O princípio da relatividade dos contratos: a responsabilidade do terceiro que contribui para o inadimplemento contratual / The relativity principle of the contracts: the third party liability that contributes to a breach of contract

O presente trabalho se dedica em apresentar uma nova interpretação do princípio da relatividade dos efeitos contratuais e uma de suas principais conseqüências: a responsabilidade civil do terceiro que contribui com o inadimplemento contratual. Com as transformações ocorridas durante o século XIX, sobretudo em decorrência da Revolução Industrial, o contrato deixou de ser um mero instrumento de circulação de riquezas, para se tornar um instrumento social. Assim, ele não pode mais ser visto como algo que interessa exclusivamente às partes, como determinava a leitura clássica do princípio da relatividade dos efeitos contratuais. A sociedade moderna impõe a necessidade de o contrato ser entendido como um fato social, que produz seus efeitos para além de suas partes. Desse modo, aqueles que são terceiros em relação a ele devem considerar a sua existência, não interferindo negativamente na relação contratual, de forma a causar o inadimplemento da obrigação contratual. Esse dever de respeito é imposto pelo princípio da oponibilidade dos efeitos contratuais, por meio do qual se entende que o direito de crédito decorrente do contrato pode ser oponível a terceiros, que devem respeitá-lo da mesma maneira que respeitam um direito real. Diante disso, defende-se aqui que o princípio da relatividade dos efeitos contratuais deve ser interpretado exclusivamente no sentido de que o contrato apenas gera obrigações para as partes contratuais, o que não significa que terceiros possam ignorar a existência desta relação jurídica. Dessa maneira, se o terceiro celebra com o devedor de um contrato já existente um segundo contrato que impossibilite o cumprimento do primeiro, causando, assim, o inadimplemento contratual, ele deve ser civilmente responsável perante o credor do primeiro contrato. Com o objetivo de alcançar estas conclusões, analisam-se, nessa dissertação, as transformações sofridas pelo direito contratual, a interação entre os seus seis princípios (princípio da liberdade contratual, da obrigatoriedade dos efeitos contratuais, da relatividade dos efeitos contratuais, da boa-fé objetiva, do equilíbrio contratual e da função social do contrato) e os fundamentos da responsabilidade civil que justificam a responsabilidade do terceiro cúmplice do inadimplemento contratual. / This work aims to introduce a new interpretation of the relativity principle of contractual effects and one of its main consequences: third party civil liability that contributes to breach of contract. With the changes that occurred in the 19th century, in particular as a consequence of the Industrial Revolution, the contract was no longer a mere tool for the exchange of wealth it became a social tool. Thus, it no longer can be seen as something of exclusive interest to the parties, as set by the classical interpretation of the relativity principle of contractual effects. Modern society imposes the need for the contract to be understood as a social fact that has its effect beyond the contracting parties. Therefore, third parties must consider its existence, not interfering negatively in the contractual relationship so as to cause a breach of contract. This duty of respect is imposed by the enforceability principle of contractual effects, which provides that the credit right arising from the contract can be enforced against third parties, who have to respect it in the same way that they respect a right in rem. Having said that, this work argues that the relativity principle of contractual effects must be exclusively interpreted in the sense that the contract creates only obligations to the contracting parties, which does not mean that third parties can ignore the existence of this legal relationship. Therefore, if a third party enters into a second contract with a debtor of a pre-existing contract that prevents compliance with the first contract, leading to a breach of contract, this third party should have civil liability before the creditor of the first contract. In order to reach these conclusions, this work analyzes the transformations undergone by contractual law, the interaction between its six principles (contractual freedom, the obligations of contractual effects, relativity of contractual effects, objective good faith, contractual equilibrium and social function of the contract) and the fundamentals of civil liability that justifies the liability of the third party accomplice in a breach of contract.

A responsabilidade civil objetiva do empregador nos acidentes de trabalho ocorridos dentro da empresa em atividade de risco

O presente trabalho versa sobre uma análise da responsabilidade civil decorrente dos acidentes de trabalho ocorridos dentro da empresa, e a defesa da responsabilidade objetiva do empregador nas atividades de risco. O número de acidentes do trabalho cresce a cada dia, despertando uma preocupação mundial a respeito do tema. Os acidentes de trabalho são conceituados em nosso sistema normativo na lei 8213/91 e agregam as doenças profissionais, os acidentes in itinere e alguns casos que a lei determina que sejam equiparados ao acidente do trabalho. A Constituição Federal Brasileira (art. 7°, XXVIII) prevê a responsabilidade do empregador frente aos acidentes, mas determina que esta tem que ser decorrente de dolo ou culpa do empregador. Com o advento do Código Civil, o nosso ordenamento jurídico passou a contar com a previsão da responsabilidade civil objetiva quando a atividade normalmente desenvolvida pelo agente provocador do dano implicar, por sua natureza, risco para os direitos de terceiro. Desta forma, defendemos a aplicação da responsabilidade objetiva do empregador frente às atividades de risco optando por uma interpretação sistemática do caput do dispositivo constitucional citado em conjunto com o art. 927, parágrafo único do Código Civil, objetivando uma maior proteção do acidentado. Com o avanço da doutrina alguns Tribunais Regionais do Trabalho já estão contemplando a responsabilidade objetiva do empregador. The number of labor accidents increases everyday, arousing a global concern about this issue. Labor accidents are defined in our legal system by Law 8213/91 and include professional diseases, in itinere accidents and some other situations that law determines its equalization to labor accidents. Brazilian Federal Constitution (art. 7º, XXVIII) establishes employer´s liability toward accidents, but determines that it must be due to deceit or guilt of the employer. With the institution of the New Civil Code, Brazilian law system started to establish the objective civil liability when the activity done by the agent, responsible for the damage, causes, by its nature, risk to other people´s rights. Thus, we defend the employer´s objective liability toward to risky activities, considering a systematic interpretation of the caput of the constitutional article previously mentioned and article 927, paragraph, of Civil Code, aiming at a better protection of the victim of the accident. Pirmoje dalyje išnagrinėti žalos asmeniui atlyginimo principai,antroje dalyje - sveikatos priežiūros įstaigų civinės atsakomybės draudimo problemos. Trečioje darbo dalyje nagrinėtos turtinės žalos asmeniui atlyginimo problemos, susijusios su išlaidų būtinumo fakto bei subjektų, kuriems gali būti mokamas žalos atlyginimas, nustatymu.Ketvirtoje darbo dalyje nagrinėtos neturtinės žalos atlyginimo problemos, penktoje ir šeštoje darbo dalyse - teorinės gydytojų kaltės nustatymo bei ikiteisminio ginčų sprendimo institucijos įterpimo problemos žalos atlyginimo mechanizme. Pabaigoje, pateikiant nuorodas į įstatymus, parodyta, kiek ilgai gali užtrukti ginčas dėl žalos atlyginimo. / In the firs part of this work, principles of individual damege has bees studied briefly. On the second part has been studied problems of medical facilities civil liability insurance. In the third part, individual property damage compensation has been studied in relation to identification of necessary expenses and subjects who can get damage compensation.In the third part has been studied moral damage compensation problems.In the fifth and sixth parts of this work, theoretical problems on damage made by medical personnel have been demonstrated as well as problems caused by insertion of pretrial dispute solving institution in the mechanism of damege compensation.In conclusion, with reference to the legislation, an example has been provided to show how long dispjute for damage compensation can last.

Civilinė atsakomybė už gyvūnų padarytą žalą Santrauka Teismų praktika rodo, kad tinkamai įvertinti gyvūnų padarytos žalos aplinkybes, jų savininkų (valdytojų) atsakomybės laipsnį yra pakankamai sudėtinga. Darbo tikslas remiantis teisės norminiais aktais, teisės doktrina ir Lietuvos Respublikos teismų praktika išanalizuoti civilinės atsakomybės už gyvūnų padarytą žalą taikymo sąlygas, jų ypatumus. Atskleisti Lietuvos teismų praktikoje išryškėjusias problemas sprendžiant nuostolių atlyginimo klausimus dėl laukinių gyvūnų padarytos žalos bei išnagrinėti civilinės atsakomybės ypatumus dėl naminių gyvūnų padarytos žalos asmens sveikatai bei turtui, taip pat pateikti savo nuomonę aktualiausiais temos klausimais. Siekiant šio tikslo apžvelgiama deliktinės atsakomybės samprata, funkcijos, taikymo sąlygos gyvūnų padarytos žalos kontekste; atskleidžiami civilinės atsakomybės ypatumai laukinių gyvūnų sukeltuose eismo įvykiuose, aptariama civilinė atsakomybė už naminių gyvūnų padarytą žalą asmens sveikatai bei turtui. The thesis is devoted to an analysis of legal doctrine, legal acts and jurisprudence on pre-conditions for application of civil liability for damage caused by animals in order to reveal problems that occur in practice. The thesis covers conceptual issues of tort liability, its functions and pre-conditions for its application in the context of damage caused by animals; peculiarities of tort liability for damage caused by wild animals in traffic accidents as well for damage to health and property of persons caused by domestic animals are revealed. Šiame magistro darbe nagrinėjami žalos, padarytos pacientams, atlyginimo teisinio reguliavimo ypatumai, įvertinant Lietuvos valstybės pasirinktą žalos atlyginimo modelį, procedūrinius žalos atlyginimo klausimus, apžvelgiama pacientams padarytos žalos atlyginimo teisinio reguliavimo raida. Taip pat analizuojami mažai nagrinėti pacientams padarytos žalos atlyginimą reglamentuojančių teisės normų konkurencijos bei dualizmo klausimai bei šių normų taikymo skirtumai teismų praktikoje. Darbe analizuojamas pacientams padarytos žalos atlyginimo teisės normų taikymas teismų praktikoje, aprašomi probleminiai aspektai, susiję su šių normų praktikoje taikymu. Šio darbo tikslas yra nustatyti ar Lietuvos Respublikoje galiojantis pacientams padarytos žalos atlyginimo teisinis reglamentavimas yra tinkamas, efektyvus ir ar jis užtikrina sklandų paciento teisės į žalos atlyginimą įgyvendinimą praktikoje. Pateikiamos išvados ir rekomendacijos galimam situacijos pagerinimui. / In this master thesis pecularities in legal regulation of damage remuneration caused to patients are analised, assessing the Lithuanian state selected damage compensation model, procedural damage compensation issues and an overview of evolution in legal regulation for remuneration of damages to patients is provided. The issues of competition and dualism in legal acts regulating remuneration of damage to patients and the differences in application of these legal acts in the cases of courts of law are analised, which were examined very little. In this thesis the application of legal acts regulating remuneration of damage to patients in judicial practice are analised, describing problematic aspects related to such application of these legal norms. The aim of this master thesis is to determine wheather the legal regulation for remneration of damages to patients in Lithuanian Republic is relevant, effective and whether it ensures a smooth patient's right to remuneration of damages in practice. In this work legal grounds, conditions, parties, means of compensation of damages, types of liability applied and its‘ limits are identified and procedural issues of compensation of damages to patients are analised, also the comparison of legal norms and judicial practice is carried out. Conclusions and recommendations for possible improvement are as well introduced.

This diploma thesis compares the Czech legal regulation of civil liability for bodily harm caused during medical treatment to the German legislation on the matter. In this case, the German legal regulation can serve as a source of inspiration due to its stable development. Both legal regulations can be assessed with respect to the rules being preferable either for the harmer or the sufferer. Concerning the provisions within the German law that are preferable for the patient, they cover e.g. the origin of liability for bodily harm caused by all participating persons providing the medical treatment while doing a tortious act, including the direct liability of persons who are "used by the activity". Due to the broader concept of harm in the German civic law the patient has a right for damages based on a generally defined nonmaterial harm, where the conrete amount of damage is determined by the court. The German legal regulation is preferable and more equitable especially for young injured, in which case the assessment of damages for the salary lost is not based only on the average salary of the sufferer before the harm was caused, but it also reflects the lifetime salary, which the injured could have achieved, had the bodily harm not been caused. The thesis deals with the issue of causal link in disputes over compensation of damage to health with focus on medical care. The thesis consists of five chapters, which are further divided into parts. Chapter One basically describes three of the preconditions of the liability for damage to health: damage, the violation of the legal obligation and fault. This chapter mainly focuses on the violation of the legal obligation and analyses the term lege artis. An informed consent of the patient is also discussed. Chapter Two deals with causal link (causality) as it is fourth and last of the essential preconditions of the liability for damage to health in Czech civil law. Chapter Two consists of two parts, each of them examines various aspects of causality. Chapter Three characterizes some of the relevant institutes of civil proceedings such as burden of proof, standard of proof or free evaluation of evidence. One of the five parts of this chapter points out the importance of the expert evidence in this type of cases. Chapter Four analyses Australian approach to the medical negligence cases with focus on the doctrine of the loss of chance. Civil liability for bodily injury in the provision of health services. The purpose of the present thesis is to analyse the issue of civil liability for bodily injury in the provision of health services. This issue is very topical, especially due to the adoption of new private law, which is presented in this work. The new legislation is evaluated and the problems that have occurred or might occur are defined. In addition the legislation of important institutes is compared with previous regulation. The thesis is composed of eight chapters, each of them dealing with different aspects of civil liability. Chapter one defines basic terminology used in the thesis. The next chapter presents the sources of law. Attention is paid to complex relationship between the Civil Code and the Law on Health Services, and also to a new type of contracts established by the Civil Code - agreement on health care. Chapter three mentions the basic relationship of medical law - the relationship between a doctor and a patient, including the reasons for its creation.
