The Constitution of the Republic of South Africa and social development: an exploratory study of the link between the Bill of Rights and social development

The apartheid era did not accommodate or incorporate democratic and constitutional principles. The year 1996 saw a democratic Constitution being adopted, having been certified by the Constitutional Court. The Bill of Rights in the Constitution guarantees the rights and freedoms of all South Africans. The apartheid era ensured that the rights which are enjoyed today were reserved for only a portion of the South African population. This study emphasises the importance of the Constitution and the role and responsibility of every citizen to defend it. In defending the Constitution, the rights and freedoms of all South Africans are defended. The Bill of Rights promotes social development for all South Africans, as opposed to disparate social development under the divisive apartheid era. The Constitution is a powerful enabler for democracy and social cohesion and unity. This study depended on secondary sources which are vital to keeping historical facts alive and truthful. Desktop research is qualitative and, while less expensive, produces acceptable results and findings. / Demokrasie in Suid-Afrika het met 'n prys gekom. Die apartheidsera het nie demokratiese en grondwetlike beginsels geakkommodeer of opgeneem nie. In 1996 word 'n demokratiese Grondwet aanvaar, wat deur die Grondwet Hof gesertifiseer was. Die Handves van Menseregte in die Grondwet waarborg die regte en vryhede van alle Suid-Afrikaners. Die apartheidsera het verseker dat die regte wat vandag geniet word, slegs vir 'n gedeelte van die Suid-Afrikaanse bevolking gereserveer is. Hierdie studie beklemtoon die belangrikheid van die Grondwet en die rol en verantwoordelikheid van elke burger om dit te verdedig. Deur die Grondwet te verdedig word die regte en vryhede van alle Suid-Afrikaners verdedig. Die Handves van Menseregte bevorder sosiale ontwikkeling vir alle Suid-Afrikaners, in teenstelling met uiteenlopende sosiale ontwikkeling onder die verdelende apartheidsera. Die Grondwet is 'n kragtige instaatsteller vir demokrasie, sosiale samehorigheid en eenheid. Hierdie studie was afhanklik van sekondêre bronne wat noodsaaklik is om historiese feite lewendig en waaragtig te hou. Political reality of local government service provision in the Free State Province

Tech.(Public Management)) -- Central University of Technology, free State, 2011 / The Constitution of the Republic of South Africa, No. 108 of 1996 (SA, 1996) brought about a new system of government comprised of the national, provincial and local government spheres. In terms of the Constitution, these spheres of government must establish effective, transparent and accountable government. Local government is specifically responsible for the provision of democratic and accountable government to local communities, and for ensuring that municipal services are rendered to the community. As in the case of the national and provincial spheres of government, local government has a distinctive political nature and character. Councillors are elected to represent the voters who participate in municipal elections, as well as the relevant political parties, on municipal councils. The decisions of municipal councils are influenced by political considerations, as well as by the policy directives of the ruling party. The Constitution also establishes and describes the various governmental bodies that exercise the powers of the state. These governmental bodies represent the state and can be classified in terms of three primary groups, namely legislative, executive and legal structures. In a bona fide democracy, the doctrine of separation of powers, also known as the trias politica, is of fundamental importance in order to prevent autocracy and ensure civil liberty. The provision of viable municipal services is the most crucial reason for the existence of local government. The community has a legitimate expectation with regard to the provision of appropriate municipal services; and in terms of the Municipal Systems Act, No. 32 of 2000 (SA, 2000c) municipalities must supply basic municipal services in order to ensure an acceptable quality of life. However, inadequate levels of municipal service provision are encountered in South Africa in general, and in the Free State in particular. Such inadequate service provision has led to several violent community-protest actions in the country. These protests are an indication that municipal service provision does not meet the expectations of the communities. Various factors tend to have a negative effect on local government in the Free State, including capacity shortages, such as the lack of professional and experienced staff; financial shortages; and the extensive quantity and complexity of local government legislation. Political challenges that influence local government service provision include factors such as the absence of the political will to provide services, political in-fighting within the ruling party, the selection criteria for the appointment of municipal employees, and political interference in municipal administration. It is also essential that the ruling party should put acceptable mechanisms in place to ensure that the public sector becomes an effective instrument for carrying out the ruling party‟s mandate, rather than allowing political interference to affect the day-to-day activities of government. In order to meet the needs of the community with regard to service provision, it is essential that the three spheres of government should function as a coherent unit. Intergovernmental relations therefore play a central role in ensuring that the joint functions of government are effectively carried out. The national and provincial departments have a specific responsibility to support and strengthen local government capacity, and also to ensure the effective execution of municipal functions. However, various intergovernmental challenges need to be dealt with, namely ineffective co-ordination and integration, as well as the absence of the political will to promote intergovernmental relations. Therefore, the aim of this study is to identify specific actions and strategies that can be implemented by the government in order to address the challenges that have a negative influence on local government service provision, with specific reference to the political challenges.

The role of the Organisation of African Unity as an international governmental organisation in regional co-operation and stability: 1963-2000

The purpose of this study is to analyse the role of the Organisation of African Unity (OAU) as an international governmental organisation in regional co-operation and stability from 1963 until 2000. It is also aims to evaluate the OAU's success or failure as the initiator of African unity and the driver of regional co-operation and stability in Africa within political, economic and social spheres. As background, the motivation for the study is discussed and the problem is stated. From this, research questions are formulated, and objectives identified. Three hypotheses are formed, which the study aimed to prove. The range of core theoretical foundations, concepts, characteristics, theories, approaches and classifications are examined in detail as foundations for an understanding and evaluation of the role of the OAU. Regional organisations as a phenomenon are also studied in-depth with reference to their nature, meaning and historical origins. Inter-state relations in the international community are theoretically explored, as well as the position and potential of regionalism within international public administration. Concepts, characteristics, types and functions of regional organisations and the role of co-operation, sovereignty and supra-nationalism in regional co-operation are covered. Following this, a study is made of the historical origins, nature and character of Pan-Africanism and the evolution of the OAU. Based on the structural-functional approach, the nature and essential characteristics of the organisation are analysed, with reference to its structures, and the tasks of the Secretary-General and its various commissions. In addition, the former relationship between the OAU and the UN is also highlighted. The role of the OAU is evaluated as a regional organisation involved in the establishment of regional co-operation in Africa in the political, economic, cultural and social spheres. The study concludes with an evaluative synthesis of its findings, proposals and conclusions. The OAU is found to have been successful in certain regards, but in others, it failed to attain its primary purpose: to forge unity on the continent and to create co-operation among states. Unmaking the torturer : re-establishing meaning and identity after committing atrocities

During apartheid numerous atrocities, including torture were committed by the security forces in South Africa. Most atrocities were directed at black people, during the political violence. The question which the researcher investigated was how people who worked in the police and had tortured and committed other atrocities re-established meaning and identity after South Africa became a democracy. South Africa’s history was discussed, focussing on factors which created an environment which was conducive to the committing of atrocities. The basic tenets of social constructionism were considered and how they relate to concepts such as agency, power, essentialism, identity, morality, meaning-making, torture, illness and posttraumatic stress disorder. Dialogic analyses were conducted on each participant’s narrative. The researcher is seen as an integral part of the storytelling event. The ways in which the participants positioned themselves in telling their stories are discussed as attempts to reconstitute themselves. The impact on the researcher of working with perpetrators is discussed. Themes were distilled from participants’ narratives. These are discussed with attention given to the problems they identified as having led to perpetration, such as racism, enacting of masculinity and militarisation. Problems they identified which arose as a result of perpetration include aggression, alienation, illness and addiction to violence. The state, non-state actors and violation of economic, social and cultural rights : making the case for paradigm shift in human rights advocacy and protection in Africa

For many sets of reasons, including the unequal power relationship between them and most underdeveloped states, and probably more in Africa than anywhere else in the world, non-state actors (NSAs) like states are involved in the violation of human rights. With the phenomenon of globalization, their role has become even more pronounced with some of the traditional functions of the state being performed by them, with implications for human rights, especially socioeconomic rights. Unfortunately, state-centred traditional international law has proved to be ill-equipped to hold NSAs directly accountable and liable for their violations of human rights. NSAs are only expected to adhere to non-binding voluntary standards, such as codes of conduct. Yet, if properly interpreted and enforced, the African Charter for Human and People’s Rights (ACHPR) can be relied upon to hold them accountable. Against this backdrop, the study interrogates the existing universal and regional human rights laws and systems with the view to identifying any rules, principles, case law or literature that can help hold NSAs directly accountable for human rights violations. For better advocacy and protection of human rights on the African continent, it makes a case for a paradigm shift away from a state centred to a holistic approach that would include NSAs and ensure that they are also bound to protect human rights and become accountable for their violations. / Private Law / LL.M.

The dance of an intellectual mandarin : a study of Neville Alexander's thoughts on the language question in South Africa

This study distils some of the principal political and sociological lines of enquiry that Neville Alexander embarked upon in his published writings. It initially sets out to sketch the political, economic and intellectual milieu that he encountered after his release from Robben Island in 1974, and then it addresses the language question, as a part of the national question, in South Africa. The researcher argues that Alexander’s “dance” in the world of political and educational interventions has at times been solitary but that his discourse is substantively girded by the writings and experiences of established practitioners in the fields of sociolinguistics, political economy and cultural activities. Sub-national governments and foreign policy : the case of the Limpopo Province in South Africa

The aim of this study is to analyse and describe the role of sub-national governments (SNG’s) in foreign policy and how the conduct of diplomacy has developed in the South African context, and to assess why and how provinces engage in this phenomenon. The theoretical approach to this study is embedded in neo-functionalism. In order to illustrate this, the South African province, the Limpopo Province is used as an illustrative case study. In particular, the study will analyse the role of the International Relations Unit (IRU) within the Office of the Premier (OtP) in the Limpopo Province as a case study. Limpopo is the main focus of this study because it, inter alia, borders on three sovereign states (Botswana, Mozambique and Zimbabwe) which place the province in a good position to engage in international relations, mutual intentions and friendly relations with its neighbouring and other distant countries. The results of this study is that provinces have become important foreign policy and international relations actors in the area of low politics; however the national government remains as the main actor in the international relations and foreign policy making process. The results also indicate that Limpopo is being proactive in facilitating and accelerating the realisation of the foreign policy objectives since provinces engage with international activities that run in parallel with the objectives and principles of the national foreign policy. The study contributes to the literature on SNG’s diplomacy in South Africa. It also lays the foundation for further research in other SNG’s diplomacy especially in Africa by employing other theories that have been ignored including African theories. / Political Sciences / M.A. (Politics)

Achille Mbembe : subject, subjection, and subjectivity

This thesis examines the political thought of Achille Mbembe. It deploys decolonial critical analysis to unmask traces of coloniality with regard to the African existential conditions foregrounded in the conception of the African subject, its subjection, and subjectivity. The theoretical foundation of this thesis is decolonial epistemic perspective—the epistemic intervention that serves as a lens to understand Mbembe’s work and—that is the theoretical foundation outside the Euro-North American “mainstream” canon foregrounded in coloniality. Decolonial epistemic perspective in this thesis is deployed to expose three kinds of coloniality in Mbembe’s work, namely: coloniality of power, coloniality of knowledge and coloniality of being. The thrust of this thesis is that Mbembe’s political thought is inadequate for the understanding of the African existential condition in that it does not fully take coloniality into account. In order to acknowledge the existence of coloniality through decolonial critical analysis, the political thought of Mbembe is examined in relation to modes of self-writing, power in the postcolony, the politics of violence in Africa, Frantz Fanon’s political thought, and the idea of South Africa as major themes undertaken in this thesis. Decolonial critical analysis deals with foundational questions that have relevance to the existential condition of the African subject and the manner in which such an existential crisis can be brought to an end. These foundational questions confront issues like—who is speaking or writing, from where, for whom and why? This thesis reveals that Mbembe is writing and thinking Africa from outside the problematic ontology of the African subject and, as such, Mbembe precludes any form of African subjectivity that challenges the Euro-North American canon. This then reveals that Mbembe is not critical of coloniality and this has the implications in that subjection is left on the wayside and not accounted for. Having explored the genealogy, trajectory and horisons of decolonial critical analysis to understand the political thought of Mbembe, this thesis highlights that it is essential to take a detour through the shifting of the geography of reason. Herein lies the originality of this thesis, and it is here that Africa is thought from within a standpoint of decolonial critical analysis and not Africa that is thought from the Euro-North American canon. Therefore, the shifting of the geography of reason is necessary for the authorisation of the subjectivity of the African subject in order to combat subjection. / Political Sciences / D. Deur middel van vraelyste wat aan die teikengroep gestuur is, is data oor die navorsingsvrae ingesamel. Die empiriese studie het daarop gedui dat inligting verkry op grond van werkontleding wel kan bydra tot die effektiewe uitvoering van funksionele personeelbedrywighede. Information gathered on the basis of the job analysis, can contribute to the fact that the performing of personnel functions transpires efficiently and effectively. A literature study as well as empiricial research were undertaken in this study to determine ' what the role of job analyses is in the performing of functional personnel activities in the City Council of Lichtenburg. .on the basis of job analysis can definitely contribute to the effective performing of functional personnel activities.
