a incansável dedicação de juristas ilustres, como Seabra Fagundes, Caio Tácito, Afonso Rodrigues Queiró, Eduardo García de Enterría, Celso Antônio Bandeira de Mello, apenas para citar alguns. Dentro do amplo tema da discricionariedade, despertou-nos especial interesse a relação entre a competência discricionária e os conceitos jurídicos indeterminados. Essa discussão, embora ainda incipiente em nosso ordenamento jurídico, vem atraindo cada vez mais a atenção dos estudiosos em direito administrativo, não havendo ainda uma uniformidade de opiniões a respeito do assunto. A seguir, analisaremos as técnicas de controle judicial dos atos administrativos de forma geral, que, desde as Teorias do Desvio de Poder e do Controle dos Motivos do Ato Administrativo, foram sendo aprimoradas ao longo dos anos. Aqui também abordaremos a superação, a partir do pós-positivismo, do antigo dogma da insindicabilidade do mérito do ato administrativo, especialmente em caso de violação a princípios gerais de direito assegurados pelos ordenamentos constitucional e infraconstitucional vigentes. Abordados os aspectos relevantes acerca da discricionariedade administrativa, passaremos a analisar os princípios jurídicos que regem a ordem econômica, a finalidade inspiradora da legislação infraconstitucional de proteção ao direito da concorrência e, em especial, as competências legais do CADE. Em capítulo específico, examinaremos ainda a natureza jurídica das decisões proferidas pelo CADE nos processos de conduta e nos atos de concentração econômica, o que é imprescindível para se determinar a extensão do controle judicial aplicável. Pretendemos dar especial ênfase à controvérsia na doutrina quanto à existência ou não de discricionariedade em favor do CADE para deferir ou indeferir atos de concentração submetidos à sua análise, identificando em que situações hipotéticas a discricionariedade poderia se verificar. Nesse contexto chama a atenção a faculdade outorgada ao CADE pela Lei nº 8.884, de 11 de junho de 1994 (art. 54, parágrafos 1º e 2º), de aprovar determinadas operações que, embora sejam potencialmente lesivas à concorrência, são capazes de gerar eficiências, segundo a acepção do termo no âmbito do direito econômico, como, por exemplo, avanços tecnológicos, aumento ou diversificação na produção, aprimoramento na qualidade dos bens ou serviços, entre outras. Pretendemos indicar como a doutrina tem interpretado esses dispositivos legais, isto é, se eles representam ou não a outorga de uma certa margem de discrição ao CADE nessas situações. A nossa proposta, assim, é tentar delimitar o núcleo de incidência da discricionariedade, acaso existente, e a extensão do controle judicial aplicável às decisões do CADE, levando em consideração a existência de conceitos jurídicos indeterminados na Lei nº 8.884/94, bem como o papel que os princípios hoje exercem como balizadores da atuação de qualquer ente administrativo. Também buscaremos traçar um perfil dos litígios existentes contra o CADE, realizando uma análise crítica da jurisprudência brasileira, para após tecer nossas considerações finais sobre o tema. / [en] The objective of the present essay is to analyze the judicial review applicable to the decisions rendered by the Administrative Council of Economic Defense (Conselho Administrativo de Defesa Econômica - CADE), an agency reporting to the Ministry of Justice legally competent to prevent and repress violations to the economic order. This essay analyzes the extent but not the viability, per se, of the judicial review applicable to CADE s decisions, because it is a principle of Brazilian Law, supported by the Federal Constitution, that the law shall not exclude from appreciation by the Judiciary Branch an injury or threat to a right (art. 5, XXXV, of the 1988 Federal Constitution). For the sake of logic and planning, this essay will initially approach relevant aspects of administrative discretion - one of the most fascinating themes of Public Law and worthy of endless dedication by distinguished jurists such as Seabra Fagundes, Caio Tácito, Afonso Rodrigues Queiró, Eduardo García de Enterría, and Celso Antônio Bandeira de Mello, among others. In the scope of administrative discretion, the relationship between discretionary competence and undetermined legal concepts was an issue that has specially called our attention. This discussion, although still incipient in our legal system, has increasingly been attracting the attention of scholars dedicated to administrative law. Nonetheless, a peaceful understanding has not been reached in this respect yet. The techniques for judicial review of administrative acts - which have been perfected since the establishment of the theories of Deviation of Power and Control of the Reasons of the Administrative Act - will be analyzed subsequently. We will also address the elimination, in the post-positivism era, of the ancient dogma banning the judicial review of the merits of the administrative act, especially in case of violation of legal principles guaranteed by the Constitution and ordinary legislation. After the analysis of the relevant aspects of administrative discretion, we will review the legal principles that govern the economic order, the objectives of antitrust legislation and, mainly, CADE s legal competence. In a specific chapter, we will focus on the legal nature of the decisions rendered by CADE in cases involving anticompetitive practices and in the analysis of concentration acts, which is necessary in order to determine the extent of the judicial review applicable. Special attention was drawn on the controversy regarding the existence or not of discretional powers on the benefit of CADE in granting or denying approval to concentration acts submitted to its analysis. We will also identify situations in which such discretional powers could theoretically take place. In this scenario, the faculty granted to CADE by Law 8,884 of June 11th, 1994 (art. 54, paragraphs 1 and 2) to approve certain transactions which, although potentially harmful to competition, might give rise to efficiencies - in the scope of the meaning attributed to the term by economic law - such as, for instance, technological progress, production increase or diversification, improvement of the quality of goods or services, among others. This essay also indicates how legal scholars have construed such legal provisions, i.e., whether or not such legal provisions actually confer a certain discretion to CADE under those circumstances. Thus, the aim of this essay is to outline the area of administrative discretion, if any, and the extent of the judicial review applicable to CADE`s decisions, taking into consideration the existence of undetermined legal concepts in Law No. 8,884/94, as well as the role played by the principles in guiding the acts performed by any administrative entity. A Study on Dangerous Driving Prevention Legal System of Police Officer

Due to the great change of Taiwan social environment, values are seriously distorted. Many adolescents would gather together at holiday nights for dangerous driving on road (racing) which not only causes gridlock on road and interferes traffic seriously, what¡¦s worse is these youths even attack the public, police officers on duty and related competed agency with force. This behavior not only violates legal regulations but damages social security severely, threatens citizens¡¦ life, body and property safety. Since the role of police officer serves as the function of social security maintenance, to clamp down and hold back dangerous driving is one important segment for the exercise of police powers. The exercise method of police powers in Taiwan has been reformed greatly due to the change of political and economical situation. During Martial Law Period, to meet the demand, this nation conferred authority on police officers to great extension. The nature of duty enforcement also belonged to regulation, clampdown, and penalty with compulsive implementation upon enforcement. However, the delegation scope pursuant to law is unspecific and the requirement of enforcement is general, human right violation controversy is often occurred. Till Interpretation of Shih-Zih No. 535 made by Grand Justice of Judicial Yuan, police authority then faces the importance of administrative procedure and is able to step forward to a country of nomocracy. With the promotion from all circles, ¡§Act of Exercise of the Police Powers¡¨ of Taiwan was effected on Dec. 1, 2003, herein not only regulates specifically the definition, function of power limits and implementation method of police officer, it also stipulates the practical measures of civil rights adopted for police powers exercise in proclamation to demand police officers to be in compliance with principle of proportionality while exercising authority. It also bestows the legal basis on police powers exercising that can look after both the insurance of human right and the maintenance of police safety which really possesses groundbreaking meaning of a time. Only that whether the formulation of the said act in practical really indicates the dangerous driving prevention legal system of police officers has already achieved its perfection worth the further research and exploration by this study. Administrative law is deep and profound as well as extensive and infinite and hasn¡¦t formed a complete administration law till now. Only that with observation from the method and principle of administrative act, it can be divided into five main structures of Basic Principle, Organization Framework, Limit of Administrative Rights, Administrative Relief, and Administrative Surveillance. Any administrative legal system pursuits to achieve its perfection, it then shall be analyzed by the five main structures of administrative act. Therefore, the five main structures of administrative act serve as the center in this study to examine the dangerous driving prevention legal system of police officer and review the practice method of police authority and compare to current relative decrees and regulations, expecting police officers can work out the problems concerning to the requirements of power exercise and procedure and to be advantageous to the reinforcement of dangerous driving prevention. Under this pattern of thought, this study tries to examine all systems upon dangerous driving prevention and clampdown of Taiwan police officers from the angle of administrative act with the said five main structures of administrative act basic principles as the research method in this study. The main frameworks of this study are divided into seven chapters respectively: Chapter 1 Introduction To bring forth the dubious interpretation of current dangerous driving prevention reinforcement by police authority firstly to explain the research motive, purpose, research scope, limits, research method, framework, the determination of related terms, and so on. Chapter 2 The Basic Principle of Dangerous Driving Prevention Legal System of Police Officer. To interpret the concept and definition of dangerous driving firstly and then bring forth the cruxes in reality and data analysis against the four aspects of society with actual phenomena, economy with most appropriate adjustment, politics of interrogation and legal system of decrees and regulations to make us understand the establishment background of dangerous driving prevention legal system of police officers. And further to compliment with Japan dangerous driving prevention system, the analysis of international aspect to adopt the successful experiences of dangerous driving prevention in foreign countries; and then explore the nomocracy of dangerous driving legal system of police officers from the angle of three principles of administrative act and seven principles of procedure justices to discuss the related legal basis and regulations concerning police power exercise; and finally explore the participation of relative parties of dangerous driving prevention legal system of police officers, expecting to assist police officers in the reinforcement of dangerous driving prevention with the participation of the public to make the dangerous driving prevention legal system more complete. Chapter 3 The Organization Framework of Dangerous Driving Prevention Legal System of Police Officer To explore current central and local police administrative organization to deep understand the problems of organization framework, personnel system and fund budget of police authority, expecting to establish complete organization framework for the advantages of practical operation of dangerous driving prevention of police authority. Chapter 4 The Limit of Administrative Rights and Implementation of Dangerous Driving Prevention Legal System of Police Officer Traditional clampdown with penalty and other administrative actions exempted from high power type are included. The types and meaning is to be explored against the regulation items of seven ¡§Administrative Procedure Law,¡¨ including Administrative Investigation, Administrative Plan, Administrative Legislation, Administrative Penalty, Administrative Contract, Administrative Instruction, and the insurance of Administrative Duty Reinforcement that is helpful for the clear-up of the requirements and procedures of police power exercise. Chapter 5 The Relief and Solutions to Problems Arising from Dangerous Driving Prevention Legal System of Police Officer According to the different categories of agency receiving relief procedures, they can be divided into the administrative relief within and outside administrative system. Start from the relief system of compliant, declaration against different opinions and petition; and then discuss the administrative suit system outside administrative system; and then continue to compliment other relief ways of petition and pleading; and finally to explore national compensation, constitute interpretation and public vote one by one to cover all surveillance rights of people in details. Chapter 6 The Administrative Surveillance of Dangerous Driving Prevention Legal System of Police Officer Due to quality and quantity changes of modern country administration, the necessity of administrative control increases day by day. Complete administrative surveillance legal system consists in exploring the supervising system of inspect, supervise, political affairs and sales within police authority and outer supervising system of power, the public, opinion and social groups. With the supervising function of administrative surveillance to expect the work of dangerous driving prevention of police officer would meet the demand of nation, society and people in the respects of legal system and effects. Chapter 7 Conclusion and Suggestion To bring forth problems discovered after research and propose suggestions for improvements against dangerous driving prevention for the reference of police officers upon the reinforcement.

Administrative Justice in the CSR in the Years 1918 - 1938 within European context. For my thesis I chose as a topic 'Administrative Justice in the CSR in the Years 1918 - 1938 within European Context', as administrative justice including the protection against illegal interventions of executive power is topical for any democratic state at any time. The purpose of administrative justice is reviewing administrative acts of public administration namely by independent courts. I decided to target my thesis on the period of so-called first republic thus on the period from 28 October 1918 i.e. from establishing the independent Czechoslovak state to 30 September 1938, i.e. the signing of the Munich agreement. After establishing the independent Czechoslovak state The Act on the Supreme Administrative Court and on Solving Competence Litigations was one of the first acts passed by the National Czechoslovak Committee. This year i.e. in 2018 it has been 100 years since constituting administrative justice in the Czechoslovak Republic. However, when the Czechoslovak Republic came into being administrative justice was not formed from scratch, but by the above mentioned Act on Administrative Justice and Solving Competence Litigations Austrian administrative justice was adopted.
