Investigando aspectos da configuração e dos usos dos espaços da Praça Pádua Salles, município de Amparo S.P. no passado e no presente, além dos significados a ela atribuídos no decorrer do tempo, o trabalho busca responder em que se baseiam suas identidade e memória. Pretende construir a memória da Praça a partir de um levantamento sobre a sua história que referencia a história da cidade. Analisa, também, construções e usos da Praça no cotidiano em que ela se apresenta como espaço de convívio, lazer e cívico. No decorrer do trabalho, a Praça é analisada em relação à cidade: à sua evolução urbana, à preservação do patrimônio histórico e cultural e às estratégias atuais de desenvolvimento urbano de Amparo. Por fim, o trabalho busca sintetizar o universo de informações levantadas, indagando a identidade da Praça e apontando diretrizes de projeto para a Praça Pádua Salles do amanhã. Faz referências às noções de permanências, coração da cidade e lugar. Também, da cidade que, por suas características culturais e conformação histórica tem, no presente, sua identidade vinculada ao passado, embora seja provida de informação atual expressa por intervenções urbanas que enxergam o futuro. Portanto, da cidade que se mantém em harmonia com o ontem e o hoje, com a cultura e o ambiente local. / Investigating aspects of the past and current configurations and uses of the spaces of Praça Pádua Salles (Amparo, S.P.) as well as the significance attributed to the site over time, this work attempts to identify the basis for the squares identity and memory. It intends to reconstruct Praça Pádua Salles´s memory with a survey about its history that uses the history of the city of Amparo as a reference point. The work analyzes the constructions and uses of the square in daily life, when it appears as a space for social, recreational, and civic gatherings. As the work progresses, the square is analyzed in relation to Amparos urban evolution, the preservation of the citys historical and cultural heritages, as well as the citys current urban development strategies. Finally, the work summarizes all the information gathered and ponders upon the squares identity, suggesting guidelines for a future Praça Pádua Salles project. The work makes references to the notions of permanency, heart of a city, and site. Also, it makes reference to a city that, because of its cultural characteristics and historical conformation, has its current identity linked to the past even though it is provided with current knowledge, as shown by urban interventions that have the future in mind. The city, therefore, remains in harmony with yesterday and today, as well as with the local culture and environment.

A produção científica brasileira na área de Bioquímica cresce de maneira admirável, e, em tal contexto, o Rio Grande do Sul se destaca. Assim, o presente estudo visa a traçar o perfil da pesquisa científica no estado, tendo em vista a sua posição proeminente no cenário brasileiro. Dessa maneira, pesquisas, pesquisadores, laboratórios, formação de recursos humanos e o aporte de investimentos por parte da Fundação de Amparo à Pesquisa do Estado do Rio Grande do Sul foram identificados e mapeados. Para tal fim, os currículos dos professores de Departamentos/Setores de Bioquímica foram estudados, com foco em seu perfil, em sua produção científica e na contribuição para a formação de RH, relacionando esses fatores com os investimentos estaduais recebidos por cinco universidades públicas federais gaúchas. Considerações significativas surgiram deste estudo – dentre elas, uma aponta para o investimento em interações entre diferentes instituições como elemento importante para uma maior contribuição científica. A necessidade de reedição de programas da FAPERGS para a formação de RH foi assinalada, assim como a ampliação de apoio financeiro aos departamentos/setores de bioquímica de estrutura ainda incipiente (UFPEL, FURG e FFFCMPA). Isso, no entanto, não deve influir na demanda por maior fomento por parte dos departamentos que já estão mais bem estruturados em termos de produtividade científica (UFRGS e UFSM). / Brazilian scientific production in Biochemistry is growing impressively fast, and Rio Grande do Sul is outstanding in that context. Thus, this study aims to outline the state’s scientific research profile, given its prominent position in the national scenario. Hence, researches, researchers, laboratories, development of human resources and investments by Foundation for the Support to Research in the State of Rio Grande do Sul have been identified and mapped. To that end, the curricula of Biochemestry Departments/Sectors professors have been studied with focus on their profile, scientific production and contribution to the development of human resources, and further related to state investments received by five federal public universities in Rio Grande do Sul. Significant considerations have stemmed from this study. One of them is that the interaction among institutions may bring great profit. The necessity to restablish some of FAPERGS’s human resources development programs, as well as to increase financial support to incipient Biochemestry departments/sectors (UFPEL, FURG and FFFCMPA), has also been considered. That should not, however, disregard the demand for further funding to the departments that are already better structured and more scientifically productive (UFRGS and UFSM).

Neste sentido, os mecanismos de desenvolvimento limpo (MDL’s) e o seqüestro de CO2 fundamentam os planos de crescimento sustentável. Atualmente, inovadoras pesquisas consideram também o seqüestro de CO2 por meio da carbonatação mineral, onde minerais silicáticos ricos em magnésio, cálcio, ferro e manganês são convertidos em carbonatos, por meio de reações com o CO2 em estado supercrítico ou em solução. Nas proximidades do distrito industrial de Paulínia (SP), ocorrem rochas metabásicas e metaultramáficas relacionadas aos Complexos Amparo e Itapira, que representam terrenos metamórficos de grau médio a alto. Nessa área as metabásicas são representadas por anfibolitos, actinolita-xistos e hornblenditos, e são encontradas sob a forma de lentes ou camadas estiradas intercaladas a rochas quartzo-feldspáticas. As metaultramáficas ocorrem em corpos pequenos e descontínuos, muitas vezes de estrutura maciça e composição mineralógica rica em olivina, piroxênio e anfibólio. O potencial destas rochas, em duas áreas selecionadas, foi avaliado para uso em processos de carbonatação mineral, com base em análises petrográficas e litogeoquímicas, fornecendo valores da ordem 73 x 106 toneladas de CO2 seqüestrável. / Greenhouse effect gas emission reduction has been a great technological challenge to the industrial models standings. Furthermore, the clean development mechanism (CDM) and CO2 sequestration are fundamental on sustainable development in order to reach safer levels of CO2. Nowadays, innovate researchers have also considered the CO2 sequestration by mineral carbonatation, where silicates rich in Mg, Ca and Fe are transformed into carbonates. Nearby to the industrial district of Paulinia (São Paulo), high grade metabasic and ultramaphics rocks of Amparo-Itapira Complex occur. The metamorphic rocks consisting of amphibolites, actinolite-schist and hornblend-rich amphibolite are found intercalated with quartz-feldspatic rocks as lenticular layers. The ultramafic rocks present as discontinuous massive bodies are rich in olivine, pyroxene and amphibole. Carbon sequestrating potential of two selected areas, based on petrographic and litogeochemical analyses are estimated to be capable of capturing approximately 73 x 106 tons of CO2.

Buscamos identificar os mecanismos para incentivar o estabelecimento da pesquisa e desenvolvimento em regiões com maiores proporções de desigualdades e ainda sem a infraestrutura necessária para se utilizar da ciência e tecnologia, visando o alcance do desenvolvimento regional. Políticas federais de interiorização da ciência e tecnologia editadas de forma planejada e estruturada, entre outras, tiveram o seu início há mais de duas décadas no país. Em políticas mais recentes, foram introduzidos novos instrumentos, como a descentralização de recursos federais e de seus programas e projetos, que eram de execução prioritária do Estado-Nação e que foram descentralizadas para outros entes da Federação. Foram analisados os procedimentos e rotinas utilizados pelo CNPq para a transferência de recursos da União e os mecanismos de acompanhamento, monitoramento e avaliação dos recursos transferidos por meio de parcerias institucionais com as Fundações de Amparo à Pesquisa (FAP). Foram examinados processos de concessão internos ao CNPq, e os procedimentos frente às exigências legais, a efetividade desse procedimento. Foram realizadas entrevistas com técnicos e gestores do CNPq, comprometidos com a execução e gestão das transferências voluntárias e realizada uma pesquisa junto às FAP que recebem essas transferências. ______________________________________________________________________________________________ ABSTRACT / The aim of this study was to analyze and understand how the Evaluation of Voluntary Transfer of Union Resources is carried out , decentralized by CNPq to the State Foundations for Research Support (FAP). We sought to identify mechanisms to promote the establishment of research and development in areas with higher proportions of inequalities and still without the necessary infrastructure to use science and technology, aimed at achieving regional development. Federal policies of internalization of science and technology edited in a planned and structured way, among others, were initiated in the country more than two decades ago. In more recent policies, new instruments were introduced, such as the decentralization of federal funds and its programs and projects, which were of priority implementation to the State-Nation and that were decentralized for other entities of the Federation. Procedures and routines used by CNPq for the transfer of federal funds and monitoring mechanisms were analyzed, as well as the monitoring and evaluation of the resources transferred through institutional partnerships with the State Foundations for Research Support (FAP). CNPq’s internal granting process were examined, and the procedures to face legal requirements, as well as the effectiveness of this procedure. Interviews were conducted with staff and managers from CNPq, committed to the implementation and management of the voluntary transfers and a survey to the FAP receiving such transfers.

El presente caso se trata de una demanda de amparo contra resolución judicial, específicamente, una resolución emitida por nuestra Corte Suprema en el ejercicio de sus competencias. A partir de la Sentencia surgen varias discusiones en torno a la procedencia de la demanda de amparo, el conflicto de competencias entre el Tribunal Constitucional y la Corte Suprema, el rol del Tribunal Constitucional en el control de constitucionalidad, la participación de la parte vencedora en el proceso ordinario. Adicionalmente, se suman las diversas críticas que ha realizado un sector de la doctrina sobre el amparo contra resolución judicial que generan cuestionamientos sobre ciertos aspectos que caracterizan a este proceso. Debido a ello, este trabajo propone analizar y responder, con base a fuentes normativas y doctrinarias, a la problemática sobre el conflicto de competencias que surge cuando el Tribunal Constitucional revisa el fondo de una resolución judicial emitida por un órgano jurisdiccional en el ejercicio de sus competencias, así como reflexionar sobre el límite al control constitucional de una resolución judicial, a fin de destacar la importancia de dicha actividad en salvaguardia de los derechos fundamentales y la vigencia del Estado Constitucional de Derecho. Por otro lado, se analizará la posición de la parte que obtuvo una pronunciamiento a su favor en sede ordinaria, pero debido al amparo interpuesto, verá posiblemente afectado su derecho a la cosa juzgada y la ejecutabilidad de las resoluciones judiciales. A partir de ello, propondremos algunas disposiciones cuyo propósito será proporcionar de mayor protagonista. / This case is about a judicial protection against a judicial decision, specifically, a decision issued by Supreme Court in the exercise of its powers. As from the judgment, several discussions have arisen regarding the admissibility of the amparo claim, the conflict of competence between the Constitutional Court and the Supreme Court, the role of the Constitutional Court in the control of constitutionality, the participation of the winning party in the ordinary proceeding. In addition, there are several criticisms made by a sector of the doctrine on the amparo against judicial decision that generate questions on certain aspects that characterize this process. Therefore, this paper proposes to analyze and respond, based on normative and doctrinal sources, to the problem of the conflict of competences that arises when the Constitutional Court reviews the merits of a judicial resolution issued by a jurisdictional body in the exercise of its competences, as well as to reflect on the limit to the constitutional control of a judicial resolution, in order to highlight the importance of such activity in safeguarding fundamental rights and the validity of the Constitutional Rule of Law. On the other hand, we will analyze the position of the party that obtained a ruling in its favor in the ordinary courts, but due to the amparo filed, will possibly see its right to res judicata and the enforceability of judicial decisions affected. Based on this, we will propose some provisions whose purpose will be to provide a greater protagonist.

El presente Informe Jurídico tiene como finalidad entender la categoría del trabajador de confianza, siendo que este cargo a la actualidad produce aún incertidumbre entre los trabajadores, empleadores y genera discusiones académicas en el medio; todo esto usando como fuente el Expediente N° 05214-2016-PA/TC, referido a la desnaturalización del contrato de trabajo del Sr. Edgar Raúl Zúñiga Morán. Es en ese sentido, que el presente documento busca determinar no solo las características propias de esta categoría según el ordenamiento jurídico peruano, sino también analizar las vías procesales idóneas con las cuales se puede acceder a una correcta tutela jurisdiccional efectiva. Asimismo, efectuar una debida diferenciación entre la vía procesal laboral ordinaria y cuáles son los aspectos que resuelve, así como la necesidad de revisar algún tema de carácter laboral en el Proceso de Amparo. Para lograr este objetivo, he efectuado la determinación de los hechos del caso en conflicto, la selección y análisis de validez e idoneidad del material normativo, así como la aplicación de este material a los hechos del caso. Finalmente, conforme al criterio de resolución empleado por el Pleno del Tribunal Constitucional, justificar y criticar constructivamente la Sentencia. / The purpose of this Legal Report is to understand the category of trusted worker, since this position currently still produces uncertainty among workers, employers and generates academic discussions in the domain of research. We aim to report th File No. 05214-2016-PA / TC involving to the denaturing of Mr. Edgar Raúl Zúñiga Morán's employment contract. It is in this sense that this document aims to achieve the following goal: to determine not only the characteristics of such category according to the Peruvian legal system, but also to analyze the most adequate proceeding for a correct and effective judicial protection to be obtains. Furthermore, we shall individualize the ordinary labor procedural route and what are the aspects that solves, as well as the necessity to review any labor issue in the Amparo Process route [writ of amparo]. To achieve this objective, I have carried out the determination of the facts of the case in conflict, the selection and analysis of the validity and suitability of the statutory rules, as well as the application of such rules to the facts of the case. Finally, according to the resolution criteria used by the Plenary of the Constitutional Court, the legal report brings a justified and critical approach to the Sentence.
