This essay is justified by the evolution of the access to the courts by the commons users of the Social Security what brings the revival of the administrative process as an instrument of social protection. The focus of this work is the birth of the jurisprudence in social welfare by the processual exercise of the Public Administration. It emphasizes the unicity of the political power and its indivisibility, and the importance of the exercise of the administrative activity, in its jurisprudential guide lines as a basilar element for the State secures its purposes for the social order, such as the welfare and the social justice. This study recognizes the administrative process as a branch of the processual gender as so, one of the fundamental guarantee to the citizen. The core of this study will be the analysis of the instrument of jurisprudential uniformization at service of the Plenary Court of the Council of Social Welfare Recourses (CRPS). This work broaches the subject of the species of jurisprudential uniformization expected by the Internal Rules of the Council of Social Welfare Recourses (CRPS). At last, this essay arises essential conclusions developed during the study, which evidence of rule character of the statements of the Council of Social Welfare Recourses, which get in the Brazilian Law as rules of general and abstract character, as an element that binds all the administrative structure of the social welfare, mainly the Social Security National Institute / A presente dissertação de mestrado tem por finalidade situar os enunciados do Conselho de Recursos da Previdência Social no ordenamento jurídico brasileiro. Justifica-se o presente estudo diante da evolução do acesso à justiça por parte dos beneficiários que impõe um renascimento do processo administrativo como instrumento de proteção social. O trabalho focaliza a formação jurisprudencial administrativa previdenciária pelo exercício da processualidade no âmbito da Administração Pública. Destaca o poder político como uno e indivisível e o exercício da atividade administrativa pela sua linha jurisdicional como elemento fundamental para que o Estado alcance os objetivos traçados para a ordem social, quais sejam, o bem-estar e a justiça sociais. Reconhece o processo administrativo como uma espécie do gênero processo e como garantia fundamental do cidadão. O núcleo do estudo será, por sua vez, a análise do instrumento de uniformização jurisprudencial colocado à disposição do Conselho Pleno do CRPS. Por derradeiro, aborda as espécies de uniformização de jurisprudência previstas no Regimento Interno do CRPS. Ao final, apresentam-se as conclusões essenciais desenvolvidas durante o estudo, que evidenciam o caráter de norma aos enunciados do CRPS, os quais ingressam no ordenamento jurídico na qualidade de norma com caráter geral e abstrato, vinculando toda a estrutura administrativa previdenciária, em especial o Instituto Nacional do Seguro Social

L'expansion de la formation professionnelle continue / The expansion of vocational training

Depuis les années 1970, la formation professionnelle continue s’étend à de nombreuses activités économiques et sociales, salariées comme non-salariées. La loi et le contrat, notamment, permettent cette expansion réalisée dans une grande instabilité normative. Constamment modifiés, les dispositifs d’accès à la formation sont souvent complexes et parfois peu efficaces. Le financement de la formation professionnelle suscite également des interrogations en raison des nombreuses personnes, publiques ou privées, chargées d’intervenir dans ce domaine. Le dispositif peut et doit être amélioré afin de permettre l’expansion de la formation professionnelle là où celle-ci mérite d’être encouragée. / Since the 1970s, continuing vocational training extends to many economic and social activities, either employed or self-employed. The law and the contract particulary provide such an expansion, which is carried out in a context of great normative instability. Constantly amended, training programmes are often complex and sometimes even reveal to be ineffective. Financing vocational training also raises questions due to the many people, both public and private, who are involved in this area. The overall system can and must be substantially improved so as to enable the expansion of vocational training wherever it deserves to be encouraged

Bakgrund: Traditionellt sett förknippas ekonomistyrning med den formella styrningen och mycket fokus har därmed lagts på den formella styrningen. Eftersom företag idag påverkas av kultur på olika sätt, kan den formella styrningen kompletteras med den informella styrningen. I styrningsarbetet blir ledarnas uppgift att reflektera på inflytande, vägleda och vidta olika åtgärder så att medarbetarna utför önskvärda ageranden. Samtidigt bör hänsyn tas till att det som kommuniceras av ledarna inte alltid uppfattas likadant av medarbetarna. Syfte: Uppsatsen syftar till att beskriva hur företagskultur relaterar med den cybernetiska och administrativa styrningen, med avseende på vilken typ av relation som är förekommande enligt ledarna och medarbetarna. Uppsatsens delsyfte är att beskriva ledarna och medarbetarnas uppfattning om den cybernetiska, administrativa och kulturella styrningen som styrmedel. Metod: Studien har genomförts på en av IKEAs organisationer i Älmhult och är därmed en fallsstudie. Undersökningen utgår ifrån en kvalitativ ansats med femton semistrukturerade intervjuer med ledare och medarbetare. Vidare har studien utgått ifrån en deduktiv ansats. Slutsats: Resultatet av studien visar att företagskultur relaterar till den cybernetiska och administrativa styrningen på flera olika sätt. Kulturen har en kompletterande, stödjande och samverkande effekt på den cybernetiska ochadministrativa styrningen. I vissa fall förekommer det även motsägande relationer mellan styrsystemen. Ytterligare en slutsats som kan dras är att kultur som styrmedel används i större omfång än den cybernetiska och administrativa styrningen i fallföretaget. Ledarna och medarbetarna har liknande uppfattning om den kulturella och administrativa styrningen. Uppfattningen om den cybernetiska styrningen som styrmedel varierar dock bland ledare och medarbetare. / Background: Traditionally, management accounting is associated with formal management and a lot of focus has thus been placed on formal management. Since companies today are influenced by culture in different ways, formal control can be supplemented with informal control. In the management work, the leaders' task is to reflect on influence, guide and take various measures so that the employees perform desirable actions. At the same time, it should be taken into account that what is communicated by the leaders is not always perceived in the same way by the employees. Purpose: The essay aims to describe how organizational culture relates to the cybernetic and administrative management, with respect to what type of relationship is present according to the leaders and employees. The partial aim of the essay is to describe the leaders' and employees' perception of the cybernetic, administrative and cultural management as a means of governance. Method: The study has been carried out at one of IKEA's organizations in Älmhult and is thus a case study. The survey is based on a qualitative approach with fifteen semi-structured interviews with leaders and employees. Furthermore, the study was based on a deductive approach. Conclusion: The result of the study show that corporate culture relates to cybernetic and administrative control in several different ways. Culture has a complementary, supportive and synergistic effect on cybernetic and administrative control. In some cases, there are also contradictory relationships between the control systems. Another conclusion that can be drawn is that culture as a means of control is used to a greater extent than cybernetic and administrative control in the company. Leaders and employees have a similar opinion about the cultural and administrative management. However, the perception of cybernetic governance as a means of governance varies among leaders and employees.

Le droit pénal face à la migration transfrontière / Criminal law faced with crossborder migration

Centrée sur le droit pénal face à la migration transfrontière, la présente étude prend le parti d’intégrer en son sein deux formes de migration spécifiques : la migration irrégulière et la migration pour motif terroriste. Elle choisit également de faire du droit pénal son objet central. Ce choix conduit naturellement à renverser les perspectives initiales et à envisager, non les effets du droit pénal sur la migration transfrontière, mais l’inverse : les incidences de la migration transfrontière sur le droit pénal. À cet égard, migration irrégulière et migration pour motif terroriste ont en commun d’ébranler le droit pénal. Face à la migration irrégulière, le droit pénal subit une instrumentalisation : sa mobilisation n’est effectuée que dans une finalité administrative d’éloignement de la migration présente à la frontière (particulièrement dans les zones d’attente et frontalières). Plus encore, la politique de prévention contre l’immigration irrégulière développée à l’échelle de l’Union européenne a entraîné un véritable enchevêtrement de normes pénales, agissant dans de multiples espaces géographiques, dont certaines sont détournées afin d’entraver la migration en mer, et d’autres créées pour l’empêcher de se former sur terre, au sein des États tiers de départ. À l’inverse, le droit pénal apparaît absent face à la migration pour motif terroriste. Alors qu’il pourrait se saisir de ce phénomène, il semble au contraire dépassé par la montée en puissance de mesures de police administrative. De nature à anticiper d’une manière quasiment prédictive le risque terroriste porté par la migration transfrontière, ces mesures entraînent l’obsolescence du droit pénal. Penser le droit pénal face à la migration transfrontière permet enfin de révéler que la migration irrégulière et la migration pour motif terroriste sont liées par le droit, en étant envisagées sous le prisme du risque qu’elles portent en elle. / This study focuses on the link between criminal law and crossborder migration and will address two specific forms of migration : irregular migration and migration with a terrorist purpose. The main focus of this study is criminal law. This choice has resulted in a reversal of the original focus ; that is to say the effects of crossborder migration on criminal law as opposed to the effects of criminal law on crossborder migration. Both irregular migration and migration with a terrorist purpose undermine criminal law. With respect to irregular migration, criminal law is used as an administrative instrument to repel migrants from national borders particularly those in waiting zones and crossborder zones. Prevention policies against irregular migration implemented at the EU level have resulted in an entanglement of criminal norms, in various geographic areas, some of them were diverted to prevent migration by sea and other were created to stop migrants trying to enter by land via third countries. On the contrary, criminal law seems absent with regards to migration with a terrorist purpose. While it could effectively tackle this phenomenon, it seems overwhelmed by the rise of administrative police measures. These measures are able to anticipate in a quasi-predictive manner the risk of terrorism via crossborder migration and they in fact render criminal law ineffective. Thinking criminal law in the face of crossborder migration has allowed to reveal that irregular migration and migration with a terrorist purpose are legally contected, when they are considered through the prism of the risk conveyed.

No. of bitstreams: 0 Previous issue date: 2009 / Este trabalho propõe analisar o fenômeno da terceirização desenvolvido ao longo das duas últimas décadas em Bio-Manguinhos. Trata-se de um estudo de caso realizado na unidade de produção de vacinas e reagentes para diagnóstico da Fundação Oswaldo Cruz. Inicialmente foi realizado um estudo de cenário, analisando a política de gestão do trabalho desenvolvida pelo Estado brasileiro para as instituições públicas. A seguir, a análise passou a verificar a inserção da Fiocruz nessas políticas, desde a sua criação e no decorrer de vigência de diferentes formas de contratação, alternando da extrema rigidez para a total flexibilidade sempre com foco na gestão do trabalho, e, como essas políticas se refletiram no desempenho de Bio-Manguinhos. Baseado no contexto da conformação do Estado e na análise do desempenho da unidade, o trabalho critica a falta de planejamento e de prospecção dessas políticas, que favoreça a inovação de processos, produtos e procedimentos e o desempenho pleno de uma unidade de produção de insumos para a saúde, tão necessários ao atendimento das necessidades da população brasileira. Critica também, a ausência de um modelo de Estado consolidado que sirva de arcabouço à formulação dessas políticas. Devido às fortes críticas dos órgãos de controle acerca da extrapolação dos limites da terceirização praticada nas últimas duas décadas e à falta de definição clara desses marcos legais, o trabalho apresenta uma metodologia baseada nas atribuições dos cargos do plano de carreiras da Fiocruz e culmina com a apresentação de uma matriz de atribuições passíveis de serem realizadas por contratação indireta. Conclui pela necessidade de convivência de dois quadros de trabalhadores: um permanente formado por servidores, estáveis e de carreira e outro flexível, executado por contratação indireta, de caráter eventual, temporário ou de apoio às atividades relacionadas à missão de Bio-Manguinhos. O trabalho ainda sugere a aplicação da mesma metodologia às demais unidades da Fiocruz e que a instituição afirme, frente aos órgãos de controle, quais atividades que ela precisa manter no quadro de servidores permanente e quais ela quer delegar a terceiros sem contudo, ferir a legislação vigente. Por fim, constata-se que a metodologia apresentada ameniza, mas não resolve o problema, dessa forma, recomenda-se à Fiocruz buscar mecanismos que altere o modelo de gestão pelo qual está submetida a fim de viabilizar as duas formas de incorporação de mão-de-obra.
